Mcmahon Turns Twenty: The Regulation Of Fairness In Securities Arbitration, Jill I. Gross
Mcmahon Turns Twenty: The Regulation Of Fairness In Securities Arbitration, Jill I. Gross
Elisabeth Haub School of Law Faculty Publications
I believe that current regulation of securities arbitration does ensure that it is fair to investors. Part II of this Commentary explores the various sources of law, including the FAA, which could require fairness in securities arbitration. It revisits the first critical assumption of the McMahon Court, that the FAA's provisions for post-award judicial review protect investors from an unfair arbitration process. This Part demonstrates that, while the FAA does require “fundamental fairness” in arbitration, courts loosely construe that requirement and find most arbitration proceedings meet it easily. Part IIII of this Commentary explores SEC oversight of securities arbitration, particularly …
Fair Use And The Digital Millennium Copyright Act, Thomas J. Loos
Fair Use And The Digital Millennium Copyright Act, Thomas J. Loos
Michigan Telecommunications & Technology Law Review
In the last decade of the 20th Century, more than 200 years after the first Copyright Act of 1790, the rights of copyright owners have increased relative to those of the public. The Visual Artists Rights Act of 1990 provided a limited right to visual artists to control their work; even after sold, limiting first use rights. The first copyright act had a 28 year term; in 1998, the term of copyright was increased to the life of the author plus 70 years. The Digital Millennium Copyright Act (DMCA) of 1998 dramatically shrank the fair use rights provided under 17 …
Copyright And Youtube: Pirate's Playground Or Fair Use Forum?, Kurt Hunt
Copyright And Youtube: Pirate's Playground Or Fair Use Forum?, Kurt Hunt
Michigan Telecommunications & Technology Law Review
The entertainment industry has a history of framing new technology as piracy that threatens its very existence, regardless of the potential benefits of the technology or the legal limits of copyright rights. In the case of YouTube, copyright owners' attempts to retain content control negatively impact the public's ability to discuss culture in an online world. This implicates the basic policy behind fair use: to prevent copyright law from "stifl[ing] the very creativity which that law is designed to foster." The internet has become a powerful medium for expression. It is a vital tool in today's world for sharing original …

Court Review: Volume 44, Issue 1/2 – Procedural Fairness In The California Courts, Douglas Denton
Court Review: Volume 44, Issue 1/2 – Procedural Fairness In The California Courts, Douglas Denton
Court Review: Journal of the American Judges Association
In 2005, California’s judicial branch embarked on a two-part assessment to determine current levels of trust-and-confidence in the state courts and to obtain information concerning expectations and performance of the state courts. The findings were revealing—they highlighted good news for the courts and identified considerable challenges. The trust-and-confidence study not only informed the subsequent strategic and operational planning processes, it also spurred a large-scale initiative focused on one particularly compelling aspect of the public-trust-and-confidence assessment: the significant and important role that perceptions of procedural fairness play in determining court users’ trust and confidence in the California courts.
William Jennings Bryan, The Railroads, And The Politics Of "Workingmen", William G. Thomas, Iii
William Jennings Bryan, The Railroads, And The Politics Of "Workingmen", William G. Thomas, Iii
Nebraska Law Review
Early in his career as a lawyer William Jennings Bryan took a principled position that set him apart from many of his colleagues at the bar. When he teamed up with Dolph Talbot in a law practice in Lincoln in 1887, the state was growing faster than any other in the nation in that decade, catapulting from 450,000 residents to over 1 million. It was a promising field for the law business by any measure. Talbot took on a wide spectrum of clientele and represented the Missouri Pacific Railroad, but Bryan refused "to accept money from a railroad company."' This …

We are here today to celebrate and be challenged by a remarkable speech delivered by Dean Roscoe Pound on August 29, 1906. 1 We meet in the city where Dean Pound gave his historic address. On that occasion, Dean Pound was not Dean of the Harvard Law School, which he later became, but rather was the 36-year-old Dean of the University of Nebraska College of Law. 2 He was a well- educated man, having both a law degree from Northwestern University School of Law and a PhD in Botany from the University of Nebraska, 3 but he was not very …
Real Estate Practice In The Twenty-First Century, Ann Burkhart
Real Estate Practice In The Twenty-First Century, Ann Burkhart
Articles
The next century will bring profound changes in real estate law and in the ways that it is practiced. This prediction may seem rather unremarkable for any area of law or for almost any other area of human endeavor. But the changes in real estate law will be exceptional because of their relative rapidity and comprehensiveness.
A Century Of Juvenile Justice: A Work In Progress Or A Revolution That Failed?, Barry C. Feld
A Century Of Juvenile Justice: A Work In Progress Or A Revolution That Failed?, Barry C. Feld
Articles
A century ago, Progressive reformers adopted a more modem construction of childhood as a developmental period of innocence, dependence, and vulnerability. They embraced a more scientific understanding of social control - positive criminology - and tried to identify the causes of crime and to treat, rather than to punish, offenders. Reformers combined the new vision of childhood with new insights into criminality to create a judicial-welfare alternative to the adult criminal process. Jurisdiction over dependent as well as delinquent children reflected juvenile courts' broader role as a child-saving welfare agency and not simply a "junior" criminal court.'

The Choice Is Ours: Expanding Educational Opportunity For All Twin Cities Children, Institute On Metropolitan Opportunity
Studies
This IRP report reveals the disturbing extent of school segregation in the Twin Cities region. However, the authors envision a brighter future if an already successful school choice program is expanded. The report describes how economic and racial segregation harm children and the region.
