Interpreting Anti-Boycott Laws In The Shadow Of The First Amendment, Joseph A. Tomain Jan 2026

Interpreting Anti-Boycott Laws In The Shadow Of The First Amendment, Joseph A. Tomain

Articles by Maurer Faculty

Thirty-eight states have enacted “anti-BDS” laws. These laws require people or entities doing business with the state to certify that they do not participate in the Boycott Divestment Sanction movement against Israel. Typically, these laws define boycott as a “refusal to deal, terminating business, or other actions” that limit commercial relations with Israel or Israeli entities. It is highly contested in the courts and commentary whether these anti-boycott laws violate the First Amendment. Assuming arguendo that the “refusal to deal” and “terminating business” clauses do not implicate the First Amendment, that leaves the residual clause. At least one court and …

The Impacts Of Experiential Learning On Moral Development, Jacob Tyler Greenfield Jan 2026

The Impacts Of Experiential Learning On Moral Development, Jacob Tyler Greenfield

Graduate Theses, Dissertations, and Problem Reports (ETD)

Burnout remains a widely studied phenomenon in the healthcare literature, with much of the focus placed on reactive mitigation strategies that lack meaningful engagement with moral development. Healthcare education programs rarely incorporate formal learning experiences that promote moral development as a means of addressing burnout symptoms. This qualitative single case study examined how health professions students describe the impact of experiential learning on their moral development. Participants engaged in adapted photovoice methods, focus groups, and interviews to reflect on how serving as a Project MUSHROOM student leader influenced their morality. Four themes emerged: 1) recognizing bias and the need to …

Phylogeography, Fungal Host Specificity, And Fitness In The Corallorhiza Maculata Species Complex, Hana Thixton-Nolan Jan 2026

Phylogeography, Fungal Host Specificity, And Fitness In The Corallorhiza Maculata Species Complex, Hana Thixton-Nolan

Graduate Theses, Dissertations, and Problem Reports (ETD)

Mycoheterotrophic plants exploit fungi for most or all nutritional needs, providing a compelling system to address the evolutionary consequences of genome reduction, population-level variation, and germination requirements. I am using the widespread Corallorhiza maculata species complex to address questions of genomic variation, fungal host specificity, morphological variation, and germination requirements across the broad geographic range from Mexico to northern North America. This complex contains C. bulbosa, C. macrantha, and C. mertensiana, the latter with three varieties (maculata, occidentalis, and mexicana). These taxa vary in flowering time, floral morphology, and fungal associations. However, the degree …

A New Functional Setting For Term Structure Modeling Using The Health-Jarrow-Morton Framework, Michael Pokojovy, Ebenezer Nkum, Thomas M. Fullerton Jr. Jan 2026

A New Functional Setting For Term Structure Modeling Using The Health-Jarrow-Morton Framework, Michael Pokojovy, Ebenezer Nkum, Thomas M. Fullerton Jr.

Mathematics & Statistics Faculty Publications

The well-known Heath–Jarrow–Morton (HJM) framework provides a universal and efficacious instrument for modeling the stochastic evolution of an entire yield curve by explaining the interest rate dynamics in continuous time under no-arbitrage conditions. Existing implementations involve exponentially weighted function spaces as theoretical settings for the former stochastic evolution. While the choice of weight can have a drastic effect on model calibration and subsequent forecasting, it cannot be estimated from market data and does not allow for any objective interpretation. The proposed approach does not have this shortcoming as it adopts a suitably designed unweighted function space. The HJM equation is …

Welfare Litigation, State Courts, And Social Citizenship, Andrew Hammond Jan 2026

Welfare Litigation, State Courts, And Social Citizenship, Andrew Hammond

Articles by Maurer Faculty

For half a century, federal courts have stood at the center of welfare rights enforcement. That era is ending. The One Big Beautiful Bill Act’s historic cuts to Medicaid and SNAP will generate an avalanche of benefit terminations, work requirement sanctions, and overpayment actions from state agencies. And with a federal judiciary increasingly hostile to the private enforcement of public law, state courts will become not just a concurrent forum for welfare litigation, but an increasingly important one. Understanding how state courts have handled welfare litigation over the past three decades, then, is essential to anticipating what comes next. This …

Little Better Than One Of The Savages, Michael J. Aaron Jan 2026

Little Better Than One Of The Savages, Michael J. Aaron

The Gettysburg Historical Journal

Western Pennsylvania was one of the earliest frontiers in US history, but is often overlooked and oversimplified. The frontier just west of the Appalachian Mountains was a complicated place of settler and Native American interaction, varied permanent settlement, and wilderness. The journal and letters of Major Ebenezer Denny show a complicated frontier of danger, wilderness, and chaos that is often not seen within historical views of the region. Through Denny and other Western Pennsylvania settlers, this paper complicates the common view of the Western Pennsylvania as a simply and quickly colonized region by showing the area as an unsettled frontier …

