Caught In The Content Tornado: How To Protect Violent-Crime Trials From The Prejudicial Effects Of Live Streaming, Katie Grace Frisbee Jan 2025

Caught In The Content Tornado: How To Protect Violent-Crime Trials From The Prejudicial Effects Of Live Streaming, Katie Grace Frisbee

Duke Law Journal

With the rise of social media use and true-crime consumption postpandemic, this Note argues that current court practices regarding cameras in the courtroom are insufficient to protect a defendant’s right to a fair trial. This Note focuses on the impact of live streaming violent-crime trials on social media and its consequences—specifically, the “content tornado” that it creates. The content tornado, a concept this Note introduces, refers to the whirlwind of fact, fiction, and opinion that emerges when violent-crime trials are live streamed on social media. This concept describes how live streamed trials generate emotional and moralized content that gets amplified …

Discretionary Immigration Detention, Mary Holper Jan 2025

Discretionary Immigration Detention, Mary Holper

Duke Law Journal

Immigration detainees challenging immigration judges’ bond decisions are hitting a jurisdictional wall—federal courts are given license to ignore errors that immigration judges make in determining dangerousness and flight risk, because such decisions can be categorized as “discretionary.” This license comes from a 1996 amendment to the Immigration and Nationality Act that removed federal courts’ jurisdiction over discretionary decisions to detain for immigration purposes. Detainees’ important liberty interests are left to the whims of a single immigration judge, who determines bond under conditions representing an implicit bias minefield.

This Article explores the justifications for unreviewable discretion and for stripping federal court …

The Impact Of Carbon Disclosure On Firm Value: Examining The Role Of Institutional Ownership In The Energy Sector, Hendra Arie Rachmadhika, Amrie Firmansyah

Journal of Accounting Auditing and Business

This study examines the influence of carbon disclosure on firm value with institutional ownership as a moderator in energy sector companies listed on the Indonesia Stock Exchange during 2019-2022. Carbon disclosure is measured using the disclosure scale developed by Bae Choi et al. (2013a), the percentage of institutional ownership in the company to calculate institutional ownership, and Tobin's Q to calculate firm value. This study uses data from energy sector companies listed on the Indonesia Stock Exchange for the observation period of 2019-2022, with a total of 80 observations through purposive sampling. The results show that carbon disclosure has a …

Rewind, Fast Forward, Record, Delete? Liberating Ourselves From The Past 500 Years, Ambeth R. Ocampo

Perspectives in the Arts and Humanities Asia

Significant differences emerge upon comparing the 1921 Carnaval de Magallanes conference and the 2021 Contacts and Continuities conference: A century ago, the Magellan expedition was celebrated; today it is merely commemorated, using Magellan as a springboard for a wider discussion. A century ago, the “discovery” of the Philippines was credited to Magellan; today, Magellan is rightly cast as an explorer, not the discoverer, of the Philippines. Furthermore, Magellan now shares the glory of the first circumnavigation of the globe with Sebastian Elcano. The seven papers from a century ago had Spain and Mexico as reference points; today, research and discussion …

Familial Income Status, Food Insecurity, And Oral Health In Adolescents In The Prepandemic Era, Gersom I. Jimeenz

Walden Dissertations and Doctoral Studies

Oral health and hygiene present a significant public health problem that can cause short- and long-term effects among families with adolescents. This quantitative, correlational research design study aimed to investigate associations between food security (FS) levels and familial income status to oral health and hygiene among adolescents aged 13-19 throughout the United States. This study used the health belief model to determine if the perceived susceptibilities, severities, benefits, and barriers can lead to self-efficacy and cues to action among adolescents who experience varying familial income levels. Controlled variables included age, sex, and race. Data were derived from the National Health …

Relationship Between Racial Trauma, Microaggression, Cultural Coping Behaviors, And Resilience Among Black Counseling Students, Chrismathe Lindsay

Walden Dissertations and Doctoral Studies

Black students in counseling programs face many challenges stemming from racial trauma and microaggression; for instance, they are at greater risk for mental health problems and degree incompletion. Grounded in critical race theory, the purpose of this quantitative correlation study was to examine whether racial trauma, the experience of microaggression, and cultural coping behaviors were significant predictors of resilience and whether cultural coping behaviors mediated the relationship between racial trauma, microaggression, and resilience among Black counseling students. A convenience sample was used to anonymously survey 80 Black counseling students. The results of the multiple regression mediation analysis showed a statistically …

