Flattening The World Of Legal Services? The Ethical And Liability Minefields Of Offshoring Legal And Law-Related Services, Carole Silver, Mary C. Daly

Articles by Maurer Faculty

This article examines offshore outsourcing of legal and law-related services as the newest twist in the international market for legal services. We consider the impact of offshore outsourcing on the profession generally and analyze the ethical issues raised by offshore outsourcing, both as it exists today and as the practice may develop in the future. The article begins by situating offshore outsourcing in the framework of relationships created in the context of delivery of legal services. This framework is used, in turn, to construct a structure of analysis for the ethical implications of offshore outsourcing. Lawyers who outsource to offshore …

A Design Science Approach To Developing And Determining Web Site Quality Dimensions For The Public Accounting Profession, Casty K. Nyaga Jan 2007

A Design Science Approach To Developing And Determining Web Site Quality Dimensions For The Public Accounting Profession, Casty K. Nyaga

Theses: Doctorates and Masters

Public Accounting (PA) firms play an important role in both the local and the international business environment. Their accounting and business services functions cut across organisations, sectors and industries. Like other professional service firms, PA firms are becoming concerned about the World Wide Web (web) since the services they offer can be delivered via the web more efficiently (eg. at a lower cost) and effectively (24/7). Thus there is a need to assess the quality of their web site. This study developed an instrument for measuring PA web site quality based on an extensive literature review which identified the previously …

How Can Japanese Corporations Protect Confidential Information In U.S. Courts?, Masamichi Yamamoto Jan 2007

How Can Japanese Corporations Protect Confidential Information In U.S. Courts?, Masamichi Yamamoto

Vanderbilt Journal of Transnational Law

U.S. courts have seen a significant increase in the number of lawsuits involving both U.S. and Japanese corporations. In deciding these cases, U.S. courts may have to choose how to apply the attorney-client privilege to in-house lawyers retained by corporations in Japan, where the legal system and discovery rules are fundamentally different from those of the United States. U.S. courts would most likely analyze these situations under the Remy-Martin/Minolta test and recognize the attorney-client privilege only for managers of legal departments in Japanese corporations, not for other non-bengoshi (non-licensed) in-house lawyers. This will change in the near future, however, when …

An Ounce Of Prevention: Improving The Preventative Measures Of The Trafficking Victims Protection Act, Takiyah R. Mcclain Jan 2007

An Ounce Of Prevention: Improving The Preventative Measures Of The Trafficking Victims Protection Act, Takiyah R. Mcclain

Vanderbilt Journal of Transnational Law

Trafficking is a multi-billion dollar industry that affects the lives of millions of people, especially young girls and women. In an effort to combat this issue, the United States enacted the Trafficking Victims Protection Act in 2000. The Act has had some positive effects on the trafficking industry, but its preventative measures overlook or fail to deal sufficiently with some key factors: human rights issues, gender and economic inequalities, and sensationalism of the sex industry.

This Note discusses these three issues and their importance in establishing more effective preventative measures. Additionally, this Note looks to two approaches to trafficking, the …

Elite Law Firm Mergers And Reputational Competition, Bruce E. Aronson Jan 2007

Elite Law Firm Mergers And Reputational Competition, Bruce E. Aronson

Vanderbilt Journal of Transnational Law

Although rapid law firm growth has persisted since the 1980s, the acceleration of this trend over the last decade by means of mergers is puzzling. Why would normally conservative law firms embark on a merger strategy that appears to encompass significant risk and uncertain benefits? Is this trend a peculiarly U.S. phenomenon?

Most of the popular explanations for law firm mergers focus on a single factor: Law firms everywhere cite strikingly similar reasons based on a presumed client demand for "one-stop shopping." This Article contributes to providing a more robust, multi-causal explanation for law firm behavior through a comparative study …

Environmental Justice, Community Empowerment, And The Role Of Lawyers In Post-Katrina New Orleans, Janell Smith, Rachel Spector

City University of New York Law Review

Working together toward a common goal often requires mobilizing the strength and energy of many groups of people, all of whom share the same passion for accomplishing that goal. Does Your Wireless Lan Have Criminal Intent?, Michael Crowley, Andrew Woodward

Australian Information Security Management Conference

All of the literature relating to wireless network security has focused on the flaws, newer alternatives and suggestions for securing the network. There is much speculation and anecdotal statements in relation to what can happen if a breach occurs, but this is mostly from a computer security perspective, and mostly expressed in terms of potential for financial loss. This paper examines the potential legal ramifications of failing to properly secure a wireless network. Several scenarios are examined within based on usage of wireless on the various category of attack. Legal opinion, backed up with case law, is provided for each …

Work Life Benefit Needs For The City Of Lafayette, Colorado, Lisa E. Chrisman

Regis University Student Publications (comprehensive collection)

Successful organizations create great people places. They focus on both human and financial assets by placing a heavy emphasis on meeting the needs of employees. Results are a more collaborative approach to achieving work and personal objectives, with benefits to both the organization and the employee. Utilizing an action research methodology of diagnosing, action planning, implementing, and evaluating, this paper will evaluate work life benefit issues at the City of Lafayette.
