Illiberal Democracy, Merger Regulation, And Corporate Culture, Brian Jm Quinn Jan 2026

Illiberal Democracy, Merger Regulation, And Corporate Culture, Brian Jm Quinn

Emory Business Law Review

This Essay examines how the second Trump Administration has weaponized merger regulation and regulatory approval processes as tools of corporate capture in service of democratic backsliding toward an illiberal regime. Drawing on theoretical frameworks of competitive authoritarianism and illiberal democracy, this paper demonstrates how discretionary regulatory authority combined with weakened enforcement mechanisms creates opportunities for grand corruption that systematically undermines liberal democratic institutions.

This Essay accomplishes three primary objectives. First, it establishes the essential characteristics of illiberal regimes which maintain the facade of democratic institutions while systematically skewing the political playing field through selective enforcement and regulatory capture. Second, it …

Nostalgic Rhetoric: Unraveling An "Authentic" Past, Quinn Thomas Gienapp Jan 2026

Nostalgic Rhetoric: Unraveling An "Authentic" Past, Quinn Thomas Gienapp

Dissertations and Theses

Our changing awareness of time and memory can generate feelings of nostalgia that impact perceptions of the past, present, and future. Nostalgia should not be described as inherently good or bad. In certain contexts, nostalgia can be used as a positive or negative tool to convey values, arguments, and reactions to the past that are much more than simply appealing to feelings of longing. In this thesis, I examine how nostalgic rhetoric is used to convince individuals of various ideas surrounding memory, culture, and politics. In particular, I identify and describe three modes of nostalgic rhetoric: gratification, denial, and subversion. …

Determinants Of Digital Piracy: An Integrated Model, C. Christopher Lee, Peiyao Chen Jan 2026

Determinants Of Digital Piracy: An Integrated Model, C. Christopher Lee, Peiyao Chen

Journal of International Technology and Information Management

Digital piracy is a form of copyright infringement, and challenges persist in addressing it effectively. Accordingly, understanding why people engage in digital piracy is crucial. Although prior studies have examined digital piracy from multiple perspectives, existing studies on the explanatory factors of digital piracy remain fragmented. To address this research gap, this study develops an integrated model that incorporates key theoretical perspectives, neutralization theory, social learning theory, and the theory of planned behavior (TPB), along with key determinants including gender, age, and the technology factor. Rather than conducting a meta-analysis of previous studies, this study adopts a survey-based approach to …

Too Warm To Win Big? Unpacking The Backer Dynamics Behind Female Crowdfunding Success Using A Warmth And Competence Perspective, Dan Liu Jan 2026

Too Warm To Win Big? Unpacking The Backer Dynamics Behind Female Crowdfunding Success Using A Warmth And Competence Perspective, Dan Liu

Journal of International Technology and Information Management

While crowdfunding is often heralded as a democratized funding avenue that empowers women with higher success rates, this study reveals a more nuanced picture of gender dynamics. The Stereotype Content Model suggests that women are often perceived as warmer but less competent. Using a large dataset from Kickstarter, we find that female-led projects can attract more backers, likely due to warmth-driven appeal, but receive smaller average contributions, potentially due to concerns about risk linked to lower perceived competence. However, the total funding raised by female-led campaigns is comparable to that of male-led ones, showing no clear advantage or disadvantage. This …

Journal of International Technology and Information Management

With the power of social media transforming the way people connect and interact with each other, the dynamics of community formation on platforms such as X during major events are of crucial importance. While social media is an increasingly key driver in determining interactions, little is known about the online influence forming and developing fan communities in high-stakes events. This study looks into the development of user communities for datasets drawn from Kaggle on two of the world’s largest sporting events: the FIFA World Cup 2022, or football, and the T20 World Cup 2022, or cricket, with the aim of …

Modern (Networked) Warfare: Its Concepts, Evolution, And Issues, Ramesh Subramanian Jan 2026

Modern (Networked) Warfare: Its Concepts, Evolution, And Issues, Ramesh Subramanian

