Corporate Investigations, Attorney-Client Privilege, And Selective Waiver: Is A Half-Privilege Worth Having At All?, Colin P. Marks Jan 2006

Corporate Investigations, Attorney-Client Privilege, And Selective Waiver: Is A Half-Privilege Worth Having At All?, Colin P. Marks

Seattle University Law Review

This article will explore both the various problems that arise with a policy that essentially mandates waiver of the attorney-client privilege as well as the limited appeal of the selective waiver theory as a compromise position. It concludes that selective waiver is inadequate in addressing the many problems created by policies that coerce waiver and that a more desirable solution is to eliminate or amend the governmental policies that coerce waiver. Part II of this article explains and explores the metes and bounds of the attorney-client privilege and work-product protection. Part III explains the development of the selective waiver theory, …

Legal Representation Of Birth Parents And Adoptive Parents, Elizabeth Samuels Jan 2006

Legal Representation Of Birth Parents And Adoptive Parents, Elizabeth Samuels

All Faculty Scholarship

The Article examines the role that legal representation of birth and prospective parents may or may not play in independent domestic adoptions in furthering two primary goals that characterize ethically and humanely conducted adoptions, deliberate decision making and finality. Ideally, these two goals are complementary and can be balanced with one another. There is, however, a danger of the second goal eclipsing the first. Many state laws appear to value an increase in infant adoptions over the goal of encouraging careful deliberation. Most domestic infant adoptions involve powerful market forces as well as powerful emotional pressures, and they occur in …

It is a pleasure to be with you this evening and share some thoughts with you. Sandy and I are delighted to see so many wonderful friends here. I hope we have an opportunity to greet each of you before the evening is over. I include my wife, Sandy, in our network of friends because she has been my partner throughout my association with the Law School - during the time I was a student, then a faculty member, and eventually as Dean - and so many friends here tonight are friends of both of ours. I'd like to ask …

Collaboration In Resource Sharing Among Malaysian Academic Libraries In A Digital Environment, Harvinder Kaur, Kiran Kaur, Diljit Singh Jan 2006

Collaboration In Resource Sharing Among Malaysian Academic Libraries In A Digital Environment, Harvinder Kaur, Kiran Kaur, Diljit Singh

Research Publications (2006 to 2010)

The need for resource sharing among libraries has become even more important today with constraints of finance, space, and manpower. Traditional forms of resource sharing – inter-library loans and document delivery – are more suited to a print environment than a digital environment. The digital environment however provides many new opportunities for resource sharing, and the literature suggests many emerging models. This paper examines the views, practices, and plans of resource sharing among Malaysian academic libraries. From the interviews conducted, it was noted that librarians were aware of and support the concept of resource sharing. Current resource sharing activities in …

Corporate Investigations, Attorney-Client Privilege, And Selective Waiver: Is A Half-Privilege Worth Having At All?, Colin P. Marks

Faculty Articles

As the title suggests, this article is an analysis of the selective waiver doctrine, which allows a party to disclose materials protected by the attorney-client and work product privileges to the government during investigations without waiving the privilege as to third-party litigants. Specifically, the article analyzes the development of the selective waiver doctrine and why recent policies adopted by governmental agencies, specifically the Department of Justice and SEC, have made this doctrine a forefront of conversation amongst litigators, legislators and academics. But is a blanket adoption of the selective waiver doctrine wise?

Courts have taken a variety of approaches to …

Attorney General’S Annual Report To Congress On U.S. Government Activities To Combat Trafficking In Persons Fiscal Year 2005, U.S. Department Of Justice

Human Trafficking: Data and Documents

Trafficking in persons (“TIP”) is a regrettably widespread form of modern-day slavery. An estimated 600,000 to 800,000 human beings are trafficked across international borders each year. More than 80 percent of these victims are women and girls, and 70 percent of them are forced into sexual servitude. Furthermore, one estimate claims that between 14,500 and 17,500 victims may be trafficked into the United States each year, although that figure may be overstated. In response, the United States has led the world in the fight against this terrible crime.