Saying Hello Again Rather Than A Long Goodbye: A Novel Way Of Addressing Pre-Death Grief And Facilitating Continuing Bonds For Dementia Caregivers, Elizabeth Gilmour, Edith Steffen Jan 2025

Saying Hello Again Rather Than A Long Goodbye: A Novel Way Of Addressing Pre-Death Grief And Facilitating Continuing Bonds For Dementia Caregivers, Elizabeth Gilmour, Edith Steffen

School of Psychology

The ‘Hello Again’ letter-writing intervention is sometimes used in grief counselling to facilitate continuing bonds with the deceased. Family member caregivers of those with dementia often experience a ‘long goodbye’, as the relationship with their loved one gradually changes through serial losses before they have physically died, making the relationship markedly different than the one before the dementia. There are limited interventions to support caregivers with this pre-death grief. This study aimed to address this lack by offering the ‘Hello Again’ intervention to dementia family caregivers, exploring the perceived helpfulness of the task, and attempting to understand the meanings of …

Doing Doctorates Differently: The Parapedagogic Potentialities Of The Phd Process, Helen Bowstead, Ken Gale, Mary Catherine Garland, Claire Walsh

School of Law, Humanities and Social Sciences

Coming together in this conference collectivity, these are doctorates that in their doing – thinking, researching, writing, supervising, assessing, publishing – live by “no preexisting rules, processes, methods, categories or ‘determining judgement’.”1 They are doctorates that “cannot be taught or learned.”23 Such PhDs – thesis’ refusing to (con)form – in their ever probing, in-forming, stubborn curiousness of problematics living beyond solution driven research, lead to transformative moments in the act of learning, that in their difference are “...made sense of, not in terms of what [they] mean but in terms of what [they] do.”4Yet in their difference, doctorates working within …

Lived Experiences Of Emerging Adults’ Transitioning Back To College Campus After Covid-19., Aleesha Hayes Jan 2025

Lived Experiences Of Emerging Adults’ Transitioning Back To College Campus After Covid-19., Aleesha Hayes

Walden Dissertations and Doctoral Studies

The COVID-19 pandemic led to a worldwide shutdown as there were many uncertainties on how to prevent exposure. Emerging adults who were full time students were impacted in a variety of ways, both negatively and positively. There is substantial research on the impact that college students had when transitioning off college campuses. However, there is a lack of literature on the experiences that emerging adults had when transitioning back to college campus after COVID-19. This gap is important because multiple transitions have significant implications for development and well-being. To better understand this, a phenomenological qualitative study was conducted to explore …

Geospatial Analysis Of Social Variables Of The Health Opportunity Index And Stroke Prevalence In Health And Human Services Region 3, Wanderimam R. Tuktur

Walden Dissertations and Doctoral Studies

Disparities exist in stroke prevalence and outcome. There is sparsity of ecological studies at the census tract level that elucidate neighborhood predictors of stroke prevalence in states across U.S. Health and Human Services Region 3 (HHS Region 3: Delaware, Maryland, Pennsylvania, Virginia, West Virginia, and the District of Columbia). This study was conducted to explore the geospatial relationship between the 13 indicators of the Health Opportunity Index (HOI) and stroke prevalence at the census tract level in HHS Region 3 using four HOI indicator profiles: (a) neighborhood and built environment profile, (b) social and community context profile, (c) resource profile, …

The data used for this study come from manufacturing companies listed on the IDX from 2020 to 2023. Overall, the research sample consists of 121 companies. The criteria for classifying a company's life cycle are based on the company's average sales growth. This study uses panel data regression analysis through the EViews 12 application. The results conclude that all intellectual capital components negatively influence earnings management, regardless of the company's life cycle. Meanwhile, HCE has a significant negative effect at …

A Case Study Of A Local Newspaper's Demands For Budget Austerity From South Ridge State University, Daniel Nash Jan 2025

A Case Study Of A Local Newspaper's Demands For Budget Austerity From South Ridge State University, Daniel Nash

MAGIS: Student Development Journal

This article analyzes the budget situation at a fictional state comprehensive college, as detailed by NACUBO’s Leading in Tough Times Workbook. The scenario includes public optics factors, including scrutiny of the school’s fiscal circumstances by local pundits, and a controversial celebrity guest entertainer scheduled by students to appear on campus. The author recommends a crisis communication approach that includes a public relations campaign, cautious evaluation of the pundit’s claims that takes politicized interpretations of resource use into account, and an internal audit of budget use.