Journal of International Technology and Information Management

The on-going Russo-Ukraine war (February 2012-present), the recent India-Pakistan war (May 7-10, 2025), and the Israel-US attacks on Iran (June 13, 2025) have become interesting for a variety of reasons, and garnered a lot of attention in international defense publications and weapons manufacturers. To many defense analysts and defense industry professionals, these wars have become real-life testing platforms to examine and evaluate various present-day war technologies. They have opened up discussion on the future of war, the increasing use of inter-connected networks in warfare, and the increasing use of remote-operated drones in conducting surveillance and in offensive actions against …

Blockchain As A Digital Coordination Infrastructure For Project Management: A Systematic Review And Integrative Framework, Cherie Bakker Noteboom, Sai Neelima Seru, Aravindh Sekar

Journal of International Technology and Information Management

Blockchain technology has gained increasing attention as a digital infrastructure capable of improving transparency, trust, and coordination in complex, multi-organizational project environments. However, existing research on blockchain-enabled project management remains fragmented and industry-focused, providing limited guidance for organizational adoption and integration. This study addresses this gap through a systematic literature review of 29 peer-reviewed studies, following PRISMA guidelines, to examine how blockchain capabilities are incorporated into project management practices across industries and maturity stages.

Grounded in Resource-Based View and Coordination Theory, the analysis employs a feature-to-process mapping approach to link six core blockchain capabilities—decentralization, transparency, immutability, smart contracts, traceability, and …

Colorectal Cancer Screening In Saudi Arabia: Current Challenges And Future Directions, Abdulrahman A. Aljabri, Abdulrahman G. Alharbi

Saudi Medical Journal

Abstract Colorectal cancer has become a major public health concern in Saudi Arabia. It is the most prevalent cancer among men and the third most prevalent among women. Although screening for people aged 45-75 is recommended by national recommendations, screening uptake is still below 10%, and less than 1% of older persons have a colonoscopy. With regional differences that vary from age-standardized rates of 3.2 per 100,000 in Jouf to 21.8 per 100,000 in Riyadh among men, approximately 29% of cases are detected at late stages. Therefore, we assessed the epidemiological, social, and health-related systemic structures preventing effective colorectal cancer …

De-Skilling Or Re-Skilling? The Case For Smarter Writing Assignments, John Lande Jan 2026

De-Skilling Or Re-Skilling? The Case For Smarter Writing Assignments, John Lande

Faculty Publications

This article challenges the assumption that AI inevitably leads to the de-skilling of law students.  Some faculty understandably fear that students will use AI to bypass critical thinking and avoid meaningful effort.  This article reframes AI as a potential catalyst for improving legal education rather than inherently a threat.

Concerns about de-skilling generally are based on the assumption that faculty will not change traditional writing assignments.  This article analyzes why these assignments often fail to help students develop strong analytical and writing skills. These include limited instruction in basic writing skills, poor design, lack of feedback, and faculty inertia in …

Sharing Patient-Generated Health Data With Electronic Health Record: A Standardised Provenance And Context-Rich Information Model And Clinician Evaluation, Abdullahi Abubakar Kawu

Dissertations

With the advent of Patient-Generated Health Data (PGHD) through wearable, mobile, and home monitoring systems, there is immense potential for ongoing monitoring and patient engagement. But integrating PGHD with Electronic Health Record (EHR) is challenged by sub-optimal support for contextual metadata and its relevant elements, lack of semantic interoperability among disparate systems, poor knowledge regarding the factors that impact clinician acceptance, and absence of globally agreed standards for data exchange. This thesis explores how contextually relevant patient-generated health data can be shared with EHRs through a FAIR standardized information model that ensures semantic and syntactic interoperability.

The study addresses six …

Potential Of Crispr/Cas9 Genome Engineering For Biofuel Production From Economically Relevant Algae, Sundram Kumar, Ankur J. Phillips, Bashir Adelodun, Francesco Di Maria, Suresh Sundaramurthy, Tarun Pal

Arusha Climate and Environmental Research Centre

The worldwide energy demand continues to rise, while reliance on fossil fuels remains unsustainable due to global warming, declining reserves and rising oil prices. This has intensified the search for renewable alternatives. Among these, microscopic algae have emerged as a promising feedstock for third-generation biofuels. Owing to their rapid biomass productivity, high lipid content and ability to generate diverse bioproducts, microalgae offer distinct advantages over terrestrial plants. Lipids derived from algae can be converted into biodiesel, while their biomass yields valuable co-products such as carbohydrates, proteins and polyunsatu- rated fatty acids (FAs). These attributes position algae as critical contributors to …

