Passing The Buck: The Perils Of Oklahoma V. Castro-Huerta, Adam Crepelle, Timothy Purdon, Brendan Johnson Dec 2023

Passing The Buck: The Perils Of Oklahoma V. Castro-Huerta, Adam Crepelle, Timothy Purdon, Brendan Johnson

Denver Law Review

The Supreme Court’s 2022 decision in Oklahoma v. Castro-Huerta upended federal Indian law by allowing states to prosecute crimes involving Indians committed in Indian country. Castro-Huerta created a concurrent jurisdiction over Indian country crimes involving non-Indians. While concurrent jurisdiction increases the number of law enforcement agents with jurisdiction, it also creates opportunities for those law enforcement agents to shirk responsibility. Neither state nor federal law enforcement is accountable to tribes, so Castro-Huerta is likely to create a pass the buck mentality among non-Indian law enforcement. Moreover, there is little to indicate expanding state authority over tribes will benefit Indians. In …

Haaland V. Brackeen: The Indian Child Welfare Act, States' Rights, And The Survival Of America's First Peoples And Nations, Andrew B. Reid

Denver Law Review

At the end of its 2023 term, the United States Supreme Court issued a long-awaited decision on the Indian Child Welfare Act, Haaland v. Brackeen. The Court was presented with the direct conflict between three well-established bodies of constitutional law: (1) the right of individuals against racial discrimination, (2) the rights reserved by the states under Tenth Amendment federalism, and (3) federal supremacy over the states in matters concerning Native peoples and nations. These conflicts risk the survival of Native families, communities, and culture as well as the collective rights of Native peoples to their survival as inherently sovereign nations …

The Future Of Anti-Poverty Legislation, Andrew Hammond, Ariel Jurow Kleiman, Gabriel Scheffler Dec 2023

The Future Of Anti-Poverty Legislation, Andrew Hammond, Ariel Jurow Kleiman, Gabriel Scheffler

Articles

The era of big-government COVID relief is over. The initial pandemic relief legislation, followed by two years of Democratic control in Washington, seemed to herald the expansion and modernization of the U.S. safety net. But sustained reform proved elusive. Now that this window of opportunity has closed, it's time to step back and take stock. For those who focus on anti-poverty programs, one question persists: The next time there is such an opportunity to strengthen anti-poverty programs through legislation, how should federal law change?

This Article suggests the answer to that question lies in lessons from recent experience, including, but …

An Examination Of The Utilization Of Programming For Female Delinquency Prevention In Jamaica, Regan R. Reid

All Dissertations

Little to no academic inquiry has examined interventions targeting girls involved in the justice system in Jamaica. This qualitative study asked: (1) How do girls in conflict with the law in Jamaica experience victimization? (2) How does the justice system respond to girl offenders who have also been victims? (3) What are the needs of girls in conflict with the law in Jamaica? (4) What programs exist specifically for girls in conflict with the law? (5) How effective have existing programs been for girls in conflict with the law, and do outcomes vary across education levels and settings (i.e., rural …

Identification Of Genes Conferring Resistance To 2-Amino-3-Methylimidazo [4,5-F] Quinoline Genotoxicity In Budding Yeast Using High-Throughput And Targeted Approaches, Michael J. Dolan

Legacy Theses & Dissertations (2009 - 2024)

Heterocyclic aromatic amines (HAAs) are potent carcinogenic agents found in charred read meat and cigarette smoke. We hypothesize that HAAs may contribute to red meat being a risk factor for colorectal cancer (CRC). At present, few eukaryotic genes conferring resistance to HAAs have been identified. In this research, the genome of Saccharomyces cerevisiae (budding yeast) was profiled using next-generation sequencing to identify genes conferring resistance to one such HAA, 2-amino-3-methylimidazo[4,5-f] quinoline (IQ).CYP1A2 and NAT2 activate IQ to become a mutagenic nitrenium compound. Deletion libraries expressing human CYP1A2 and NAT2 or no human genes were exposed to either 400 or 800 …

Deserving Care: How Older Chinese Immigrants Seek Support, Xuemei Cao Dec 2023

Deserving Care: How Older Chinese Immigrants Seek Support, Xuemei Cao

Legacy Theses & Dissertations (2009 - 2024)

Older immigrants make up an increasingly larger share of the overall aging population in the United States. This demographic shift brings challenges to existing systems of elder care provision and calls for an in-depth understanding of aging immigrants’ diverse needs. As immigrants grow older, they need to get support from families, non-kin persons, and formal services to manage various challenges. However, their sense of entitlement to receive care from each source has changed because of the readapted intergenerational reciprocity at home, shifting contexts of interactions and norms of reciprocity with non-kin persons in the community, and the interrupted obligations between …

