Rooted: Metaphors And Judicial Philosophy In Artis V. District Of Columbia, Richard L. Heppner Jr.

Law Faculty Publications

This article examines how the metaphors in judicial opinions reveal judicial theories of lawmaking and judicial philosophies, through a close reading of Justice Ginsburg’s majority opinion and Justice Gorsuch’s dissenting opinion in the Artis v. District of Columbia, 138 S. Ct. 594 (2018).

Artis was about what the phrase “shall be tolled” means in the federal supplemental jurisdiction statute, 28 U.S.C. §1367. Does a state-law claim’s statute of limitations pause or continue to run while the claim is in federal court? In holding that Congress used “stop the clock” tolling, an “off-the-shelf” legal device that pauses statute of limitations, …

Gardening And Watering 21st Century Soil: Culturally Responsive And Technology Enhanced Instructional Design In K12 Schools, Elissa W. Frazier Jan 2023

Gardening And Watering 21st Century Soil: Culturally Responsive And Technology Enhanced Instructional Design In K12 Schools, Elissa W. Frazier

Dissertations

Decades of research have documented the positive impact of culturally responsive teaching on academic outcomes for African American and LatinX students. However, as the field of education has become increasingly embedded with technology as a powerful tool of instruction, more attention is needed to understand how culturally responsive teachers use technology to close achievement gaps. Although national public policy over the last twenty-years has documented the negative impact of the digital divide on low SES, African American and LatinX students, large-scale efforts to close the divide have focused primarily on access to devices only. More recently, the second digital “use” …

A Society Impaired: Why Students Must Be Taught Mythology, Elise Hayen Jan 2023

A Society Impaired: Why Students Must Be Taught Mythology, Elise Hayen

Emerging Writers

This piece investigates why mythology taught in schools is not being retained by most students and therefore causing a major deficit of understanding in society. The author analyzes why mythology is still relevant and how it has impacted our world by shaping our language, our brain, and our perception of the world. Different educational methods are introduced to demonstrate how mythology education can be advanced in all levels of schooling. Lastly, the author shares stories from teachers and students that have successfully integrated impactful mythology into their curriculum and in order to see how this impacted their communities.

Immigrant Mothers’ Experiences In Accessing And Utilizing Education And Health Care Services For Children With Intellectual And Developmental Disabilities: A Scoping Review, Elizabeth Izampuye Jan 2023

Immigrant Mothers’ Experiences In Accessing And Utilizing Education And Health Care Services For Children With Intellectual And Developmental Disabilities: A Scoping Review, Elizabeth Izampuye

Public Health Theses

As the number of immigrants arriving in the US increases, it is necessary to understand the barriers they face in adapting to a new country to help ease their transition and improve their quality of life. One aspect of the immigrant experience that remains under-researched is the experiences immigrant mothers of children with intellectual and developmental disabilities (IDD) have in navigating the health care and education systems. Immigrant mothers are held to higher standards than non-immigrant mothers in raising their children and are usually expected to advocate for their children’s education and health care. It is crucial that immigrant children …

Socioeconomic Rights, Competition, And Systemic Neutrality: Approaching The Right(S) Contribution To Emancipatory Social Movements, Joshua Curtis Jan 2023

Socioeconomic Rights, Competition, And Systemic Neutrality: Approaching The Right(S) Contribution To Emancipatory Social Movements, Joshua Curtis

Indiana Journal of Global Legal Studies

Debate over the emancipatory potential of socioeconomic rights and their relevance to broader social movements is long-standing but is now picking up steam and taking on a life well beyond its traditionally legal disciplinary confines. This article contributes to the widening debate by emphasising the need for socioeconomic rights to be re-thought simultaneously outward (through deeper engagement with extant economic and political systems) and inward (by re-assessing various doctrines ingrained in their own construction). I pursue this ‘two-track’ methodology by first constructing a novel theory regarding the outward engagement of socioeconomic rights with competition law and policy, focusing on the …

Government By Algorithms At The Light Of Freedom Of Information Regimes: A Case-By-Case Approach On Adm Systems Within Public Education Sector, María Estrella Gutierrez Jan 2023

Government By Algorithms At The Light Of Freedom Of Information Regimes: A Case-By-Case Approach On Adm Systems Within Public Education Sector, María Estrella Gutierrez

