From Cigarettes To Cereal: Analyzing The Rise, Peak, And Fall Of Ultra-Processed Foods And The Legal Battle Against Industry Food Deception, Charlotte F. Baird

SMU Science and Technology Law Review

This Comment explores the legal, regulatory, and public health dimensions of ultra-processed foods (UPFs) in the United States and abroad, revealing the urgent need for comprehensive reform. It traces the historical evolution of UPFs, exposing how Big Tobacco strategically pivoted into the food industry after facing public backlash and regulatory crackdowns with cigarettes and tobacco products. Using the same research tactics, behavioral manipulation, and aggressive marketing practices once employed to sell cigarettes, Big Tobacco companies repurposed their corporate expertise to engineer food designed for potential addiction, overconsumption, and profit, while often targeting children and marginalized communities. This Comment critically examines …

Incremental Innovation, George Horvath Jan 2025

Incremental Innovation, George Horvath

SMU Science and Technology Law Review

Transformative innovations—the ones that use new technologies to disrupt the world—command our attention. But most new products are the result of a more mundane process of incremental iterative innovation, evolving through a long series of small modifications of existing technologies. Although both kinds of innovation can result in improved safety and utility, both can also create new dangers. We tend to be more aware of this in trans- formative innovations (as current worries over artificial intelligence show); by contrast, dangers created by incremental iterative innovation often go unrecognized, because the process itself is easy to overlook. Policymakers and regulators need …

Shutting Down The Supply Chain Pipeline Of Counterfeit Goods Running From Alibaba To Amazon, Daniel C. Chow Jan 2025

Shutting Down The Supply Chain Pipeline Of Counterfeit Goods Running From Alibaba To Amazon, Daniel C. Chow

SMU Science and Technology Law Review

An immense supply chain pipeline constantly funnels millions of counterfeit goods from Alibaba’s e-commerce sites in China to third party sellers who sell these goods on Amazon to U.S. consumers. Amazon has acknowledged that it has a problem with counterfeits on its e-commerce sites, but its current responses to counterfeiting are primarily performative and intended to pacify disgruntled brand owners and frustrated consumers. Amazon’s responses will likely have little or no effect on counterfeits on its websites. This Article sets forth a direct and straightforward method for shutting down or seriously disrupting this pipeline based on using China’s existing laws. …

Disenchanting Consent, Ruifeng Song Jan 2025

Disenchanting Consent, Ruifeng Song

SMU Science and Technology Law Review

Despite being criticized as a flawed mechanism for data protection, con- sent has witnessed a revival in the recent wave of state privacy statutes. One factor that contributed to the revival may be the widely held belief that con- sent constitutes the “cornerstone” of data privacy laws. This Article conducts a comparative historical survey to examine the validity of this belief. The findings are twofold. First, contrary to what many believe, consent has been playing a limited role in global data privacy laws. Second, consent is an inherently defective mechanism for data protection. Some of its problems have existed since …

The Language Of Mechanical Support In Children: Is It "Sticking," "Hanging," Or Simply "On" ?, Julia Hauss, Jennifer Barbosa, Paul Muentener, Laura Lakusta

Department of Psychology Faculty Scholarship and Creative Works

How do children learn the language-to-concept mappings within the domain of Mechanical Support - a spatial domain involving varied and complex force-dynamic relations between objects based on specific mechanisms (stickiness, clips, etc.)? We explore how four- and six-year-olds, and adults encode dynamic events and static configurations of Mechanical Support via attachment (picture put on a door). Participants viewed spatial configurations (Experiment 1 - in dynamic events or Experiment 2 - in static states) and were then prompted with the question, "Can you tell me what my sister did with my toy?"Children and adults used lexical verbs, and the visibility of …

Keynote Address: The Future Of Constitutional Interpretation, Madiba K. Dennie Jan 2025

