A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie Failinger Jan 2007

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie Failinger

Faculty Scholarship

This author argues that poverty advocates who are willing to carefully attend to their law school’s mission and vision, and to give careful thought to how poverty law may play an important role in achieving that vision, may win a more lasting place for poverty law in the curriculum than it has heretofore managed to achieve in most law schools. This article will argue that poverty law can be a key piece in the curriculum of law schools who define their mission, at least in part, as educating lawyers according to one of five paradigms: 1) lawyers as public citizens …

Alberta Legal Services Mapping Project: Brief Overview, Glynnis Lieb, Stephanie Abel

Canadian Forum on Civil Justice

The Alberta Legal Services Mapping Project is a collaborative action research initiative undertaken by the Canadian Forum on Civil Justice in association with a broad partnership of justice community representatives. The map will include the central services provided by pro bono initiatives, clinics, public legal education services, courts, legal aid, the private Bar and social services relevant to the needs of users of the …

The Legal Problems Of Everyday Life: The Nature, Extent And Consequences Of Justiciable Problems Experienced By Canadians, Ab Currie Jan 2007

The Legal Problems Of Everyday Life: The Nature, Extent And Consequences Of Justiciable Problems Experienced By Canadians, Ab Currie

Canadian Forum on Civil Justice

The purpose of this project is to inform policy makers about the incidence of civil justice problems and the extent of unmet need for assistance that justiciable problems in civil matters might represent. The study assumes a broad view of civil justice problems and unmet need. The broad view looks at the problem of civil justice and access to justice in terms of the prevalence of civil justice problems in the population. This involves identifying, by means of a sample survey, civil justice problems people have experienced that meet some reasonable threshold of seriousness. The broad view contrasts with the …

Bar Mental Fitness Questions: Perpetuating The Stigma, Sara Josselyn Jan 2007

Bar Mental Fitness Questions: Perpetuating The Stigma, Sara Josselyn

Dalhousie Journal of Legal Studies

In order to be admitted to the practice of law, all applicants to provincial Barristers’ Societies must respond to a series of questions aimed at ensuring that they are of good character and are generally “fit” to practice. Some applicants must also demonstrate their medical fitness by responding to various mental disability-related questions. This article examines whether the medical fitness questions currently asked of Bar applicants in many provinces are discriminatory and whether they serve to perpetuate the stigma associated with mental illness. The author will evaluate the propriety of broadly worded mental fitness questions in order to show that …

The Relationship Between Law School And The Bar Exam: A Look At Assessment And Student Success, Lorenzo A. Trujillo Jan 2007

The Relationship Between Law School And The Bar Exam: A Look At Assessment And Student Success, Lorenzo A. Trujillo

University of Colorado Law Review

Law schools have a moral and ethical obligation to society-and, to an even greater degree, to their students-to adequately prepare the students to succeed as professionals. Ultimate success for law students is measured by the ability to competently practice in the legal profession, which requires passing the bar exam. A recent downward trend in national bar passage rates highlights the need for law schools to address the factors negatively affecting bar passage rates. Based on research conducted at the University of Colorado School of Law, this article discusses methods to reform new attorney licensure and also highlights strategies to improve …

Thompson/Mcnulty Memo Internal Investigations: Ethical Concerns Of The Deputized Counsel, Colin P. Marks Jan 2007

Thompson/Mcnulty Memo Internal Investigations: Ethical Concerns Of The Deputized Counsel, Colin P. Marks

Faculty Articles

Outside counsel who conduct internal investigations for corporate clients have always faced ethical concerns, especially when interviewing employees. Generally, a carefully crafted blanket statement at the beginning of the interview explaining outside counsel's role was sufficient to address these concerns. However, recent charging policies adopted by the Department of Justice ("DOJ") have drastically changed the rules. These policies, articulated in what is now commonly referred to as the "Thompson Memo," after the author and then Deputy General Larry Thompson, allowed prosecutors to consider factors such as waivers of the attorney-client privilege and work-product protections and whether the company provides legal …

Urban Law School Graduates In Large Law Firms, David Wilkins, Ronit Dinovitzer, Rishi Batra Jan 2007

Urban Law School Graduates In Large Law Firms, David Wilkins, Ronit Dinovitzer, Rishi Batra

Faculty Articles

Two major trends have dominated the American legal profession in recent years. First, "the legal profession has seen a striking growth in the largest firms during the latter part of the last century." In 1960, Shearman Sterling & Wright (now called Shearman & Sterling) was the largest firm in the country - and therefore the world. It had 125 lawyers. By the close of the century, there were more than 250 firms larger than Shearman & Sterling had been forty years before, with the largest ten topping the scales at 1000 lawyers or more. Today, in order to make the …

Case For Less Secrecy In Lawyer Discipline, The, Leslie Levin Jan 2007

Case For Less Secrecy In Lawyer Discipline, The, Leslie Levin

Faculty Articles and Papers

This article looks at the problems created by a lawyer discipline process that continues to be conducted mostly in secret. The vast majority of the 125,000 discipline complaints received annually are disposed of without an opportunity for the public to observe the process or the outcome of complaints. Heavy reliance on confidential dispositions - either through private sanctions or diversion programs - keeps most information about lawyer misconduct a secret from the public. As a result, clients are often injured by lawyers who have previously engaged in misconduct, little is known about the extent of recidivism among disciplined lawyers, and …

A Law Guardian By The Same Name: A Response To Professor Guggenheim's Matrimonial Commission Critique, Merril Sobie

Elisabeth Haub School of Law Faculty Publications

I commence this article with a discussion of the statutory provisions governing the appointment and responsibilities of attorneys who represent children in New York. Part II briefly outlines the chronological implementation from initial enactment through the Matrimonial Commission Report, a period spanning forty-five years. Parts III and IV explore the specific nature of child custody representation and the relationship between the attorney and the child client during the course of a frequently lengthy proceeding. Last, the Commission's conclusions and recommendations are critiqued in Parts V and VI.

Globalization Of Law Firms: A Survey Of The Literature And A Research Agenda For Further Study, D. Daniel Sokol Jan 2007

Globalization Of Law Firms: A Survey Of The Literature And A Research Agenda For Further Study, D. Daniel Sokol

UF Law Faculty Publications

The international expansion of law firms plays a critical role in understanding the business of law and the nature of globalization. This article responds to two articles on law firm expansion in the Indiana University - Bloomington Law School symposium on the Globalization of the Legal Profession. The article utilizes management studies' theoretical work on internationalization and applies it to law firm expansion to explain law firm strategic decision-making. The author creates a six part taxonomy for types of law firm expansion and provides a snapshot of the increasing U.S./U.K. dominance of capital markets, corporate and mergers and acquisitions legal …
