Religious Liberty In The American Republic: How A Catholic Family Influenced Religious Freedom In The United States, Darien J. Garland
Religious Liberty In The American Republic: How A Catholic Family Influenced Religious Freedom In The United States, Darien J. Garland
Bound Away: The Liberty Journal of History
The American Revolution was a call for both individual freedom and freedom from British Rule. Tyrannical rule, taxation without representation in Parliament, and British military control of the colonies were all central to the Revolution, as was the emphasis on individual rights. One such right sought by the American colonists was the right to practice a religion of their choosing – but there was much debate about how freedom of religion would apply in the colonies. Ironically, the same freedom of religion which was central to the Revolution was not equally applied to all religions – in the colonies, Catholicism …
Rome Goes West: The Influence Of Classical Antiquity Upon The American Founding, Rebecca Felton
Rome Goes West: The Influence Of Classical Antiquity Upon The American Founding, Rebecca Felton
Bound Away: The Liberty Journal of History
To the American founding generation, the history of classical antiquity—of Rome in particular—not only supplied a common vernacular capable of transcending geographical and social boundaries, but also imparted important lessons regarding statecraft and the destinies of nations. Over the course of the 1760s and 1770s, the founders increasingly regarded America as the inheritor of Roman imperium, politically, culturally, and even religiously. Thus, alongside British constitutionalism, Enlightenment philosophy, and Christian resistance theory, the memory of Rome contributed to the declaration of American independence from Great Britain.
“King George And Broadswords”: An Assessment Of Governor Josiah Martin’S Military Plan In North Carolina, Christopher Dyer
“King George And Broadswords”: An Assessment Of Governor Josiah Martin’S Military Plan In North Carolina, Christopher Dyer
Bound Away: The Liberty Journal of History
In the early morning of February 27, 1776, the cold dark swamp surrounding the Moore’s Creek Bridge in southeast North Carolina came alive with the roar of combat to quickly be replaced with the silence of the dead. In moments, the political, military, and social structure of North Carolina in the early years of the Revolutionary War would be cemented until the Cornwallis-led Southern Campaign of 1780-1781. While considerable research has been expended on the later campaign, the crucial battle at Moore’s Creek set the conditions for the partisan struggle of the later years of the conflict with less concerted …
Forgotten Founder: The Life And Death Of Dr. Joseph Warren, Katie Cassady
Forgotten Founder: The Life And Death Of Dr. Joseph Warren, Katie Cassady
Bound Away: The Liberty Journal of History
While thousands of pages have been written about the American Revolution, minimal attention has been devoted to earlier aspects of this critical time period. Historiography hesitates to analyze figures such as Dr. Joseph Warren, whose tragic death in the early days of the war consigned him to relative oblivion in the contemporary American psyche. While Warren’s legacy has largely been forgotten, historians rediscovering this critical figure argue that his contributions to the revolution loom as large as those of Thomas Jefferson or George Washington. His untold story reveals a life of dedicated service to his country in the medical, political, …
A Gentleman’S Agreement: Prisoners Of War During The American Revolution, Delynn Burrell
A Gentleman’S Agreement: Prisoners Of War During The American Revolution, Delynn Burrell
Bound Away: The Liberty Journal of History
The topic of prisoners of war in any war is often controversial and convoluted. The American Revolution is no different. The problem surrounding prisoners of war during this era is the lack of official policies regarding care and exchange. For centuries, armies had relied on a gentleman’s agreement, often made on the battlefield or in the immediate days following, by commanders, most often Washington and Gage or Burgoyne and Lee. Washington frequently deferred to the Continental Congress, which had no issue expressing its opinions on matters such as provisions and the locations where prisoners were held. The British, for their …
In Touch With The Lord: U.S. Army Chaplains Of The Christian Faith In World War Ii, Timothy W. Brophy
In Touch With The Lord: U.S. Army Chaplains Of The Christian Faith In World War Ii, Timothy W. Brophy
Bound Away: The Liberty Journal of History
This paper argues that the Christian chaplains of the U.S. Army during World War II greatly impacted the soldiers that they served by caring for their spiritual, physical, mental, and emotional well-being. The paper begins with a reference to the “Four Chaplains” who gave their lives to save others in 1943 and a brief look at the history of the U.S. military chaplaincy. It also examines the leadership and training of U.S. Army chaplains during World War II under William R. Arnold, who was the Army Chief of Chaplains from 1937 to 1945. Then, the paper demonstrates that Christian Army …
George Washington And His Involvement In The Anglican Church, Brittany Biggerstaff
George Washington And His Involvement In The Anglican Church, Brittany Biggerstaff
