The Future Regulation Of The Legal Profession: The Impact Of Treating The Legal Profession As Service Providers, Laurel Terry
The Future Regulation Of The Legal Profession: The Impact Of Treating The Legal Profession As Service Providers, Laurel Terry
Faculty Scholarly Works
In the past fifty years, one has heard debates about whether law is a business, a profession, or both, what these terms mean and whether it matters. Regardless of what one thinks about these debates, there is a new paradigm that must be added to the mix, which is the paradigm of lawyers as "service providers." In the "service providers" paradigm, the legal profession is not viewed as a separate, unique profession entitled to its own individual regulations, but is included in a broader group of "service providers," all of whom can be regulated together. This new paradigm represents a …
Constructs Of Justice: Beyond Civil Litigation, Alan Tomkins, Kimberly Applequist
Constructs Of Justice: Beyond Civil Litigation, Alan Tomkins, Kimberly Applequist
Alan Tomkins Publications
It is the case that civil justice problems constitute the bulk of courts’ work in both the state and federal legal systems (see, e.g., Court Statistics Project, 2006; U.S. Courts, 2007). Nevertheless, a decision rendered by a jury (or a judge) takes place in only a relatively small percentage of civil disputes. There are exponentially more civil disputes resolved outside of court than are resolved via jury verdicts (see, e.g., Galanter, 1983, 1993, 1996; Miller & Sarat, 1980–1981; Trubek, Grossman, Felstiner, Kritzer, & Sarat, 1983), a state of affairs true for the UK as well as the US (Pleasence, 2006). …

Untangling Tenth Amendment Standing: Why Private Parties Cannot Enforce The Federal Structure, David M. Palmer
Untangling Tenth Amendment Standing: Why Private Parties Cannot Enforce The Federal Structure, David M. Palmer
UC Law Constitutional Quarterly
In the last thirty years, the Tenth Amendment has experienced a resurgence as an independent check on the powers of the federal government. This newfound interest in the meaning and power of the Tenth Amendment has inevitably led to the question: Who may bring a Tenth Amendment claim? As the Tenth Amendment concerns the relationship between states and the federal government, states, not private parties, have traditionally acted as plaintiffs in suits against federal government incursion. However, the Seventh and Eleventh Circuit Courts of Appeals have, in a series of cases beginning twenty-five years ago, expressly permitted private parties to …

An Empirical Examination Of The Factors Affecting The Internationalization Of Professional Service Smes: The Case Of India, Lori Ann Petrill Radulovich
An Empirical Examination Of The Factors Affecting The Internationalization Of Professional Service Smes: The Case Of India, Lori Ann Petrill Radulovich
ETD Archive
This dissertation examines the factors contributing to the internationalization and performance of professional service small and medium-sized enterprises (SMEs) in emerging markets. Specifically, this research documents the relationships among a professional service SME's entrepreneurial orientation, human capital, the degree of internationalization, service innovation, and financial performance. Entrepreneurship literature has recently been extended to the international environment, confirming a positive influence on firm internationalization. Research which examines human capital is limited, yet has potential to contribute to service research. Separately, innovation has been examined from several research disciplines, yet has not been integrated in a model with an entrepreneurial orientation, firm …

Haiti Is Black! Racial Essentialism And United States Involvement In The 2004 Removal Of President Aristide, Jordan E. Dollar
St. Thomas Law Review
Through this paper I seek to interrogate the United States' policy toward Haiti as one based on racial essentialism. This paper will track the historical evolution of racial essentialism towards Haiti by the United States and the culmination of this essentialism through the removal of populist president Jean-Bertrand Aristide. I will show the common theme in U.S. policy towards Haiti, beginning with the successful slave rebellion in 1804, and ending with the 2004 removal of Aristide; the suppression of popular movements in Haiti based on racial essentialism. I also will attempt to provide an analysis of key actions taken by …

New Trends In Procedural Law: New Technologies And The Civil Litigation Process, Janet Walker, Garry D. Watson
New Trends In Procedural Law: New Technologies And The Civil Litigation Process, Janet Walker, Garry D. Watson
UC Law SF International Law Review
This report for the International Association of Procedural Law examines the impact of new technologies on the litigation process in six countries: The United States, Australia, Israel, Singapore, England and Wales, and Canada. Drawing on national reports from each of these countries, it considers: how new technologies are re-shaping the ways that we record and store information in the litigation process; the ways that the participants in the process communicate with one another; and the ways in which the case record or file is developed. It also considers whether new technologies are making the litigation process more efficient, more accessible …

