Notes From Tsinghua: Law And Legal Ethics In Contemporary China, Eli Wald Apr 2008

Notes From Tsinghua: Law And Legal Ethics In Contemporary China, Eli Wald

Connecticut Journal of International Law

This article contributes to the expanding body of literature studying Chinese law and the Chinese legal profession by exploring Chinese legal ethics from the unique perspective of a legal ethics professor in China. Based on the vast differences between Chinese and American law in general, and between Chinese and American legal ethics in particular, one may expect to find that Chinese law students differ from American law students in significant, ideological and explicit ways. This article argues, however, that differences between Chinese and American law students emerge in subtle and implicit details: methods of reasoning and arguing; habits of learning …

Presidential Powers and Functional Equivalence The comparative methodology embraced by Jenny Martinez, the first speaker on this panel, is functionalism - a traditional tool for comparative inquiries.' Functionalism starts from the pragmatic assumption that societies sharing similar values will perform identical tasks even if by means of different rules. Functionalism posits the possibility of comparing the relative success of such rules, and hence borrowing useful insights from analogous foreign experiences.2 Accordingly, Professor Martinez has identified functional common ground in various legal systems, analyzed the scope and substance of presidential powers in several European States, and skillfully compared the status of …

Is It Wrong To Sue For Rape?, Tom Lininger Apr 2008

Is It Wrong To Sue For Rape?, Tom Lininger

Duke Law Journal

The title of this Article poses a rhetorical question. Of course it is not improper to site a rapist. The act of rape qualifies as a tort in all fifty states. Rape causes egregious injuries, both physical and psychological. The Supreme Court regards rape as the ultimate violation of personal autonomy. Other than homicide, no act is more plainly tortious. Yet the criminal justice system is surprisingly hostile to civil suits by rape survivors. Judges in criminal cases virtually always allow impeachment of accusers with evidence of civil suits against the alleged assailants or third parties. This Article surveys every …

The plaintiffs in this case met their burden of demonstrating the irrationality of Iowa’s statutory exclusion of same-sex couples from marriage. They did this, in part, by presenting social science research regarding the irrelevance of sexual orientation to parental ability and the psychological and social well-being of children raised by same-sex parents. In addition to arguing that the marriage exclusion is irrational, the plaintiffs also alleged that the exclusion should be subject to heightened scrutiny because it violates the fundamental right to marry and discriminates on the bases of gender and sexual orientation. Amici agree that the exclusion of same-sex …

Legal Ethics, Pain, And Suffering, N. Gregory Smith Mar 2008

Legal Ethics, Pain, And Suffering, N. Gregory Smith

Annual Institute on Mineral Law

The lessons that come to us from the application of legal ethics rules can be instrucive, but they often involve a considerable measure of pain and suffering. If presentations like this have any value, perhaps that value could be found in change. The hope would be that, after some exposure to the stories and other matters included in the presentation, a lawyer might thereafter do something that is more consistent with the standards of the profession than he or she might otherwise have done.

Forecasting Expeditionary Training For Company Grade Logistics Readiness Officers: A Delphi Study, Phillip Kirk Larson Mar 2008

Forecasting Expeditionary Training For Company Grade Logistics Readiness Officers: A Delphi Study, Phillip Kirk Larson

Theses and Dissertations

Since the development of the Expeditionary Airman concept and the start of combat operations in the Global War on Terrorism, the Logistics Readiness Officer’s (LRO) duty environment has expanded beyond traditional garrison-based duties. This expansion can arguably incorporate current topics of joint operations, irregular warfare, and cultural intelligence. The intent of this study is to determine what training, if any, future company grade LROs will require on these three topics. The research uses Delphi methodology, utilizing an expert panel of twelve LROs with experience in joint operations within a deployed environment, and interactions with foreign nationals. The study applies two …

Overseas Legal Outsourcing And The American Legal Profession: Friend Or “Flattener”?, Carlo D'Angelo Mar 2008

Overseas Legal Outsourcing And The American Legal Profession: Friend Or “Flattener”?, Carlo D'Angelo

Texas Wesleyan Law Review

In his bestseller The World Is Flat author Thomas Friedman commented on how the worldwide proliferation of high-speed broadband technology has "flattened" the global marketplace and enabled U.S. corporations to efficiently and cost-effectively offshore many traditionally domestic white-collar services. Friedman observed that a convergence of technological advances has leveled the global economic playing field and in turn created thousands of well-paying jobs for workers in English-speaking countries such as India and the Philippines. As a consequence of this flattening phenomenon, American white-collar jobs are moving overseas at record numbers to countries where they can be performed at a fraction of …