Bound Away: The Liberty Journal of History
George Washington’s involvement within the Anglican Church (with later ties to its counterpart, the Episcopal Church,) was influenced by his Christian upbringing and moral compass. Elements of Christianity can also be outlined in his leadership within and outside of the church. Throughout his life, Washington visited and attended several churches also outside of his denomination as well as churches within the Anglican/Episcopal denomination. The Post-Revolutionary War period was when the Anglican Church began to separate itself from the Church of England and later would become recognized as its American counterpart, the Protestant Episcopal Church. The Church’s progression is important to …
Impact Of Package Dimension Changes On The Consumer’S Perception Of Ready-To-Eat Meal Serving Size, Greg Roskos, Koushik Saha
Impact Of Package Dimension Changes On The Consumer’S Perception Of Ready-To-Eat Meal Serving Size, Greg Roskos, Koushik Saha
Journal of Applied Packaging Research
Consumers increasingly scrutinize changes in food packaging, particularly in the context of “shrinkflation,” yet little empirical work has examined whether small dimensional changes in primary packaging affect perceived value when product weight is held constant. This study investigates the impact of minor tray dimension changes on consumers’ perception of serving size and product quality for ready-to-eat (RTE) frozen meals. Three single-compartment tray formats were evaluated: a control tray, a larger-volume tray (~18% increase), and a hybrid tray with an intermediate volume (~8% increase). All trays contained identical net product weight. Thirty-six untrained panelists from a local community participated in a …
Chopped And Screwed: How The Soundexchange V. Sirius Xm Decision Remixes Section 114 Of The Copyright Act, Cat Wood
Journal of Intellectual Property Law
In SoundExchange, Inc. v. Sirius XM Radio Inc. (S.D.N.Y. 2025), the court held that SoundExchange—the congressionally designated nonprofit that collects and distributes statutory digital performance royalties under 17 U.S.C. § 114—lacks authority to bring suit to recover alleged underpayments. That ruling creates an enforcement paradox at the center of the section 114 statutory-license ecosystem: SoundExchange is the entity built to receive royalty reports, audit compliance, and distribute payments at scale, yet it cannot directly compel payment through litigation when the system fails. This Note argues that the decision misreads statutory structure by treating SoundExchange as a mere administrative clearinghouse rather …
Truth That Lies: How Literal Falsity Lost The Consumer And How To Restore It, Porter Alexander Tynes, Iii
Truth That Lies: How Literal Falsity Lost The Consumer And How To Restore It, Porter Alexander Tynes, Iii
Journal of Intellectual Property Law
The more deceptive the claim, the safer it becomes. Recent false advertising decisions hold that a categorical marketing promise is not literally false so long as it works for someone—even if it fails for ordinary consumers in ordinary use. Under this logic, technical accuracy immunizes practical deception, and truth is measured by theoretical possibility rather than communicative meaning.
This Note argues that this “truth for some” doctrine represents a sharp break from the Lanham Act’s consumer-protection purpose. Decisions such as BPI Sports v. ThermoLife invert the doctrine of literal falsity, transforming it from the Act’s strongest safeguard into a liability …
Using The Uniform For Views: How The Department Of Defense Can Better Protect Its Brand And Image, Maddox Rose
Using The Uniform For Views: How The Department Of Defense Can Better Protect Its Brand And Image, Maddox Rose
Journal of Intellectual Property Law
Today, the vast majority of American military servicemembers have active personal social media accounts. By creating and posting content online—particularly when in uniform—they run the risk of reflecting poorly on the image of the Department of Defense and their respective branches. Yet, the statutory and regulatory restrictions on content creation are loose and ambiguous. To combat this problem, either the Department and its branches should clarify their regulations, or Congress should amend its statutory protections. There is scholarly disagreement as to whether an entity’s right of publicity is violated when social media content is created that reflects poorly upon that …
Skin In The Game: The Case For Statutorily Excluding Tattoos From Copyright Protection, Emily Gamble
Skin In The Game: The Case For Statutorily Excluding Tattoos From Copyright Protection, Emily Gamble
Journal of Intellectual Property Law
The growth of social media, AI-generated imagery, and name, image, and likeness (NIL) licensing has exponentially increased the reproduction of tattoos, yet their status under the Copyright Act remains unsettled. While tattoos arguably satisfy the threshold requirements of Title 17, their fixation on human skin challenges the definition of a "material object" and raises unique conflicts regarding bodily autonomy and publicity rights. Currently, courts address these disputes largely through equitable doctrines like implied license and fair use to avoid public policy failures, resulting in an unpredictable and incoherent legal framework.
