Still Uncertain After All Of These Years: Constitutional Rights Of Guantanamo Detainees Tried By Military Commission, Michael D. Ross Apr 2026

Still Uncertain After All Of These Years: Constitutional Rights Of Guantanamo Detainees Tried By Military Commission, Michael D. Ross

Mercer Law Review

This article explores whether Guantanamo detainees are entitled to constitutional protections at military commission trials. In 2006, Congress passed the Military Commissions Act (“MCA”). Its goal was to establish a fair system to try foreign detainees accused of war crimes. The ensuing nineteen years have revealed that the system needs reform. The most important cases, such as the 9/11 and U.S.S. Cole prosecutions, are still bogged down in pre-trial litigation that has lasted over a decade. But before policy makers consider reforms, they should know what constitutional protections apply at a military commission. Federal courts have not answered that question. …

New York Times V. Sullivan Protects Freedom Of The Press Against Seditious Libel, Not Against Personal Libel, Louis W. Hensler Iii

Mercer Law Review

Justice Clarence Thomas appears to be on a mission to reconsider the actual malice standard adopted sixty years ago by the Supreme Court of the United States in New York Times v. Sullivan. And Thomas has not been a lone voice crying in the wilderness—others also have questioned New York Times. While New York Times represents a big shift in the law for those cases to which it applies, the scope of its precise holding is relatively narrow—New York Times protects publications about the official conduct of public officials.

Moreover, focusing on the precise facts in the New York Times …

Discursive Power, Civilian Agency, Wartime Duress, And Resilience: Letters To The Authorities In The Blockade Of Leningrad, Jeffrey Hass, Nikita A. Lomagin

Sociology and Anthropology Faculty Publications

How did World War II affect the nature and resilience of Soviet institutions and authority, especially in the extreme case of the Blockade of Leningrad? During the Blockade, Leningraders acted with great agency by engaging in the shadow trade of food and shadow talk for information and community in order to survive. One case of shadow talk included sending letters to Smolny with requests, claims, protests, and advice. In these letters, Leningraders employed language that was relatively more straightforward and pragmatic than language used before the war. They used several rhetorical strategies to describe the dire straits that they faced, …

The Philosopher Of The Future: What Is It To Us That Herr Nietzsche Has Become Well Again?, Erli Mertika Apr 2026

The Philosopher Of The Future: What Is It To Us That Herr Nietzsche Has Become Well Again?, Erli Mertika

USF Tampa Graduate Theses and Dissertations

This dissertation argues that Nietzsche thought he was a genuine philosopher despite seeming at times to suggest that he was not. I arrive at this conclusion by comparing his thoughts on genuine philosophers with his thoughts about himself in an effort to show that his self-professed task is identical to theirs.

There are two types of genuine philosophers in Nietzsche’s late works: an old species that relied on a belief in “God” to legislate their values, and a new one that must do so without it. The former cannot perform their task after the death of God, which is why …

Systemic neoadjuvant chemotherapy, often combined with immunotherapy, is the standard of care for early-stage, non-breast cancer susceptibility gene (BRCA)-mutant triple negative breast cancer (TNBC). However, up to 70% of patients retain residual disease after treatment, which is linked to recurrence and mortality within 5 years. To define mechanisms of resistance, we performed single-cell RNA sequencing on orthotopic TNBC patient-derived xenografts during a cycle of treatment with doxorubicin and cyclophosphamide (AC). Clustering identified four tumor epithelial cell populations, with basal cells enriched in residual tumors. These basal cells up-regulated C15ORF48, a paralog of the mitochondrial cytochrome c oxidase associated subunit FA4 …
