The Center for Human Services Research (CHSR), in collaboration with the University at Albany School of Social Welfare (SSW), worked with Lifespan of Greater Rochester, the Weill Cornell Medicine’s New York City Elder Abuse Center (NYCEAC), NYCAging (formerly the New York City Department for the Aging), and the New York State Office for the Aging (NYSOFA) to develop and complete a program evaluation of the Elder Abuse Interventions and Enhanced Multidisciplinary Team (E-MDT) Initiative in New York State. E-MDTs use a collaborative approach to intervene in complex cases of elder abuse (financial, physical, psychological, sexual, and neglect by others). Members …

There are haves and have-nots in the federal appellate courts, and the haves get more attention. For decades the courts have used a triage regime where they distribute judicial attention selectively: some appeals receive a lot of judicial attention, some appeals receive barely any. What this work unearths is that this triage system produces demonstrably unequal results depending on the circuit handling the appeal and whether the appellant has counsel or not. Together, these two factors produce dramatic disparities: in one circuit, for example, an unrepresented appellant receives, on average, a decision less than a tenth the length of a …

The Trafficking Victims Protection Act of 2000 (TVPA) is a contemporary effort to combat human trafficking. In 2000, the Congress enacted the T Nonimmigrant Status (or T visa) in the effort to protect victims of trafficking and to enhance law enforcement’s ability to investigate and prevent these crimes in the U.S. This thesis explores from a legal and social point of view the obstacles, hurdles, and challenges that victims of human trafficking face, when applying for a T visa. I find that (1) victims assess their exploitation as wrong and immoral but not amounting to human trafficking, thus they are …

This qualitative phenomenological study examined the lived experiences of Black men in the United States who have overcome barriers to advance to leadership positions at predominantly White institutions (PWI). The qualitative phenomenological approach was used to examine three research questions that addressed the factors that encouraged Black men on their paths to pursue executive leadership positions, the obstacles they encountered, and how identifying as a Black male at a PWI affected their career pursuits. Social support theory (SST) guided the theorical framework and critical race theory (CRT) guided the conceptional framework. Interviews from six participants were used. During the interviews, …

Teaching Cultural Competence In Law School Curricula: An Essential Step To Facilitate Diversity, Equity, & Inclusion In The Legal Profession, Phyllis Taite, Nicola "Nicky" Boothe

Law schools must recognize and seek to remove the barriers to teaching cultural competence and DEI and provide appropriate training and workshops for law professors. Providing law professors with the tools to integrate cultural competency into existing curricula is a first and crucial step to ensure that law professors are well-versed in both their own cultural competency, and in the ability to provide cultural competency training to their students. The culturally competent student will become a culturally competent lawyer with the skillset to make impactful contributions towards DEI in and beyond the practice of law.

Dignity: A Journal of Analysis of Exploitation and Violence
The extant research literature indicates that human trafficking survivors have a myriad of service needs, including acute and long-term needs. A statewide resource guide, needs assessment, and service inventory were developed for Missouri through community action research involving a partnership with an anti-trafficking coalition, a consortium of funders, and a series of small research teams. This article details the evolution of a resource guide and describes the methods used to 1) develop a statewide resource guide for human trafficking survivors and the service providers who work with them, 2) evaluate the resource guide, 3) create a statewide/regional service inventory based …

Consulting for a startup company is an effective way for Master of Business Administration (MBA) students to learn about management consulting, and the ways and means of a startup company. This paper discusses the experience of an MBA startup project within the context of a core corporate finance course. The project requires the active engagement of several groups of stakeholders—MBA students, the university’s entrepreneurship incubator, a selection of startup companies, and the project’s academic collaborators. In line with the literature, we find that entrepreneurship education through student-startup collaboration contributes to the students’ entrepreneurial learning, and that the offering of an …

The Influence Of Landmark Judgments And Statutory Changes On The Family Litigation Explosion: A Citation Network Analysis, Joseph Hickey, Lyndsay Campbell, Jörn Davidsen
Canadian Journal of Family Law
Family law in many countries has changed radically since the 1960s. However, despite family law’s central importance, few detailed quantitative analyses of the relationship between legal developments (landmark judgments and statutory changes) and the amount and subject of family litigation have been made. We examine this relationship using a unique dataset of citations among Canadian family law judgments from all levels of the court hierarchy. The network analysis draws attention to significant changes in law and legal practice over time. Not only did litigation increase overall, but the number of judgments involving multiple legal issues grew dramatically in the mid-1990s, …

Eviction Court Displacement Rates, Nicole Summers

This Essay introduces the concept of eviction court displacement rates, defined as the percentage of eviction filings that result in tenant displacement. The Essay argues that a jurisdiction’s eviction court displacement rate provides crucial insight into the role of its legal system in driving substantive eviction outcomes. The Essay then compiles existing data on court displacement rates and compares those rates across jurisdictions. This comparison reveals massive variation in court displacement rates nationwide. In some jurisdictions, a tenant’s likelihood of displacement upon receiving an eviction filing is approximately one in twenty. In other jurisdictions, it is higher than one in …

Detained noncitizens experiencing serious intellectual and mental health disabilities are among the most vulnerable immigrant populations in the United States. The Executive Office for Immigration Review’s (EOIR) creation of the National Qualified Representative Program (NQRP) following a class action lawsuit was an important step in finally bringing meaningful protections to this population. The EOIR pledged to ensure government-paid counsel for those facing removal who had been adjudicated “incompetent” by an immigration judge, as well as other protections for those who had been identified as having a “serious mental disorder” but who had not yet been found incompetent. In the first semester of my honors thesis, I looked at how big events like COVID-19 affect non-heritage English speakers. Through my research, I was able to compile a literature review to see what challenges ELL students face, and how we could overcome those difficulties. This then led me this semester to look at what strategies could better assist ELL students in the classroom. To understand how teachers are working with students in classrooms now I interviewed teachers and observed classrooms to find out what strategies, technology, and resources could help ELL students.

College students face a vast array of basic needs challenges that can impact their ability to thrive inside and outside of the classroom. Basic needs can include (but are not limited to) food and housing security, healthcare for mental and physical health/well-being, childcare, resources for personal hygiene, and more. Utah State University has many programs and services that aim to support the basic needs of students. In addition, there are many off campus resources that students are often eligible for. Being aware of the resources available and connecting students to those resources is essential when helping students navigate these hardships. …

Northern Vistas: A Retrospective Of The Rural Alaskan Volunteers In Service To America Program 1965-1971, Carol Fuiten Hoefler

This thesis examines the Volunteers in Service to America program as it operated in rural Alaska from 1965 to 1971. Oral histories, correspondence from the volunteers, trainers and stakeholders offer a rich historical perspective of the program's successes and failures. Remote and underdeveloped village conditions presented daunting operational challenges to the program and its volunteers. During the study period, rural Alaska underwent dramatic social and political changes as recent statehood and looming resource development necessitated resolution of Native land claims. A series of new federal anti-poverty initiatives and the transfer of existing agencies to state and local oversight presented opportunities …