Indiana Journal of Global Legal Studies

What the Houston Court qualified as “mysterious ‘black box’ impervious to challenge” was in practice a sophisticated software of many layers of calculations, which rated teachers’ effectiveness to make employment decisions. In the European Union, a system as such would fall under the Proposal for AI Regulation of 2021, which qualifies AI models in education and vocational training as “high-risk” systems. Automated decision-making systems (ADM systems), AI-driven or not, are being increasingly used by governments in public education for different purposes, such as handling applications for undergraduate admission or profiling students and teachers to assess their performance. Across cases and …

Climate Cap And Trade And Pollution Hot Spots: An Economics Perspective, Jeff Todd Jan 2023

Climate Cap And Trade And Pollution Hot Spots: An Economics Perspective, Jeff Todd

Georgia State University Law Review

Although cap and trade is overwhelmingly preferred by economists for reducing greenhouse gases and spurring the adoption of renewables and other zero-carbon alternatives, some scholars and advocates worry that it allows firms to concentrate operations in poor and minority neighborhoods, thus leading to hot spots of harmful co-pollutants. Commentators differ on the danger of hot spots and the necessity of adjusting cap-and-trade programs to avoid them, however. This Article therefore surveys ex post economic studies of cap-and-trade programs to show that they do not lead to hot spots but may actually cool them—perhaps even better than command-and-control regulation. Accordingly, cap …

Approaching Venezuelan Migration From The Borderland: Dynamics And Identity In La Guajira, Colombia, Dalton Price Jan 2023

Approaching Venezuelan Migration From The Borderland: Dynamics And Identity In La Guajira, Colombia, Dalton Price

Journal of Latino/Latin American Studies (JOLLAS)

Based on an ethnography in the Colombian border state of La Guajira, this article argues that ethnographic research can challenge defaults to methodological nationalism, stark binaries be-tween host and migrant communities, and a framing of Venezuelan migration that flattens the complex realities of individuals in these borderlands who have extensive ties between both Colombia and Venezuela. This article begins by characterizing this border region, describing the relevant history of La Guajira and contemporary dynamics that help situate this specific Venezuelan migration flow. After, I describe the complex identities that form in these borderlands and what exactly “Venezuelan” looks like in …

Dialecto Literario And Regional Literature In The College Classroom: Salvador Salazar Arrué’S Cuentos De Barro (1933), Denise Cloonan Cortez Jan 2023

Dialecto Literario And Regional Literature In The College Classroom: Salvador Salazar Arrué’S Cuentos De Barro (1933), Denise Cloonan Cortez

World Languages and Cultures Faculty Publications

Regional literature, specifically eye dialect, is conspicuously missing from language classrooms due to its non-normative orthography. Even native speakers of the language struggle with unconventional spellings as dictionaries become useless tools. Moreover, most readers lack intuition regarding regional speech phenomena or its orthographic representations. While we are all speakers of a dialect, many are only familiar with their regional variety. Salvadoran regional literature may feature “pue” instead of “pues”, “pos” in Mexican literature, and “po” in Chilean literature. All examples divert from the normative “pues” despite sharing the same contextual cues. In regional representations, “fue” is written as “jue” to …

Hope In Constitutional Drafting: Reorientation In The Construction Of The Indian Constitution, Sujata Gadkar-Wilcox Jan 2023

Hope In Constitutional Drafting: Reorientation In The Construction Of The Indian Constitution, Sujata Gadkar-Wilcox

Western New England Law Review

This Article suggests that moments of contemporary constitution formation are often moments of rupture, but at the same time, the legitimacy of that break from the past paradoxically relies on establishing a continuity with the past. Drawing on ideas of hope and reorientation from Hirokazu Miyazaki, this Article examines the formation of the Indian Constitution and argues that while that constitution embraces what appear to be liberal constitutional norms from other constitutions, it reorients their meaning to transform them into useful vehicles for contemporary Indian social reform.

