Wage theft is a severe problem in Santa Clara County, with the Santa Clara Wage Theft Coalition identifying more than 25,000 local wage theft cases as of 20211. In this study we will be addressing the issue of wage theft particularly in the Santa Clara County caregiving industry. Wage theft is prevalent in the caregiving industry for several reasons. First, the industry employs many migrant Filipino workers who are unaware of their legal rights and protections or even the fact if they are experiencing wage theft or not. Second, the sizable undocumented portion of these workers are coerced to lower …

The Alternative Billing Diner: Serving Up A New Billing Scheme For The Technological Age, Bradley A. Ullrick
Journal of Technology Law & Policy
This comment advocates that the American Bar Association (“ABA”) revise its stance on billing to account for technological advancements in the legal profession. Specifically, this comment argues that ABA Opinion 93-379 is an inadequate attempt at controlling billing practices at a time when technology is shifting the way legal work is done. Part II provides a brief discussion of the Model Rules of Professional Conduct and a history of hourly billing, along with a brief discussion of the positives and negatives of hourly billing. Part III discusses some of the technological advancements in the legal profession and how these advancements …
Ambulance Chasers On The Internet: Regulation Of Attorney Web Pages, Mark Hankins
Ambulance Chasers On The Internet: Regulation Of Attorney Web Pages, Mark Hankins
Journal of Technology Law & Policy
Since the U.S. Supreme Court in 1977 decided Bates v. State Bar of Arizona, attorney advertising, once anathema to the profession, has become tolerated, if not entirely welcome fixture of the landscape. Regulations of attorney advertising have passed the intermediate scrutiny of the Supreme Court on a number of occasions with a recent Supreme Court victory of the Florida Bar over an advertising attorney defining the outer limits of permissible attorney conduct in targeted direct mail advertising. Debate continues on the effect of advertising on the profession. Many argue persuasively that its added economic pressures are converting the practice …

Dental Support Organizations And The Corporate Practice Of Dentistry: Will Streamlining Create Legal Violations?, Angelina Campin
Dental Support Organizations And The Corporate Practice Of Dentistry: Will Streamlining Create Legal Violations?, Angelina Campin
DePaul Journal of Health Care Law
The increased use of technology when searching for health care providers means that consumers of dental care are more concerned with efficiency in making appointments and paying bills, immediate access to information, clear pricing, and transparency when it comes to choosing a provider and a facility to visit. Keeping up with the increased demands for efficiency and technological advances presents a challenge to sole practitioner dentists, which is the standard dental practice model. Dental support organizations (“DSOs”) have seen an increase in popularity recently, especially over the last five to ten years, in part to meet both the needs of …

SITIE Symposiums
This panel featured two “disrupters” who detailed their experiences innovating in the legal services space. The first panelist spoke about data-driven regulatory reform and the other spoke as an entrepreneur whose product introduces artificial intelligence (AI) into the legal recruiting process. Two additional panelists provided commentary regarding the second panelist’s presentation.
The panel provided insight on the topics of: (1) the legal regulatory process at large; (2) how a data-driven and feedback-oriented sandbox provides an alternative regulatory process; (3) the legal hiring and recruiting process and (4) how AI allows law firms to consider alternative hiring metrics when assessing candidates …

Working In Space: The Final Frontier Of Remote Work, Alyson Clare Decker
Working In Space: The Final Frontier Of Remote Work, Alyson Clare Decker
Northern Illinois University Law Review
Due to the COVID-19 pandemic, virtual workplaces have become much more common. But while advancements in technology have made remote work more accessible for many employees, jurisdictional confusion and varying state-specific employment regulations have made it extremely difficult for employers to switch from traditional in-person office settings to work-from-anywhere workplaces. In addition, taxation and mandatory workers’ compensation insurance requirements mean that employers often need to be registered to do business in any state they have employees in, making a truly remote workforce somewhat of a misnomer. However, as difficult as it might be for terrestrial employers to navigate our patchwork …
Attorneys, E-Discovery, And The Case For 37(G), Marilyn G. Mancusi
Attorneys, E-Discovery, And The Case For 37(G), Marilyn G. Mancusi
Notre Dame Law Review
There are currently various sources of authority that federal courts can invoke to sanction attorneys who bungle their e-discovery obligations, but each is insufficient. All fifty states have their own rules authorizing courts within the state to refer misbehaving attorneys to the local disciplinary body, but each state’s rule is different, leading to much inconsistency and lack of uniformity among the federal courts. The Federal Rules of Civil Procedure (“FRCP”) address e-discovery abuse but do not authorize courts to impose sanctions on attorneys for their role in e-discovery abuse. This is a problem because attorneys have ethical and professional obligations …