Is Silence A Sustainable Act Of Self-Preservation For Asian Americans?, Laurie Nilo

MAGIS: Student Development Journal

This paper is a combination of self-reflection and academic writing. It begins with a description of the event that inspired this paper. This event is an example of the author's Asian American identity development journey. In this paper, the author explores the effects of silence on the lifestyle that Asian American college students can create for themselves after college and what Student Affairs professionals can do to best support these students. To do this, she draws on interviews with student affairs professionals, Yosso's (2205) theory on community cultural wealth, and Strayhorn's (2019) theory on Sense of Belonging.

Intelligent Topic Merging For Highly Correlated Data In Kafka, Alok Roy Jan 2025

Intelligent Topic Merging For Highly Correlated Data In Kafka, Alok Roy

Defensive Publications Series

The present disclosure provides systems and techniques to optimize resource usage in Apache Kafka by detecting and merging topics carrying highly similar or correlated data streams. The system consists of a Topic Similarity Detection Engine that analyzes data across Kafka topics using schema comparison, content similarity, and workload characteristics. Once topics with highly correlated data are identified, the system suggests or automatically merges these topics through a Merging Decision and Topic Merge Executor Module. The merging process is executed by dynamically adjusting partitions, consumer, and producer mappings, and ensuring consistency across merged topics. By reducing the number of partitions and …

For The Love Of Subtitling: Analysing The Challenges In Audio-Visual Translations Of Rocky Aur Rani Kii Prem Kahani, Haritima Sharma Jan 2025

For The Love Of Subtitling: Analysing The Challenges In Audio-Visual Translations Of Rocky Aur Rani Kii Prem Kahani, Haritima Sharma

Living in Languages

Any form of audio-visual media utilises specific stylistic elements in order to represent the reality within which the media form is situated. These representations occur through the language and iconography of the media form, which works on stereotypical features that the audience can easily identify. Forming a pivotal part of the media, these representations must be rendered in the translations for a linguistically and culturally diverse audience. Audio-Visual Translation (AVT) has been used since the 1930s to make media accessible. Of the various modalities, subtitling has emerged as the most widespread mode of AVT due to time and cost benefits. …

Untangling Memories Of Violence: The Khipu In El Rincón De Los Muertos (Alfredo Pita), Jonathan J. Oliveri Jan 2025

Untangling Memories Of Violence: The Khipu In El Rincón De Los Muertos (Alfredo Pita), Jonathan J. Oliveri

Living in Languages

This research proposes a structural reading of El rincón de los muertos to decode and trace echoes to the khipu which are embedded throughout the novel. Contrary to a graphic writing system, the Incan empire’s khipu (khipu) was a mnemotechnic system—a three-dimensional communicative device, an archive of memory that recorded information using different colored strings, and a system of knots. Our concept of mnemonics is different than that of the indigenous communities who relied on oral tradition and specifically for khipu a khipukamayuq (reader of khipu), in a narrative and discursive manner, to reconstruct the message the khipu contained. …

Odesa Will Never Be A 'Russian' City Again, Ian R. Singleton Jan 2025

Odesa Will Never Be A 'Russian' City Again, Ian R. Singleton

Living in Languages

Russophone poet Galina Itskovich wrote the statement serving as the title of this text about the identity of her native Odesa, Ukraine in 2023, more than a year and a half after the full-scale invasion by Russia. I propose an examination of the relationship of contemporary Odesan writers to the Russian language. Sources for this examination include the work of writers in or from Odesa such as Galina Itskovich, Maria Galina, Oleg Fesenko, and Igor Bozhko. To discuss what this situation means for translation, such as is demanded by Ukraine’s 2019 law on the status of the Ukrainian language, I …