Keynote Address: The Future Of Constitutional Interpretation, Madiba K. Dennie

Saint Louis University Law Journal

The American constitutional order is in a state of flux, caused in part by the Supreme Court and its embrace of originalism. The originalist ideology contends that the Constitution has one true historically discoverable meaning, and interpreters must understand the document today the same way the public purportedly understood it when it was enacted. While its advocates insist that originalism promotes objectivity and democratic legitimacy, closer examination reveals that it is little more than a political tool designed to entrench 18th-century power hierarchies by transforming some of the nation’s lowest historical shortcomings into its highest legal standards. The author argues …

Chemerinsky’S Lament: Insurrection, Secession, And The End Of American Democracy, Anders Walker Jan 2025

Chemerinsky’S Lament: Insurrection, Secession, And The End Of American Democracy, Anders Walker

Saint Louis University Law Journal

In his latest book, No Democracy Lasts Forever, Erwin Chemerinsky laments the decline of democracy in America. Citing problems like the Electoral College, the Senate, and partisan gerrymandering, Chemerinsky posits that the United States Constitution itself is to blame. If we do not amend it in radical ways, he argues, then America is likely to break apart as prosperous, populous states like California no longer find it in their interest to preserve the union. Though riveting, Chemerinsky’s account fails to acknowledge that the Constitution’s undemocratic features have long served to preserve the union, and may well continue to do …

Pitch It Big: Cultivating Entrepreneurism Through Use Of An Innovative Competitive Business Plan And Presentation, Margaret (Peggy) Grill, Erin Epley

Journal of Occupational Therapy Education

This educational innovation aimed to explore the effectiveness of a student assignment titled ‘Pitch it Big,’ designed to enhance understanding of the business aspects outlined in the accreditation standards for occupational therapy programs. Limited research evidence exists for business education related to occupational therapy. Working in self-chosen groups based on their targeted area of interest, students collaboratively wrote a business plan for a fictitious occupational therapy business or product invention. Students then participated in a competition modeled after the popular television program Shark Tank, where they pitched their business proposals to a panel of experts acting as judges. The panel …

Intentional Grouping: Impacts On Cognitive And Social Presence In A Hybrid Classroom, Bridget Scheidler, Kelly Layne, Marian Gillard, Barbara M. Doucet

Journal of Occupational Therapy Education

Hybrid learning models in healthcare education often present challenges related to reduced cognitive and social presence. This study explores the impact of intentional grouping of students, using Learning and Study Strategies Inventory (LASSI) scores, on cognitive and social presence in a hybrid Doctor of Occupational Therapy program. Over four seven-week terms, students were grouped intentionally based on their LASSI scores, which measured anxiety, motivation, and test strategies. Quantitative data were collected using the Community of Inquiry survey, and qualitative data were gathered from open-ended questionnaires. Student responses revealed that consistent intentional grouping improved perceived work quality, time management, and relationship …

This study employed a qualitatively-driven mixed method approach to exploring temporal occupational patterns among occupational therapy graduate students in the United States during the COVID-19 pandemic. Data collected from cohorts in 2021 and 2022 were contrasted with those previously reported for 2019 and 2020, highlighting how these patterns evolved over time. Notable changes in time use were identified between the 2021 and 2022 cohorts. In 2022, students reported increased time spent in class and in driving/community mobility, while their time dedicated to physical activity, health maintenance, and family interactions declined. The analysis revealed the complexity of students' time use due …

Of 58 students with reported outcomes, 56% passed …

Improving Self-Regulated Learning Among Occupational Therapy Students, Pola Ham Jan 2025

Improving Self-Regulated Learning Among Occupational Therapy Students, Pola Ham

Journal of Occupational Therapy Education

Many occupational therapy students, particularly first-generation students, face significant academic and social challenges in higher education that affect their self-regulated learning (SRL). SRL involves goal setting, self-monitoring, strategy implementation, and reflection. The rigorous academic demands, combined with the unique challenges experienced by many first-generation students, exacerbate these difficulties, particularly in developing SRL skills, which are essential for academic and professional success. While first-generation students often lack these skills due to a variety of factors, many occupational therapy students also struggle to develop these skills, regardless of background. This narrative review examines the role of SRL in occupational therapy education and …

