Comparative Authoritarian Law, Madhav Khosla, Benjamin L. Liebman Feb 2026

Comparative Authoritarian Law, Madhav Khosla, Benjamin L. Liebman

Faculty Scholarship

In recent years, comparative constitutional lawyers have turned their attention to the study of democratic backsliding. However, such scholarship is yet to draw on the now extensive literature on traditional authoritarian systems. The bifurcation of regime type that has structured comparative legal research for decades — for comparative constitutional lawyers and for scholars of specific authoritarian regions — is now under strain. With the global rise of authoritarianism and the growing use of law by authoritarian states, the world is harder to neatly separate into two camps than it once might have been. This Article reflects on how we might …

Does Law Constitute Society?, Jeremy K. Kessler Feb 2026

Does Law Constitute Society?, Jeremy K. Kessler

Faculty Scholarship

The resistance of capitalist inequality to legal reform has led a growing number of scholars to reconsider the explanatory virtues of Marxist legal thought. But what are those virtues? Some scholars hold that what makes Marxist legal thought special is its ability to explain the development of legal relationships in terms of the development of extra-legal relationships — specifically, the relations of production as they adapt to changes in the productive forces. Other scholars argue that this focus on the causal process by which extra-legal change (or stasis) drives legal change (or stasis) is too reductive. They contend that Marxist …

Thermodynamic Analysis Of Metal Segregation In Two Metal Boride-Carbide Ceramics Containing V With Cr, Hf, Ti, Or Zr, Ana C. Feltrin, Simon Divilov, Gregory E. Hilmas, Stefano Curtarolo, William G. Fahrenholtz Feb 2026

Thermodynamic Analysis Of Metal Segregation In Two Metal Boride-Carbide Ceramics Containing V With Cr, Hf, Ti, Or Zr, Ana C. Feltrin, Simon Divilov, Gregory E. Hilmas, Stefano Curtarolo, William G. Fahrenholtz

Materials Science and Engineering Faculty Research & Creative Works

Dual-phase carbide-boride ceramics in different vanadium-Me (Me = Cr, Hf, Ti, and Zr) binary systems were synthesized by boro/carbothermal reduction under stoichiometric and carbon-deficient conditions and densified by spark plasma sintering. Thermodynamic analysis was used to evaluate the influence of composition on the phase stability and metal segregation between phases, along with the resulting effects on microstructure and hardness. Pairing vanadium with Group IV elements (Hf, Ti, and Zr) consistently formed one boride and one carbide phase, while the Cr-V system formed a monoboride phase and a carbon-deficient carbide. Metal segregation trends depended on composition. Vanadium preferentially segregated to the …

Transforming Indigent Appellate Advocacy, Rachel T. Goldberg, Estelle M. Mckee Feb 2026

Transforming Indigent Appellate Advocacy, Rachel T. Goldberg, Estelle M. Mckee

Cornell Law Faculty Publications

Indigent appellate advocacy has long been confined to a narrow, technocratic model—one that prioritizes legal expertise over client autonomy and treats appellate cases solely as isolated legal battles rather than opportunities for systemic change. Unlike their trial-level counterparts, appellate attorneys representing indigent clients have received little scholarly attention, leaving critical questions about client participation, ethical representation, and social justice largely unexplored.

This Article challenges the status quo, arguing that appellate attorneys should rethink their role in ways that empower clients and confront the broader injustices shaping their cases. We introduce two alternative frameworks—client-centered appellate representation and participatory appellate representation—that draw …

“Take A Seat”: Overcoming The Enforceability Challenges Of Crowdsourced Blockchain Arbitration, Anna-Sophie Hochgürtel Feb 2026

“Take A Seat”: Overcoming The Enforceability Challenges Of Crowdsourced Blockchain Arbitration, Anna-Sophie Hochgürtel

