Built For Business: The Commercial Need For Aggregate Litigation, Jack Zarin-Rosenfeld Jan 2023

Built For Business: The Commercial Need For Aggregate Litigation, Jack Zarin-Rosenfeld

Connecticut Law Review

Commercial actors long have argued that class actions are bad for business. But for even longer, business groups have supported other types of aggregate litigation that closely resemble class actions, such as expansive federal bankruptcy. While critics have successfully limited national aggregation via class actions, they have not even attempted to criticize aggregation via bankruptcy.

Why have business groups attacked aggregate litigation in some cases and supported it in others? This Article provides an answer by examining aggregation’s origins and development, and what emerges, it turns out, is very much the opposite of what aggregation’s pro-business critics would have us …

Nomad Gallery, Maria Paula Suárez, Renata Ribeiro Jan 2023

Nomad Gallery, Maria Paula Suárez, Renata Ribeiro

MA Projects

NOMAD Gallery is a flash retailing business model that will seek to attract consumers with discretionary spending power but are unfamiliar with highly curated art experiences. Despite its size, the art market today is not easily accessible to younger generations, as it possesses several structural barriers to access (such as the need to know and develop relationships with Art galleries and curators). NOMAD Gallery’s value proposition is anchored on sharing culture and democratizing the access to art through playful and interactive pop-up galleries that exhibit artists from around the world in different seasonal settings and structured such that it provides …

What Do Law Professors Believe About Law And The Legal Academy?, Eric Martinez, Kevin Tobia Jan 2023

What Do Law Professors Believe About Law And The Legal Academy?, Eric Martinez, Kevin Tobia

Articles

Legal scholarship is replete with debates about competing legal theories: textualism or purposivism; formalism or realism; natural law or positivism; prison reform or abolition; universal or culturally specific human rights? Despite voluminous literature about these debates, great uncertainty remains about which views experts endorse. This Article presents the first dataset of American law professors’ views about legal theory. A study of over six hundred law professors reveals expert consensus and dissensus about dozens of longstanding debates.

Law professors also debate questions about the legal academy. These include descriptive questions: Which subjects (for example, constitutional law) and methods (for example, law …

Challenging Myths And Stereotypes In Domestic Violence Cases, Jennifer Koshan Jan 2023

Challenging Myths And Stereotypes In Domestic Violence Cases, Jennifer Koshan

Canadian Journal of Family Law

Survivors of domestic violence, who are disproportionately women, face numerous myths and stereotypes about the veracity, nature, and extent of violence they and their children experience. In legal disputes, they encounter allegations that they have lied about or exaggerated domestic violence out of vengeance, jealousy, or to gain an advantage in family law proceedings; that their partners are victims too; that abuse ends at separation or is irrelevant unless it is physical; and that it has no impact on children or only matters if it does. Although scholars and activists have revealed how these allegations are tainted by false and …

“This Isn’T Justice”: Abused Women Navigate Family Law In Greater Vancouver, Wendy Chan, Rebecca Lennox Jan 2023

“This Isn’T Justice”: Abused Women Navigate Family Law In Greater Vancouver, Wendy Chan, Rebecca Lennox

Canadian Journal of Family Law

With the implementation of the Family Law Act in 2013, the family legal system in British Columbia saw a series of progressive reforms. These include the recognition of emotional, psychological, and financial control as family violence, a new protection order process to replace the limited restraining orders formerly available to abuse victims, a mandate that courts consider how exposure to family violence impacts children, and minimum mandatory training standards for family dispute resolution professionals. While there has been a great deal of legal commentary on these new provisions, there is a paucity of scholarly research documenting the experiences of frontline …

In this Paper, I test the ability of ChatGPT to assist with common tasks performed by law professors. To conduct the experiment, I ran four service-related prompts and three teaching-related prompts through the free version of ChatGPT and then analyzed the results. ChatGPT performed very well on the service-related prompts and moderately well on the teaching-related prompts. I conclude that ChatGPT can provide law professors with near-finished products for routine tasks and a solid jumping-off point for those that are more complex.