The Impact Of Corporate Mergers And Acquisitions On Performance From The Perspective Of Growth Pressure, Jiandong Wang Jan 2026

The Impact Of Corporate Mergers And Acquisitions On Performance From The Perspective Of Growth Pressure, Jiandong Wang

Dissertations and Theses Collection (Open Access)

Against the backdrop of economic volatility and intensified industry competition, firms generally face multidimensional growth pressures, including historical growth pressure, social growth pressure, and market competition pressure. Growth pressure is not only related to firms’ operational stability, but also profoundly influences their strategic choices, particularly merger and acquisition (M&A) behaviour.Grounded in performance feedback theory, this study constructs an integrated analytical framework encompassing growth pressure, M&A strategic decisions, and M&A performance, and systematically examines how different types of growth pressure affect firms’ M&A decisions, as well as how M&A performance varies across different firm characteristics and different types of M&A.

Educational technologists have not settled on a fixed definition of the field and likely never will. However, attempting to define the field helps to understand the epistemological meanings that shape what the field sees, values, and considers worth pursuing. Through a critical historical review spanning over a century, alongside theoretical engagement with the concepts of entanglement and distributed agency, this paper identifies three key insufficiencies in current educational technology frameworks. These are the persistence of an instrumental-facilitative paradigm that treats technology as a resource deployed by human agents; the theoretical dissolution of the pedagogy-technology dichotomy that existing definitions have not …

State Climate Superfunds, Rachel Rothschild Jan 2026

State Climate Superfunds, Rachel Rothschild

Articles

The harmful effects of climate change have already arrived in cities and states across America, with disasters increasing markedly in recent years along with more gradual environmental changes like sea-level rise and drought. To protect populations and natural resources, significant funding will be necessary for preventative measures as well as disaster response.

At present, it is states and ordinary taxpayers who must shoulder the enormous costs and planning for climate adaptation. A number of state legislators, however, have recently proposed enacting new laws that would require the companies who have most profited from fossil fuel usage to assist in funding …

Authorship Nonsense, Jessica Litman Jan 2026

Authorship Nonsense, Jessica Litman

Articles

Copyright law’s primary device for promoting progress is to bestow rights on the authors of works. Rights vest automatically and last for a very long time. Authors’ choices to retain, license, or transfer those rights fuel opportunities to communicate the works to their audiences. The copyright system’s mechanisms for determining who authored works (and therefore automatically obtained copyright rights) should be both accurate and reliable, since misidentifications will undermine the law’s working as intended.

This article examines authors’ creation of works and copyright law’s handling of authorship disputes. Many works result from creative collaboration. Although the copyright statute incorporates mechanisms …

Monitoring, Oversight, And Learning In Medical Ai, W. Nicholson Price Ii Jan 2026

Monitoring, Oversight, And Learning In Medical Ai, W. Nicholson Price Ii

Articles

When medical AI errs, it often goes unnoticed. If there’s a specific patient injury, and the link to AI is obvious, that problem might be reported to the Food and Drug Administration (FDA), but not always. And many other types of problems, like worse performance on specific groups or ineffective integration into health system workflows, simply don’t fall within the contours of regularized reporting. Even if they are noticed by the health system—far from a given—there’s no obvious way to share that information more broadly. Against this backdrop, there are justified calls for better oversight and reporting. But there’s the …

Read But Not Understood? An Empirical Analysis Of Consumer Comprehension In Homeowners Insurance, Daniel Schwarcz, Brenda J. Cude, Kyle D. Logue, German Marquez Alcala Jan 2026

Read But Not Understood? An Empirical Analysis Of Consumer Comprehension In Homeowners Insurance, Daniel Schwarcz, Brenda J. Cude, Kyle D. Logue, German Marquez Alcala

Articles

Modern contract law assumes that consumers meaningfully assent to the standard forms that govern their daily lives. However, this assumption is widely regarded as a legal fiction for two key reasons: first, most consumers do not read standard forms, and second, even those who do often struggle to fully comprehend their terms and implications. Although the lack of consumer reading has been well documented through empirical research, consumers’ ability to comprehend standard-form contracts has received surprisingly little attention.

