Utah Law Review

Law School students and faculty alike enjoy the opportunity to contribute to new developments for the improvement of access to justice. Too often, our traditional research is published in a law journal and is often unknown to policymakers and community organizations that make an impact on our society and the way our legal system functions. Community-based research conducted by a student with the courts, the bar, legal service providers, and volunteer providers of services is presented in a context in which it can be used by these organizations dedicated to improvement of access to justice.

The Regulation Of Intercountry Adoption, Mary E. Hansen, Daniel Pollack

As of January 2006, the United States was the only major receiver of children through intercountry adoption that had not implemented the 1993 Hague Convention on Intercountry Adoption. The U.S. signed the Hague Convention in 1994, but did not pass implementing legislation until 2000. Regulations pursuant to the legislation were proposed in 2003, but final regulations did not go into effect until March 2006. The slow pace was partly the result of Congressional wrangling over designation of a regulator and partly the result of a prolonged conversation between the designated regulator and the adoption community over specific regulations.

As the demand for affordable legal services grows, law schools and the legal profession struggle to respond. By examining lessons from successful social movements in the last century, Cause Lawyering and Social Movements: Can Solo and Small Firm Practitioners anchor Social Movements looks at the Law School Consortium Project and its potential to participate in and anchor the social movements of our time. The collaboration of the law schools, networks of solo and small firm attorneys and activists at the local, regional and national level provide key elements for powerful change given the technological developments of the 21st century.

Conflict Of Interest And The Standard Of Review In Erisa Cases: The Seventh Circuit’S Refusal To Acknowledge What Other Circuits Already Know, Barbara C. Long

Seventh Circuit Review

The Supreme Court's decision in Firestone v. Bruch required that conflicts of interest by a plan administrator be "weighed as a factor in determining whether there is an abuse of discretion" in the decision to deny benefits. Nearly every circuit court of appeals, except the Seventh Circuit, has determined that where the plan administrator is also the funder or insurer of a plan, there is an inherent conflict of interest that warrants adjusting the standard of review. This article discusses the Seventh Circuit's reasons for departing from the wisdom of the other circuit courts, and why its reasons are unjustifiable.