Journal of Dispute Resolution

This essay addresses the recent phenomenon of Crowdsourced Blockchain Arbitration (CBA). Within the landscape of new digital dispute resolution tools, I argue that CBA stands out as a cost-effective adjudicative dispute resolution forum for online consumer disputes. I then provide an overview of existing CBA platforms and address the question to what extent CBA constitutes a form of arbitration. Only if it does can CBA arbitration agreements and arbitration awards be enforced domestically and internationally under the New York Convention of 1958. I demonstrate that while CBA proceedings correspond to a conceptual understanding of arbitration, they fall outside the international …

Artificial Neural Network Model For Predicting Fatigue Endurance Limit Of Hot Mix Asphalt Using Uniaxial Tension–Compression Tests, Prashanta Kumar Acharjee, Mayzan Isied, Mena I. Souliman, Sameer Jung Karkl, Tanvir Ahmed, Gokhan Saygili Feb 2026

Artificial Neural Network Model For Predicting Fatigue Endurance Limit Of Hot Mix Asphalt Using Uniaxial Tension–Compression Tests, Prashanta Kumar Acharjee, Mayzan Isied, Mena I. Souliman, Sameer Jung Karkl, Tanvir Ahmed, Gokhan Saygili

Civil Engineering Faculty Publications and Presentations

Fatigue is one of the major distresses occurring in asphalt concrete pavement. Repeated traffic loading causes escalated structural damage which results in the formation of cracks. There is a strain level below which the Hot Mix Asphalt goes under fatigue failure, and it is called endurance limit. In this study, a predictive model is developed to predict endurance limit strain values by using artificial neural network. Uniaxial tension-compression fatigue test results conducted under NCHRP Project 9–44 A were utilized in the model development process. An equation is also extracted from the model along which gives the exact values as the …

Firm-Level Political Risk And Earnings Manipulation, Hui Liang James, Thanh Ngo, Jurica Susnjara Feb 2026

Firm-Level Political Risk And Earnings Manipulation, Hui Liang James, Thanh Ngo, Jurica Susnjara

Accounting, Finance, Information Systems, and Business-Law Faculty Publications and Presentations

Using recently developed proxies for firm-level political risk and earnings manipulation, we test the limited attention theory. Contrary to Hirshleifer and Teoh’s core prediction that investor attention is associated with less managerial manipulation, we find that firm-level political risk, serving as a proxy for investor attention, is positively associated with manipulative earnings management, using both accruals and real activities. The results are robust to alternative proxies for political risk and earnings manipulation, various techniques addressing endogeneity concerns, and subsamples of firms with different earnings manipulation incentives. Moreover, we find that the negative relation between earnings manipulation and subsequent operating performance …

Microtransit In Florida: Strategic Considerations And Research Needs, Jennifer Flynn, Martin Catala, Victoria Perk Feb 2026

Microtransit In Florida: Strategic Considerations And Research Needs, Jennifer Flynn, Martin Catala, Victoria Perk

CUTR Internal Grant Research Program

In response to increasingly dispersed trip patterns, changing travel behavior, and new technology platforms, transit agencies are under pressure to modernize their services to sustain ridership and remain relevant. One strategy gaining traction is microtransit, an on-demand service model that allows riders to request trips (in real time or in advance) and receive service in smaller vehicles that may be shared with other passengers.

Agencies are exploring microtransit to address well-known fixed-route challenges, particularly in low-density areas where limited demand, circuitous routing, and weak pedestrian connectivity can lead to low productivity. By right-sizing service to real-time demand, microtransit can reduce …

Conditions Of Vulnerability: Interpreting Social Condition Discrimination, Colleen Sheppard, Geneviève Plumptre, Hannah Reaburn Feb 2026

Conditions Of Vulnerability: Interpreting Social Condition Discrimination, Colleen Sheppard, Geneviève Plumptre, Hannah Reaburn