This Article addresses the latter issue by empirically examining whether providing excerpts from the dominant standard-form homeowners insurance policy improves consumer understanding …

How The U.S. Constitution Shapes International Tax Law: Instrument Choice In Tax Agreements, Noam Noked, Young Ran (Christine) Kim, Reuven Avi-Yonah Jan 2026

How The U.S. Constitution Shapes International Tax Law: Instrument Choice In Tax Agreements, Noam Noked, Young Ran (Christine) Kim, Reuven Avi-Yonah

Articles

The U.S. Constitution’s Treaty Clause, which requires Senate approval by a two-thirds vote for treaties, has significantly influenced the development of international tax law. This Article examines the implications of Senate supermajority requirements on bilateral and multilateral tax treaties and agreements, alternative instruments, relevant international tax standards, and global tax governance.

Historically, tax treaties have been approved exclusively as Article II treaties requiring Senate approval. The difficulty of entering into treaties with the United States has influenced the instrument choice and design of U.S. and international tax standards. To address this challenge, several U.S. and international tax reforms have employed …

Covid And The Great Retrenchment, Samuel R. Bagenstos Jan 2026

Covid And The Great Retrenchment, Samuel R. Bagenstos

Articles

The past six years have seen two dramatic shifts in federal health and benefits policy. First, during the COVID pandemic, the government dramatically expanded public benefits. These expansions had incredibly positive effects, and recipients were largely satisfied with them. But after a relatively short time, Congress rolled back nearly all of the expansion. Worse, the immediate pullback set the stage for even more significant retrenchments in the second Trump Administration. Where in 2023 the United States came closest to universal health care in its history—with a record low uninsured rate of 7.7%—the Trump Administration’s Medicaid cuts and failure to extend …

Noneconomic Tort Damages And Biased Beliefs About Vulnerability To Harm, Roseanna Sommers Jan 2026

Noneconomic Tort Damages And Biased Beliefs About Vulnerability To Harm, Roseanna Sommers

Articles

The American tort system aspires to provide fair compensation to injured plaintiffs, regardless of socioeconomic status, race, religion, or gender. Recent experimental evidence from psychology suggests, however, that factfinders consistently judge identical harms as less severe when experienced by individuals of lower socioeconomic status (SES). People presume, for instance, that a paper cut hurts a wealthy person more than a less well-off person, that domestic violence inflicts greater suffering on a high-SES woman than a lower-SES woman, and that bullying harms a fiveyear- old from a high-SES family more severely than one from a low- SES family. This Essay examines …

Optimization Of Social Determinants Of Health Data With Z Code Utilization In Inpatient Care, Felicia Cordia Alleyne Jan 2026

Optimization Of Social Determinants Of Health Data With Z Code Utilization In Inpatient Care, Felicia Cordia Alleyne

Yale School of Nursing Digital Theses

The U.S. healthcare system is characterized as being costly, wasteful, and fraught with inequity, due to historical disparities and contemporary challenges such as the aftermath of the COVID 19 pandemic and recent international policy changes that raise the costs of materials and imports. There is evidence to support that with the use of social determinants of health screening tools that are associated with a standardized data capture approach can contribute to value-added clinical and financial changes, resulting in improve care, reduce healthcare disparities, and reduce healthcare costs. This DNP project piloted the implementation of a training protocol for a social …

Exploring Parent-Child Reminiscing Style And Internal-State Talk When Discussing Positive And Negative Shared Events, Komal Verma Miss. Jan 2026

Exploring Parent-Child Reminiscing Style And Internal-State Talk When Discussing Positive And Negative Shared Events, Komal Verma Miss.

Theses and Dissertations (Comprehensive)

Conversations between parents and children about past events play a critical role in children’s social, emotional, and cognitive development. Parents scaffold their children in learning to recount details of their autobiographical memories by creating a space to reflect on internal states, specifically emotions and cognitions. Parents with an ‘elaborative’ reminiscing style are responsive to children’s utterances and ask open-ended questions (e.g., What do you remember about...?). Parents who are less ‘elaborative’ typically ask narrow questions like Did you like it?” that do not encourage conversation. Children whose parents use an elaborative reminiscing style have children who produce the most detailed …