Adr And Litigation Involving Social Problems, Steven Banks
Fordham Urban Law Journal
This Article addresses remarks of the Corporation Counsel of the City of New York, Michael Cardozo, regarding the use of ADR in legal disputes involving municipal government. It also highlights the special responsibilities of class counsel in the ADR context in class action litigation on behalf of vulnerable families and individuals. Specifically, the Article addresses ADR resolutions in Sheppard v. Phoenix, No. 91 Civ. 4148(RPP), 1998 WL 397846 (S.D.N.Y. July 16, 1998), Marisol v. Giuliani, 185 F.R.D. 152 (S.D.N.Y. 1992), and McCain v. Dinkins, 84 N.Y.2d 216 (1994). The Article concludes with a discussion of ADR in the context of …
The Attorney-Client Privilege Protection Act: The Prospect Of Congressional Intervention Into The Department Of Justice's Corporate Charging Policy, Andrew Gilman
Fordham Urban Law Journal
This Note analyzes the Privilege Protection Act, focusing on how it might change corporate white-collar prosecutions. Part I of this Note explores the mechanics of the corporate privilege, the development of the DOJ's waiver policy, and the structure of the Privilege Protection Act. Part II addresses the conflicting views on whether the Privilege Protection Act will bolster corporate attorney-client privilege, provide for the effective and efficient prosecution of white-collar crime, and promote ethical prosecutorial practices. Finally, Part III argues that the Privilege Protection Act is a misguided attempt to correct a greater systemic problem with the corporate attorney-client privilege and …

Ignoring The Golden Principle Of Charter Interpretation?, David M. Tanovich
Ignoring The Golden Principle Of Charter Interpretation?, David M. Tanovich
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
One consistent and disturbing trend since the birth of the Charter in 1982 is that race has been and continues to be, with a few notable exceptions, erased from the factual narratives presented to the Supreme Court of Canada and from the constitutional legal rules established by the Court in criminal procedure cases. Understanding the etiology of this erasing is not easy. In earlier pieces, the author has explored the role of trial and appellate lawyers. This paper focuses on principles of judicial review and the failure of the Supreme Court to consistently consider the impact of the constitutional rules …
Conflict Resolution In The Aftermath Of The World Trade Center Attacks: A Family Mediation Program, Alan E. Gross
Conflict Resolution In The Aftermath Of The World Trade Center Attacks: A Family Mediation Program, Alan E. Gross
Cardozo Journal of Conflict Resolution
It is not unusual for a disaster or crisis to give rise to increasing tensions, interpersonal disputes and general conflict; however, even after an unexpected disaster of the magnitude of the 9/11 attacks, mobilizing conflict resolution services was not a priority for conflict professionals. In the wake of 9/11, mediators, arbitrators and other conflict resolvers were primarily concerned, like their fellow citizens, with their own safety and the safety of their families. When the fear of harm from additional attacks eventually subsided, many who had not been directly affected turned their attention to assisting those less fortunate who had lost …
Deaning For Whom? Means And Ends In Legal Education, Hon. Kristin Booth Glen
Deaning For Whom? Means And Ends In Legal Education, Hon. Kristin Booth Glen
Seattle University Law Review
I was an accidental dean. Law school deanship, or any kind of administration, was something that had never occurred to me. But after almost thirty happy and rewarding years as a constitutional litigator, state trial and appellate judge, and frequent law school professor, my dear friend, W. Haywood Burns, asked me to apply for the deanship at City University of New York School of Law (CUNY). Any request from Haywood was a good enough reason for complying. When, to my surprise, I was selected, I had to confront the more profound question of why I should become a law school …

Domestic Violence And The Workplace: The Explosion Of State Legislation And The Need For A Comprehensive Strategy, Deborah A. Widiss
Domestic Violence And The Workplace: The Explosion Of State Legislation And The Need For A Comprehensive Strategy, Deborah A. Widiss
Articles by Maurer Faculty
In recent years, domestic violence legislation has migrated out of its traditional locus in family law and criminal law to include a rapidly growing body of employment law. The new laws respond to a relatively simple problem: Economic security is one of the most important factors in whether a victim of domestic violence will be able to separate from an abusive partner, but domestic violence often interferes with victims' ability to maintain jobs, thus causing job loss that further traps victims in abusive relationships. By providing supports to victims and empowering employers to take direct legal action against perpetrators of …
