Commercial actors long have argued that class actions are bad for business. But for even longer, business groups have supported other types of aggregate litigation that closely resemble class actions, such as expansive federal bankruptcy. While critics have successfully limited national aggregation via class actions, they have not even attempted to criticize aggregation via bankruptcy.

Why have business groups attacked aggregate litigation in some cases and supported it in others? This Article provides an answer by examining aggregation's origins and development, and what emerges, it turns out, is very much the opposite of what aggregation's pro-business critics would have us …

Despite the checkered history of contingency fees in the practice of law, attorneys often claim that such fee arrangements perfectly align the interests of lawyer and client. After all, contingency fee lawyers proclaim in TV ad after TV ad, "we don’t get paid unless you win." That superficial logic does not withstand economic scrutiny. Utilizing a behavioral economics lens, this Article demonstrates that contingency fee arrangements give attorneys excessive incentives to settle cases that their clients would be better off taking all the way through trial. Guardianship proceedings under New York Mental Hygiene Law Article 81 are intended to protect the personal needs and property management of an alleged incapacitated person. A guardian appointed for a person is responsible for making decisions in line with the best interests and wishes of his or her ward. Adventists have been inconsistent in dealing with inequality and injustice in society, swaying between silence, accommodation, positional statements, and direct advocacy approaches. Although advocacy has become more prominent among Adventist thinkers since the end of the twentieth century, there is a lack of empirical data which answer questions related to contemporary Adventists' beliefs and practices in relation to advocacy in the context of mission. Concomitantly, there does not yet exist a documented or articulated Adventist missiological perspective on advocacy.

Family law is for young people. To facilitate child rearing and help spouses pool resources over a lifetime, the law obligates parents to minor children and spouses to each other. Family law’s presumption of young, financially interdependent, conjugal couples raising children privileges one family form — marriage — and centers the dependency needs of children.

By the terms of its own statute and the limits of its constitutional authority, multidistrict litigation (“MDL”) is designed to transfer and coordinate individual lawsuits then return plaintiffs back to their chosen fora for case-specific discovery and trial. Because each plaintiff is present and has her own lawyer, there is no need for the judge to police conflicts of interest or attorney loyalty as in the MDL’s kin, the class action.

But these assumptions do not match the empirical reality. Remand is rare. MDL judges resolve ninety-nine percent of the cases before them. And to some attorneys, the people of …

Promoting Cognitive Complexity Among Yezidi Youth Impacted By Isis In Kurdistan, Iraq, Sara Savage, Jessica Francar, Kristin Perry

This article reports on the results of an intervention to promote the reintegration of Yezidi children and youth in the Kurdistan Region of Iraq, who had been in ISIS captivity or were displaced by ISIS, by increasing their cognitive complexity through experiential learning. The article explores the challenges faced by this demographic, including trauma and exclusion. It looks at the impact of a group-based curriculum designed to increase cognitive complexity (measured by integrative complexity), and discusses how the intervention addressed socio-cognitive needs in order to support reintegration. การติดตั้งโซลาร์เซลล์บนหลังคาบ้านได้รับความนิยมเพิ่มขึ้นเป็นอย่างมากในปัจจุบัน และมีแนวโน้มจะมากขึ้นอีกในอนาคต อย่างไรก็ดี ด้วยลักษณะเฉพาะแผงโซลาร์เซลล์ ซึ่งเป็นสินค้าที่ผู้บริโภคต้องมีความรู้ ความเข้าใจในตัวสินค้า และเป็นการลงทุนระยะยาวที่ใช้เวลาการคืนทุนค่อนข้างนาน จึงมีความจำเป็นที่ผู้บริโภคจะต้องได้รับสัญญาที่มีข้อกำหนดระบุถึงสาระสำคัญของสินค้า ตลอดจนสิทธิหน้าที่ของผู้บริโภคและผู้ประกอบธุรกิจ ประกอบกับปัจจุบันประเทศไทยยังไม่ได้มีกฎหมายว่าด้วยการคุ้มครองผู้บริโภคกรณีของการติดตั้งโซลาร์เซลล์บนหลังคาบ้านพักอาศัยเป็นการเฉพาะจากการศึกษาแนวทางการคุ้มครองผู้บริโภคด้านสัญญากรณีติดตั้งโซลาร์เซลล์บนหลังคาบ้านพักอาศัยของต่างประเทศ ได้แก่ รัฐแคลิฟอร์เนีย สหรัฐอเมริกา เครือรัฐออสเตรเลีย ประเทศญี่ปุ่น และประเทศมาเลเซีย พบว่ามีแนวทางการคุ้มครองผู้บริโภคด้านสัญญาที่แตกต่างกัน โดยแบ่งรูปแบบการบังคับใช้กับผู้ประกอบธุรกิจได้เป็น 2 รูปแบบ คือ บังคับใช้โดยกฎหมาย และ อาศัยความสมัครใจของผู้ประกอบธุรกิจ เมื่อผู้วิจัยวิเคราะห์และเปรียบเทียบกับบริบทของประเทศไทยแล้ว พบว่าแต่ละรูปแบบการบังคับใช้มีความเหมาะสมกับประเทศไทยในสถานการณ์ที่แตกต่างกัน กล่าวคือ ในช่วงระยะเริ่มต้นที่ผู้บริโภคเริ่มสนใจการติดตั้งโซลาร์เซลล์ และยังไม่ได้ปรากฏข้อร้องเรียนเกี่ยวกับการเอารัดเอาเปรียบผู้บริโภคจากผู้ประกอบธุรกิจ การบังคับใช้เป็นกฎหมายจึงยังไม่อาจกระทำได้ เพราะตามแนวปฏิบัติในการออกประกาศของคณะกรรมการว่าด้วยสัญญาให้เป็นธุรกิจควบคุมสัญญาจะต้องปรากฏสถิติข้อร้องเรียนก่อน ผู้วิจัยจึงเสนอให้มีการเผยแพร่แบบสัญญามาตรฐานสำหรับการติดตั้งโซลาร์เซลล์ภาคครัวเรือนบนเว็บไซต์ของกรมพัฒนาพลังงานทดแทนและอนุรักษ์พลังงาน อันเป็นแนวทางการคุ้มครองผู้บริโภครูปแบบสมัครใจในระยะเริ่มต้นก่อน แต่หากในอนาคตปรากฏข้อร้องเรียนเช่นว่านั้น ผู้วิจัยเสนอให้นำรูปแบบการบังคับใช้เป็นกฎหมาย หรือ รูปแบบที่อาศัยความสมัครใจของผู้ประกอบธุรกิจมาปรับใช้ตามความเหมาะสมต่อไปในประเด็นเรื่องหน่วยงานกำกับดูแล ผู้วิจัยเสนอให้สำนักงานคณะกรรมการคุ้มครองผู้บริโภค (สคบ.) เป็นหน่วยงานผู้มีหน้าที่มีอำนาจกำกับดูแลธุรกิจติดตั้งโซลาร์เซลล์บนหลังคาบ้านพักอาศัย ด้วย สคบ. มีบุคลากรที่มีความเชี่ยวชาญในด้านการคุ้มครองผู้บริโภคมากกว่าสำนักงานคณะกรรมการกำกับกิจการพลังงาน (สำนักงาน กกพ.)

