Is Current “Repeat Player” Theory Much Ado Over Much Less—An Evidence-Based Overhaul, Edward P. Mcdermott
Is Current “Repeat Player” Theory Much Ado Over Much Less—An Evidence-Based Overhaul, Edward P. Mcdermott
Journal of Dispute Resolution
This empirical study suggests that the existence and impact of the “repeat player effect” (“effect”) may be exaggerated. Legal and conflict resolution theorists suggest that the existence of repeat players is a process flaw. They opine that first time players (“one-shotters”) are at a disadvantage to repeat players. Stulberg extended this process flaw theory to mediation.
Arbitration: An Unstoppable Wave?, Matthew Boston
Arbitration: An Unstoppable Wave?, Matthew Boston
Journal of Dispute Resolution
In recent years, large companies have started favoring the use of compelled arbitration agreements. Arbitration is one of many mechanisms encompassed under alternative dispute resolution (“ADR”), a broad framework by which parties may seek alternatives to litigation. As a whole, ADR arose with the intent of avoiding the high costs of litigation. Arbitration became the “principal form of ADR” for a period of time, with cost savings in mind.
Cooperative Creativity: The Adr Foundations Of Modern Dance Copyright, Audrey O'Brien
Cooperative Creativity: The Adr Foundations Of Modern Dance Copyright, Audrey O'Brien
Journal of Dispute Resolution
In the mid-twentieth century, the landscape of copyright was quickly changing, facing new technologies as well as cultural changes that would ultimately test the limits of the 1909 Copyright Act. Choreographic copyright protection changed immensely throughout the last half of the twentieth century, and one ballet company at the forefront of the changing tides of copyright law was the New York City Ballet (“NYCB”), led by choreographer George Balanchine. By the time Balanchine passed, the legacy of both his company, NYCB, and his body of copyrighted work was immense enough to determinatively color the way choreographic copyrights are handled under …
Extracting From The Extracurriculum: Using Extracurricular Composition Practices To Bring Purpose, Voice, And Engagement Back To The English Classroom, Grace N. Ellis
Department of English: Dissertations, Theses, and Student Research
This thesis explores how principles and practices from extracurricular literacy spaces and the extracurriculum as a whole can inform and revitalize the secondary English classroom. In response to growing student disengagement, apathy, and disconnection, particularly within highly standardized and product-focused classrooms, this argument investigates how programs such as the Nebraska Writers Collective’s All Writes Reserved program and the University of Nebraska–Lincoln’s Young Writer Camp model authentic engagement, identity exploration and development, and rhetorical agency through creative, student-centered writing practices. Drawing from composition theory, educational research, and experiential data from Nebraska-based writing initiatives, the thesis argues that incorporating choice, safe-risk taking, …
The Effect Of Individual Variation On Epidemiological Dynamics: From Super-Spreaders To Landscapes Of Risk, Alexis Shannon Beagle
The Effect Of Individual Variation On Epidemiological Dynamics: From Super-Spreaders To Landscapes Of Risk, Alexis Shannon Beagle
Dissertations and Doctoral Documents, University of Nebraska-Lincoln, 2023–
Individuals that make up a population always display some level of variation between members. At the smallest scale, individuals always maintain genetic variation, but variation continues to arise at other scales of biological organization from physiological or immunological variation within individuals to variation in behavior between individuals that can be both genetically and environmentally mediated. The role of individual variation is particularly important in the context of infectious diseases because there is strong evidence that infections are highly heterogenous, indicating that patterns of individual variation drive a significant portion of the epidemiological patterns we observe. Individual variation leads to heterogeneity …

Assessing The Risk Of Adverse Obstetric Outcomes And Determinants Among Mothers With Gestational Diabetes Mellitus At Aga Khan University Hospital, Nairobi, Justus Wambugu
Master of Medicine in Obstetrics and Gynecology
Background: Gestational diabetes (GDM) is recognized as a major concern in obstetric care. It is associated with adverse obstetric outcomes including the risk of cesarean delivery, pregnancy-induced hypertension, obstetric hemorrhage, induction of labour, large for gestational age fetus, preterm delivery, and admission to neonatal critical care units. However, there is limited evidence on the magnitude of risk conferred by GDM for various adverse pregnancy outcomes
Objectives: The primary objective of our study was to assess the relative risk for adverse obstetric outcomes associated with GDM in women diagnosed using the WHO-recommended 75g 2-hour oral glucose tolerance test (OGTT), compared to …
Urbanization And Earthquake Resilience In The Kathmandu Valley, Alex Nation
Urbanization And Earthquake Resilience In The Kathmandu Valley, Alex Nation
Nepal: Geoscience in the Himalaya
The Kathmandu Valley is the fastest growing city in South Asia and is developing in a haphazard manner, subsequently creating an unnecessary earthquake risk. Few papers have been published regarding the development of Kathmandu and its surroundings as a whole and relating it to earthquakes. This study conducted visits to some cities in the valley and analyzed the infrastructure, architecture and engineering, as well as city layout. It was discovered that zoning is completely absent in the region and planning attempts are unable to keep up with the rate of expansion. Further awareness, enforcement of codes, and zoning is needed …

