Opening The Door: Crowe V. Tull And The Application Of The Colorado Consumer Protection Act To Attorneys, Daniela Ronchetti
Opening The Door: Crowe V. Tull And The Application Of The Colorado Consumer Protection Act To Attorneys, Daniela Ronchetti
University of Colorado Law Review
In Crowe v. Tull, the Colorado Supreme Court held that the Colorado Consumer Protection Act ("CCPA") applies to attorneys. Putting consumers of legal services on par with consumers in other industries, the decision opened a new avenue of recovery in attorney-client disputes. This Note explores the ramifications of Crowe for attorneys and their clients. Specifically, the Note analyzes the elements of a CCPA claim and their interpretation by the courts and argues that in most cases, a client will not be able to successfully pursue a CCPA claim against his or her attorney. Particularly, a client will have difficulty proving …

This update reflects voluminous new literature and looks behind the statistics to find fresh efforts and pathways to solutions that can benefit women as well as the profession generally.

Effects Of Reputation On The Legal Profession, Fred C. Zacharias
Effects Of Reputation On The Legal Profession, Fred C. Zacharias
Washington and Lee Law Review
This Article considers how the reputation of lawyers and signaling between lawyers and clients affects the impact of legal ethics rules. Academics who have written about the relationships between lawyers and clients have not adequately considered the influence of reputational signaling on who clients hire and on lawyers' implementation of discretion. These empirical issues are key to a proper analysis of many professional rules and to the approach bar associations should take to matching lawyers and clients. The Article will focus primarily on lawyers' reputations as a proxy for what clients want, or need, to know about their representatives. Part …

Assault Upon The Citadel Of Privity: The Coexistence Of Strict, Privity And Belt V. Oppenheimer, Blend, Harrison & (And) Tate, Inc. Comment., C. John Muller Iv
St. Mary's Law Journal
The practicing attorney must have a complete understanding of legal malpractice liability. Managing this risk can be a precarious responsibility when the law is not clearly defined. This is compounded by the steady erosion of attorney-client privity barriers making it easier for third party non-clients to sue lawyers for legal malpractice. This is the current state of matters in Texas since the Texas Supreme Court decided Belt v. Oppenheimer, Blend, Harrison & Tate, Inc. on May 5, 2006. The Belt court determined personal representatives of an estate may bring a malpractice claim against the decedent’s attorneys. The Belt court was …

Faith In Action: Religious Accessory Uses And Land Use Regulation, Shelley Ross Saxer, Scott D. Hansen
Utah Law Review
For religious groups, faith in practice often consists of much more than formal worship. While religious institutions have traditionally provided places, such as churches and synagogues, for congregants to worship together in religious exercise, worshipping together is not necessarily the only function served by religious institutions. Institutions may also seek to provide individuals with spiritual nourishment that can include education, recreation, and the opportunity to serve others by providing social services for the poor and needy. Problems arise when communities have accepted houses of worship into their neighborhoods and these same religious institutions decide to expand their activities beyond worship …
Saving Homes In Bankruptcy: Housing Affordability And Loan Modificatio, John Eggum
Saving Homes In Bankruptcy: Housing Affordability And Loan Modificatio, John Eggum
Utah Law Review
The record number of foreclosures in 2007 and 2008 is threatening homeownership as a fundamental institution of American middle-class life. The inability of millions of families to afford; the strain housing costs place on th~ir incomes is a driving factor in the foreclosUre crisis. While chapter 13 bankruptcy offers families the opportunity to repay arrearages on their mortgage loans in a repayment plan, this relief does not address the ongoing struggle with loan affordability that resulted from the loose underwriting standards and nontraditional loan products that characterized the mortgage market in the last several years. The Mortgage Study data show …

A Literature Review Examining The § 501 (H) Election And § Irc 501 (C)(3) Organizations, Kimberly Anne Hefernan Moss
Graduate Research Papers
The purpose of the study was to conduct a literature review to determine what IRC § 501(c)(3) organizations know about the§ 501 (h) election, and why they do or do not take it. The literature review is divided into three sections: 1) IRC 501 (c) Organizations and Legislation; 2) IRC § 501 (c) lobbying; and 3) IRC § 501(c)(3) Lobbying Rules/Regulations. There has been scant research conducted surrounding lobbying by nonprofit organizations. The first national study that addressed IRC § 501 (c)(3) organizations' lobbying was the Strengthening Nonprofit Advocacy Project (SNAP). Despite the fact that very few organizations have taken …

Sexual And Gender Based Violence In Africa: Literature Review, Population Council
Reproductive Health
This report provides details of a literature review that is intended to inform partners in the Population Council–coordinated regional network that aims to develop a multisectoral and comprehensive response to sexual and gender-based violence (SGBV) in Eastern, Central, and Southern Africa. The first section defines the terminology used throughout the review, and discusses the prevalence and consequences of SGBV, considers the implications of the disproportionate programmatic focus on adult women survivors, and explores approaches to managing child and male survivors of sexual violence. The second section presents regional policies and programming relating to the medical and psychosocial management of survivors. …
South Africa: Integrated Approach Improves Quality Of Post-Rape Care, Population Council
South Africa: Integrated Approach Improves Quality Of Post-Rape Care, Population Council
Reproductive Health
In South Africa, an integrated model for post-rape care by nurses in a rural district hospital, which included a designated room for medical management and guidelines for providing reproductive health and HIV services, improved the quality of care provided. However, nurses remained reluctant to collect forensic evidence that could be used for prosecuting perpetrators. South Africa has developed a strong policy framework outlining medical management of rape survivors, which includes provision of HIV testing and post-exposure prophylaxis and emergency contraception, ideally within 72 hours. However, implementation has been hampered by numerous obstacles, both in health care infrastructure and policy, and …

Reproductive Health
In March 2008, the Population Council brought together members of the Africa Regional Sexual and Gender Based Violence (SGBV) Network for a South-South technical exchange meeting. The objectives were to identify best practices from existing programs, provide an evidence base for new programming, and develop mechanisms for South-South technical assistance. As detailed in this report, discussions covered the medical, legal, and psychosocial issues associated with SGBV prevention and response activities. Participants identified the following: Protocols and guidance documents are essential for ensuring comprehensive, quality response at all levels. Access To Justice: The Use Of Contingent Fee Arrangements By Public Officials To Vindicate Public Rights, Neil F. X. Kelly, Fidelma L. Fitzpatrick
Cardozo Journal of Equal Rights & Social Justice
The article examines the legality and efficacy of contingent fee agreements in public nuisance litigation, particularly in the context of childhood lead poisoning cases. It argues that such agreements are valid, ethical, and necessary for governments to pursue justice and remediation in cases where public health and safety are at risk. The analysis focuses on the landmark Rhode Island case against lead pigment manufacturers, highlighting how contingent fee arrangements ensure fair representation and accountability without compromising due process or impartiality.

Walking The Path Of The Law: How Law Graduates Navigate Career Choices And Tolerate Jobs That Fail To Meet Expectations, Deborah J. Cantrell, Elizabeth Levy Paluck, Heather Lord, April Smith
Cardozo Journal of Equal Rights & Social Justice
The article presents a longitudinal study of Yale Law School graduates from 1970 to 1999, analyzing their career paths, job satisfaction, and gender differences in professional experiences. It highlights the prevalence of career transitions, with many graduates moving from private practice to academia, government, or public interest roles. The study reveals significant gender disparities in job satisfaction and work-life balance, while challenging common assumptions about legal careers, such as the notion that women abandon private practice more frequently than men. The analysis underscores the importance of understanding career dynamics to improve support systems for law graduates.
