Impact Of Therapeutic Design On Patients’ Satisfaction And Wellness In Healthcare Facilities., Dalia Moati

Architectural Engineering

In recent years, there has been a growing recognition of the signi3icance of designing healthcare environments that extend beyond functionality. These healing hospital environments are designed to promote patient satisfaction and well-being. However, despite increased awareness of their bene3its, the global adoption of healing-centred hospital designs remains limited. While the healthcare system has long focused on treating physical ailments, there is a growing recognition that to promote overall wellness, it must shift toward a more comprehensive approach to healing, addressing not only the body but also the emotional and psychological needs of patients. This paper aims to investigate the impact …

Reforma Alutsista Dan Sumber Daya Alam: Menjawab Tantangan Hukum Internasional Dan Perdamaian Dunia, Wildan Azkal Fikri, Rohadhatul Aisy

Jurnal Hukum & Pembangunan

This study departs from the paradox of the failure to achieve world peace despite the existence of an established international legal regime. It addresses three main objectives: (1) identifying the key factors that undermine world peace; (2) analyzing the failure factors of international law to realize global peace; and (3) formulating a responsive international legal architecture to future peace agendas. The study employs a critical descriptive method with a socio-legal (non-doctrinal) approach, drawing on the analytical frameworks of neorealism, great powers oligarchy, and Third World Approaches to International Law (TWAIL). The qualitative analysis is conducted by examining power relations, the …

Copyright is one form of legal protection for intellectual works, occupying an important position within the intellectual property law system. The Copyright Law explicitly grants exclusive rights to creators, encompassing both moral rights and economic rights. Economic rights, as stipulated in Article 9 paragraph (1), allow creators to obtain economic benefits from their works, ranging from publication, reproduction, distribution, performance, to communication to the public. This provision shows that creators hold a primary position as legal subjects entitled to protection, while also serving as central actors in the creative industry ecosystem. In practice, the mechanism for copyright protection requires implementing …

Remote Access Restrictions To Immigration-Related Court Records, Doris H. Zhang Jan 2026

Remote Access Restrictions To Immigration-Related Court Records, Doris H. Zhang

Fordham Law Review

Journalists today often report on newsworthy federal court cases by remotely accessing the court records online. However, thanks to Federal Rule of Civil Procedure 5.2(c), remote access is not available by default in immigration-related cases. To obtain any court records in immigration cases, journalists must go to the courthouse, hire someone to go on their behalf, or ask the court to exercise its discretion to lift the Rule 5.2(c) remote access restrictions. These alternatives are burdensome, hindering the ability of the press and the public to keep track of immigration cases in federal courts. Despite the burdens on the press …

Magang Atau Pekerja? Menggugat Status Abu-Abu Tenaga Paruh Waktu Mahasiswa Di Fakultas Hukum Ugm, Patricia Nerissa Krisna Putri, Markus Togar Wijaya

Jurnal Hukum & Pembangunan

This study highlights the controversy surrounding the change in nomenclature for student workers at Gadjah Mada University, particularly within the Faculty of Law. The status of these workers has shifted from 'part-time' to 'student intern'. This unilateral change has created a legal grey area that could lead to students being subjected to disguised employment practices. Using socio-legal research methods, this article examines the validity of the 'internship' status based on the elements of an employment relationship (work, orders and wages) within the labour law regime, analysing it using the theory of structural injustice. The research findings suggest that reclassifying part-time …

Omnibus Law Sebagai Strategi Mengatasi Disharmonisasi Peraturan Di Indonesia, Tuti Tri Hastuti S., Zainal Arifin Hoessein

Jurnal Hukum & Pembangunan

This article discusses the challenges in implementing the Omnibus Law (OL) both as a regulatory system and as a tool for harmonizing regulations within Indonesia’s legal positivist tradition and its complex, non-simple regulatory hierarchy, from the perspectives of legislative consolidation theory, regulatory coherence theory, and multilevel regulation theory. This study is based on the assumption that OL, within the framework of legal positivism (norm hierarchy system), faces problems in applying these three theories. The research employs normative juridical and comparative methods, analyzing national regulations and international research findings. The results indicate, first, that the positioning of OL, which does not …

Jurnal Hukum & Pembangunan

Maritime transportation plays a vital role in supporting trade, yet risks such as perils of the sea or ship accidents caused by unseaworthiness often lead to disputes, particularly when General Average is declared. This practice, recognized since Roman times, has evolved into a legal concept in marine insurance to distribute deliberate sacrifices made for the safety of the vessel and its cargo. This study aims to analyze the liability of carriers in General Average actions and to evaluate the concept as a fair mechanism for loss distribution. The research employs a normative juridical method with statutory, conceptual, and comparative approaches, …

Constraining Citizenship: Presidential Threshold In Indonesia’S Judicial Framework, Arfan Yanayir Akbar Sabillilah

Jurnal Hukum & Pembangunan

This research critically evaluates the constitutionality of Indonesia's Presidential Threshold as regulated by Article 222 of Law No. 7/2017, requiring political parties or coalitions to secure 20% of DPR seats or 25% of national valid votes for presidential nominations. The term “Presidential Threshold” follows Constitutional Court jurisprudence, distinguishing it from the election threshold in Article 6A(3) requiring 50%+1 votes to win the presidency and the parliamentary threshold in Article 414 requiring 4% of votes for legislative seat allocation. Through normative legal analysis of Constitutional Court decisions No. 51-52-59/PUU-VI/2008, 53/PUU-XV/2017, and 62/PUU-XXII/2024, this study examines 33 judicial reviews from 2017 to …