When Donor Meets Purpose, Atinuke O. Adediran Jan 2023

When Donor Meets Purpose, Atinuke O. Adediran

Faculty Scholarship

This Essay addresses a gap in law and the Restatement of the Law Charitable Nonproít Organizations regarding the relationship between a charitable nonproít’s donors and its purpose. I argue that charitable nonproíts can align their purposes with the personal or professional identities of their donors, and it may be in the best interest of some charities to do so. Charities whose purposes are to address racial or economic inequality should seriously consider aligning their donor identity with their purpose as a way of improving their legitimacy in the communities they serve, and to reach previously untapped sources of funding.

Understanding Financial Toxicity Among Adult Cancer Survivors In The Us, Siddhi Korgaonkar Jan 2023

Understanding Financial Toxicity Among Adult Cancer Survivors In The Us, Siddhi Korgaonkar

Electronic Theses and Dissertations

The term ‘financial toxicity’ (FT) has been used to describe cancer-related financial hardship and psychological distress experienced by cancer survivors. FT can be detrimental to the health and wellbeing of cancer survivors due to its multifarious adverse effects.

This dissertation strives to advance extant knowledge on cancer-related FT research by investigating three key questions: 1. How have the trends in the direct total and out-of-pocket (OOP) healthcare expenditures, and OOP financial burden of US cancer survivors aged 18-64 years evolved between 2008 – 2019? 2. What are the self-reported HIL levels among adult cancer survivors aged 27-64 years in the …

This Is Not Your Grandparents' Military Justice System: The 2022 And 2023 National Defense Authorization Acts, David A. Schlueter, Lisa M. Schenck

Faculty Articles

Despite the major reforms to the American military justice system in the 2016 Military Justice Act, the drumbeat for reform has continued. One of the most-often heard calls for reform over the last decade has suggested removing commanders from the military justice system. Some have argued that a command-centric military justice system was outdated, and it was time to make the system look more like the Federal criminal procedure system. Other critics have advocated for a military justice system that looks more like those of our allied nations. This article briefly addresses the 2022 and 2023 NDAA changes to the …

Inviting The People Into People's Court: Embracing Non-Attorney Representation In Eviction Proceedings, Gregory Zlotnick Jan 2023

Inviting The People Into People's Court: Embracing Non-Attorney Representation In Eviction Proceedings, Gregory Zlotnick

Faculty Articles

Evictions often hide in plain sight-and so does one of the most effective responses. Studies uniformly confirm that represented tenants avoid evictions, and with it associated downstream effects, at appreciably higher rates than unrepresented tenants. Tenant representation is one of the most cost-effective anti-poverty interventions available in our housing system. Lawyers should support its expansion, even if and when it a non-lawyer serves as that intervenor in eviction court.

This paper argues that the legal profession should embrace and expand existing pathways for training eligible and interested individuals, regardless of whether they are licensed attorneys, to assist tenants facing eviction. …

Seismic Shifts: Post-Covid Legal Education And The Profession, Zoe Niesel Jan 2023

Seismic Shifts: Post-Covid Legal Education And The Profession, Zoe Niesel

Faculty Articles

The 2020-2021 COVID-19 pandemic created significant upheaval in the legal profession. Courts closed, cases were delayed, and law firms and other legal institutions rapidly moved their employees and operations to a virtual forum. And among this disruption, law schools made unprecedented changes to their curricula and pedagogy as students attended classes over Zoom, through asynchronous means, or in a hybrid fashion that split their learning between in-person and online. These rapid developments have sparked new discussions regarding the future of legal education. Specifically, law schools and the American Bar Association (ABA) are now re-examining their approach to determine the appropriate …

Revolutionizing Justice: Unleashing The Power Of Artificial Intelligence, Samuel D. Hodge Jr. Jan 2023

Revolutionizing Justice: Unleashing The Power Of Artificial Intelligence, Samuel D. Hodge Jr.

SMU Science and Technology Law Review

The practice of law is changing, and most lawyers are unprepared for this metamorphosis. This statement is not an exaggeration but the acknowledgment that artificial intelligence (“AI”) has altered the way lawyers do business. Instead of having a “battle of forms,” attorneys will now be confronted with the “battle of computers.” Linking artificial intelligence and the law, however, is a natural progression. Both operate in similar fashions: each examines and applies “historical examples in order to infer rules to apply to new situations.”

While many attorneys are unsure how to integrate this new technology into their practices, they already use …