This Note argues that judicial improvisation is insufficient to resolve …
Posts, Not Personae: Why Influencer Personae Fall Outside The Doctrine Of Character Copyright, Abbey Brantley
Posts, Not Personae: Why Influencer Personae Fall Outside The Doctrine Of Character Copyright, Abbey Brantley
Journal of Intellectual Property Law
Over the past decade, social media has enabled an increasing number of people to pursue influencing as a full-time career on platforms such as TikTok, Instagram, and YouTube. To succeed commercially, these creators make repeated stylistic choices that both conform to online trends and project a carefully curated persona. As these personae become profitable, however, they also become susceptible to imitation. This dynamic raises the question whether copyright law, specifically the doctrine of character copyright, can protect influencers from unauthorized copying of their online identities. This Note argues that influencer personae do not and should not qualify for such protection, …
Patents And Technology Evolution: Altering Innovations And Innovators Via Patent Influences, Richard Gruner
Patents And Technology Evolution: Altering Innovations And Innovators Via Patent Influences, Richard Gruner
Journal of Intellectual Property Law
Technologies improve primarily through evolutionary change not rational optimization. New technologies emerge as attempts to solve practical problems, the technologies are tested in marketplaces to determine if they are superior in cost and function to alternatives, and those that fare well in the testing gain widespread adoption. Widely adopted technologies, and their problems, form the basis for the next round of technology improvements and evolution. Through these steps, evolutionary processes lacking rational direction can generate changing technologies matched to the desires and problems of present society.
As they operate to advance diverse technologies, evolutionary processes governing technology change are subject …
The Expanding Patent Document: Fewer Claims, More Words, And The Drivers Of Growth, Dennis D. Crouch
The Expanding Patent Document: Fewer Claims, More Words, And The Drivers Of Growth, Dennis D. Crouch
Journal of Intellectual Property Law
Patent specifications have nearly quadrupled in length over the past four decades, rising from approximately 3,500 words in the early 1980s to over 13,000 words by 2025. At the same time, the average number of claims per patent has declined since peaking in 2005. Using the population of 7.6 million published patent applications from 2005 through early 2025, this Article advances a supply-side explanation for the persistent growth in specification length. The divergence between expanding specifications and contracting claims reflects a structural asymmetry in the USPTO fee schedule: excess claim fees impose a per-unit cost that visibly constrains claim counts …
Using The Inform Consumers Act To Combat China’S Online Counterfeiters, Daniel C.K. Chow
Using The Inform Consumers Act To Combat China’S Online Counterfeiters, Daniel C.K. Chow
Journal of Intellectual Property Law
Everyday millions of counterfeit goods are shipped from suppliers on Alibaba’s website based in China to retailers on Amazon, Walmart, and other e-commerce platforms and sold to U.S. consumers. The significance of this massive pipeline seems to have eluded brand owners and U.S. government authorities. Most brand owners have concentrated their efforts on suppressing counterfeits on U.S. e-commerce markets after the counterfeits have already appeared on their sites. These efforts have proven to be ineffective as once millions of counterfeits are commingled with genuine products on the internet their suppression becomes an impossible task. The key to successful interdiction of …
The Prestige Economy Of Legal Scholarship, Jeffrey A. Katz, Jacob Sandler
The Prestige Economy Of Legal Scholarship, Jeffrey A. Katz, Jacob Sandler
Florida Law Review
Law reviews sit at the center of American legal scholarship, but their role is widely misunderstood. They are not peer-reviewed, yet the academy treats their placement decisions as markers of scholarly merit. This Essay argues that law reviews function as participants in a prestige economy—one in which reputation, familiarity, and institutional brand often matter more than substantive judgment. Tracing the student-edited model from its pedagogical origins to its modern professional consequences, this Essay shows how prestige became currency, how that currency shapes editorial and authorial behavior, and why the system strains under political and methodological pressure. It concludes by urging …

Black Joy And The Mother Connection: An Evaluative Case Study Of A Graduate Book Club, Shandria Hill, Meredith A. Rausch, Megan Buning, Janny Liu, Tyler Gray
Journal of Graduate Education Research
