The Minds Behind The Movement: The Role Of Academics In East Asia’S War Reparations Litigation, Timothy Webster
The Minds Behind The Movement: The Role Of Academics In East Asia’S War Reparations Litigation, Timothy Webster
Faculty Scholarship
East Asia's war compensation litigation simultaneously unites diverse regional actors (lawyers, survivors, activists) and fray international relations (as recent verdicts from South Korea attest). However, one view of the merits of these lawsuits is that they have reconfigured transnational activism in East Asia, exhumed forgotten and suppressed histories of Japanese aggression, and on occasion compensated victims of World War II. This Article highlights the role of Chinese, Japanese, Korean, Taiwanese activists, lawyers and scholars in researching, filing, litigating and appealing over 80 lawsuits between 1972 and the present.

The Gdpr As Privacy Pretext And The Problem Of Co-Opting Privacy, Neil M. Richards
The Gdpr As Privacy Pretext And The Problem Of Co-Opting Privacy, Neil M. Richards
Scholarship@WashULaw
Privacy and data protection law's expansion brings with it opportunities for mischief as privacy rules are used pretextually to serve other ends. This Essay examines the problem of such co-option of privacy using a case study of lawsuits in which defendants seek to use the EU’s General Data Protection Regulation (“GDPR”) to frustrate ordinary civil discovery. In a series of cases, European civil defendants have argued that the GDPR requires them to redact all names from otherwise valid discovery requests for relevant evidence produced under a protective order, thereby turning the GDPR from a rule designed to protect the fundamental …

Ethical Leadership And Leadership In Ethics, Robert Audi
Ethical Leadership And Leadership In Ethics, Robert Audi
Interdisciplinary Journal of Leadership Studies
This paper offers a conceptual portrait of leadership and a framework for exercising it in the realm of ethics. The paper provides an account of what constitutes leadership, a set of moral standards for its ethical exercise, and a distinction between leadership that meets these standards and leadership that not only meets them, but positively engages them. This engagement is central for leadership in ethics. The main context for analysis in the paper is organizational. Leadership is essential for the success of organizations and morally important in their daily operations. The paper also describes its nature and role in less …
Centering Noncitizens’ Free Speech, Gregory P. Magarian
Centering Noncitizens’ Free Speech, Gregory P. Magarian
Scholarship@WashULaw
First Amendment law pays little attention to noncitizens’ free speech interests. Perhaps noncitizens simply enjoy the same First Amendment rights as citizens. However, ambivalent and sometimes hostile Supreme Court precedents create serious cause for concern. This Essay advocates moving noncitizens’ free speech from the far periphery to the center of First Amendment law. Professor Magarian posits that noncitizens epitomize a condition of speech inequality, in which social conditions and legal doctrines combine to create distinctive, unwarranted barriers to full participation in public discourse. First Amendment law can ameliorate speech inequality by promoting an ethos of free speech obligation, amplifying the …
Redefining “Misinformation,” “Disinformation,” And “Fake News”: Using Social Science Research To Form An Interdisciplinary Model Of Online Limited Forums On Social Media Platforms, Audrey C. Normandin
Redefining “Misinformation,” “Disinformation,” And “Fake News”: Using Social Science Research To Form An Interdisciplinary Model Of Online Limited Forums On Social Media Platforms, Audrey C. Normandin
Campbell Law Review
“Misinformation,” “disinformation,” and “fake news” have spread division and contention through online social media platforms, resulting in adverse effects to various areas of science, politics, and public health. This Comment takes a deeper look into the underlying motivations and beliefs behind this phenomenon by presenting a cohesive summarization of the empirical evidence gained from social science research. These terms are reclassified as “conflicting information” to deemphasize the considerations of fact or fiction and emphasize the empirical data showing these terms are social signifiers connotating “in-group” and “out-group” divisions. After developing this backdrop of social science research, the current legal proposals …
#Fintok And Financial Regulation, Nikita Aggarwal, D. Bondy Valdovinos Kaye, Christopher K. Odinet
#Fintok And Financial Regulation, Nikita Aggarwal, D. Bondy Valdovinos Kaye, Christopher K. Odinet
Faculty Scholarship
Social media platforms are becoming an increasingly important site for consumer finance. This phenomenon is referred to as “FinTok,” a reference to the “#fintok” hashtag that identifies financial content on TikTok, a popular social media platform. This Essay examines the new methodological possibilities for consumer financial regulation due to FinTok. It argues that FinTok content offers a novel and valuable source of data for identifying emerging fintech trends and associated consumer risks. As such, financial regulators should use FinTok content analysis—and social media content analysis more broadly—as an additional method for the supervision and regulation of consumer financial markets. The …
Sentiment Without Sentiment Analysis: Using The Recommendation Outcome Of Steam Game Reviews As Sentiment Predictor, Anqi Zhang
Electronic Theses and Dissertations
This paper presents and explores a novel way to determine the sentiment of a Steam game review based on the predicted recommendation of the review, testing different regression models on a combination of Term Frequency-Inverse Document Frequency (TF-IDF) and Latent Dirichlet Allocation (LDA) features. A dataset of Steam game reviews extracted from the Programming games genre consisting of 21 games along with other significant features such as the number of helpful likes on the recommendation, number of hours played, and others. Based on the features, they are grouped into three datasets: 1) either having keyword features only, 2) keyword features …

