Expressive Discrimination: Universities' First Amendment Right To Affirmative Action, Alexander Volokh Jun 2025

Expressive Discrimination: Universities' First Amendment Right To Affirmative Action, Alexander Volokh

Florida Law Review

In the wake of Students for Fair Admissions, Inc. v. President & Fellows of Harvard College, affirmative action proponents should pursue a First Amendment approach. Private universities, which are speaking associations that express themselves through the collective speech of faculty and students, may be able to assert an expressive association right, based on Boy Scouts of America v. Dale, to choose their faculty and students. This theory has been recently strengthened by 303 Creative LLC v. Elenis.

I discuss various complexities and counterarguments: (1) Race is not different from sex or sexual orientation for purposes of the …

Examining The Impact Of Stress On Collegiate Flight Students, Shivanee D. Cannon-Patron Jun 2025

Examining The Impact Of Stress On Collegiate Flight Students, Shivanee D. Cannon-Patron

Beyond: Undergraduate Research Journal

Stress may negatively affect the timely completion of a student pilot's flight training. A student pilot influenced by stress may be subject to what is known as "falling behind the aircraft," a condition that constantly requires minor interventions from their flight instructor. This lack of situational awareness and decreased performance may inadvertently cause the student pilot to repeat the flight lesson, increasing the time spent in the training course.

Sports And Physical Activity Of Poles In The Context Of Good Health And Well-Being As A Sustainable Development Goal, Elżbieta Biernat, Monika Piątkowska, Robert Podstawski Jun 2025

Sports And Physical Activity Of Poles In The Context Of Good Health And Well-Being As A Sustainable Development Goal, Elżbieta Biernat, Monika Piątkowska, Robert Podstawski

Baltic Journal of Health and Physical Activity

Investing in physical activity (PA) is vital for achieving sustainable development goals. We examine PA trends in Poland using data from Eurobarometer surveys conducted in 2013, 2017, and 2022. In 2022, 64.6% of Poles did not participate in sports, and 41.8% did not engage in non-sport PA. There is a concerning trend of increasing inactivity in sports (Chi22022/2017 = 34.64; p < 0.001; Chi22017/2013 = 56.98; p < 0.001) and non-sports PA (Chi22022/2017 = 18.3, p < 0.01 and Chi22017/2013 = 16.95, p < 0.01). Participation in sport and PA is influenced by individual, inter-personal, environmental, political, and global factors. Notably, there is an upward trend in interpersonal (e.g., club membership, volunteering), environmental (e.g., PA in parks/nature, at home), and political (e.g., dissatisfaction with local government actions) factors. Government intervention is crucial and requires: (1) establishment of an institution for leadership and advocacy of PA, (2) adoption of a cross-sectoral approach for a coordinated change, and (3) increased in-vestment in monitoring systems to track the impact of interventions. These actions are essential for fostering a more active and healthier population in Poland.

Making The Case For Using Mobile Technology To Facilitate Inclusion In Outdoor Physical Activity For Those Who Live With Disabilities, Ta Loeffler Phd

International Symposium of Adapted Physical Activity and International Symposium on Physical Activity and Visual Impairment and Deafblindness

Introduction This presentation contributes to the conference theme of ‘Inclusivizing our world,’ by highlighting ways that the outdoors can be made more inclusive through the informed use of mobile technology. There is a longstanding divide between outdoor practitioners who use MT while leading outdoors and those who do not. Bolliger et al. (2021) reported that 90% of US outdoor instructors they surveyed thought that mobile technology should be used as little as possible in the outdoors.