As an effort to concretize ethics, there is a process of formalizing ethics into a set of rules through a code of ethics. The code of ethics needs institutional enforcement instruments so that it can be effectively applied through ethical trials. Ethical courts, as institutions that adjudicate violations of the code of ethics, have the authority to issue decisions as a follow-up to cases of violations of the code of ethics that they handle. In carrying out its duties, ethical courts use ethical and moral analysis to assess the appropriateness of an action. This analytical approach differs from legal decisions …

Significant progress has been made in advancing priority actions to conserve manta and devil rays, yet implementation and enforcement of protective measures often fall short, leaving most mobulid populations at risk of overfishing. Drawing on a literature review, fisheries databases, agency reports, and expert interviews, we assess global trends in mobulid catch and mortality. We examine both targeted and incidental catch, in small (<15 m, ‘SV’) and large (>15 m, ‘LV’) vessel fisheries to identify hotspots with the highest risk of fisheries-related mortality and population decline. We estimate global fisheries catch at 264,520 (184,407–344,987) mobulids per year, with SV fisheries accounting for 87 % …

On The Edge Of Science?: Commentary On Birch On Edge Of Sentience, Mark Briffa, Lynne U. Sneddon

School of Biological and Marine Sciences

In The Edge of Sentience, Jonathan Birch (2024) provides a thought-provokingsynthesis of current perspectives on animal (and artificial) sentience. He addresses the question from conceptual, ethical, regulatory and empirical viewpoints. Here we focus on some of the scientific issues raised, including defining and operationalising the concept of sentience and the implications for policy and regulation. Despite unresolved conceptual challenges, the book makes a compelling case for the continued scientific investigation of animal sentience.

The Impact Of Service Learning On Social Capital And Community Engagement, Jason R. Ross Jan 2026

The Impact Of Service Learning On Social Capital And Community Engagement, Jason R. Ross

Journal of Excellence in College Teaching and Learning

Social capital is important for individual and societal advancement. For individuals, social capital helps one advance in the organizational hierarchy but also flows to communities as these individuals are more likely to volunteer for non-profit organizations and pool their resources to advance societal causes. This paper argues that one overlooked mechanism for generating social capital is through service learning. Service learning benefits students not only academically, but professionally as it helps students connect with voluntary organizations, often composed of individuals of means. Students then integrate into the social networks of these influential members and potentially benefit from the resources they …

The Persistent Shock Of The Old: Making The Case For The Responsive Development Of Artwork Deploying Historical Museological Display Techniques., Duncan Cameron Jan 2026

The Persistent Shock Of The Old: Making The Case For The Responsive Development Of Artwork Deploying Historical Museological Display Techniques., Duncan Cameron

School of Art, Design and Architecture Theses

My sculpture work and thesis investigate the potential of historical museological practices—particularly Victorian and Edwardian display technologies—in contemporary art-making and sculptural practice. I ask three central questions: how can the collection and display of natural history materials be ethically defended in the present day; how might traditional exhibition orthodoxies be reconfigured to privilege the prosaic, domestic, and handmade over the novel and precious; and what role does the idiosyncratic and beautiful play in narrating material stories within an ethical, Anthropocene-aware framework? The study employs a practice-led methodology combining iterative art-making, critical reflection, and active fieldwork. Working from a studio in Somerset, …

The econometric analysis applied a stepwise framework, employing cumulative Impulse Response Functions (IRF) and Forecast Error Variance Decomposition (FEVD) based on Vector Error Correction Model (VECM) estimations, as well as Historical Decomposition (HD) for specific crisis periods. While IRF and FEVD were used to capture dynamic properties under general …

Driving Venture Success: A Collaborative Framework For The Consumer Goods Industry, Mohammad Alhusaeini Mohammad Jan 2026

Driving Venture Success: A Collaborative Framework For The Consumer Goods Industry, Mohammad Alhusaeini Mohammad

Plymouth Business School Theses

This thesis addresses the persistent gap between the strategic promise of external corporate venturing (ECV) and its frequently disappointing outcomes in the global consumer goods industry, with a specific focus on the non-durable consumer goods sub‑sector. Despite ECV’s recognised importance for innovation—particularly in a sector characterised by rapid consumer preference shifts, tight margins, and complex supply chains—collaborations with external start-ups are often undermined by cultural misalignment, strategic ambiguity, and ineffective performance measurement. Through an abductive, mixed-methods research design within an interpretivist paradigm—integrating archival analysis, six in-depth corporate case studies (P&G, PepsiCo, Unilever, Danone, Henkel, and L’Oréal), and 32 interviews with …

The Permanent Bar(S): The Unprincipled Cage Of Retribution For Immigrant Youth, Dianara Ramirez Ibarra Jan 2026

The Permanent Bar(S): The Unprincipled Cage Of Retribution For Immigrant Youth, Dianara Ramirez Ibarra

Cardozo Law Review

This Note argues that a minor’s diminished decisional capacity should be recognized as an affirmative defense when a permanent bar that is triggered during minority strips away a noncitizen’s opportunity to gain lawful status in the United States. Dreamers and Deferred Action for Childhood Arrivals (DACA) recipients, individuals who arrived in the United States as children, are victims of punitive immigration laws that have extinguished any possibility of securing lawful residency in the United States. Even more egregiously, Dreamers and DACA recipients are subject to these permanent bars despite lacking the intent and capacity to fully understand the long-term consequences …
