Kennedy V. Louisiana And The Future Of The Eighth Amendment, Alexandra L. Klein

Scholarly Articles

In 2023, Florida passed a law permitting the imposition of the death penalty for the rape of a child under twelve. Tennessee enacted a similar law in 2024. These laws conflict with Kennedy v. Louisiana, a 2008 decision in which the Supreme Court held that imposing the death penalty for the rape of a child violated the Eighth Amendment’s Cruel and Unusual Punishments Clause because it was inconsistent with the evolving standards of decency. Legislators in Florida and Tennessee have expressed their hope that the Supreme Court will overrule Kennedy v. Louisiana. These laws, which resemble state attempts …

Risk, Routes, And Media Reports: The Impacts Of Perceptions Of Crime On Bus Ridership In Minneapolis And Saint Paul, Christina Spicher Jan 2025

Risk, Routes, And Media Reports: The Impacts Of Perceptions Of Crime On Bus Ridership In Minneapolis And Saint Paul, Christina Spicher

Economics Honors Projects

By collecting data on media reports about crimes on or near public transit, I study how changes in perceptions of crime affect bus ridership at the route level in Minneapolis and Saint Paul between 2015-2019. Treating the publication dates of these media reports as events, I perform panel event studies. Based on these models, I find no statistically significant evidence that media reporting about crimes on or near bus routes impacts ridership. With that said, my work points out important gaps in the literature where researchers and policymakers still have the opportunity to more deeply understand a key determinant of …

The Importance Of Pragmatics In The Foreign Language Classroom, Emma Marie Hatsuko Van Ermen Jan 2025

The Importance Of Pragmatics In The Foreign Language Classroom, Emma Marie Hatsuko Van Ermen

All Electronic Theses and Dissertations

Pragmatics has received relatively little attention in language instruction, as it is often regarded as a higher level skill and has only recently gained prominence in linguistic research. This literature review examines the role of pragmatics in foreign language teaching and explores why it is a critical component of language acquisition. First, pragmatics is distinguished from other linguistic branches, such as syntax and semantics, to clarify its unique function in shaping context-dependent communication. Then, the importance of pragmatics in language learning is discussed and the benefits of explicit teaching are highlighted. Finally, common methods for teaching pragmatics such as audio-visual …

Multilingual Voices: Transforming Professional Development Based On Student Perceptions Of Literacy Learning, Nicole Ferguson-Sams, Emily Howell, Rebecca Kaminski, Mihaela Gazioglu, Victoria Pennington

Publications

Acknowledging student perceptions of academic learning has been shown to increase the effectiveness of classroom instruction. However, existing research on multilingual learners (MLs) often focuses on their pedagogical and linguistic needs, overlooking their perceptions of literacy learning. This research, part of a large-scale, design-based research (DBR) project, explores MLs' perceptions of literacy learning to increase the capacity of instruction through professional development to classroom teachers in a high-needs school district. Using grounded theory coding, we analyzed MLs' responses from a self-efficacy survey to gain insight into their perceptions of literacy learning. Those findings were used to inform DBR modifications, including …

Professional Quality Of Life Of Air Force First Sergeants: An Exploratory Study, Ryan K. Barney

Theses and Dissertations--Social Work

This exploratory study was designed to measure the prevalence and correlates of professional quality of life constructs in a novel population: active-duty Air Force First Sergeants. Given the similarities in duties and stressors that First Sergeants encounter with those of other helping professionals, this study aimed to expand the scope of existing professional quality of life research by applying Stamm’s (2010) professional quality of life framework to cross-sectional survey research with a sample of First Sergeants. Four primary research questions guided this study: first, what is the prevalence of secondary traumatic stress (STS), burnout, and compassion satisfaction in a sample …

Caregiver Resources For Aging With An Intellectual And/Or Developmental Disability (Raidd), Lena M. Conway Jan 2025

Caregiver Resources For Aging With An Intellectual And/Or Developmental Disability (Raidd), Lena M. Conway

Entry Level Occupational Therapy Doctoral Capstone Projects Class of 2025

Caregivers of individuals with intellectual and/or developmental disabilities (IDD) are essential in supporting health, well-being, and aging in place; however, they are often overlooked in policy and occupational therapy (OT) practice. Caregivers frequently experience heightened levels of stress, anxiety, depression, physical fatigue, and social marginalization. Adults with IDD face disproportionately high rates of chronic disease and mental health conditions, and despite the development of resources to support this population, caregivers report barriers to locating, understanding, and utilizing these assets. A scoping review was conducted to determine and explore the needs of caregivers and the systemic challenges they face, including fragmented …

Parkinson’S Optimal Wellness And Educational Resource (Power) Project, Christina Mcfadden Jan 2025

Parkinson’S Optimal Wellness And Educational Resource (Power) Project, Christina Mcfadden

Entry Level Occupational Therapy Doctoral Capstone Projects Class of 2025

By 2030, over 1.3 million adults in the U.S. are predicted to be diagnosed with Parkinson’s disease (PD), with Pennsylvania exhibiting a notably high incidence (Parkinson’s Foundation, 2023; Willis et al., 2022). Despite this prevalence, non-specialist clinicians, policymakers, and the public generally remain poorly informed in adequately supporting PD (World Health Organization [WHO], 2022). There is a gap within the literature regarding occupational therapy’s (OT) role in community-based PD programming in the U.S. The Parkinson’s Optimal Wellness and Educational Resource (POWER) Project addresses this through a tertiary health approach as identified in the WHO’s Parkinson’s technical brief (2022). Informed by …

