Contractual Evolution, Matthew Jennejohn, Julian Nyarko, Eric L. Talley Jun 2022

Contractual Evolution, Matthew Jennejohn, Julian Nyarko, Eric L. Talley

University of Chicago Law Review

Conventional wisdom portrays contracts as static distillations of parties’ shared intent at some discrete point in time. In reality, however, contract terms evolve in response to their environments, including new laws, legal interpretations, and economic shocks. While several legal scholars have offered stylized accounts of this evolutionary process, we still lack a coherent, general theory that broadly captures the dynamics of real-world contracting practice. This paper advances such a theory, in which the evolution of contract terms is a byproduct of several key features, including efficiency concerns, information, and sequential learning by attorneys who negotiate several deals over time. Each …

8 Dof Quadrupedal Hopping Robot, Clayton T. Elwell, John Bennett, Tyler Mccue, Daniel Munic

Mechanical Engineering

The goal of our senior project was to fabricate an eight degree of freedom (DOF) prototypical quadrupedal robot, develop a controller than commands the quadruped to repeatedly jump 10 cm in the air, and fabricate a modular test stand to safely deploy our controller on the quadruped. The creation of a functional quadruped will bring attention to Dr. Siyuan Xing and Charlie Refvem’s research group, Cal Poly Legged Robots, and will give future Cal Poly undergraduate and graduate students a learning tool to explore dynamic control of biomimetic robotic systems.

Over the course of our senior project, we successfully manufactured …

Pandemics & People: Designing A Virtual Epidemic Event For Immersive, Connected, And Playful Participation In An Infectious Disease Outbreak, Deborah Fields, Amanda Strawhacker, Michael Giang, Yasmin Kafai, Colby Tofel-Grehl, Tyler Hansen, Jen Sun, Mark Dinan

Teacher Education and Leadership Faculty Publications

Researchers and educators have identified an urgent need for more rigorous teaching and learning about epidemiology topics and practices, such as engaging in behaviors that prevent the spread of viral disease such as COVID-19. Responding to this need, we designed a virtual epidemic as a special event hosted in a virtual world. In this paper we share the strategic, tactical, and detailed design of the SPIKEY-20 virtual epidemic and data that reflects back on the design in terms of player participation. Reflecting on the design, we ask: What kinds of players participated in the SPIKEY-20 virtual epidemic? How did players …

Nanoplasmonic Sensing Using Gold Nanostructures, Abbas Thajeel, Mohammed Ibrahem, Duha Ahmed Jun 2022

Nanoplasmonic Sensing Using Gold Nanostructures, Abbas Thajeel, Mohammed Ibrahem, Duha Ahmed

Journal of Applied Sciences and Nanotechnology

Nanoplasmonic sensing, based on the plasmonic resonance absorption of thin, irregularly-shaped Au nanostructures film, with a starting thickness of about 15 nm (±3 nm) sputtered on a quartz substrate, is used to monitor the CeO2 NPs (with an average diameter of 50 nm) film refractive index variations using different film thicknesses (90 nm, 146 nm, 172 nm, and 196 nm). Increasing the film thickness of solution-processed CeO2 NPs film, with layer-by-layer deposition on top of Au nanostructures, shows a significant redshift in the plasmonic resonance absorption of the plasmonic metal, from 580 nm to 611 nm. Such an increase is …

Publications

The Office on Violence Against Women (OVW), established under the Violence Against Women Act of 1994, leads national efforts to prevent and respond to domestic violence, dating violence, sexual assault, and stalking through 19 grant programs that strengthen victim services and enhance offender accountability. These programs include four formula grants distributed to states and fifteen discretionary programs for which OVW defines eligibility, goals, and deliverables. Grantees submit biannual progress reports containing quantitative and qualitative data that are later compiled into biennial Reports to Congress. While these reports effectively capture outputs such as numbers of victims served, trainings conducted, and partnerships …

"This Is Your Team": Examining A Sense Of Belonging Among Transracial International Adoptees, Sheera Tamura Jun 2022

"This Is Your Team": Examining A Sense Of Belonging Among Transracial International Adoptees, Sheera Tamura

Anthropology, Sociology, & Social Work Undergraduate Honors Theses

It has been argued that developing a sense of belonging is a unique process for transracial international adoptees. This qualitative study examines how three transracial international adoptees (N=3) experience a sense of belonging within themselves, their family environments, and their communities. Each participant was thoroughly interviewed about their adoptive experiences and how they find a sense of belonging within their adoptive identities. Once all of the interviews were completed, the interview transcripts underwent a thematic analysis process in which four unique themes emerged. Although there were notable differences in how each adoptee acknowledges a sense of belonging, there were also …

A Way Forward In The Covid-19 Pandemic: Making The Case For Narrative Competence In Pulmonary And Critical Care Medicine, Rana Awdish, Margaret M. Hayes, Avraham Z. Cooper, Megan M. Hosey, Alison Trainor, Rosemary Weatherston, M. Elizabeth Wilcox

