Nefarious Notarios: Responding To Immigration Scams As White Collar Crime As A Matter Of Public Policy, Sarah Cossman Aug 2023

Nefarious Notarios: Responding To Immigration Scams As White Collar Crime As A Matter Of Public Policy, Sarah Cossman

Refugee Law & Migration Studies Brief

Immigration scams targeting non-citizens can have devastating impacts on an individual's status and ability to remain in the United States legally. The phenomenon of notario fraud occurs when an individual misrepresents themself as a notario publico in an effort to defraud immigrants seeking legal services. In Spanish-speaking countries, a notario publico is a highly trained legal professional, akin to an attorney, who provides legal advice and drafts legal documents. The term is a false cognate. The English equivalent, a notary, is an individual with narrow witnessing duties and much less discretion. Problems arise when individuals obtain a notary public license …

The Impact Of Historical Housing Policies On Impoverished Communities: Recommendations To Improve Socioeconomic, Environmental, And Health Outcomes., Destinee A. Cruz Aug 2023

The Impact Of Historical Housing Policies On Impoverished Communities: Recommendations To Improve Socioeconomic, Environmental, And Health Outcomes., Destinee A. Cruz

Master's Projects and Capstones

Discriminatory historical housing policies, like redlining and racially restrictive covenants, segregated communities across the United States leading to the disinvestment of resources and negative socioeconomic, environmental, and health outcomes. These negative consequences continue to affect low-income communities and require modernized urban renewal programs to offset the residual effects of racially discriminatory housing policies. Therefore, the purpose of this thesis is to recommend critical funding to support urban renewal and the inclusion of housing protection policies for homeowners and tenants currently residing in former redlined neighborhoods. The initial proposed recommendation identifies several financing options to successfully implement urban renewal programs. The …

Ethics At The Speed Of Business, James A. Doppke Jr. Aug 2023

Ethics At The Speed Of Business, James A. Doppke Jr.

DePaul Business & Commercial Law Journal

This paper discusses several ways in which the Illinois Rules of Professional Conduct, and the Illinois Supreme Court Rules, construct barriers that prevent lawyers and businesses from accomplishing reasonable commercial goals. Often, those barriers arise from outdated concepts, or terminology that does not reflect current business realities. The paper argues for the amendment of specific Rules to enhance lawyers’ and businesses’ respective abilities to conduct their affairs more efficiently, without sacrificing public protection in the process.

Examining Factors Impacting The Service Needs Of Unhoused Women, Holly Brott Aug 2023

Examining Factors Impacting The Service Needs Of Unhoused Women, Holly Brott

Dissertations and Theses

Women account for a sizeable proportion of the unhoused population in the U.S. Over one-third (38.7%) of unhoused individuals are women, which is a 17% increase from 2016 (United States Department of Housing and Urban Development, 2019). The increased prevalence of women experiencing homelessness calls for a renewed examination of their service needs. This dissertation presents three studies examining factors impacting the service needs of unhoused women. The first manuscript examined factors contributing to unhoused mothers’ successful completion of transitional housing; highlighted participant-identified programmatic strengths; and investigated differences in facilitators to success across two geographic contexts: one rural and one …

The Practitioner King - A Study Of Legal Education And Practice In Pakistan, Summaiya Zaidi Aug 2023

The Practitioner King - A Study Of Legal Education And Practice In Pakistan, Summaiya Zaidi

PhD Dissertations

This dissertation is a study of legal education and practice in Pakistan and investigates the rise of the legal practitioner through a socio-historical examination. It seeks to determine the extent to which legal education in Pakistan is bound by colonial norms of practice through a genealogy of the legal practitioner in South Asia where the practitioner emerges as a dominant actor in the legal field. This dissertation argues that the fields of legal education and practice cannot be studied separately because the two are intimately connected for three main reasons: firstly, the law degree serves as an entry requirement to …

The International Patent Practice Narrative: Patent Agents, Epistemic Capture And The Patent Bargain, Wissam Joseph Aoun Aug 2023