Boycotts, Backlash, And Beer: The Impact Of Brand Partnerships On Political Polarization In The United States, Elizabeth Gray Shoultz

Undergraduate Honors Thesis Collection

In an election year with political instability happening around the world, there are many lessons to be learned about businesses’ role in exacerbating or helping to calm these politically wild times. This research aims to uncover the mysteries that lie at the intersection of the corporate and political worlds by investigating if, and how, political stability is heightened by various brand practices, including but not limited to marketing efforts, social media posts, and influencer collaborations. This paper utilizes the lens of the 2023 Bud Light collaboration with transgender influencer Dylan Mulvaney and the effects this partnership had on American political …

Everything Old Is Q Again: An Analysis Of The Resurgent #Pizzagate Myth In Social Media, Bond Benton, Daniela Peterka-Benton

College of Communication and Media Scholarship and Creative Works

On November 28, 2023, X CEO Elon Musk posted a meme suggesting that the #pizzagate conspiracy had been suppressed by powerful forces complicit in the exploitation of children. The #pizzagate conspiracy presumed that elites had organized a ring serving pedophiles in the basement of a pizzeria in Washington D.C. The conspiracy was debunked in major news outlets with social media platforms such as Facebook banning such content, as well (BBC News). These efforts ultimately did not prevent #pizzagate from morphing into the QAnon conspiracy that would galvanize multiple extremist political movements (Bleakley). Specifically, however, #pizzagate as a discrete narrative was …

Raw Data For A Mild Alkaline Hydrothermal Etchant For Mbene Exfoliation, Michael Yeung Jan 2025

Raw Data For A Mild Alkaline Hydrothermal Etchant For Mbene Exfoliation, Michael Yeung

Chemistry Department Faculty Scholarship

Abstract for data:

Raw data for the journal publication, A Mild Alkaline Hydrothermal Ethant for MBene Exfoliation. ReadMe file provided.

Abstract for journal publication:

MoBene (the boride equivalent of MXenes) has been a synthetic challenge because borides degrade in common etching media. Inspired by the intercalation of lithium ions into AlOOH, we hypothesized that a hydrothermal route enables lithium ions to intercalate the aluminum layer of MoAlB and further separate the MoB sheet apart. Here, MoBene is first synthesized through a mild hydrothermal etching method with dilute lithium hydroxide. X-ray diffraction showed a peak at 8.9°, confirming an exfoliated layered …

Unwarranted Warrants? An Empirical Analysis Of Judicial Review In Search And Seizure, Miguel De Figueiredo, Brett Hashimoto, Dane Thorley

Faculty Articles and Papers

Every year, police perform searches governed by the Fourth Amendment on hundreds of thousands of individuals and their property throughout the United States. Many of the academy’s most decorated scholars have focused on the genesis and jurisprudential nature of the Fourth Amendment’s warrant requirement. Surprisingly, we know almost nothing about how the Fourth Amendment regulates searchers and how searches actually work in practice.

In this Article, we pull back the curtain on the search and seizure process by presenting the largest quantitative study of warrants of any kind. We analyze over 33,000 warrant applications filed through Utah’s “e-warrants” system over …

Drawing On The Christian Tradition As A Source For The Renewal Of Labor Law Theory, Alvin Velazquez Jan 2025

Drawing On The Christian Tradition As A Source For The Renewal Of Labor Law Theory, Alvin Velazquez

Saint Louis University Law Journal

Does the Christian tradition have anything to offer to legal theorists exploring the renewal of labor law from its ossified framework? This Essay argues that the Christian tradition has much to offer. There are streams within the Christian intellectual tradition that offer a third way between a “naked public square” of legal thought that refuses to look at religion as a source of ideas for constructing law and Christian nationalism. Schools of theological inquiry within the Christian tradition such as the Theology of the Social Gospel, Catholic Social Teaching, and Liberation Theology draw on the “Sermon on the Mount” for …

