"Deference" Versus "Security Of Tenure": Eviction Of Residents Of Subsidized Housing Co-Operatives At The Superior Court Of Justice For Ontario, 1992-2009, Jeff Schlemmer Jan 2009

"Deference" Versus "Security Of Tenure": Eviction Of Residents Of Subsidized Housing Co-Operatives At The Superior Court Of Justice For Ontario, 1992-2009, Jeff Schlemmer

Journal of Law and Social Policy

Explores the different levels of protection against arbitrary eviction for Ontario residents of subsidized government housing and those living in a housing cooperative or another type of subsidized housing. The difference comes from the evolution of the case law over the last decade, where all evictions from residential tenancies, except housing cooperatives, have been removed from the jurisdiction of courts. This is based on the theory that cooperatives function as "democracies" and residents who accept subsidized housing in a housing cooperative, voluntarily lose the legislative rights that protects all other tenants. This area of law has become unsustainable. The court …

An Application Of Input-Output Analysis To Pollution, Paul Burkander Jan 2009

An Application Of Input-Output Analysis To Pollution, Paul Burkander

Senior Honors Theses and Projects

Using data on pollution emissions from over 20,000 facilities in the United States, we find most pollution is released by a small number of firms, and that there is no correlation between the amount of pollution released and socioeconomic indicators such as income. We apply Leontief’s method of input output analysis to determine pollution generated both by demand for final goods and inter-sector demand for intermediary goods. We find the sector that generated the most pollution in 2002, both in production of final goods and in use of intermediary goods, was primary nonferrous metal products. The analysis of several sectors, …

Competition And Tax Evasion : A Cross Country Study, Yiqun Wang Jan 2009

Competition And Tax Evasion : A Cross Country Study, Yiqun Wang

Lingnan Theses

This paper investigates the determinants of informality (tax evasion in particular) utilizing rich cross-country data of firm-level survey from the World Bank, and hypothesizing that competition is a significant factor determining tax evasion behaviors. Competition pressure is a key stimulus to induce questionable manipulations of tax reporting behaviors. However its effect works at a decreasing speed. It is also hypothesized that business obstacles facing firms such as tax administration and corruption play significant roles in explaining tax evasion. This paper further hypothesizes that firm characteristics such as size, age, ownership are important evasion determinants. Empirical results are found supporting these …

Choice Of Law For Professional Responsibility Issues In Aggregate Litigation, Nancy J. Moore Jan 2009

Choice Of Law For Professional Responsibility Issues In Aggregate Litigation, Nancy J. Moore

Faculty Scholarship

As the rest of the papers in this symposium issue demonstrate, aggregate litigationi raises difficult, often intractable choice-of-law issues for judges, as well as for litigants and their lawyers. Typically, judges must choose among rules governing not only substantive law, but also statutes of limitations, allocation of damages, and punitive damages. 2 What is less well-recognized is that aggregate litigation may also present difficult choice-of-law issues regarding the ethical conduct of the lawyers involved in these cases. So far, these issues have barely surfaced, not because professional responsibility questions have not been raised with respect to aggregate litigation, but rather …

Privatizing Trademarks, Irina D. Manta Jan 2009

Privatizing Trademarks, Irina D. Manta

Hofstra Law Faculty Scholarship

While trademarks promote a competitive and productive marketplace, the Patent and Trademark Office runs the current system of trademark registration as a monopoly of questionable productivity. Delays in obtaining trademark registrations result in a risk to applicants of investing substantial sums into ultimately unregisterable marks. This Article proposes a system of privatized trademark registration as a solution, with features including: multiple entities serving as registrars; an optional expedited process; and quality-control mechanisms. To explore the viability of trademark privatization, the Article relies on the theoretical privatization literature and practical examples in which government exclusivity has been removed from intellectual-property (and …

A Tale Of Two Debtors: Bankruptcy Disparities By Race, Rory Van Loo Jan 2009

A Tale Of Two Debtors: Bankruptcy Disparities By Race, Rory Van Loo

Faculty Scholarship

This article offers the first quantitative evidence on race and bankruptcy. Minority debtors fare worse overall in bankruptcy — blacks are 40% and Hispanics 43% less likely than whites to receive a discharge in Chapter 13 after controlling for variables such as education, income, and employment. While the data do not allow for causal inference, Chapter 13 trustees were twice as likely to have made a motion to dismiss even against black debtors who ultimately completed their multi-year bankruptcy plans than against similar white debtors. The paper also indicates that a lack of attorney representation by minority debtors may make …

Reconciling Southern Identity: Revising The Public Memory Of Lucius Quintus Cincinnatus Lamar, James Matthew Hopper Jan 2009

Reconciling Southern Identity: Revising The Public Memory Of Lucius Quintus Cincinnatus Lamar, James Matthew Hopper

Honors Theses

This project explores the accepted historical narrative of white male Southern identity based upon L.Q.C. Lamar's public memory. My objective is to reinterpret some long held beliefs about Lamar s life, career, and politics, while analyzing the effect of those interpretations in fostering and challenging white male Southern identity. I found that Lamar was never fully reconstructed from his Confederate views and many of his pre-war principles made him popular and garnered loyalty among his constituency. In reinventing himself as a reconstructed politician, he used the death of Charles Sumner to offer a reconciliatory version of Southern masculinity in an …

Chapter 13 Plan Must Pay Adequate Protection Payments Prior To Attorney’S Fees, Brian Lacoff Jan 2009

Chapter 13 Plan Must Pay Adequate Protection Payments Prior To Attorney’S Fees, Brian Lacoff

Bankruptcy Research Library

(Excerpt)

In In re Dispirito, a decision of importance to Chapter 13 debtors’ attorneys, the Bankruptcy Court for the District of New Jersey ruled that an undersecured creditor was entitled not only to adequate protection payments, but that the section 507(b), 11 U.S.C. § 507(b) (2006), “super-priority” status of the inadequate adequate protection provided during the case meant that the Chapter 13 plan had to pay those amounts before paying any of the debtor’s attorneys fees. 371 B.R. 695, 695 (Bankr. D.N.J. 2007). This article will compare how the Dispirito court’s ruling compares to other bankruptcy court’s rulings. It …

Can Software Be A Bankruptcy Petition Preparer?, Thomas Szaniawski

Bankruptcy Research Library

(Excerpt)

Recently, in Reynoso v. United States (In re Reynoso) — a case of first impression for the Ninth Circuit that addressed the intersection of cyberspace and bankruptcy — the court held that a provider of web-based bankruptcy software was a bankruptcy petition preparer (“BPP”) under 11 U.S.C. section 110 and that under California law, the features and functionality of the software went beyond mere typesetting and constituted the unauthorized practice of law. Reynoso v. United States (In re Reynoso), 477 F.3d 1117 (9th Cir. 2007). In re Reynoso is significant because prior to this …

Leveraging Grantmaking: Understanding The Dynamics Of Complex Social Systems, David Peter Stroh Jan 2009

Leveraging Grantmaking: Understanding The Dynamics Of Complex Social Systems, David Peter Stroh

The Foundation Review

· The nonobvious interrelationships among elements in a complex system often thwart people’s best intentions to sustainably improve system performance.

· The complex, nonlinear problems that most foundations address can be solved most effectively by thinking systemically instead of linearly about these problems.

· Systems thinking offers a range of analytic tools to improve our capacity to think systemically, including ways to distinguish problem symptoms from root causes, reinforcing and balancing feedback, system archetypes, mental models, and system purpose and goals.

· Applying these tools enables us to target highleverage interventions that can lead to sustainable, system-wide improvement.

· These …