Automated Detection Of Vaping-Related Tweets On Twitter During The 2019 Evali Outbreak Using Machine Learning Classification, Yang Ren, Dezhi Wu, Avineet Singh, Erin Kasson, Ming Huang, Patricia Cavazos-Rehg
Publications
There are increasingly strict regulations surrounding the purchase and use of combustible tobacco products (i.e., cigarettes); simultaneously, the use of other tobacco products, including e-cigarettes (i.e., vaping products), has dramatically increased. However, public attitudes toward vaping vary widely, and the health effects of vaping are still largely unknown. As a popular social media, Twitter contains rich information shared by users about their behaviors and experiences, including opinions on vaping. It is very challenging to identify vaping-related tweets to source useful information manually. In the current study, we proposed to develop a detection model to accurately identify vaping-related tweets using machine …
The Implications Of Integrating The Theory Of Multiple Intelligences Into English Language Learning Methodologies, Taylor Woodbury
The Implications Of Integrating The Theory Of Multiple Intelligences Into English Language Learning Methodologies, Taylor Woodbury
Education Theses
The achievement gap between English Language Learners and their peers has emerged as a problem in our nation's school system. Although the Theory of Multiple Intelligences has been used in education, it is not often applied to English Language Learners. This research analyzed the application of Multiple Intelligence Theory as it pertained to the achievement of EL’s. The results show that by using MI to dictate what teaching method to use, EL’s benefited both socio-emotionally and academically. Overall, the findings show the importance of 1) ESL training for all teachers, 2) the consideration of students' Funds of Knowledge, and 3) …
Babel Fish: Court Interpreters In America (1790-1921), John Alcalde
Babel Fish: Court Interpreters In America (1790-1921), John Alcalde
Graduate Research Theses & Dissertations
This dissertation examines court interpretation and English language fluency in US law from the Revolution to the Progressive Era. From its inception, the United States has operated with an Anglophone legal system that presumes English fluency embedded in a society that has contained an ever-evolving population of non-English speakers. Using legal records from cases with non-English speakers, I study how court interpretation evolved over the course of the long nineteenth century. The major themes that emerge from my research tell the story of how the American legal system discovered interpreters as the tool for communication with non-English speakers in the …