Toward A Seed Commons: Practicing Commons For Future Economies, Caitlin Corleen Denny Dec 2023

Toward A Seed Commons: Practicing Commons For Future Economies, Caitlin Corleen Denny

Legacy Theses & Dissertations (2009 - 2024)

ABSTRACT In this thesis, commons theory is utilized to critically assess the impact of the expanding consolidation of the global seed industry on the seed's status as a common resource. Various understandings of the commons are considered and contradictions and recent insights into the significance of relational dynamics in commons governance are acknowledged. I argue that our daily interactions are instrumental in reconstructing the commons and act as transitional ways of relating that can guide us toward future economies. I use instances of cooperation in the Capital Region, as well as existing seed commons at both local and global scales, …

Legacy Theses & Dissertations (2009 - 2024)

Background: Stigma about mental health and illness remains a pervasive public health concern. Moreover, stigmatizing oneself for experiencing a mental health disorder is associated with further psychological distress. Yet, processes that may account for this relation remain unclear. Thus, the present study aimed to elucidate processes that may account for this relationship, with specific attention to psychological inflexibility as a transdiagnostic mediator between self-stigma and psychological distress. Methods: Undergraduates (N = 486, Mage = 18.68, SDage = 1.31, 66% Female) completed a battery of measures assessing self-stigma, psychological inflexibility, and psychological distress. We tested psychological inflexibility and its six subprocesses …

Postpartum Visitation Policies, Jenna B. Holderman, Morgan E. Matthews

The Eleanor Mann School of Nursing Undergraduate Honors Theses

Background: Continual support for the birthing person during labor improves delivery outcomes and overall childbirth experiences. How many support people are present and their relation to the birthing person varies based on individual preference, family dynamics, and sociocultural expectations. During the Covid-19 pandemic, many hospitals implemented a one-visitor policy for deliveries. With these new guidelines in place, the length of hospital stays significantly decreased, and there were a variety of opinions towards these restrictions.

Purpose: The purpose of this study was to explore birthing persons’ overall sentiment towards visitors in the immediate postpartum period.

Methods: The current study analyzed …

Restraining Chatgpt, Roee Sarel Dec 2023

Restraining Chatgpt, Roee Sarel

UC Law Journal

ChatGPT is a prominent example of how Artificial Intelligence (AI) has stormed into our lives. Within a matter of weeks, this new AI—which produces coherent and humanlike textual answers to questions—managed to become an object of both admiration and anxiety. Can we trust generative AI systems, such as ChatGPT, without regulatory oversight?

Designing an effective legal framework for AI requires answering three main questions: (i) is there a market failure that requires legal intervention?; (ii) should AI be governed through public regulation, tort liability, or a mixture of both?; and (iii) should liability be based on strict liability or a …

Shifting Perspectives: How Scrutiny Shapes The Relationship Between Ceo Gender And Acquisition Activity, Daniel L. Gamache, Cynthia E. Devers, Felice B. Klein, Timothy Hannigan Dec 2023

Shifting Perspectives: How Scrutiny Shapes The Relationship Between Ceo Gender And Acquisition Activity, Daniel L. Gamache, Cynthia E. Devers, Felice B. Klein, Timothy Hannigan

Management Faculty Publications and Presentations

Research Summary: Several upper echelons studies have found that firms led by female executives are less likely to engage in risky endeavors than those led by male top executives. We argue that conceptualizing female CEOs as universally conservative decision-makers may paint too simplistic a picture and that the impact of CEO gender on strategic decision-making may vary significantly depending on the given situation CEOs are experiencing. We integrate executive job demands and gender research to propose that scrutiny will exhibit differential effects on female and male CEOs' acquisition activity. We show that in high-scrutiny contexts, the difference between male and …

The Illusion Of Due Process In School Discipline, Diana Newmark Dec 2023

The Illusion Of Due Process In School Discipline, Diana Newmark

William & Mary Bill of Rights Journal

Long-term suspensions and expulsions can be enormously consequential for students and their families. Not only do exclusionary disciplinary measures directly result in lost learning opportunities for children, but school discipline decisions can also result in significant collateral consequences. These consequences range from lower rates of graduation and higher rates of contact with the criminal justice system to disruptions in foster care placements, violations of juvenile probation, and even possible immigration consequences for undocumented students.