Strategies For Thoughtful Dissemination Of Climate Change Knowledge: A Blueprint For Scientists In The Heart Of The Empire, Christopher Cronk
Nepal: Geoscience in the Himalaya
This interdisciplinary research investigates how climate change education, Indigenous knowledge systems, journalism, and anthropology intersect in shaping environmental awareness and action, focusing primarily on Nepal and drawing parallels with Indigenous Peoples of Turtle Island (North America). Stationed in Kathmandu, I conducted interviews with climate educators, journalists, anthropologists, and activists to explore how scientific and local knowledge are communicated and acted upon. Findings highlight the strong awareness of climate change in Nepal, the systemic barriers to effective mitigation and adaptation, and the potential of community-led initiatives like the Community Forest Program. Anthropological insights proved crucial in linking human experience to environmental …
A Preliminary Classification And Quantification Of The Microplastics Within Remote Glacial Runoff In The Upper Manang Region Of Nepal, Caden Lipsky
Nepal: Geoscience in the Himalaya
Microplastics, defined as particles of plastic waste less than 5mm (US EPA), are becoming steadily more common throughout remote ecosystems and are damaging to human and environmental health. The level of microplastics found in water sources within remote regions has become increasingly concerning following growing influxes of tourists and residents each year. These particulates found in freshwater have historically only been found downstream of populated areas; however, more recent cases have demonstrated their appearance at higher elevations and lower population water sources. This study aims to develop a preliminary understanding of the amount and type of contamination that has occurred …
Beneath The Crap: Assessing Melt Potential Through Debris Thickness And Sub-Debris Ice Temperature On The Ponkar Glacier, Nepal, Delaney Hartgen
Beneath The Crap: Assessing Melt Potential Through Debris Thickness And Sub-Debris Ice Temperature On The Ponkar Glacier, Nepal, Delaney Hartgen
Nepal: Geoscience in the Himalaya
Understanding melt potential beneath debris-covered glaciers is critical to predicting future glacial mass loss in the Himalayas. This study investigates the relationship between debris thickness and sub-debris ice temperature on the Ponkar Glacier, Nepal, through a combination of field measurements and remote sensing analysis. In-situ data collected along a 200-meter transect revealed that thicker debris layers consistently corresponded with colder sub-debris ice temperatures, supporting the hypothesis that debris acts as a thermal insulator. Surface ice temperatures remained near 0 °C regardless of debris thickness. Remote sensing products, including NDVI, albedo, and Landsat thermal data, provided additional spatial context, although a …

Exploring Dna Metabarcoding To Understand Diet In Declining Columbian Sharp-Tailed Grouse (Tympanuchus Phasianellus), Alexandria J. Serbellon, Jack Knutson, Morgan Calahan, Julia Parker, Stephanie J. Galla
Idaho Conference on Undergraduate Research
The Columbian Sharp-tailed Grouse (Tympanuchus phasianellus; hereafter CSTG) formerly occupied shrub-steppe ecosystems across western North America but now inhabit less than five percent of their former range due to habitat loss and other anthropogenic factors. Despite their social and ecological significance, research on CTSG diet has been limited, with the last comprehensive study taking place over 20 years ago. Understanding dietary habits is crucial, as food availability directly impacts population dynamics, local adaptation, and overall fitness of this species. Through the application of plant DNA metabarcoding (i.e., p6 loop of trnL) from non-invasively collected fecal samples, this …

Idaho Conference on Undergraduate Research
Irrigated agricultural lands can provide important habitat and forage locations for wild birds. The costs and benefits of irrigated agricultural areas compared to wildlands remain unclear. Green vegetation attracts insects and small mammals, creating an abundant food source for predators. In addition, the use of chemicals on crops may reduce vectors of disease. American Kestrels (Falco sparverius) are a small species of falcon that make extensive use of both irrigated and non-irrigated landscapes. We examined nest site selection and Haemosporidian parasite loads in a partial migrant population of American Kestrels in irrigated and non-irrigated landscapes. If irrigated lands …

Network And Tree-Based Approaches To Data-Driven Modeling Of Complex Climate Systems, Adam M. Giammarese
Theses
The guiding thread throughout this thesis work is data-driven modeling of Earth's climate. We investigate a variety of settings within the field of complex climate systems, such as gridded, high-resolution reanalysis data, lower-resolution climate indices, and incomplete paleoclimate records with missing values. We begin with reanalysis data of high spatial and temporal resolution, and use climate network analysis to uncover hidden trends in the data in regards to the Amazon rainforest and its changing role in the global climate system. We introduce a novel formulation of k-nearest neighbors climate networks to study changing trends at a local level, and apply …

Research outputs 2022 to 2026
The advancement in the micro electro mechanical system, MEMS, had been utilized for several years before. This embarked on the compact and high density of power generation for tiny devices. This led to the development of a heat dissipating system for high-power-density devices. Hence, the work intends to simulate the fluid flow performance of interrupted minichannel heat sinks due to the redeveloping and interrupting of the boundary layer merging in previous work that augments the heat dissipation. The study is conducted through numerical work of laminar steady flow, by governing the Navier-Stokes and energy equation. Three interrupted minichannel heat sinks …