The Participatory Approach And Student Active Learning In Language Teaching: Language Students As Journalists And Filmmakers, Svetlana Sokolova, Andrei Rogatchevski, Kristian Bjørklund, David Henrik Lavén, Håkon Sverdrupsen
Russian Language Journal
This article contributes to two recent discussions in pedagogy and education, namely, the impact of the participatory approach (Jenkins et al., 2009; Yowell & Rhoten, 2009) on learning and the benefits of student active learning (Sokolova et al., in press; Spasova & Welsh, 2020). The participatory approach incorporates texts and tasks on the topics of interest that are relevant to students’ daily lives and potential workplaces. Student active learning builds upon the idea that “L2 learners must engage in classroom activities that allow them to be active learners rather than passive listeners” (see Nesset et al., this volume). This idea …

Teaching Discourse Markers To Students With Students: The Case Of Italian Learners Of L2 Russian, Beatrice Bernasconi, Marina Giampietro
Russian Language Journal
The present study explores the development of a teaching treatment on discourse markers (DMs) for Italian learners of Russian as a Second Language (L2) using students in the research process. We believe that learners’ insights are a valuable resource in the design of teaching treatments tailored to learners’ needs. Both researchers and students can benefit from such cooperation when dealing with slippery aspects of spoken language, such as DMs.

Pre-Service Secondary Mathematics Teachers' Definitions Of Mathematics Terms In Their Video-Lesson Presentations: A Deductive Content Analysis, Art Walden A. Dejoras, Catherine P. Vistro-Uy
Mathematics Faculty Publications
Taking into account the nature of mathematics as an exact science and the essential role of mathematics teachers’ knowledge of fundamental mathematics definitions; the authors investigated the pre-service secondary mathematics teachers (PSMTs) knowledge of a good mathematics definition in their group video-lesson presentations related to algebra; geometry; descriptive statistics; and number theory. The quality of their definitions can provide a glimpse of their preparedness to teach mathematics at the secondary level. Drawing on Leikin and Zazkis’ (2010) framework to analyze teacher- generated definitions; and Borasi’s (1992) characterizations of a good definition; the authors developed an analytical framework to analyze a …

“The Pealing Of Stillness”: Gadamer On Georg Trakl, Ian Alexander Moore
Philosophy Faculty Works
Addressing the place of the Austrian poet, Georg Trakl, in the philosophical hermeneutics of Hans-Georg Gadamer, this article turns in particular to Trakl’s poem “A Winter Evening” in order to unfold a sense of language in dialogue with the poet. This engagement equally becomes the occasion for Gadamer to confront Heidegger, whose own reading of Trakl becomes both an inspiration and a challenge.

The Psychology Of Hate: Moral Concerns Differentiate Hate From Dislike, Clara Pretus, Jennifer L. Ray, Yael Granot, William A. Cunningham, Jay J. Van Bavel
Psychology: Faculty Publications
We investigated whether any differences in the psychological conceptualization of hate and dislike were simply a matter of degree of negativity (i.e., hate falls on the end of the continuum of dislike) or also morality (i.e., hate is imbued with distinct moral components that distinguish it from dislike). In three lab studies in Canada and the United States, participants reported disliked and hated attitude objects and rated each on dimensions including valence, attitude strength, morality, and emotional content. Quantitative and qualitative measures revealed that hated attitude objects were more negative than disliked attitude objects and associated with moral beliefs and …
Providing Educational Occupational Therapy Services To Support The Self-Management Of Chronic Conditions In Adults: A Pilot Study Demonstrating The Need For A Student-Run Ot Center, Michelle Damelio
OTD DEx Reports - College of Pharmacy and Health Sciences
"It is hypothesized that the implementation of a student-run occupational therapy (OT) center can increase access to necessary holistic healthcare services, promote health equity and alleviate the influence of social and health disparities on community-dwelling members while advancing students’ clinical practice. Through the completion of this doctoral experiential project (DEx) evidence regarding the efficacy and need for a student-run OT center was gathered through an extensive review of the literature and implementation of a 6-week pilot study."