Religious Issues In The Journal "Ukrainian Life" (1912-1917), Olga Polumysna, Mariia Bobro Jan 2023

Religious Issues In The Journal "Ukrainian Life" (1912-1917), Olga Polumysna, Mariia Bobro

Occasional Papers on Religion in Eastern Europe

The article establishes that at the beginning of the 20th century, the journal Ukrainskaia Zhizn became a reliable and unbiased source of information about the social-political and religious life in Ukraine. The reports published in the journal make it possible to state that through the mediation of Russian priests, the authorities imposed the use of the Russian language while holding services in Ukrainian churches. Besides, it is ascertained that those priests who advocated the Ukrainian national idea, the spreading of the Ukrainian language in all spheres of life, who upheld the Ukrainian issue in various state institutions were humiliated and …

Examining Colonial Impact On Beothuk Technological Traditions On The Island Of Newfoundland, Amanda G. Samuels Jan 2023

Examining Colonial Impact On Beothuk Technological Traditions On The Island Of Newfoundland, Amanda G. Samuels

Legacy Theses & Dissertations (2009 - 2024)

Indigenous technological production and use of tools is often influenced by several cultural factors including, functionality, environment, and cosmological and ideological beliefs. Projectile points are no exception, and they are often imbued with rich, symbolic meaning. While projectile points across North America have been extensively studied using various methods, there are some Indigenous groups and environments that are often excluded from academic, archaeological research, such as the Beothuk of Newfoundland. Since the Beothuk have seldom been the focus of archaeological research, their lithic and iron technology has not yet been analyzed thoroughly. I have conducted a systematic comparative analysis of …

Synergic Concepts And Lexical Idiosyncrasies As Means Of Reconceptualization To Develop Bilingual Pragmatic Competence : A Study Of Sequential Bilingual Students In Different Sociocultural Contexts, Truong My Hanh Dinh Jan 2023

Synergic Concepts And Lexical Idiosyncrasies As Means Of Reconceptualization To Develop Bilingual Pragmatic Competence : A Study Of Sequential Bilingual Students In Different Sociocultural Contexts, Truong My Hanh Dinh

Legacy Theses & Dissertations (2009 - 2024)

This dissertation uses the Conceptual Blending Hypothesis from the socio-cognitive method presented and refined by Kecskes (2002, 2004, 2007, 2010, 2020) to explain how the lexical choice of bilinguals differs across sociocultural situations. Quantitative (lexical density, lexical diversity, and lexical sophistication) and qualitative (lexical concepts) processes demonstrate this variance. Hence, the thesis shows the interplay between two aspects of the bilingual’s word choice, namely conceptualizing and selecting words in the linguistic system, which influence word choice in context (i.e. individual words via words used in essay writing). It is hypothesized that a conceptual blending of the sociocultural loads of the …

Sexual Reproductive Health Of Asian Indian American Women, Pooja Chugh-Clayton Jan 2023

Sexual Reproductive Health Of Asian Indian American Women, Pooja Chugh-Clayton

Legacy Theses & Dissertations (2009 - 2024)

Asian Indian Americans (AIA) represent the least understood ethnic minority regarding sexual health practices in the United States and the fastest growing population among all Asian groups. Public health practitioners face gaps in understanding communication styles and perceptions concerning sexual and reproductive health within the AIA community. Current researchers strongly associate transparency and openness in parent-child relationships as attributable to better and healthier sexual attitudes and choices in young adults (Romo et al., 2011). Sexual and reproductive health information traditionally stems from one's parents. Little is known about parent-child communication regarding sexuality and reproductive health within the Asian Indian community …

Elementary Students Co-Constructing Meaning During Read Alouds With Picture E-Books, Colleen Marie Monaco Jan 2023

Elementary Students Co-Constructing Meaning During Read Alouds With Picture E-Books, Colleen Marie Monaco

Legacy Theses & Dissertations (2009 - 2024)

Educators need to provide students with opportunities to engage with digital texts to support their development in becoming digitally literate (Plowman et al., 2012). The purpose of this practitioner research inquiry was to explore how teachers can support readers in the meaning-making process during read alouds with picture e-books, which contain multimodal, digital features that can encourage interactions with readers and texts (Aliagas & Margallo, 2017; Schugar et al., 2016). I drew on post-humanism and multimodal literacy to examine these research questions: (1) What multimodal features invited the third-grade students and me to interact with one another and picture e-books …

Encajar From The Margins: Drop-Out And Undocumented Latinx Youth Negotiating Deservingness And Spaces Of Belonging, Eric J. Macias Jan 2023

Encajar From The Margins: Drop-Out And Undocumented Latinx Youth Negotiating Deservingness And Spaces Of Belonging, Eric J. Macias