Pulmonary and Critical Care Medicine Articles

Each surge of the coronavirus disease (COVID-19) pandemic presented new challenges to pulmonary and critical care practitioners. Although some of the initial challenges were somewhat less acute, clinicians now are left to face the physical, emotional, and mental toll of the past 2 years. The pandemic revealed a need for a more varied skillset, including space for reflection, tolerance of uncertainty, and humanism. These skills can assist clinicians who are left to heal from the difficulty of caring for patients in the absence of families who were excluded from the intensive care unit, public distrust of vaccines, and morgues overtaken …

Fighting Global Surveillance: Lessons From The American Muslim Community, Danna Z. Elmasry Jun 2022

Fighting Global Surveillance: Lessons From The American Muslim Community, Danna Z. Elmasry

University of Michigan Journal of Law Reform

The United States government has been spying on its citizens through a massive surveillance infrastructure that is unrestricted to a particular target or suspicion of wrongdoing. The statutory and regulatory authorities responsible for this infrastructure are sprawling and often secret. Built-in limitations and oversight mechanisms are riddled with loopholes or inaccessible due to exceedingly high thresholds. Litigation challenges to surveillance overreach often fail at standing. Under the current doctrine, plaintiffs must show that their own communications have been surveilled by a specific surveillance program. This Note contributes to surveillance reform by proposing a private right of action that sets the …

Suspect Development Systems: Databasing Marginality And Enforcing Discipline, Rashida Richardson, Amba Kak Jun 2022

Suspect Development Systems: Databasing Marginality And Enforcing Discipline, Rashida Richardson, Amba Kak

University of Michigan Journal of Law Reform

Algorithmic accountability law—focused on the regulation of data-driven systems like artificial intelligence (AI) or automated decision-making (ADM) tools—is the subject of lively policy debates, heated advocacy, and mainstream media attention. Concerns have moved beyond data protection and individual due process to encompass a broader range of group-level harms such as discrimination and modes of democratic participation. While a welcome and long overdue shift, the current discourse ignores systems like databases, which are viewed as technically “rudimentary” and often siloed from regulatory scrutiny and public attention. Additionally, burgeoning regulatory proposals like algorithmic impact assessments are not structured to surface important –yet …

City and Regional Planning

The North Hollywood-Burbank Airport Red Line Extension is a proposal that plans to connect the Red Line from the North Hollywood Station to the Hollywood Burbank Airport. The main focus of the extension is to reduce traffic by allowing a direct Metro rail to the airport. Extending the line will help commuters traveling between Los Angeles to San Fernando Valley and new arrivals at the Hollywood Burbank Airport. In the proposal, commuters will have a direct connection to Amtrak’s Pacific Surfliner and Coast Starlight without having to travel down to Union Station. New arrivals will also have access to cities …

The Mustang Bridge, Dominic Loreto, Jacob Bulotti

City and Regional Planning

The purpose of this project is to develop a pedestrian overpass in San Luis Obispo, California at the entry of the city that will successfully provide crossing and safety on Boysen Ave. and Santa Rosa Street connecting Mustang village to university square. The current circulation routes have a significant impact on a community’s pedestrians, cyclists, and automobile drivers. Safety becomes a growing concern when the streets are illegally crossed in unsafe sections, putting everybody at risk. The planned environment will be revised and accurately assessed to provide safety, flexibility, and proper use of the circulation route in place. The community’s …

The Tragedy Of The Commons: A Podcast Exploring Solutions To The Housing Crisis In California, Delaney Li-Ming Faherty Jun 2022

The Tragedy Of The Commons: A Podcast Exploring Solutions To The Housing Crisis In California, Delaney Li-Ming Faherty

City and Regional Planning

Affordable housing has become increasingly inaccessible across the United States, particularly in California. Because of its long history and far-reaching span, California’s housing crisis is a complexity that affects individuals at most income levels. Accordingly, opinions on solving the crisis vary among each public.

A popular solution is increasing the amount and scale of housing, however, barriers, such as single-family zoning, exist at the state and local level. While statewide legislation is working to counteract municipal zoning codes, local opposition is rampant. Because of this pushback, and the slow pace at which housing reliant on individual action is built, today’s …

Procedural Environmental Justice, Jonathan Skinner-Thompson Jun 2022

Procedural Environmental Justice, Jonathan Skinner-Thompson

Washington Law Review

Achieving environmental justice—that is, the fair treatment and meaningful involvement of all people regardless of race, color, national origin, or income, with respect to the development, implementation, and enforcement of environmental laws, regulations, and policies—requires providing impacted communities not just the formal right, but the substantive ability, to participate as equal partners at every level of environmental decision-making. While established administrative policy purports to provide all people with so-called meaningful involvement in the regulatory process, the public participation process often excludes marginalized community members from exerting meaningful influence on decision- making. Especially in the environmental arena, regulatory decisions are often …

The Chorus Doctrine: Promoting Sub-National Diplomacy In Regional Growth Management, Conor J. Mannix Jun 2022

The Chorus Doctrine: Promoting Sub-National Diplomacy In Regional Growth Management, Conor J. Mannix

Washington Law Review

Sub-national diplomacy, also known as paradiplomacy, occurs when sub-national actors (think cities or states) engage in international relations, either with other sub-national actors or nation-states. Though typically the province of foreign policy scholarship, paradiplomacy touches on several legal issues, particularly where sovereignty and legal frameworks collide. In the United States, the federal system established by the Constitution gives individual states plenary power but reserves international relations to the federal government through the Supremacy Clause. However, the lines between federal power and state power with regards to international relations remain fuzzy.

