Race, Identity, And Professional Responsibility: Why Legal Services Organizations Need African American Staff Attorneys, Shani M. King

UF Law Faculty Publications

Given the fundamental importance of the attorney-client relationship in securing favorable outcomes for clients, legal services organizations that serve large populations of African Americans should employ African American staff attorneys because: (1) African American lawyers and clients share a group identity that makes it more likely that a black attorney will be able to gain a black client's trust; (2) black attorneys communicate more effectively with black clients; and (3) the perception of a judicial system that is unfair and racist is likely to encourage black clients to trust black lawyers more than white lawyers, who are more likely to …

Ethical Duties To Prospective Clients Who Send Unsolicited Emails, Nicole Lindquist Oct 2008

Ethical Duties To Prospective Clients Who Send Unsolicited Emails, Nicole Lindquist

Washington Journal of Law, Technology & Arts

Recent Iowa and Massachusetts ethics opinions declared that an attorney may owe ethical obligations to prospective clients who send the attorney just a single email regarding legal assistance. These ethics opinions are part of a trend whereby jurisdictions are extending the duty of confidentiality to prospective clients who send unsolicited emails to attorneys, when those persons reasonably believe that the conveyed information will be held in confidence. These opinions highlight the importance for all attorneys to disclaim duties of confidentiality and representation, particularly when advertising online. This article discusses ethical opinions regarding prospective clients who send unsolicited emails and concludes …

Law Commissions And Access To Justice: What Justice Should We Be Talking About?, Patricia Hughes Oct 2008

Law Commissions And Access To Justice: What Justice Should We Be Talking About?, Patricia Hughes

Osgoode Hall Law Journal

In addition to their explicit mandates, law reform commissions have a generic mandate to make recommendations that are designed to increase access to justice. Moreover, contemporary commissions ought to interpret the concept of access to justice broadly. Even though they undertake topics of 'lawyers' law,' or at times limit their focus to the narrower legal system, commissions should also consider how law can be employed to realize economic or social justice. In order to make pragmatic recommendations to increase access to justice, commissions must study the non-legal realm and incorporate into their work the insights of other disciplines and the …

Peer Review In Canada: Results From A Promising Experiment, Frederick Zemans, James Stribopoulos Oct 2008

Peer Review In Canada: Results From A Promising Experiment, Frederick Zemans, James Stribopoulos

Osgoode Hall Law Journal

The end point in the access to justice debate often focuses on expanding the availability of legal services for the poor. This article argues that true access to justice requires greater focus on the quality of legal services provided. It tells the story of the introduction of peer review in Canada as a quality assurance tool for evaluating the legal work of a group of criminal lawyers. The article chronicles the various obstacles encountered in making even a very limited form of peer review a reality in Canada, where historically there has been skepticism about the peer review process in …

Why The Filed Rate Doctrine Should Not Imply Blanket Judicial Deference To Regulatory Agencies, Jim Rossi Oct 2008

Why The Filed Rate Doctrine Should Not Imply Blanket Judicial Deference To Regulatory Agencies, Jim Rossi

Vanderbilt Law School Faculty Publications

The filed rate doctrine is a venerable doctrine of public utility regulation. Federal courts applying the doctrine frequently defer to the regulatory agency and refuse to consider the merits of alleged violations of antitrust, tort or contract claims where resolution would require a departure from a filed rate. For over a century, the filed rate doctrine has served many important purposes. However, with increased attention to market-based approaches to electric power, natural gas and telecommunications regulation, there is reason to question both the doctrine's continued applicability and usefulness. This short essay argues that, as regulators implement competitive markets in utility …

South Valley Incorporation Feasibility Study (Revised), Lee A. Reynis, Molly J. Bleecker Oct 2008

South Valley Incorporation Feasibility Study (Revised), Lee A. Reynis, Molly J. Bleecker

BBER Publications

Determining the financial feasibility of a South Valley municipality requires developing estimates of the revenues that might be raised, and this in turn requires a careful reading of NM statutes to see what the city may be entitled to and what authority it has under state law, as well as estimating the tax bases and the levels of activity against which fees and charges for services will be assessed. It is also critical to determine how much it will cost to provide various municipal services to the South Valley. This study focuses on the costs and revenues associated with operating …

The Case Against Tax Incentives For Organ Transfers, Lisa Milot Oct 2008

The Case Against Tax Incentives For Organ Transfers, Lisa Milot

Scholarly Works

Each year some 6,700 Americans die while awaiting an organ transplant. On its face, this fact seems almost inconsequential, representing less than 3% of American deaths annually. However, for the nearly 100,000 patients on the transplant wait list (and their families), nothing could be more consequential. What is more, the demand for transplantable organs is sure to rise as (1) more diseases become subject to prevention or cure, making organ failure the first sign of medical problems; (2) the success rate for transplants increases, leading to wider use; and (3) barriers to inclusion on the wait list are removed.

A Survey Of Recent Illinois Ethics Law: Professionalism In Practice, Kate T. Hlava Oct 2008

A Survey Of Recent Illinois Ethics Law: Professionalism In Practice, Kate T. Hlava

Southern Illinois University Law Journal

Professionalism should be a part of every Illinois lawyer’s daily practice. It is not enough to memorize the Rules of Professional Responsibility. Creating a legal practice that reflects one’s ethical duties and lives up the high degree of professionalism required by an attorney is a daily task and one that cannot be accomplished without effort. The rules can be unclear and ethical dilemmas can be ambiguous.

However, in many situations there are no excuses; the rules and case law make clear what is required. There are rules that every attorney should know and ethical duties that should always be implemented. …

Should Parties’ Disclosure Requirements For Arbitrators Be Honored By Courts: Positive Software Solutions, Inc. V. New Century Mortgage Corporation, Leonard E. Gross, Howard L. Wieder Oct 2008

Should Parties’ Disclosure Requirements For Arbitrators Be Honored By Courts: Positive Software Solutions, Inc. V. New Century Mortgage Corporation, Leonard E. Gross, Howard L. Wieder

Southern Illinois University Law Journal

Courts should refuse to confirm arbitrators’ awards when arbitrators fail to comply with the terms of an arbitration agreement requiring them to disclose significant information about themselves. When Congress enacted the FAA, it made it clear that it wanted contracts to arbitrate enforced according to the parties’ agreement. The parties’ agreement includes the disclosure requirements to which the parties have negotiated themselves or to which they have agreed by electing to follow the procedures of an arbitration association such as the AAA. Parties to arbitration lack the protection that court litigants have from potentially biased judges. Consequently, there is a …