The International Patent Practice Narrative: Patent Agents, Epistemic Capture And The Patent Bargain, Wissam Joseph Aoun

PhD Dissertations

This work explores the question of how professionalization of patent agency along with its accompanying discourse has affected the direction of international patent institutions and networks. Professionalization of patent agency is defined as the government regulation of who may provide patent agent services to the public through the form of professional licensing requirements. To the extent that professionalization of patent agency has created a unique discourse of patent agency, to what degree and in what respects has this discourse transformed global patent institutions? In particular, has this discourse created a form of ‘epistemic’ or ‘cultural’ capture that has the effect …

Indigenous Water Rights: Navigating Sovereign Waters, Cynthia N. Pina Aug 2023

Indigenous Water Rights: Navigating Sovereign Waters, Cynthia N. Pina

Master's Projects and Capstones

The issue of Native American water rights and the sovereignty of their land on reservations is gaining increasing prominence, making it the focal point of this thesis as an environmental justice concern. Native Americans face disproportionate public health challenges related to water accessibility, contamination, sanitation, outdated infrastructure, and other social determinants of health. The legal framework that governs the coexistence of Native Americans in the United States is rooted in a settler colonial perspective. Consequently, this has created a dependent relationship between Native Americans and the United States federal government. Despite the long-standing advocacy of Tribes for sovereignty since the …

Legal Needs And Health Outcomes For People With Cancer In Medical-Legal Partnership Programs: A Systematic Review, Allison B. Dowling, Caitlin Schille Jensen, Abigail Sweeney, C. Scott Dorris, Deborah F. Perry Aug 2023

Legal Needs And Health Outcomes For People With Cancer In Medical-Legal Partnership Programs: A Systematic Review, Allison B. Dowling, Caitlin Schille Jensen, Abigail Sweeney, C. Scott Dorris, Deborah F. Perry

HJA Scholarship

Medical-legal partnerships (MLPs) integrate lawyers into the medical team to address patients’ unmet legal needs that create barriers to good health and well-being (i.e., “health-harming legal needs”) and improve health outcomes. Given the growing popularity of MLP as an innovative healthcare model, this review has two objectives: to identify peer-reviewed literature measuring (1) cancer patients’ legal needs, and (2) outcomes for cancer patients after receiving MLP legal services. A systematic literature search was conducted in concordance with the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) for the period 2006- 2022. Four articles met the inclusion criteria for objective …

Naming And Blaming Automated Decision-Making Systems: Analysis Of Contesting Algorithmic Injustice, Esra Gules-Guctas

Legacy Theses & Dissertations (2009 - 2024)

This dissertation is centrally concerned with understanding how algorithmic harms evolve into legal claims in the context of automated public benefits determinations. Data collection consists of multiple source of data including semi-structured in-depth interviews, court opinions, expert witness reports, deposition transcripts, and investigative news reports. Analysis was conducted in parallel with data collection through iterative process of open coding. Results indicate that algorithmic errors are not merely technical glitches, they lead to cascading harms. In-depth analysis of algorithmic errors identified in legal cases reveals the type of errors that top-down formal audit mechanisms fail to capture. As statistical tools automated systems …

Governmental And Semi-Governmental Federal Charitable Entities, Ellen P. Aprill Aug 2023

Governmental And Semi-Governmental Federal Charitable Entities, Ellen P. Aprill

UC Law Journal

The standard view of the relationship between government and the nonprofit charitable sector treats them as separate and distinct. But they are not. Numerous federal agencies have statutory authority to receive tax-deductible charitable deductions. Their ability to do so, however, undermines the oversight accomplished through the constitutionally mandated appropriations process. Congress has also created many nonprofit tax-exempt organizations. These entities enjoy flexibility as to fundraising, investment, and spending that government agencies lack. However, they avoid the accountability that various federal statutes impose on government agencies, on the one hand, and that state nonprofit laws accomplish for private nonprofit organizations, on …