Methodology A scoping review was used to gather evidence from the literature (56 articles) regarding the adoption of MT and it’s use (or …

Psycho-Analysis Will Not Save Us: Reflections On The Gen Z Mental Health Crisis, Victor Dubitans Jun 2025

Psycho-Analysis Will Not Save Us: Reflections On The Gen Z Mental Health Crisis, Victor Dubitans

Middle Voices

Generation Z (born between 1997 – 2012) is characterized as having both unprecedented mental health awareness and unprecedented mental distress. An apparent contradiction with troubling implications for the mental health field: Either the response to the mounting crisis has been insufficient or the field forms part of the problem. Taking seriously Wilks’ (2023) criticism of “therapeutic overreach” of the contemporary mental health field in the lives and development of youth, this paper attempts a selfanalysis and moral inventory about the field’s potential complicity in the crisis and in the history of hysteria. Lacan’s writings on the “analyst’s discourse” are considered …

The Power Of The Electorate Under State Constitutions, Joshua A. Douglas Jun 2025

The Power Of The Electorate Under State Constitutions, Joshua A. Douglas

Florida Law Review

Voters are special. They are the foundation of our constitutional democracy. Everything starts with the voters.

State constitutions, too, are special, as the recent surge in scholarship on state constitutions demonstrates.

This Article bridges the gap between various strands of scholarship on state constitutions, the right to vote, and democracy, making several novel claims about the way in which state constitutions protect voters. First, this Article canvasses all fifty state constitutions to conclude that they contain multiple levels of protection for the right to vote through numerous clauses that, in combination, elevate the status of voters in the constitutional structure. …

Combatting Extremism, Richard H. Pildes Jun 2025

Combatting Extremism, Richard H. Pildes

Florida Law Review

Few of us are happy with the state of American democracy. Our political institutions appear dysfunctional and our political culture more generally has become increasingly toxic and tribalistic. Our current election structures make it too easy for extreme or factional candidates to win office even when they lack the support of electoral majorities. Additionally, our current system also creates incentives for candidates and those in government to be more responsive to the ideological wings of the parties, rather than to citizens more generally.

I want to help shift the focus of election law from rules about voting policy and …

Nanoscale Structure-Property Relationships Of Cyanate Ester As A Function Of Extent Of Cure, Khatereh Kashmari, Josh Kemppainen, Sagar U. Patil, Julieta Barroeta Robles, Pascal Hubert, Gregory Odegard Jun 2025

Nanoscale Structure-Property Relationships Of Cyanate Ester As A Function Of Extent Of Cure, Khatereh Kashmari, Josh Kemppainen, Sagar U. Patil, Julieta Barroeta Robles, Pascal Hubert, Gregory Odegard

Michigan Tech Publications

Cyanate esters are key thermosetting resins for composite materials that require structural integrity and resistance to elevated temperatures. Because cyanate ester composites require relatively high processing temperatures, they are susceptible to the formation of process-induced residual stresses, which compromise their overall strength and durability. Process modeling is a key strategy for optimizing processing parameters to minimize such residual stresses. A necessary component of effective and efficient process modeling of composites is computationally established resin property evolution relationships for a range of processing parameters. In this study, the physical, mechanical, and thermal properties of a cyanate ester resin are established as …

Masters Theses

This thesis addresses how the United States (U.S.) currently faces various homeland and national security threats. A specific and substantial threat to the U.S. is the border crisis that began to escalate in later 2020 but has been an ongoing issue for decades. Several elements encompass the border crisis such as the political circumstances, policy passed by Congress and endorsed or drafted by the President, resources at borders, and law enforcement or security implementation. However, two vital elements to analyze within the current border crisis are the border security and immigration policies of the Trump and Biden administrations as well …

The Discipling Worship Leader: How Perceptions Impact The Role Of The Worship Leader, Justin Smith Jun 2025

The Discipling Worship Leader: How Perceptions Impact The Role Of The Worship Leader, Justin Smith

Masters Theses

Although worship and discipleship are often envisioned as two distinct practices, they share fundamental aspects of spiritual formation. Worship is often restricted to music, emotional expression, and outward performance, while discipleship tends to be associated with intellectual study, biblical knowledge, and structured learning. However, both disciplines encompass holistic contributions to a believer’s spiritual growth. Discipleship extends beyond epistemology; it involves personal transformation. Worship is not merely an experience or the expression of emotions but rather transformative in nature. Both worship and discipleship, however, encompass more than the contemporary church culture often acknowledges. The two-fold research plan combined findings from a …

Planches, Cases, Bulles Entre Les Langues : Représentations Des Langues Dans Le Roman Graphique « Le Piano Oriental » De Zeina Abirached, Chiara Denti