Answerable only to the courts that have the sole authority to grant or withhold the right to practice law, lawyers operate under a system of self-regulation. The self-regulated legal profession staunchly resists external interference from the legislative and administrative branches of government. Sandin and Wilkinson were decided during Chief Justice William Rehnquist's tenure, and the Chief Justice played the lead role in reshaping the Court's solitary confinement caselaw over the past thirty years. It was Chief Justice Rehnquist who fashioned the “atypical, significant hardship” test in Sandin v. Conner and it would have to be exhibit 1 demonstrating the Chief Justice's “indifference to prison terrors,” to borrow Professor Judith Resnik's eloquent phrase. Should pro-immigrant advocates pursue federally funded counsel for all immigrants facing deportation? For most pro-immigrant advocates and scholars, the answer is self-evident: More lawyers for immigrants would mean more justice for immigrants, and thus, the federal government should fund such lawyers. Moreover, the argument goes, federally funded counsel for immigrants would improve due process and fairness, as well as make immigration enforcement more efficient. This Article argues the opposite: Federally funded counsel is the wrong goal. The majority of expulsions of immigrants now happen outside immigration courts— and thus are impervious to immigration lawyering. Even for those who make it …

Clinical legal education has evolved substantially in the fifty years since Elliott Milstein initiated the clinical model at American University Washington College of Law (“WCL”) that, notwithstanding numerous changes in program and personnel since that time, remains essentially in effect today. In this Article, we explore the theoretical, pedagogical, structural, programmatic, and personnel developments that have occurred during this period. We link these developments to broader developments within the national and international clinical legal education spheres. Tourists' Perceptions Of And Reactions To Child Sex Tourism: An Exploratory Qualitative Investigation, Joshua Aston, Jun Wen, Shaohua Yang

Purpose: Using a qualitative approach, this cross-disciplinary study integrating modern slavery, tourism and marketing expertise outlines Chinese outbound tourists' perceptions of and reactions to issues related to child sex tourism.

Design/methodology/approach: In total, 27 in-depth interviews were conducted, and data were analysed. Manual coding was chosen as an efficient method to process qualitative interview data given the relatively small sample size in this study.

Findings: Three main themes emerged from analysis: (1) tourists' negative perceptions of child sex tourism; (2) tourist boycotts against child sex tourism destinations and activities as reactions to this socially deviant and illegal phenomenon and (3) …

Passionate And Psychologically-Undetached: A Moderated-Mediated Investigation Of Psychological Distress Among Engaged Employees, Jennifer Ann L. Lajom, Stephen Teo, Moises Kirk De Carvalho Filho, Alicia Stanway

Guided by the effort-recovery model and the dualistic model of passion, we tested a conditional process model that examined the relationships between work engagement, workplace passion, psychological detachment, and psychological distress among Japanese professionals. We conducted an online panel survey across two time points, six weeks apart (N = 202 matched responses) where we measured all the variables at both instances. Findings show that engaged employees become susceptible to psychological distress due to decreased levels of psychological detachment. The moderating role of work passion was partially supported: being obsessively passionate towards work exacerbates this relationship further while contrary to expectations, …

In the United States, law condemns poor people to their fates in states. Where Americans live continues to dictate whether they can access cash, food, and medical assistance. What’s more, immigrants, territorial residents, and tribal members encounter deteriorated corners of the American welfare state. Nonetheless, despite repeated retrenchment efforts, this patchwork of programs has proven remarkably resilient. Yet, the ability of the United States to meet its people’s most basic needs now faces an unprecedented challenge: climate change. Capital mobility has preoccupied scholars of international taxation for more than 30 years. According to prevailing narratives, when capital is highly mobile, countries compete to attract investment, creating a race to the bottom; capital mobility also enables multinational enterprises (MNEs) to shift profits. The appeal of these narratives has culminated in the OECD’s proposed Global Minimum Tax, which declares the aim of substantially curtailing tax competition. This paper suggests, however, that the significance of mobile capital for international taxation may be largely an illusion.
