Do Judges Systematically Favor The Interests Of The Legal Profession? , Benjamin H. Barton

College of Law Faculty Scholarship

This Article answers this question with the following jurisprudential hypothesis: many legal outcomes can be explained, and future cases predicted, by asking a very simple question, is there a plausible legal result in this case that will significantly affect the interests of the legal profession (positively or negatively)? If so, the case will be decided in the way that offers the best result for the legal profession.

The article presents theoretical support from the new institutionalism, cognitive psychology and economic theory. The Article then gathers and analyzes supporting cases from areas as diverse as constitutional law, torts, professional responsibility, employment …

Branded, Bombarded And Besieged: Advertising Exposure And The "Average" Consumer, Mark Blackwell

Student Work

This study explored the commonly accepted estimate that the average consumer is exposed to about 1500 advertisements a day. Through single-subject, naturalistic observation, the researcher quantified the number of advertisements a subject was consciously exposed to over a seven-day period. In addition, this study recorded the day of the week, time of day, media source and product or service of each advertising exposure. This study found that this subject was consciously aware of being exposed to 690 advertisements during the weeklong study — an average of 98.5 exposures a day. The study also revealed that exposure to advertising could occur …

Outsourcing And The Globalizing Legal Profession, Jayanth K. Krishnan May 2007

Outsourcing And The Globalizing Legal Profession, Jayanth K. Krishnan

William & Mary Law Review

The issue of outsourcing jobs abroad stirs great emotion among Americans. Economic free-traders fiercely defend outsourcing as a positive for the U.S. economy, while critics contend that corporate desire for low wages, alone, drives this practice. In this study Professor Krishnan focuses on a specific type of outsourcing, one which has received scant scholarly attention to date-legal outsourcing. Indeed, because the work is often paralegal in nature, many see the outsourcing of legal jobs overseas as no different from other types of outsourcing. But by using case studies of both the United States and India, the latter of which is …

Silent Sacrifices: The Impact Of “Don’T Ask, Don’T Tell” On Lesbian And Gay Military Families, Kathi Westcott, Rebecca Sawyer

Duke Journal of Gender Law & Policy

The sacrifices of the nation's 65,000 lesbian, gay, and bisexual military personnel2 and the one million lesbian, gay, and, bisexual veterans, however, have only recently garnered significant attention.3 Media stories such as that of former Army Sergeant Bleu Copas, an Arabic linguist with the 82nd Airborne, illustrate the impact of the "Don't Ask, Don't Tell" law on individual service members as well as the law's impact on the military's personnel needs.4 Yet the impact of "Don't Ask, Don't Tell" on gay military families has garnered little public attention because few families headed by a same-sex couple, in which one partner …

Descriptive Analysis Of Georgia High School Teachers' Perceptions Of Academic Dishonesty, Amy Manning Rowland May 2007

Descriptive Analysis Of Georgia High School Teachers' Perceptions Of Academic Dishonesty, Amy Manning Rowland

College of Graduate Studies: Theses & Dissertations

This research study was conducted with the assistance of Georgia high school teachers for the purpose of examining teachers' perceptions of academic dishonesty during the 2006-2007 school year. Data were gathered to establish teachers' perceptions of academic dishonesty by exploring what behaviors teachers felt to be academically dishonest, how teachers addressed such occurrences, whether teachers felt any internal conflict regarding academic dishonesty, whether any external pressures were involved in instances of academic dishonesty, and how these experiences affected teachers attitudes toward their profession. Results of the study indicated that high school teachers in Georgia consider academic dishonesty to be a …

How The Court Got It Wrong In Woodford V. Ngo By Saying No To Simple Administrative Exhaustion Under The Plra, Karen M. Harkins Slocomb

San Diego Law Review

Congress has estimated that the number of people who have been sexually assaulted in America's prisons over the past twenty years tops one million. Some inmates are sexually assaulted by guards, and some by other inmates, facilitated by guards. The problem is so rampant that Congress enacted the Prison Rape Elimination Act of 2003. Though the State has a constitutional obligation to "provide humane conditions of confinement," sometimes it fails. To receive compensation for or relief from such harm, a prisoner must conform to the guidelines provided in the Prison Litigation Reform Act of 1995 (PLRA), which requires an inmate …

Law Firms, Ethics, And Equity Capital: A Conversation, Georgetown University Law Center, The Center For The Study Of The Legal Profession

CSLP Papers & Reports

The correspondence collected here represents an effort to start a conversation. Pending legislation in the United Kingdom, based on what is known as the Clementi Report, would permit non-lawyer equity investment in law firms, subject to regulatory oversight. In other words, UK law firms could become publicly-traded businesses. This legislation has been proposed as part of reforms heralded as improving the delivery of legal services to consumers. By contrast, such investment in law firms is forbidden by ethical rules in the United States. What will happen when the two countries with the most dominant global law firms begin to move …

Developing Expanded Conceptions Of Governance In Community Foundations, Michael Wolfe Apr 2007

Developing Expanded Conceptions Of Governance In Community Foundations, Michael Wolfe

Student Scholarship

Community foundations administer over $44 billion and distribute $3.5 billion annually to improve the quality of life throughout the United States. In 2000, a series of "National Standards for U.S. Community Foundations" was developed. Are changes currently promoted by the field of community foundations truly propelling community foundations to a more advanced role? Present research posits the value to community foundations of engaged proactive behavior by the board of directors and CEO. By examining the developmental responses of boards during times of institutional pressure, we can inform research and practice that seeks to improve nonprofit governance.