Kill ‘Em With Lies: The False Narrative Of The American Execution Laboratory, Danica Howell Jan 2025

Kill ‘Em With Lies: The False Narrative Of The American Execution Laboratory, Danica Howell

Saint Louis University Law Journal

The Supreme Court’s narrative regarding capital punishment, in keeping with the laboratories of democracy theory, boasts the consistent development of more humane methods of execution. Contrary to the Court’s narrative, however, states are not driven by the desire to create humane execution; they are merely striving to keep state-sanctioned killing alive. Examination reveals that execution methods are adopted on best guess and are retained without post-adoption verification of their effectiveness, humanity or painlessness. As abolitionist ideals close in on capital punishment, legislative shortcuts, willful ignorance, and secrecy allow new methods to propagate. As those tactics begin to fail, states resort …

Opening Space For Negotiation Reflection In Law Practice, Katrina Lee Jan 2025

Opening Space For Negotiation Reflection In Law Practice, Katrina Lee

Saint Louis University Law Journal

Critical to negotiations learning and skills-building, reflection is an enduring feature of law school negotiations courses. At the same time, anti-reflection forces in law practice persist. Lawyers face demanding work environments that compel them to make seemingly impossible choices among advancing their careers, maintaining mental and emotional health, and continuing to learn and grow. The time for slowing down and reflecting can be excruciatingly hard to come by. Technology in negotiations may also obscure the need or opportunities for reflection. This Article highlights the importance of negotiation reflection and the longstanding and emerging challenges to creating and maintaining a lawyer’s …

Pracademically Speaking: Incorporating Real-World Legal Practice Into The Dispute Resolution Curriculum, Debra Berman, Denise Peterson

Saint Louis University Law Journal

Bridging the gap between traditional dispute resolution pedagogy and the realities of practice has been a major point of discussion within the legal academy for some time. Professors want to equip students with the dispute resolution knowledge and skills that will allow them to thrive as attorneys. At the same time, the dynamics and time constraints within traditional dispute resolution courses can create many obstacles to doing so. In this article, Professors Berman and Peterson provide tangible recommendations for designing dispute resolution courses that maximize practice-readiness. They address options for course structure, class format, skills building, and various methodologies professors …

Humanizing The Law: Building Better Lawyers Through Mediation Coursework, Simone A. Haberstock Jan 2025

Humanizing The Law: Building Better Lawyers Through Mediation Coursework, Simone A. Haberstock

Saint Louis University Law Journal

Many students enter law school with the goal of helping others. Traditional law school classes do not help students develop empathy and an understanding of client needs and interests. This paper argues that mediation training in law school helps students improve their understanding of the human experience of litigants involved in legal disputes and builds important empathic, relational, conflict resolution, and problem-solving skills. These skills not only help students connect with and understand their clients better but can promote the self-awareness and self-care necessary for students to become healthier and happier practicing attorneys. This results in students who are more …

Peer Feedback Skills: A Negotiation Teaching Imperative, Lieutenant Colonel Taren E. Wellman Jan 2025

Peer Feedback Skills: A Negotiation Teaching Imperative, Lieutenant Colonel Taren E. Wellman

Saint Louis University Law Journal

Critical feedback, especially among peers, is difficult to give well but can be taught. Alternative Dispute Resolution (ADR) and Negotiations teachers can not only teach negotiation and facilitation skills affecting substantive outcomes but also equip students with the confidence and competence to engage well with critical feedback—a skill readily transferrable into any conflict resolution context. In this study, the author engaged a classroom intervention designed to improve peer feedback quality in an undergraduate negotiation course. The intervention included increasing transparency of what makes effective feedback and supplying a video recording of students’ negotiation performance prior to engaging in peer feedback, …
