Nature And Importance Of Legal Possession, Joseph W. Bingham May 1915

Nature And Importance Of Legal Possession, Joseph W. Bingham

Michigan Law Review

The careful student of our law of property needs no demonstration of the importance of legal possession. From before the date of the earliest year book the word possession and its synonym seisin have pervaded legal language and have signified matters of great consequence in the decision of cases. "In the history of our law," say Pollock and Maitland, "there is no idea more cardinal than that of seisin. Even in the law of the present day it plays a part which must be studied by every lawyer; but in the past it was so important that we may almost …

Sociology And The Law, Arthur W. Spencer Jan 1915

Sociology And The Law, Arthur W. Spencer

Mid-West Quarterly (1913–1918)

Progress in this field of legal philosophy has been especially rapid since the late seventies, particularly in Germany. In English-speaking countries no phenomena of equal significance have occurred. America has never produced any notable philosophical jurists; and the work of English legal scholars of the past generation, though in some instances it has been brilliant and of …

Dramatic Elements In American Indian Ceremonials, Virginia Shropshire Heath Oct 1914

Dramatic Elements In American Indian Ceremonials, Virginia Shropshire Heath

University Studies (University of Nebraska) (1888–1984)

"Poetry in general," says Aristotle, "seems to have sprung from two causes, each of them lying deep in our nature-first, the instinct of imitation ..., next, ... the instinct for 'harmony' and 'rhythm.'" Many of the lyric-legend-dance complexes of certain North American Indian religious ceremonials would seem to bear out this judgment. Indeed, in not a few of the unmistakably poetic expressions, there may be found well-defined dramatic elements suggesting the possibility of a developed, independent dramatic literature, had these savage peoples been left alone to initiate a civilization and culture of their own.