Legacy Theses & Dissertations (2009 - 2024)

Encajar from the Margins is a timely and important ethnographic project that contributes to existing literature on issues related to immigrant youth’s navigation of “illegality,” deservingness, and belonging. It examines the layers of challenges faced by undocumented youth who drop-out of high school. More specifically, this research centers the counter-narratives of undocumented youth that challenge many stigmatizing labels they have socially acquired. This dissertation focuses on an understudied population of young people who do not qualify for Deferred Action for Childhood Arrivals (DACA) or any other immigration protections after they migrated to the United States. This study provides important insight …

Understandings Of Audience In First Year Composition, Mary Josephine Morgan Jan 2023

Understandings Of Audience In First Year Composition, Mary Josephine Morgan

Legacy Theses & Dissertations (2009 - 2024)

While understanding the concept of audience is an important step in learning to write, few studies have explored how student writers conceptualize audience in academic and nonacademic settings. This dissertation explores how college students enrolled in a first-year composition course conceptualize and operationalize audience and examines how the school context mediates students’ knowledge of audience. Nine students participated in the study, and data was collected from semi-structured interviews, classroom observations, and relevant documents. Findings suggest that student conceptions of audience are more sophisticated and complex than previously thought. Additionally, students used a variety of strategies to analyze and adapt their …

"Tu Eres Inmigrante, Pero Con Mucho Honor": Exploring School-Based Identity Messaging, Belonging, And Biculturalism In Central American Immigrant Students, Stephanie L. Carnes Jan 2023

"Tu Eres Inmigrante, Pero Con Mucho Honor": Exploring School-Based Identity Messaging, Belonging, And Biculturalism In Central American Immigrant Students, Stephanie L. Carnes

Legacy Theses & Dissertations (2009 - 2024)

This study explores the lived experiences of Central American immigrant youth (N = 20) in two high schools located in the same Northeastern state in the U.S. This student sub-demographic represents one of the fastest growing populations in U.S. public schools (Suárez-Orozco & Todorova, 2009; Sibley & Brabeck, 2017). As the primary institutions charged with reception and social inclusion, schools shape trajectories of acculturation, bicultural identity development, and social integration for immigrant youth.

Competition Between Audiovisual Correspondences Aids Understanding Of Interactions Between Auditory And Visual Perception, Laura Getz Jan 2023

Competition Between Audiovisual Correspondences Aids Understanding Of Interactions Between Auditory And Visual Perception, Laura Getz

Neuroscience, Cognition and Behavior: Faculty Scholarship

An audiovisual correspondence (AVC) refers to an observer’s seemingly arbitrary

yet consistent matching of sensory features across the two modalities; for

example, between auditory pitch height and visual height or visual size. Research

on AVCs frequently uses a speeded classification procedure in which participants

are asked to rapidly classify the pitch of a sound accompanied either by a

congruent or an incongruent visual object (e.g., high pitches are congruent with

higher/smaller visual objects and incongruent with lower/larger visual objects).

To investigate the strength of these pitch AVCs (height, size, spatial frequency,

brightness, sharpness), trials where the height AVC competed with …

Discussions And Creations: Experiences Of Black Music Therapy Graduate Students Building Community And Belonging, Rebekah Irene Spann Jan 2023

Discussions And Creations: Experiences Of Black Music Therapy Graduate Students Building Community And Belonging, Rebekah Irene Spann

Theses and Dissertations--Music

There is currently a lack of racial diversity within the music therapy field and a lack of research on the experiences of Black music therapy graduate students wanting to build community and belonging. The purpose of this study was to understand the experiences of three Black graduate music therapy students at the University of Kentucky seeking to build community and belonging with their Black peers. To further understand the experiences of these Black graduate music therapy students, this study followed participatory action research (PAR) methodology. Throughout the research process, I worked with participants to shape the project in a way …

Teacher Perceptions Of The Connections Between Social And Emotional Learning And Student Success, Beth Ann Hoistad Washle Jan 2023

Teacher Perceptions Of The Connections Between Social And Emotional Learning And Student Success, Beth Ann Hoistad Washle

