Exploring Sensory Ethnography In Open Inquiry: What Does River Want Me To Know?, Marianne (Ria) Jago
Talking Heads Seminar Series
This presentation features a creative and narrative research approach to research relationality and wisdom-seeking with place. A multi-modal practice-based approach will be outlined as a pathway that can be developed by people of any background. Through transdisciplinary methods in sensory ethnography and creative geography, I notice my sensed relatedness, or entanglement, with the cosmological Being of River. Deeply influenced by Indigenous listening methods I understand sensory engagement with River as ecologically essential research, and describe a practice-based pathway to learn from, and to "think with” water.

Seeing Race & Sexuality: Child Welfare & Forced Labor, Annie Isabel Fukushima, Jens Nilson, Kaden Richards

This Article examines how child welfare responds to children who are forced to labor through a case study of California. We use an intersectional framework to argue that a conceptualization of current sociolegal responses to human trafficking cannot be delinked from racialized and sexualized forms of governmentality. In an era where cyber risks are escalating at an unprecedented rate, understanding andmitigating data breach risks has become critical for organizations. This paper proposes a novel frequency-severity model to assess hacking data breach risks at the individual company level, focusing on the Finance, Healthcare, and Technology sectors. Our anal- ysis reveals significant heterogeneity in breach frequencies and severities across sectors and individual companies within those sectors. To model breach frequency, we employ a Zero-Inflated Poisson (ZI-Poisson) model with random effects, capturing unobserved heterogeneity and within-firm correlations over time. Breach severity is modeled using a log-normal regression, given the symmetrical …

Legalization through Apostille should simplify the legalization process, doing activities abroad and improving Indonesian economic quality. Legalization is a series of procedures performed to authenticate a signature, stamp or seal which aims to provide a valid status for a public document. The legalization process in Indonesia consists of two steps, namely legalization at the Ministry of Law and Human Rights after which legalization is carried out at the Ministry of Foreign Affairs. This article recommends that law schools offer mediation representation clinics and externship courses to assist self-represented litigants in cases with legally-represented parties. These courses would prepare law students to practice in the modern world. Students would get experience working with real clients, conduct interviews, help clients assess their goals and interests, analyze claims, perform legal research, prepare documents, coordinate with mediators, and negotiate with counterpart attorneys.
The courses would address the needs of multiple stakeholders including self-represented litigants, law students, law schools, courts, attorneys, mediators, and society in general. Law schools would develop these courses in collaboration with many potential …

Access to justice literature has paid little attention to the role of gender identity and gender expression as barriers to justice that must be addressed. As a marginalized and disenfranchised population, trans and gender nonconforming people experience specific barriers to justice that cisgender people typically do not. This paper seeks to address the gap in access to justice literature by attending to specific barriers to justice that trans people face in Canada. These barriers include socioeconomic inequalities; exclusion from the legal system; sex/gender certification and bigenderism within the legal system; and transphobia and cissexism within the legal system. This Article studies how federal agencies use and might better use different types of alternative dispute resolution (ADR)-including mediation, conciliation, facilitation, factfinding, minitrials, arbitration, and the use of ombuds-in the programs Congress has entrusted them to administer. The use of ADR by the executive branch of the federal government to resolve disputes with or among private actors has deep historical roots. ADR related to managerial agency matters such as employment or procurement is well-established across the government and performed under a uniform set of laws. Labor heterogeneity limits firm flexibility, subsequently affecting a firm's capacity to adapt and grow within a dynamic economic landscape and to formulate effective financial strategies. Firms with high labor heterogeneity tend to incur significant labor adjustment costs, making it costly and challenging to adjust their workforce in response to economic changes. While retaining skilled labor can be advantageous in preserving valuable human capital, it also incurs considerable economic costs that significantly influence firms' financial strategy and decision-making processes. This dissertation comprises two essays that explore the implications of firms' dependence on skilled labor.

Small minority group organisations rarely collaborate with other nonprofits owing to a lack of expertise and resources. Third-party facilitators can help these groups navigate the process of collaboration. However, the literature has largely ignored their role in the process. We address this gap by studying the challenges third-party facilitators face in the collaboration process and best practices they can apply using the Community Collaboration Initiative (CCI), a unique third-party-facilitated collaboration process working with Muslim American nonprofits.

This qualitative descriptive case study delves into the effectiveness of academic support programs (ASPs) for students at Historically Black Colleges and Universities (HBCU) law schools, focusing on enhancing academic performance and passing the bar exam. The underrepresentation of minority lawyers in the United States, which is attributed partly to standardized test disparities, underscores the need for tailored support mechanisms. Drawing from social cognitive theory (SCT), the study investigates how ASPs impact academic success, informed by participant interviews and thematic analysis.
Key findings reveal four prominent themes. Firstly, effective features of ASPs for promoting academic performance include personalized guidance from academic …

Fines and fees are commonplace in the United States criminal justice system as a form of punishment for both minor and severe offenses. While substantial research has demonstrated that these financial consequences disproportionately affect certain communities, studies that depict a narrative of these impacts are vastly underrepresented in the field. This project expands upon past literature by delving into the effects of these practices on individuals and their families. The current study outlines the findings from a content analysis of twelve semi-structured interviews on the impacts of fines and fees in Oregon. The findings create a deeper understanding of how …

The purpose of this study was to analyze the websites of Texas public four-year, private four-year, and two-year institutions of higher education (IHEs) to determine the extent to which website content corresponds with the recommendations of undocumented scholars and supporters. The study aimed to investigate whether the website content differs based on various institutional-level characteristics and to identify any relationships between contextual-level factors that may affect the information presented on websites. Emerging forms of automation using artificial intelligence (AI) and distributed ledgers are raising transformative questions for the practice of law. Deal lawyers are well-situated to understand the convergence of various modes of automation and their implications for their clients and the markets they facilitate. This Article contends that digesting threats and leveraging opportunities associated with new technologies calls for granular, context-specific assessment. It presents one instance of automation in one predominant market—the market for asset-backed securities (ABS)—by comparing securitization to a blockchain-based analog, tokenization.
