Cover Story, "Adding more life to your years" by Dr. Frank Rosato
The trend towards flabbiness has been gradual, and only in recent years has it been given the serious consideration by health professionals it needs. Modern urban Americans live in a sedentary world. Our agrarian forefathers put in far more than an eight-hour day, and real muscle was usually involved in their efforts. Even today's rural Americans labor less strenuously than their fathers or grandfathers because of the mechanization of farms, nor do modern farmers' wives have the same backbreaking chores their grandmothers did.

This symposium Issue of the Columbia Law Review marks a moment of convergence and opportunity for an emerging field of legal scholarship focused on America’s state civil trial courts. Historically, legal scholarship has treated state civil courts as, at best, a mere footnote in conversations about civil law and procedure, federalism, and judicial behavior. But the status quo is shifting. As this Issue demonstrates, legal scholars are examining our most common civil courts as sites for understanding law, legal institutions, and how people experience civil justice. This engagement is essential for inquiries into how courts shape and respond to social …

Blockchain Disruption: Digital Assets Are Changing How We Do Business, Nick Curley
SMU Science and Technology Law Review
Digital assets are changing the way businesses think about equity, labor, business models, and business organization. Digital assets, like Bitcoin or Ethereum, provide incredible opportunities to further align shareholders with the objectives of the entity.
Each time humanity advances its technology for ledgers, markets explode, and we witness immense wealth creation. Digital assets like Bitcoin and Ethereum are the next great step forward for ledger technology. While there are incredible opportunities to leverage this new technology, there are also incredible risks. There are many public examples of “hacks” of prominent blockchains like Ethereum and Solana. Blockchain technology has captured the …

In Shaping the Bar: The Future of Attorney Licensing, Professor Joan Howarth issues a clarion call to the academy, the legal community, and the judiciary to reform the way we license lawyers in the United States. In this book Howarth identifies the current crisis in law licensing, the history of racism that created this crisis, and the tools available to address it. Shaping the Bar challenges our entrenched notions of professional identity, and it forces us to confront vulnerabilities in attorney self-regulation. It does so in a manner that will stir even those not immersed in the current debate about …

An Analysis Of Krs 123.487 And The Motor Vehicle Tax Rates Levied Among Special Districts In Kentucky, Beth Atkinson
MPA/MPP/MPFM Capstone Projects
Kentucky Revised Statute 132.487 sets forth limitations on the motor vehicle tax rate, which can be levied by the state, counties, cities, and special taxing districts. According to the statute, the rate is formulated on a January 1, 1983 date without exception. However, a lack of oversight and understanding of KRS 132.487 has created problems among counties, cities, and special districts in Kentucky. In some cases, this has led to the adoption of tax rates which violate the statute and should be investigated and addressed by the legislature. This research suggests that non-compliance with KRS 132.487 is more prevalent among …

The United States is a nation of laws, and its Constitution and the rule of law have allowed it to confront and successfully navigate many threats to democracy throughout the nation’s complex history, including a Civil War. All of these threats challenged the nation in various ways, but never has there been a challenge to the truth of our elections like what happened on January 6, 2021.
The Insurrection represents a turning point in America’s history. In addition to the unprecedented assault on the U.S. Capitol, members of the government sought to undermine an election and supported an attack on …

Female Military Sexual Trauma: A Critical And Comprehensive Literature Review, Anna Stanton
Psychology Doctoral Specialization Projects
Military Sexual Trauma (MST) refers to a psychological trauma that resulted from any sexual assault or threatening sexual harassment that a military member experienced during his or her military service. Military sexual trauma is a significant problem within the United States military that threatens the strength, readiness, and morale of the military, and has devastating personal effects on survivors and their families. During 2006, the military began taking steps to understand the prevalence of MST and implement programs to help prevent it. Despite some of the progress these programs have shown, there are still barriers that impede an MST survivor’s …

Domestic Violence And Leave Laws: How New York Can Improve Its Leave Policies Based On The Laws Of Washington, D.C. And New Jersey, Nusrat J. Khan
City University of New York Law Review
Although intimate partner violence often starts in the privacy of one’s home, its impact spills over in almost all aspects of the victim’s life. The effects of violence are tangible – physical and emotional harm to the person and their dependents, loss of educational or employment opportunities, financial problems, interactions with the criminal justice system, and ongoing legal issues. To address the loss of employment, federal and state governments have implemented leave laws to offer job protection for victims of intimate partner violence. Leave laws are an essential aspect of employment as the ability to take leave from work provides …
The Institutional Mismatch Of State Civil Courts, Colleen Shanahan, Jessica Steinberg, Alyx Mark, Anna Carpenter
The Institutional Mismatch Of State Civil Courts, Colleen Shanahan, Jessica Steinberg, Alyx Mark, Anna Carpenter
Faculty Articles
State civil courts are central institutions in American democracy. Though designed for dispute resolution, these courts function as emergency rooms for social needs in the face of the failure of the legislative and executive branches to disrupt or mitigate inequality. We reconsider national case data to analyze the presence of social needs in state civil cases. We then use original data from courtroom observation and interviews to theorize how state civil courts grapple with the mismatch between the social needs people bring to these courts and their institutional design. This institutional mismatch leads to two roles of state civil courts …

Misdemeanor And Felony Diversion Program Success, Nicole M. Teske
All-Inclusive List of Electronic Theses and Dissertations
Previous research has demonstrated that individuals who commit crimes and have mental health concerns tend to do worse while incarcerated. For this reason, mental health diversion programs were created. These programs provide individuals with the necessary treatment and resources so they can be more successful living in the community. These programs often differ in terms of program requirements, and the impact of offender variables on outcomes are often inconsistent. The current study examined two mental health diversion programs in a rural community to examine the relation between offender gender, mental health diagnosis, and charge level in predicting program success and …
Preliminary Damages, Gideon Parchomovsky, Alex Stein
Preliminary Damages, Gideon Parchomovsky, Alex Stein
Vanderbilt Law Review
Historically, the law helped impecunious plaintiffs overcome their inherent disadvantage in civil litigation. Unfortunately, this is no longer the case: modern law has largely abandoned the mission of assisting the least well-off. In this Essay, we propose a new remedy that can dramatically improve the fortunes of poor plaintiffs and thereby change the errant path of the law: preliminary damages. The unavailability of preliminary damages has dire implications for poor plaintiffs, especially those wronged by affluent individuals and corporations. Resource-constrained plaintiffs cannot afford prolonged litigation on account of their limited financial means. Consequently, they are forced to either forego suing …
Preserving The Relationship: Addressing The Covid Eviction Crisis Through Equitable Mediation, Cade Jones
Preserving The Relationship: Addressing The Covid Eviction Crisis Through Equitable Mediation, Cade Jones
Journal of Dispute Resolution
Not only has the coronavirus pandemic (“COVID-19”) has taken many lives, another substantial side effect are that many Americans are at risk of eviction because of the current COVID-19 pandemic. Since the pandemic began, more than 20 million renters have suffered job loss because of COVID-19. One particular aspect of daily life the pandemic has impacted is landlord-tenant relationships because tenants cannot make rent payments to the landlord which then leads to a landlord filing for bankruptcy. With tenants not making rent payments due to job loss, it has produced a detriment with landlord-tenant relationships that could produce a ripple …
