The Future Of Women In The Legal Profession: Recognizing The Challenges Ahead By Reviewing Current Trends, Maria Pabon Lopez Jan 2008

The Future Of Women In The Legal Profession: Recognizing The Challenges Ahead By Reviewing Current Trends, Maria Pabon Lopez

UC Law SF Journal on Gender and Justice

In 2004, the Indiana Supreme Court Race and Gender Commission undertook a large survey of lawyers' perceptions about women in the legal profession in order to assess which areas of gender bias have improved and which areas could stand improvement. This Article takes the data from this survey and interprets its significance for women in the profession and for the justice system overall. The Article compares the findings from the 2004 study of Indiana lawyers to the findings of a similar earlier Indiana study (conducted in 1990), and draws conclusions regarding the overall occurrence of gender bias in Indiana along …

East Asia Institutionalizes: China, Japan And The Vogue For Free Trade, Timothy Webster Jan 2008

East Asia Institutionalizes: China, Japan And The Vogue For Free Trade, Timothy Webster

Faculty Publications

In the past decade, East Asia has taken steps to increase regional integration. This paper examines the vogue for Free Trade Agreements (FTAs) currently raging in China and Japan. After mapping the regional links that knit East Asia together during the 1990s and 2000s, the focus then shifts to the specific trade agreements that China and Japan have signed. Both countries exhibit a particular FTA “style;” Japan has adopted a more orthodox and comprehensive approach to its treaties, while China has shown greater flexibility and gradualism when dealing with FTA partners. It is still unclear whether these efforts will lead …

Ethical Considerations For Attorneys Responding To A Data-Security Breach, Robert J. Scott, Julie Machal-Fulks

Northwestern Journal of Technology and Intellectual Property

Attorneys increasingly are confronting the significant ethical issues raised when a data-security breach occurs. Many traps exist for the unwary in this evolving area of the law, especially in light of concerns regarding e-discovery and a lack of judicial interpretation of applicable statutes. This article provides a legal framework in this area of the law and explores ethical considerations arising when an attorney represents a client who has suffered a data-security breach.

The Winding Road From Form To Function: A Brief History Of Contemporary Marriage, J. Herbie Difonzo, Ruth C. Stern Jan 2008

The Winding Road From Form To Function: A Brief History Of Contemporary Marriage, J. Herbie Difonzo, Ruth C. Stern

Hofstra Law Faculty Scholarship

Consider this contrast: American marriage was once “rigid, work-centered, custom regulated, with well-defined roles for husband, wife, and children,” but now may be characterized as “flexible, pleasure-centered, cooperatively regulated, with loosely defined roles for husband, wife, and children.” The accuracy of this comparison between conjugal unions past and present may be debated, although on the whole the distinction it draws seems defensible. What might startle the reader, however, is that quoted contrast appeared in a 1955 college sociology text entitled “Making the Most of Marriage.” The author, noted sociologist Paul H. Landis, celebrated the pliable, fun-loving marriage of his time …

Constitutional Cases 2007: An Overview, Patrick J. Monahan, James Gotowiec

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper examines the major constitutional decisions of the Supreme Court of Canada in the 2007 calendar year. The Court decided just 58 cases in 2007, the lowest number since 1975, and only 63 per cent of judgments were unanimous, a departure from the McLachlin Court’s overall average of 75 per cent. The Court’s decisions averaged 44.8 pages per appeal in 2007, the longest in 20 years, while the time from the hearing of an appeal to the release of the judgment increased to 6.6 months. Only 25 per cent of Charter claims were successful in calendar 2007. This is …

Loose Lips Sink Attorney-Client Ships: Unintended Technological Disclosure Of Confidential Communications Essay., Bill Piatt, Paula Dewitte Jan 2008

Loose Lips Sink Attorney-Client Ships: Unintended Technological Disclosure Of Confidential Communications Essay., Bill Piatt, Paula Dewitte

St. Mary's Law Journal

In general, attorneys must not reveal confidential information relating to the representation of their clients. Attorneys must make reasonable efforts to ensure the attorneys they supervise, as well as their nonlawyer employees, maintain client confidences. In modern days, technology virtually guarantees attorneys and clients will communicate electronically. While most attorneys would not knowingly disclose client confidences, there is a growing problem of unintended disclosure through electronic means. On a practical level, maintaining confidence is of utmost importance to both attorneys and clients. Attorneys may believe they are using good faith and competent, reasonable actions to protect their clients’ information from …

A Charter Reality Check: How Relevant Is The Charter To The Justness Of Our Criminal Justice System?, Kent Roach Jan 2008

A Charter Reality Check: How Relevant Is The Charter To The Justness Of Our Criminal Justice System?, Kent Roach

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

Although the Charter has made many important improvements to the criminal justice system, this paper argues that there is a need for a greater sense of perspective on the importance of the Charter to the criminal justice system. This paper critically examines the impact of the Charter on rates of imprisonment, rates of pre-trial imprisonment, rates of Aboriginal overrepresentation in prison and among crime victims, rates of crime victimization, national security activities, wrongful convictions, trial delay and complexity, and the Criminal Code. It concludes that the Charter has likely not been a major factor in explaining why Canadian rates of …

Searching For The Constitutional Core Of Access To Justice, Melina Buckley Jan 2008

Searching For The Constitutional Core Of Access To Justice, Melina Buckley

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper posits that access to justice is both a large multifaceted concept with broad policy implications and also a constitutional commitment central to our legal system. It contends that the process of refining and giving contemporary meaning to the legal principle of access to justice is obfuscated by debate surrounding the broader policy concept because the duality plays into concerns over the respective roles of governments and the courts to ensure access to justice, which brings the justiciability of access to justice claims into question. The woeful state of civil legal aid programs across Canada is attributable in part …