Well-Known Signs: Models Of Disability In Early Modern Islamic Law And Current American, European, And Pakistani Jurisprudence, Elicia Shotland
Well-Known Signs: Models Of Disability In Early Modern Islamic Law And Current American, European, And Pakistani Jurisprudence, Elicia Shotland
Washington International Law Journal
Current American, European, and Pakistani legal structures are often insufficient to ensure rights of disabled people, particularly rights of equal access to courts and to act as a witness in court. As the disability rights movement gains ground, judges and legislation drafters are struggling to shift modes of jurisprudence from a medical model that conceptualized disability as a permanent physical affliction to the social model, which locates disability in an individual’s relation to their built and social environments. A review of historical records concerning deaf and hard of hearing participants in legal processes from the Ottoman Empire shows that the …

The Field Of State Civil Courts, Anna E. Carpenter, Alyx Mark, Colleen F. Shanahan, Jessica K. Steinberg
Utah Law Faculty Scholarship
This symposium Issue of the Columbia Law Review marks a moment of convergence and opportunity for an emerging field of legal scholarship focused on America’s state civil trial courts. Historically, legal scholarship has treated state civil courts as, at best, a mere footnote in conversations about civil law and procedure, federalism, and judicial behavior. But the status quo is shifting. As this Issue demonstrates, legal scholars are examining our most common civil courts as sites for understanding law, legal institutions, and how people experience civil justice. This engagement is essential for inquiries into how courts shape and respond to social …
Contractual Evolution, Matthew Jennejohn, Julian Nyarko, Eric L. Talley
Contractual Evolution, Matthew Jennejohn, Julian Nyarko, Eric L. Talley
University of Chicago Law Review
Conventional wisdom portrays contracts as static distillations of parties’ shared intent at some discrete point in time. In reality, however, contract terms evolve in response to their environments, including new laws, legal interpretations, and economic shocks. While several legal scholars have offered stylized accounts of this evolutionary process, we still lack a coherent, general theory that broadly captures the dynamics of real-world contracting practice. This paper advances such a theory, in which the evolution of contract terms is a byproduct of several key features, including efficiency concerns, information, and sequential learning by attorneys who negotiate several deals over time. Each …

Law Firm Dynamics: Don’T Hate The Player, Hate The Game, Tom Kimbrough
SMU Law Review Forum
This paper concerns the business of law, a subject ignored by legal academia and sugarcoated by the organized bar. If law professors express little or no interest in this subject, their students most certainly do. Indeed, I have found that students are desperately hungry for information on the day-to-day realities of working in a law firm. Students are especially keen to learn about possible paths for career advancement within firms, across them, or across the organizations served by the firms.
Paths for career advancement do exist, but they are not easy to find or pursue. Law firms are hardly going …
Racial Trauma In Civil Rights Representation, Angela Onwuachi-Willig, Anthony V. Alfieri
Racial Trauma In Civil Rights Representation, Angela Onwuachi-Willig, Anthony V. Alfieri
Articles
Narratives of trauma told by clients and communities of color have inspired an increasing number of civil rights and antiracist lawyers and academics to call for more trauma-informed training for law students and lawyers. These advocates have argued not only for greater trauma-sensitive practices and trauma-centered interventions on behalf of adversely impacted individuals and groups but also for greater awareness of the risks of secondary or vicarious trauma for lawyers who represent traumatized clients and communities. In this Article, we join this chorus of attorneys and academics. Harnessing the recent civil rights case of P.P. v. Compton Unified School District, …

Lawyering The Indian Child Welfare Act, Matthew L.M. Fletcher, Wenona T. Singel
Lawyering The Indian Child Welfare Act, Matthew L.M. Fletcher, Wenona T. Singel
Michigan Law Review
This Article describes how the statutory structure of child welfare laws enables lawyers and courts to exploit deep-seated stereotypes about American Indian people rooted in systemic racism to undermine the enforcement of the rights of Indian families and tribes. Even when Indian custodians and tribes are able to protect their rights in court, their adversaries use those same advantages on appeal to attack the constitutional validity of the law. The primary goal of this Article is to help expose those structural issues and the ethically troublesome practices of adoption attorneys as the most important Indian Child Welfare Act (ICWA) case …
Protecting The Guild Or Protecting The Public? Bar Exams And The Diploma Privilege, Milan Markovic
Protecting The Guild Or Protecting The Public? Bar Exams And The Diploma Privilege, Milan Markovic
Faculty Scholarship
The bar examination has long loomed over legal education. Although many states formerly admitted law school graduates into legal practice via the diploma privilege, Wisconsin is the only state that recognizes the privilege today. The bar examination is so central to the attorney admissions process that all but a handful of jurisdictions required it amidst a pandemic that turned bar exam administration into a life-or-death matter.
This Article analyzes the diploma privilege from a historical and empirical perspective. Whereas courts and regulators maintain that bar examinations screen out incompetent practitioners, the legal profession formerly placed little emphasis on bar examinations …