Doctor of Education Dissertations

This qualitative study was about teacher perceptions of how incorporating social and emotional learning addresses the social-emotional needs of students and relates to student success. Teacher perceptions help inform educational leaders and policy makers about the impact social and emotional learning can have on students and their success. The findings of this study led to three emerging themes. Those themes were teachers believe (a) there needs to be direct instruction in social and emotional skills; (b) social and emotional learning helps students academically by becoming self-driven, taking ownership of their learning and actions, building confidence, and persevering through challenging work; …

The Role Of Mentoring In The Lives Of Underrepresented Youth, Nohely Camacho Morales Jan 2023

The Role Of Mentoring In The Lives Of Underrepresented Youth, Nohely Camacho Morales

Social Justice | Senior Theses

Underrepresented youth (Latino, Black, Pacific Islander, and Native American) face challenges in school enrollment/completion and often lack feelings of belonging in educational and social institutions. One specific group of underrepresented youth who face unique struggles is unaccompanied youth. Mentoring, a non-parental relationship between a young person and someone who supports and guides youth, has been found to result in better well-being and health in adolescents and potentially lead to higher self-worth and better academic performance. In order to fill a gap in the literature examining the effects of mentoring on underrepresented youth and specifically unaccompanied youth, I conducted a mixed-methods …

The Digital Divide: The Path Towards Digital Inclusivity, Angelica Gonzalez Almanza Jan 2023

The Digital Divide: The Path Towards Digital Inclusivity, Angelica Gonzalez Almanza

Social Justice | Senior Theses

The gap between those Americans who use or have access to ICTs and those who do not is referred to as the digital divide (PACEs, 2002). The pandemic has increased dependence on technology and exacerbated the digital divide, which perpetuates existing systems of racism and poverty (Early et al., 2021). In this study, a mixed-method approach was conducted to understand what digital literacy skills parents need to overcome the digital divide and support their child's education. Specifically, the study explored how the program Impact Technology training has affected parents' involvement with their child's education. There were 175 Latinx parents that …

Oaxacalifornia: Indigenous Transnational Spaces As Grassroots Cosmopolitanism, Antonieta Mercado Jan 2023

Oaxacalifornia: Indigenous Transnational Spaces As Grassroots Cosmopolitanism, Antonieta Mercado

Communication: Faculty Scholarship

Paradoxically both immigration and indigeneity are common conditions for exclusion from full citizenship in contemporary settler nation-states. Marginalized populations such as immigrants and Indigenous groups, resist the homogenizing rules dictated by dominant notions of culture and citizenship deployed by settler colonial states, entailing often hegemonic practices of control from institutions, such as the school and media. This essay discusses the creation of a transborder space between Mexico and the US named “Oaxacalifornia”. This “deterritorial” space was named and is maintained by Mexican Indigenous migrants from the state of Oaxaca who spend their daily lives interacting through communicative and civic practices …

Under God: Political Views And Experiences Among Young Adults Attending An Evangelical College, Olga Dietlin, Amy Sparks, Hannah Bayne Jan 2023

Under God: Political Views And Experiences Among Young Adults Attending An Evangelical College, Olga Dietlin, Amy Sparks, Hannah Bayne

Growth: The Journal of the Association for Christians in Student Development

While polarization has increased the saliency of political values, political meaning-making has been scarcely addressed in higher education literature and training. Additionally, even though the political orientation of evangelicals has been back in the spotlight since the 2016 presidential campaign, little research has been done to explore the interplay of faith commitments and political values among students at an evangelical college. This study examined religiosity, ideology, political attitudes, the salience of political identity, and experience with political differences among students at an evangelical Christian liberal arts institution (n = 223). Descriptive data confirmed the salience of religious belief and practice …

Cultivating The Self-Awareness Of Global Students: The Role Of Communities Of Practice, Stephanie Calley Jan 2023

Cultivating The Self-Awareness Of Global Students: The Role Of Communities Of Practice, Stephanie Calley

Growth: The Journal of the Association for Christians in Student Development

Research on the impact of leadership education programs on undergraduate students has demonstrated that cultivating self-awareness is foundational to developing other leadership capabilities. Yet, scant research has been undertaken to understand the impact of leadership education on global students. For the sake of this research, global students include any undergraduate student who had spent a significant portion of their development years outside the country of higher education. As such, global students include international students as well as other globally mobile students such as children of international military personnel, businesspeople, and religious workers. This qualitative research sought to understand how global …