Al-Kīmiyā

Published in France by Casterman in 2015, Le piano oriental is the fifth graphic novel by French Lebanese comic artist Zeina Abirached. Like her previous graphic works, this book is part of the autobiographical comics movement, although it takes a slightly different perspective. The author is no longer dealing with the facts of collective history, recounting the Beirut of her childhood ravaged by civil war, but she explores her linguistic biography, reflecting on her bilingualism and her dual heritage. Combining images and words, Le piano oriental retraces the author’s linguistic journey and the experience of a mother tongue that is …

Le Discours Éducatif « Expert » Dans L’Enseignement Supérieur À L’Épreuve Du Néolibéralisme, Youssef Aboudi

Al-Kīmiyā

This article aims to examine the main linguistic mechanisms employed by the “expert” educational discourse in higher education to reinforce its legitimacy and authority. The central hypothesis of this study posits that the “expert” educational discourse uses pseudo-technical/scientific rhetorical strategies to create an illusion of rationality and performance, with the aim of neutralizing critical and reflective thinking (Denault, 2016; Gobin, 2011). Theoretically, the study adopts a critical multidisciplinary approach that integrates socio-pragmatics, linguistic anthropology, political philosophy, and critical sociology of organizations. Methodologically, the study is based on a “hermeneutic” approach (Charaudeau, 2018) that seeks to explore the various discursive mechanisms …

Developmental Consequences Of Benevolent Sexism: How Awareness Can Change Women’S Lives, Bianca F. Brenes Rojas Jun 2025

Developmental Consequences Of Benevolent Sexism: How Awareness Can Change Women’S Lives, Bianca F. Brenes Rojas

Student Works

Benevolent forms of sexism become increasingly evident as society evolves, making everyday sexism more challenging to recognize and confront (Feigt et al., 2022; Watson et al., 2018). When unaware, benevolent forms of sexism can adversely affect women’s self-esteem, create feelings of inferiority, and may potentially increase women’s psychological stressors (Becker & Swim, 2011; Becker & Wright, 2011; Moradi & Subich, 2004). According to the ambivalent sexism theory, benevolent forms of sexism, while expressed in a positive tone, can potentially affect women due to the underlying belief that women are inferior to men (Glick & Fiske, 1996). Some women perceive benevolent …

The Role Of Neuroscience In Mental Health Management Within The Adhd Population, Kadi Rae Smith

University Honors Theses

Neuroscience-based educational interventions play a role in the management of Attention Deficit Hyperactive Disorder (ADHD), including the regulation of ADHD-correlated depression and anxiety. Existing research shows that elevated rates of depression correspond to anxiety within the ADHD community; approximately 8.83% of the global population. Social ostracization and isolation are established contributors to depression and anxiety which are commonly comorbid with ADHD. The need exists for further investigation of the beneficial impact that an accurate, biological understanding of how the brain works has on the mental health of the ADHD population, and by extension their families, education systems, and medical industries. …

Halcyon: Creating New Authentic Connections With Nostalgic Marketing In Small Businesses, Claire Elise Stough

Masters Theses

In an over saturated market, there are many brands that fall into the trap of uniform and formulaic marketing strategies that fail to resonate deeply with consumers. This research explores how a brand can break away from these repetitive tactics by evoking a sense of nostalgia to create emotional connections that lead to long-term loyalty with their intended audience. The importance of this topic is found in addressing a gap in contemporary marketing. The challenge is fostering genuine consumer relationships in a world that is dominated by fleeting trends and consumer engagement that is surface level. Leveraging nostalgia, which is …

Pacific Faculty Work

The macrolide class of antibiotics are widely utilized in clinical settings for a broad range of bacterial infections and have additional roles as immunomodulatory agents. Although efficacious with a good safety profile overall, they have been associated with prolongation of the QT interval and development of the polymorphic ventricular tachycardia, Torsades de pointes (TdP). In a 2020 scientific statement, the American Heart Association (AHA) classified azithromycin, clarithromycin and erythromycin as QT-prolonging drugs known to cause TdP and the online database, CredibleMeds, that maintains a list of drugs known to cause QT prolongation classifies these drugs as having an increased risk …