Digital Platform Safety And The Problem Of Variable Costs, Margaret E. O'Grady, Fiona Scott Morton Jan 2025

Digital Platform Safety And The Problem Of Variable Costs, Margaret E. O'Grady, Fiona Scott Morton

Law Faculty Scholarship

Because the United States has no digital regulator to set minimum quality or safety standards for digital products, dominant platforms have both the ability and permission to harm consumers, a trend which will accelerate. Digital platforms with market power have no incentive to shoulder the expense of providing safe, high-quality services, because the marginal costs of providing increased quality and safety—often human beings engaged in content moderation or fact-checking—are so high. If providing better quality would increase profits, digital platforms would have done so already. Instead, digital platforms act like automobile manufacturers before regulators required seatbelts: they will insist that …

Promoting Mu, Christina A. Reilley

Entry Level Occupational Therapy Doctoral Capstone Projects Class of 2025

Despite the broad scope of occupational therapy and its significant impact on patients' lives, the profession requires a strategic marketing plan to raise awareness. To address the lack of understanding on a micro level, a comprehensive marketing plan was developed for Misericordia University’s Occupational Therapy Department to align with the current wants and needs of prospective students. Designed as a 14-week doctoral capstone project, PromOTing MU aims to advocate for the profession by showcasing the experiences of current MUOT students. The cliff of OT programs expanding while application numbers decline is a prevalent issue addressed in PromOTing MU, which targets …

A Seat At The Table: Why Collegiate Athletes Should Seek Fair Nil Regulations Through Their Right To Collectively Bargain And Not Federal Legislation, Alexander J. Wood Jan 2025

A Seat At The Table: Why Collegiate Athletes Should Seek Fair Nil Regulations Through Their Right To Collectively Bargain And Not Federal Legislation, Alexander J. Wood

Loyola University Chicago Law Journal

For decades, the National Collegiate Athletic Association (NCAA) and its member universities claimed they could limit compensation for collegiate athletes because amateurism made college sports different from other professional sports leagues. However, college athletics changed immediately following the Supreme Court’s ruling in Alston v. National Collegiate Athletic Association. In that case, the Court held that certain compensation restrictions from the NCAA violated antitrust laws. After this ruling, college athletes became eligible to license their name, image, and likeness (NIL) in exchange for compensation. This long overdue right for college athletes resulted in disjointed state laws and a helpless NCAA urging …

Systemic Challenges In Pediatric Healthcare: Exploring Reimbursement Disparities And Their Impact On Healthcare Equity, Jessica Ford-Davis, Alexandra Gillette

Theses, Dissertations and Capstones

Introduction: Medicare, Medicaid, and the Children’s Health Insurance Program (CHIP) have provided health coverage for over 135 million Americans, with Medicaid playing a significant role in financing pediatric healthcare. Medicaid covers a wide range of services for children, particularly those from low-income families or with special healthcare needs, including preventive care, immunizations, vision and dental services, and mental health treatments. However, Medicaid reimbursement rates are lower compared to Medicare and private insurance, in some cases 30.6% lower, and have often been insufficient to cover the full cost of care, contributing to financial losses for children's hospitals. Despite these challenges, nearly …

Magnet Hospitals And Their Impact On Patient Outcomes, Connie Cochran, Molly A. Collins

Theses, Dissertations and Capstones

Introduction: In the competitive healthcare landscape, patient safety and quality care have remained critical priorities. The Magnet Recognition Program, awarded by the American Nurses Credentialing Center (ANCC), has recognized hospitals that have demonstrated excellence in nursing and improved patient outcomes. Built on five core pillars: transformational leadership, structural empowerment, exemplary practice, innovation, and quality results, this designation has supported professional development and collaborative care. Although only about 10% of U.S. hospitals have been Magnet-designated, they have been linked to reduced hospital mortality, hospital-acquired infections (HAIs), and patient falls.

Purpose of the Study: The purpose of this research was to evaluate …

Home—The Final Frontier: Why Privacy Means Protecting Workers' Rights To Time And Space, Joshua Fairfield, Amanda Reilly Jan 2025

Home—The Final Frontier: Why Privacy Means Protecting Workers' Rights To Time And Space, Joshua Fairfield, Amanda Reilly

Scholarly Articles

This article critiques the failure of current privacy frameworks to protect workers—especially teleworkers—from the growing encroachment of employer surveillance into their homes. It argues that prevailing privacy regimes, including notice-and-choice models and the GDPR, inadequately address the systemic power asymmetries in the employment relationship, often enabling rather than restricting invasive monitoring. Drawing from labor law traditions, the authors propose a rights-centered framework that views time and space as essential for human dignity and autonomy. They call for a non-negotiable floor of protections, including surveillance-free periods, bans on data commodification, and the establishment of an enforcement inspectorate. By reframing privacy not …