"This study aimed to identify student leaders’ understanding and perceptions of inclusive programming and the resources that the university uses to ensure that inclusive programming is occurring during event planning. Three semi-structured qualitative interviews were conducted, and participants were student leaders who have experience with campus event planning. Participants identified that there is an identified need for educational training on disability and inclusion for student leaders, as well as faculty and staff, as this is an area that is not addressed frequently enough to those who interact with individuals with disabilities. Student leaders will benefit from educational training on inclusive …
A Retrospective Study Comparing The Effects Of Dynamic Tape In Addition To Treatment On Adults With Upper Extremity Tendinopathy Versus Treatment Alone: A Focus On Wrist And Hand Tendinopathies, Kara Howansky
OTD DEx Reports - College of Pharmacy and Health Sciences
"Typical treatments for tendinopathies include rest, activity modification, anti- inflammatory medications, physical and occupational therapy, and therapeutic tapes. There are many types of therapeutic tapes to assist with various musculoskeletal conditions for the upper and lower extremity in rehabilitation. To reduce the probability of injury and reduce cost, individuals and practitioners have turned to the application of various athletic tapes. However, it has been recognized that the use of athletic and kinesiology tape has been ineffective at absorbing load or contributing to reducing the workload of the musculotendinous unit (Dynamic Tape, 2020). Dynamic Tape (DT) works to mechanically alter movement …

Disability Inclusion On Campus: A Focus On Student Perceptions And Role, Maire Mcbride
OTD DEx Reports - College of Pharmacy and Health Sciences
"Individuals with Intellectual Disabilities (ID) have a long history of unfair exclusion from educational environments, especially at the post-secondary level (Johnson et al.,, 2019). Until the enactment of the Education for All Handicapped Children Act in 1977, now known as Individuals with Disabilities Education Act (IDEA), there was highly limited access to education at any level for individuals with disabilities (Kleinert et al., 2012). In recent years, while there has been further development of strong legislation to support individuals with disabilities and their pursuit of learning as well as a growing number of inclusive post-secondary educational (IPSE) programs, there is …
The Role Of Occupational Therapy In Supporting Special Education Staff In Self-Regulation For Students With Autism Spectrum Disorder, Sinead O'Brien
The Role Of Occupational Therapy In Supporting Special Education Staff In Self-Regulation For Students With Autism Spectrum Disorder, Sinead O'Brien
OTD DEx Reports - College of Pharmacy and Health Sciences
"Self-regulation is a person’s ability to establish and maintain an optimal state with their emotions, thoughts, attention, and behavior to meet the needs of the environment. Children with Autism Spectrum Disorder (ASD) may have difficulties with communication, social interactions, or engage in repetitive patterns of behavior that influence their ability to self-regulate (Watling & Spitzer, 2018). In most elementary schools, special education teachers and paraprofessionals do not receive evidence-based training on self-regulation strategies. The goal of this DEx capstone project was to determine if occupational therapy (OT) could support special education staff to improve confidence with implementation in the area …

Social Emotional Learning In Early Childhood Parent Perspectives Of Occupational Therapy (Ot) In Supporting Community Engagement, Amanda Sutton
Social Emotional Learning In Early Childhood Parent Perspectives Of Occupational Therapy (Ot) In Supporting Community Engagement, Amanda Sutton
OTD DEx Reports - College of Pharmacy and Health Sciences
"Early childhood is a critical time for teaching and learning social and emotional skills in order to best achieve future and long-term benefits (Housman, 2017). Coaching parents and demonstrating how to model these skills are necessary for social emotional learning (SEL) and carryover to the home setting. Since parents are the most immediate people surrounding the child at this stage of learning; understanding their views, perspectives, and needs regarding SEL is crucial. The purpose of this project is to provide education/training to families regarding SEL from an occupational therapy (OT) approach and then explore their feedback and perceptions. Three, 45-minute …