This article reviews an evaluative case study of implementation of a six-session virtual book club on connection, attachment, and Black joy in women who identify as Black and African American. Participants included six women and one group leader, all but one of whom were currently enrolled in a higher education setting. Members read selected chapters from two books--What my mother and I don’t talk about: Fifteen writers break the silence (Filgate, 2019), and You are your best thing: Vulnerability, shame resilience, and the Black experience (Burke & Brown, 2021). We present the qualitative summary of the potential impact of …
Researcher Identity In Non-Conventional Research Settings: An Autoethnography, Irina Berry, Robin Hardin, Hunter B. Porter
Researcher Identity In Non-Conventional Research Settings: An Autoethnography, Irina Berry, Robin Hardin, Hunter B. Porter
Journal of Graduate Education Research
Scholars have emphasized reflexivity as a key practice for addressing potential biases and enhancing the credibility of research. Although reflexivity has been recognized as essential to qualitative rigor, limited attention has been given to its theoretical integration with broader social identity processes, particularly in non-conventional settings. This manuscript extends social identity theory and demonstrates how the insider/outsider model adds additional layer of complexity to the understanding of researcher identity negotiation. In this study, the researcher used an autoethnographic approach to examine the experiences of an able-bodied researcher conducting research in adaptive sport settings and featuring adaptive athletes. Strategies that emerged …

Research To Praxis: Transdisciplinary Skill Development In Graduate Education, Demikia Taylor, Tiffany Drape, Amy Pruden, Todd Schenk, Leigh-Anne Krometis
Journal of Graduate Education Research
This study examines how graduate students' perceptions of transdisciplinary team science evolve as they progress through a graduate training program at a university. Students participated in a series of workshops that built on and reinforced various aspects of training in transdisciplinary team science, including Team Science, Science Communication, Stakeholder Engagement, and International Case Studies in Antibiotic Resistance Monitoring. Students also took accompanying coursework towards a certificate and worked together in collaborative teams in advancing an array of transdisciplinary research projects focused on various dimensions of antibiotic resistance. A qualitative case study approach was taken, systematically examining participants’ reflections following each …
Exploring The Simultaneous Processes Of Academic Job Search And Dissertation For Culturally Diverse Doctoral Candidates In Counselor Education Programs, Galaxina G. Wright, Jasmine Griffith, Jasmine Garrison, Inga Antrobus
Exploring The Simultaneous Processes Of Academic Job Search And Dissertation For Culturally Diverse Doctoral Candidates In Counselor Education Programs, Galaxina G. Wright, Jasmine Griffith, Jasmine Garrison, Inga Antrobus
Journal of Graduate Education Research
Doctoral candidates face several challenges as they complete their academic journeys, particularly as it relates to the unique balance of applying for faculty positions while completing their dissertations. Though both processes have been explored separately within some educational fields, minimal research exists within the field of counselor education (CE) examining simultaneous experiences, particularly those from historically marginalized populations. Guided by the Career Self-Management (CSM) framework and an interpretive phenomenological analysis (IPA), we explored the perspectives of 11 CE candidates from historically marginalized backgrounds engaged in both processes. We identified five main themes and four subthemes that participants experienced. We discuss …
From Linear To Circular Transition: A Multi-Level Perspective On Waste Generation And Circularity Potential In Irish Hotels, Sahar Attari, James Hanrahan Dr
From Linear To Circular Transition: A Multi-Level Perspective On Waste Generation And Circularity Potential In Irish Hotels, Sahar Attari, James Hanrahan Dr
Irish Journal of Tourism, Hospitality, Leisure and Event Research
This study examines how the multi-stream waste composition of Irish hotels aligns with European Union circular economy targets and what this reveals about the sector's position within a linear-to-circular transition. It provides the first multi-stream waste benchmark for the Irish hotel sector and interprets the findings through a socio-technical transition lens. A cross-sectional waste audit was conducted across 30 Irish hotels, collecting full-year data on food waste, recycling, and general waste. Carbon emissions were calculated using life-cycle emission factors, threshold analysis derived empirically grounded typologies, and circularity gaps were quantified against the EU 2030 recycling target (65%). Findings were interpreted …
Cognitive Predictors Of Functional Recovery After Traumatic Brain Injury, Disha A. Thakkar, Charles J. Golden