Sub-national actors are taking advantage of this lack of sharply …

This article asks whether the dynamics of information and communication technologies, which lead to the upheaval of different lifestyles, constitute an opportunity or a threat to Cameroon’s journalistic profession. It articulates the main declinations that explain the integration or not of ICTs in the business models of Cameroonian media.

Rereading The “One Share, One Vote” Principle: Is It Also A Matter Of Competition?, Federico Ghezzi, Chiara Mosca, Maria ‎‏‏‎ Lucia‎ Passador ‎‏‏‎ ‎‏‏‎

The University of Chicago Business Law Review

Despite being a cumbersome principle of corporate governance, the “one share, one vote” principle à la Easterbrook and Fischel is constantly challenged by several attempts to circumvent the original structure of capitalism democracy, based on the provision (often a default provision) that no more and no less than one vote is attributed to each share.

The possibility of adopting categories of shares with multiple voting rights and that of resorting to mechanisms that multiply voting rights upon the occurrence of specific conditions (oftentimes linked to a loyalty bonus for long-term shareholders), depends on the articles of association’s autonomy granted to …

Should There Be Corporate Governance Police?, M. Todd Henderson Jun 2022

Should There Be Corporate Governance Police?, M. Todd Henderson

The University of Chicago Business Law Review

If a company misbehaves, lawsuits are one way of providing a remedy and encouraging that company and others to behave in the future. If the misbehavior is securities fraud, there are two potential plaintiffs—traders allegedly injured by the fraud may bring a private suit, and the government (through the SEC or DOJ) may sue to enforce the public interest in truthful disclosures of corporate information. If the misbehavior is violations of corporate governance rules, however, only private suits are available. Despite the parallel rationales for marrying private and public attorneys general, the toolkit for protecting the public interest in corporate …

Mandatory Financial Disclosures As Total Regulatory Takings, Jay Khurana Jun 2022

Mandatory Financial Disclosures As Total Regulatory Takings, Jay Khurana

The University of Chicago Business Law Review

In the aftermath of the GameStop phenomenon in early 2021, there have been increasing calls for expanded mandatory financial disclosures particularly regarding hedge funds and short selling. Efforts to increase disclosure requirements on hedge funds may implicate the Takings Clause of the Fifth Amendment. This comment argues that mandatory disclosure of a firm’s total portfolio—its long, short, and derivative positions—constitutes an uncompensated taking of its trade secrets. This comment explores the application of current takings jurisprudence to trade secrets and financial disclosures. It concludes that the per se rule established in Lucas v. S.C. Coastal Council should apply to public …

Examining The Effects Of Legalizing Marijuana In Colorado And Washington On Clearance Rates: A Quasi-Experimental Design, Cody Jorgensen, Alexis J. Harper Jun 2022

Examining The Effects Of Legalizing Marijuana In Colorado And Washington On Clearance Rates: A Quasi-Experimental Design, Cody Jorgensen, Alexis J. Harper

Criminal Justice Faculty Publications and Presentations

Objective This study follows the lead of Makin et al. (Police Quarterly 22(1): 31–55, 2019) who found that marijuana legalization is associated with a marginal increase in clearance rates for some crimes but not for others.

Methods We build on their work attempting to replicate their findings by using the synthetic control method and fixed-effects models. A 50-state panel data set was constructed and analyzed. The dependent variables were aggregated violence and property crime rates. The independent variable was dichotomously measured recreational marijuana legislation.

Results Marijuana legalization is not a meaningful avenue of increasing clearance rates.

Conclusion The synthetic …

The Health Belief Model Applied To Covid-19 Vaccine Hesitancy: A Systematic Review, Yam B. Limbu, Rajesh K. Gautam

Department of Marketing Faculty Scholarship and Creative Works

This study systematically analyzes the research that used the Health Belief Model (HBM) as a theoretical basis to examine the influence of HBM constructs on COVID-19 vaccine hesitancy. Following PRISMA guidelines, PubMed, Web of Science, Google Scholar, and Scopus were searched for quantitative studies. Sixteen studies with 30,242 participants met inclusion criteria. The prevalence of COVID-19 vaccine hesitancy was 33.23% (95% CI 24.71–41.39%). Perceived barriers and perceived benefits were the most common HBM constructs that were significantly associated with vaccine hesitancy. While perceived benefits was inversely associated, a positive association was found between perceived barriers and vaccine hesitancy. Other HBM …