Soviet Sympathies On-Screen: Cinema As A Cultural Apparatus In The Stalinist Era, Anne E. Bolenbaugh Jan 2026

Soviet Sympathies On-Screen: Cinema As A Cultural Apparatus In The Stalinist Era, Anne E. Bolenbaugh

The Gettysburg Historical Journal

The Stalinist era of the Soviet Union (1924-1956) is marked by its incredible pace of forced industrialization, extreme cultural repression, and an atmosphere of immense fear and paranoia, resulting in the Great Terror. Among the various mechanisms to enforce the state program, cinema offers a unique insight into specific state ideologies at key points in Stalin’s regime. By examining the three key phases of the Stalinist era consisting of his initial years, the Second World War, and the years of High Stalinism, it is possible to trace notable shifts in the Soviet authority’s approach to cinema as a propagandistically advantageous …

Certifying Widowhood: Lizzie Booth And The Making Of Black Widow Pension Entitlement During The Civil War, Michael B. Cox Ii Jan 2026

Certifying Widowhood: Lizzie Booth And The Making Of Black Widow Pension Entitlement During The Civil War, Michael B. Cox Ii

The Gettysburg Historical Journal

This article argues that Mary Elizabeth Wayt Lanning Booth, most commonly known as Lizzie Booth, played a decisive and underrecognized role in securing pension rights for Black widows during the Civil War. In the wake of her husband’s death at the Fort Pillow Massacre in 1864, Booth personally lobbied President Abraham Lincoln and Senator Charles Sumner for pension reform, catalyzing the passage of the Supplemental Pension Act. This reform permitted formerly enslaved women—whose marriages had been deemed extralegal—to prove their unions through eyewitness testimony and access federal benefits. Drawing primarily on pension files, the article demonstrates that while the Act …

Lunch Shaming And The Right To Privacy, Ira P. Robbins Jan 2026

Lunch Shaming And The Right To Privacy, Ira P. Robbins

Scholarly Articles in Law Reviews & Journals

Lunch shaming is the practice of penalizing students who cannot afford to pay for their meals, resulting in them being denied food, served alternative meals, or publicly identified. The origins of lunch shaming can be traced to the financial pressures faced by school districts that struggle to balance tight budgets with the mandate to provide free or reduced-price meals to eligible students. Despite legislative efforts and advocacy campaigns aimed at mitigating the problems associated with lunch shaming, the practice persists, exacerbated by rising food costs and the expiration of pandemic-era food programs.

Many law journal and other articles have correctly …

The Future Of Educational Equity In Post-Secondary Education: Student Loan Statutory Reforms Under The Big Beautiful Bill Act, Taylor Myers Jan 2026

The Future Of Educational Equity In Post-Secondary Education: Student Loan Statutory Reforms Under The Big Beautiful Bill Act, Taylor Myers

Florida Atlantic University Undergraduate Law Journal

Significant reforms to federal student loans, as outlined in the Big Beautiful Bill Act, will have a substantial impact on students pursuing secondary education, including loan limits, income-based repayment plans, and the elimination of specific deferment plans. Subsequently, those most affected by these changes will be low-income borrowers, middle-income borrowers, and graduate students. Recent changes to federal higher education loan policies, such as borrowing limits, income-based repayment plans, and elimination of certain deferments, can leave greater economic barriers within education. Although the policy aims to provide debt relief to borrowers, it raises unresolved constitutional questions, particularly regarding the government's responsibility …

Opera Houses In Aberdeen, Huron, And Watertown, Sd: 1880-1910s, Janet M. Meyer Jan 2026

Opera Houses In Aberdeen, Huron, And Watertown, Sd: 1880-1910s, Janet M. Meyer

Dissertations and Theses

In the 1880s, many newcomers arrived in Dakota Territory for a new start in Aberdeen, Huron, and Watertown. Their arrival coincided with the popularity of opera houses, so it was not surprising that entrepreneurs built opera houses in these new towns. The early opera houses included several benefits. They provided important gathering places for growing communities to hold meetings and social functions. The settler-colonial society included people from foreign countries and eastern states. Opera houses were also beneficial by providing familiar shows and concerts, perhaps some shows the residents previously enjoyed in their homes back east. Knowing that an entertainment …

Not Eu Enough: The Eu's Proposed Multilateral Investment Court As An Infeasible Replacement For The Intra-Eu Isds Mechanism After The Achmea Decision, Rohit Rakhit

Case Western Reserve Journal of International Law

In the landmark case Slovak Republic v. Achmea BV, the European Union Court of Justice (CJEU) invalidated Article 8 of the 1992 Dutch-Slovak bilateral investment treaty (BIT), holding that it conflicted with EU law. Article 8 included a provision which mandated that any party initiating an investor-state dispute governed under the Dutch-Slovak BIT bring the dispute in front of an arbitration tribunal. Since this form of investor-state dispute resolution was customary in the EU, states and investors became concerned about what the future of investment arbitration would look like in the EU. As a solution, the EU proposed the implementation …