Dalhousie Law Journal

At a time of deepening structural inequality, it is important to develop human rights categories that respond to the needs of diverse social groups living in conditions of vulnerability. One source of protection, aimed at countering the exclusion and maltreatment of people who are socially or economically disadvantaged, is the addition of “social condition” as a prohibited ground of discrimination. Québec, the Northwest Territories, and New Brunswick have such protection in their anti-discrimination laws. In this article, we argue that the social condition ground is an important tool for redressing intersectional, group-based vulnerabilities that do not fit readily into traditional …

BACKGROUND: Respiratory viral infections by SARS-CoV-2, influenza A and B viruses, and RSV overlap in disease signs and symptomology, but differ in treatment modality. Nasal swab specimens have been shown to be an effective alternative specimen type for SARS-CoV-2 detection.

OBJECTIVES: This study evaluated the performance of the Panther Fusion® SARS-CoV-2/Flu A/B/RSV assay in anterior nasal swab specimens (self- or healthcare professional [HCP]-) collected in either viral/universal (VTM/UTM) transport media or the Hologic® RespDirect® collection kit (RespDirect swab in enhanced specimen transport media [eSTM]).

STUDY DESIGN: A multicenter study was conducted from October 2022 to March 2024. A total of …

Progressive Neuroinflammation And Deficits In Motor Function In A Mouse Model With An Epg5 Pathogenic Variant Of Vici Syndrome., Bradley Thornton, Alexandra G. Hardinger, Laramie Pence, Priyanka Prem Kumar, Nikolas Connolly, Scott J. Weir, Jay L. Vivian Feb 2026

Progressive Neuroinflammation And Deficits In Motor Function In A Mouse Model With An Epg5 Pathogenic Variant Of Vici Syndrome., Bradley Thornton, Alexandra G. Hardinger, Laramie Pence, Priyanka Prem Kumar, Nikolas Connolly, Scott J. Weir, Jay L. Vivian

Manuscripts, Articles, Book Chapters and Other Papers

Vici syndrome (VS) is a rare pediatric genetic disorder characterized by profound developmental delay, seizures, immune deficits, cardiomyopathy and progressive motor dysfunction. This devastating condition is caused by pathogenic variants in the EPG5 gene, which encodes a regulator of autophagy, leading to the accumulation of toxic intracellular material and widespread cellular dysfunction. Less-severe EPG5 pathogenic variants have recently been linked to rare familial forms of Parkinson's disease, suggesting deficits in EPG5 function drive a range of neurodegenerative disorders. Currently, there are no effective treatments for any disorders associated with pathogenic variants of EPG5. The underlying cellular mechanisms driving the progressive …

Female Ceos And Esg Visual Expressions, Ziming Guo, Beng Wee Goh, Dan Li, Yuan Wang Feb 2026

Female Ceos And Esg Visual Expressions, Ziming Guo, Beng Wee Goh, Dan Li, Yuan Wang

Research Collection School Of Accountancy

Prior studies have shown that women possess unique personality traits that cause them to communicate differently than men do. Hence, we investigate whether the presence of female CEOs affects the use of visual expressions in a firm’s ESG report (“ESG visual expressions”). Using detailed disclosure data from ESG reports in China, we find that firms with female CEOs use more ESG visual expressions. This result is stronger when the firm prioritizes ESG performance, when the female CEO is more powerful, and when there are more women on the top management team. ESG visual expressions are also positively associated with the …

The National Security Internet, Anupam Chander Feb 2026

The National Security Internet, Anupam Chander

Georgetown Law Faculty Publications and Other Works

In response to widespread foreign surveillance and growing geopolitical distrust, governments are erecting a national security internet. Pioneered by China, national firewalls have gone global. But where firewalls sought to keep information out, they now seek to keep data in. Governments keen to avoid their citizens’ data from falling into foreign hands demand not only that personal data be stored on local servers, but also require that it be stored on local servers by local companies—what this Article calls “data localization squared.” Enforcing this demand requires a new mechanism of transnational control: immunity from foreign jurisdiction. Artificial Intelligence (AI) systems, …