The Supreme Court has recognized the significance of suspensions and expulsions, requiring due process for such exclusionary discipline measures. But the Supreme Court has never explained …

The State of Alaska Special Supplemental Nutrition Program for Women, Infants, and Children (WIC) offers nutrition education for low-income women and children, addressing the nutrition knowledge gap among low-income parents to improve health outcomes. However, the State of Alaska WIC program does not currently use smartphone apps for participant education even though the population served by WIC generally relies on smartphones for trusted information. For this project, a template for WIC smartphone education modules was developed, accompanied by a style guide with format recommendations and platform information that can be used in the creation of future education modules. A sample …

Aesthetics Of Religious Coexistence And Tolerance In Shafak's Turkish Novel, Mohamad Abou Adel

CoHSS Faculty Work

This paper explores the novel "Forty Rules of Love" by Elif Shafak, which evokes the historical personality of the great scholar Jalal al-Din al-Rumi, dubbed by the West "the Shakespeare of the Islamic world". He was known for his moderation and tolerance, his call to coexistence and fraternity between the members of different religions, and his condemnation of violence and extremism of all kinds. The novel strives to change the misconceptions of the West regarding the Asian countries of the East and to challenge the negative attitude towards Islam, known nowadays as Islamophobia. The paper aims to address the evil …

The Longitudinal Associations Of Body Dissatisfaction With Health And Wellness Behaviors In Midlife And Older Women, Lisa Smith Kilpela, Savannah C. Hooper, Casey L. Straud, Victoria B. Marshall, Christina L. Verzijl, Tiffany M. Stewart, Taylur T. Loera, Carolyn Black Becker Dec 2023

The Longitudinal Associations Of Body Dissatisfaction With Health And Wellness Behaviors In Midlife And Older Women, Lisa Smith Kilpela, Savannah C. Hooper, Casey L. Straud, Victoria B. Marshall, Christina L. Verzijl, Tiffany M. Stewart, Taylur T. Loera, Carolyn Black Becker

Population and Public Health Science Faculty Publications

Emerging research suggests that body dissatisfaction (BD) is prevalent among midlife and older women (i.e., upwards of 70%). Cross-sectionally, BD is associated with myriad poor health and wellness outcomes (e.g., depression, disordered eating, bad nutrition) in midlife/older women. However, relatively few studies have examined the longitudinal relations between BD and health outcomes in this population. This preliminary study investigated the longitudinal associations of BD with wellbeing and health-related quality of life (QOL) among midlife/older adult women over one year. Participants (n = 86, women aged 40–72 years, M = 51.49, SD = 7.34, 86% white) completed self-report measures of BD, …

Digital Archives: How Western Newspapers Frame Our Remembrance Of The Gezi Park Protest, Nihar Sreepada, Ahmet Aksoy Dec 2023

Digital Archives: How Western Newspapers Frame Our Remembrance Of The Gezi Park Protest, Nihar Sreepada, Ahmet Aksoy

Faculty Publications

We analyze the coverage of the Gezi Park protests by two major Western newspapers - The New York Times and The Guardian - through the lens of media framing, rhetoric, and collective memory. We argue that these digital archives frame Turkey's Gezi Park protests as a challenge to an authoritarian government by promoting the themes of unrest as a conflict of ideologies, oppression of citizens, and the park as a site of memory. In a concluding section, we focus on the significance of digital archives as repositories of collective memory and the role of media framing in shaping these reconstructions …

Relationship Between Arm Path, Ball Velocity, And Elbow Varus Torque In Professional Baseball Pitchers, Brittany Dowling, Alexander Hodakowski, Bjorn Olmanson, Matthew Cohn, Patrick Pauley, Nikhil Verma, Gregory Nicholson, Grant Garrigues Dec 2023

Relationship Between Arm Path, Ball Velocity, And Elbow Varus Torque In Professional Baseball Pitchers, Brittany Dowling, Alexander Hodakowski, Bjorn Olmanson, Matthew Cohn, Patrick Pauley, Nikhil Verma, Gregory Nicholson, Grant Garrigues

Rothman Institute Papers

BACKGROUND: Currently, most pitching instructors suggest a shorter arm path-the total distance the arm travels during pitching. Theoretically, this combination allows for better body segment sequencing, a more efficient energy transfer through the kinetic chain, and increased ball velocity, while limiting elbow varus torque.

HYPOTHESIS: Shorter arm paths would be associated with increased ball velocity and decreased elbow varus torque.

STUDY DESIGN: Descriptive laboratory study.

METHODS: A total of 182 professional pitchers threw 8 to 12 fastball pitches while evaluated by 3-dimensional motion capture (480 Hz). The arm path was calculated as the total distance the hand marker traveled during …
