Why Practice Management?, Gary A. Munneke Oct 2007

Why Practice Management?, Gary A. Munneke

Elisabeth Haub School of Law Faculty Publications

Today, lawyers must regard the practice of law as a business, inasmuch as they earn their livelihood from the practice of law. The marketplace for legal services is a competitive one; not only has the size of the profession more than quadrupled in the past 50 years, but other professions and businesses have also begun to perform services traditionally restricted to lawyers. For example, accounting firms have encroached on tax litigation, banks in the trusts and estates area, and financial planners in estate planning. In a series of cases, the United States Supreme Court has made it clear that lawyers …

Advancing The Future Of Family Violence Law Pedagogy: The Founding Of A Law School Clinic, Melissa Breger, Theresa Hughes Oct 2007

Advancing The Future Of Family Violence Law Pedagogy: The Founding Of A Law School Clinic, Melissa Breger, Theresa Hughes

University of Michigan Journal of Law Reform

This Article advocates for law schools to integrate family violence law further into their curricula and proffers reasons why family violence training is critical in preparing students to practice law. The authors posit that although live-client specialty clinics are the most in-depth way to teach family violence law, the topic should also be offered through doctrinal courses, externships, or general subject matter clinics. The Article then describes the authors' own experiences in cofounding a child advocacy clinic in New York City, outlining the steps taken to transform a vision into the actual formation of a clinic. Finally, the authors conclude …

Looking Ahead: A Personal Vision Of The Future Of Child Welfare Law, Donald N. Duquette Oct 2007

Looking Ahead: A Personal Vision Of The Future Of Child Welfare Law, Donald N. Duquette

University of Michigan Journal of Law Reform

The participants in the Thirtieth Anniversary Celebration of the Child Advocacy Law Clinic were all challenged to envision the future of child welfare and to address these questions: What should the law and legal institutions governing children's rights and child and family welfare look like in thirty more years? What steps are necessary to achieve those goals? After setting out the historical and optimistic circumstance in which the Child Advocacy Law Clinic was founded, this Article responds to the organizing questions by presenting the author's vision of the future of child welfare law and practice. When families fail children, what …

Transnational Litigation In The United States: The Emergence Of A New Field Of Law (Reviewing Gary B. Born & Peter B. Rutledge, International Civil Litigation In The United States (2007))., Samuel P. Baumgartner

Akron Law Faculty Publications

In this essay, I review the fourth edition of Gary Born's International Litigation in United States Courts (ICL), now co-authored by Peter Rutledge. This is a well-established case book/treatise that has influenced the thinking of many lawyers, both in the United States and abroad. In reviewing ICL, I explore some of the recent changes in cross-border litigation in the United States reflected in the fourth edition. Those changes demonstrate that transnational litigation has become a separate field of law in the sense that its independent study has acquired considerable practical importance. But there is more. The changes I review also …

Catholic Philanthropy And Civil Society: The Lay Volunteers Of Saint Vincent De Paul In Nineteenth-Century Mexico, Silvia Marina Arrom Ph.D. Oct 2007

Catholic Philanthropy And Civil Society: The Lay Volunteers Of Saint Vincent De Paul In Nineteenth-Century Mexico, Silvia Marina Arrom Ph.D.

Vincentian Studies

The history of the Society of Saint Vincent de Paul and the Association of the Ladies of Charity of Saint Vincent de Paul in nineteenth-century Mexico counters the argument that “civil society and philanthropy are new to Latin America.” Both organizations operated in cities nationwide, with tens of thousands of members helping hundreds of thousands of persons who were poor. Their activities, which are described in detail, encompassed traditional forms of charity and efforts to address the causes of poverty. Their contributions to the development of Mexican society are explained. Differences between the Mexican and French branches of these groups …

The Bit Generation's Emergence As A Collective Action Problem: Prisoner's Dilemma Or Network Effects?, Santiago Montt Sep 2007

The Bit Generation's Emergence As A Collective Action Problem: Prisoner's Dilemma Or Network Effects?, Santiago Montt

The Latin American and Caribbean Journal of Legal Studies

This paper presents a new theory that explains why developing countries have been entering into Bilateral Investment Treaties (BITs) in the last 50 years. It disputes Andrew Guzman’s account which depicts the BIT generation as a result of a prisoner’s dilemma among developing countries. As explained here, the BIT “game” differs from a prisoner’s dilemma in two key ways. First, the BIT game has a sequential/evolutionary nature, stemming from the fact that developing countries have been joining (and rejecting) the network at various times since 1959. Second, unlike the prisoner’s dilemma, the BIT system demonstrates the positive externalities or network …
