University of Miami International and Comparative Law Review
Many commentators have referred to domestic violence and other forms of gender-based violence (GBV) in the age of COVID-19 as a “double pandemic.” Based on results of a mixed-methods study on the impact of the COVID-19 pandemic on GBV in South Florida, conducted by the Human Rights Clinic of the University of Miami School of Law, in close collaboration with community-based organizations,1 this article offers a proposal for an expanded normative human rights framework to address domestic violence and other forms of GBV. The local study sought to elucidate the pathways that link pandemics such as COVID-19 and GBV, highlight …

Lincoln Memorial University Law Review Archive
In recent years, victims’ rights have received worldwide attention in regards to women’s rights and opportunities-or lack thereof. However, what are victims’ rights, how are women’s issues addressed under these rights, have they had their intended effect, are they adequately addressing modern issues, how have similar rights been implemented in other counties and are they working better? This article is a comparative law project between the United States, Portugal, and Pakistan evaluating victims’ rights in each country and any correlation between the presence and enforcement of victims’ rights and the impact they have had on violent crimes against women. Large Law Firms Respond To Russia’S Invasion Of Ukraine, Kira Dennis
Cardozo International & Comparative Law Review (CICLR) Blog
As these words are being strung together, the civilian death toll continues to rise in Ukraine. As of March 14th, over 600 people have died and over 1,100 civilians have been wounded. In addition to those injured, over 2.8 million people have fled their homes in Ukraine, seeking refuge in Poland, Germany, Romania, Moldova, and Lithuania, to name a few. As Russia continues to attack Ukraine and war surges, the world is responding in a number of significant ways –– donations, spreading awareness across social media platforms, cross-border acceptance of refugees, pro bono legal assistance, protests against Russian war tactics. …

Executing bankruptcy codes, acts, initiatives, and risk interventions soften the blow of disproportionately effected cases. The recent decline of bankruptcy cases from 2020 to 2022 results in a robust recovery efforts. Teacher And Lawyer, Constance Browne Is Driven By Social Justice, Constance A. Browne
Shorter Faculty Works
Constance Browne’s passion for justice has deep roots.
William Holt, her grandfather, was born in a women’s prison outside Boston in either 1887 or 1888. His mother had been incarcerated—no one is sure why. Then, when Holt was three or four years old, he was taken by rail to Maine with other orphans intended to become farm laborers. Did his mother consent to letting him go? No one knows that either.
Eventually Holt landed with a family in North Waterford who treated him well, though it seems he was never adopted. He graduated from Bowdoin College and the Medical School …

How To Protect Special Education During Covid-19: From The Courts To The Capitol, Sarah Coleman
How To Protect Special Education During Covid-19: From The Courts To The Capitol, Sarah Coleman
University of Miami Race & Social Justice Law Review
The COVID-19 pandemic has forced students around the country out of brick-and-mortar schools and into virtual classrooms. While the switch to remote learning has helped keep students and teachers safe from contracting the virus, students with disabilities have largely been deprived of a meaningful education and in person services mandated under federal law. This essay will explain how students have been denied a free appropriate public education (FAPE) under the Individuals with Disabilities Act (IDEA), how litigation has been unsuccessful in creating systemic change for these students, and how public policy by U.S. legislators can offer a solution.

When The United States Says You Do Not Belong: Suicide-Related Thoughts And Behaviors Among Immigrant Young Adults Varying In Immigration Legal Status, Amanda Venta, Tessa Long, Alfonso Mercado, Luz M. Garcini, German Cadenas
Psychological Science Faculty Publications
Background:
The number of immigrants in the United States and the risk of suicide among minoritized individuals have increased. Little research has examined the impact of immigration legal status on suicide-related thoughts and behaviors (SRTB), despite theoretical and empirical work suggesting that feelings of burdensomeness and failure to belong (prominent among immigrants) are risk factors.
Methods:
We examined a diverse sample of foreign-born young adults (18–25; N = 366). Data collection utilized the Suicide Behaviors Questionnaire Revised and items probing belongingness and immigration status (undocumented/Deferred Action for Childhood Arrivals (DACA), permanent, and citizen).
Results:
DACA/undocumented status was associated with increased …

Where Dreams Begin: Challenging The Architecture Of Migrant Detention, Pablo Garcia
Bachelor of Architecture Theses - 5th Year
Today, more than 40 million people living in the US were born in another country, accounting for about one-fifth of the world’s migrants. Even though the US is a nation comprised largely of immigrants and their descendants, immigration remains one of the most fraught social and political issues of modern times. People dream of moving into the country seeking a better life than the one they are leaving behind. Yet, upon arrival, they face inhumane circumstances due to the recent influx of people seeking asylum within the US. According to the Department of Homeland Security, over 3 million people arrived …
Adventures In Land Use Dispute Resolution: Utah's Innovative Program To Provide "Free" Legal Advice To Local Government, Neighbors, And Property Owners, Craig Call
Journal of Comparative Urban Law and Policy
Utah may have the nation’s most robust process allowing citizens to question local government land use decisions. This exists in the Office of the Property Rights Ombudsman (OPRO), created in 1997 and charged to assist in land use disputes in 2006. In three parts, this article divides an overview of the history of that office into two eras, evaluates one of the key functions of the current era—the preparation of advisory opinions (AOs), and suggests that Utah’s OPRO is a useful model for other states to consider. Most of this article focuses on the debates leading to the second era …
Market Demand-Based Planning And Permitting: Special Case Of Affordable Housing, Robert Hibberd
Market Demand-Based Planning And Permitting: Special Case Of Affordable Housing, Robert Hibberd
Journal of Comparative Urban Law and Policy
Arthur C. Nelson has advanced the concept of market demand-based planning and permitting (MDBPP) as a way in which to balance the need for development within the limits of market capacity. Lacking MDBPP discipline, real estate markets are prone to over-development that can lead to economic downturns including notably the Great Recession of 2007-2009. This article will unpack the history and challenge of MDBPP and demonstrate its efficacy. Then, it will apply these principles to the specific wicked problem of housing affordability, which is both ongoing and emerging in nature. It will tie this problem to a call for MDBPP …

Examination Of Eviction Filings In Lancaster County, Nebraska, 2019–2021, Ryan Sullivan
Nebraska College of Law: Faculty Publications
The study examined and analyzed eviction filings and proceedings in Nebraska, with a specific focus on Lancaster County—the home to the State’s capital, Lincoln. The primary objective of this study is to place eviction proceedings under a microscope to gain a better understanding of the volume of evictions in Nebraska, and whether the statutorily mandated processes are being followed. The study also attempts to capture the impact of certain external factors present during the period examined. Such factors include the COVID-19 pandemic and various eviction moratoria in place during 2020 and 2021, as well as the increased availability of legal …