Cognitive Predictors Of Functional Recovery After Traumatic Brain Injury, Disha A. Thakkar, Charles J. Golden
Archives of Assessment Psychology
This study examined whether the Brief Test of Adult Cognition by Telephone (BTACT), administered during acute rehabilitation, improved the prediction of 5-year functional outcomes after traumatic brain injury (TBI) beyond standard demographic and injury-severity variables. Data were obtained from the Traumatic Brain Injury Model Systems (TBIMS) National Database (N = 6,880; enrolled 2017 onward). Missing data were handled using multiple imputation (20 datasets). Hierarchical multiple regressions were conducted with the Functional Independence Measure (FIM) and the Glasgow Outcome Scale–Extended (GOS-E) as outcome measures. Demographics (age, sex, education, race) were entered in Block 1, injury severity indicators (post-traumatic amnesia [PTA] duration, …
Self-Esteem Development And Emotional And Behavioral Disorders, Bahaa Al Ghraibeh
Self-Esteem Development And Emotional And Behavioral Disorders, Bahaa Al Ghraibeh
Archives of Assessment Psychology
Self-esteem is a fundamental psychological construct that develops across the lifespan and influences academic, social, emotional, and behavioral functioning. Research consistently links healthy self-esteem with positive developmental outcomes, including improved educational achievement, stronger interpersonal relationships, and better mental health. At the same time, emotional and behavioral disorders (EBD) are associated with persistent emotional, behavioral, academic, and social difficulties that can interfere with healthy self-development. This paper reviews the developmental trajectory of self-esteem from early childhood through adulthood and examines how the experiences commonly associated with EBD may negatively affect that trajectory. The review discusses how children begin forming self-esteem at …
Prior Traumatic Brain Injury As A Predictor Of Cognitive Deficits After Moderate-To-Severe Injury, Disha A. Thakkar, Charles J. Golden
Prior Traumatic Brain Injury As A Predictor Of Cognitive Deficits After Moderate-To-Severe Injury, Disha A. Thakkar, Charles J. Golden
Archives of Assessment Psychology
Prior traumatic brain injuries (TBIs) are common among individuals who later sustain a moderate-to-severe TBI (msTBI), and cumulative injury models suggest repeated TBIs may worsen long-term cognitive outcomes. This study tested whether prior TBI history independently contributes to cognitive performance one year after an index msTBI beyond demographic and injury-severity factors. Data were drawn from the Traumatic Brain Injury Model Systems National Database (N = 6,880 enrolled since 2017). 2,773 participants completed the Brief Test of Adult Cognition by Telephone at one-year follow-up. Hierarchical regression models evaluated whether prior TBI history accounted for incremental variance in overall cognitive status and …
Pilot Study On The Use Of Reminder Packaging In Improving Adherence And Blood Pressure Control Among Hypertensive Patients In The Uganda Heart Institute., Grace Among, Grace Nakate
Pilot Study On The Use Of Reminder Packaging In Improving Adherence And Blood Pressure Control Among Hypertensive Patients In The Uganda Heart Institute., Grace Among, Grace Nakate
School of Nursing & Midwifery, East Africa
Background: Hypertension is a major global public health challenge that is associated with high morbidity and mortality rates. Poor medication adherence means the management of hypertension remains unsatisfactory. Non-intentional forgetfulness accounts for around 49.6% of medication non-adherence. Reminder packaging is a measure that has been experimented with in developed countries and has shown improved medication adherence, although limited data exist on its effectiveness in developing countries with resource constraints. Therefore, piloting its use in improving medication adherence and blood pressure control among hypertensive patients in Uganda Heart Institute to ascertain its effectiveness in developing countries like Uganda is paramount. …
Poor Compliance With Private Nursing And Midwifery Practice Guidelines In Urban Settings In Uganda, Dan Muramuzi, Edson Atwine, Barbara Okiror, Mercy Muwema, Christine Nimwesiga, Laban Muteebwa
Poor Compliance With Private Nursing And Midwifery Practice Guidelines In Urban Settings In Uganda, Dan Muramuzi, Edson Atwine, Barbara Okiror, Mercy Muwema, Christine Nimwesiga, Laban Muteebwa
School of Nursing & Midwifery, East Africa
Background: Optimal compliance with private practice guidelines is one of the core components of quality improvement in nursing and midwifery professions. Private nursing and midwifery practice guidelines in Uganda were introduced in 2019. However, little has been documented about compliance with these guidelines, despite playing a crucial role in ensuring safe nursing and midwifery practice and maintenance of professional standards. We assessed the compliance with private nursing and midwifery practice guidelines of Uganda (2019) and explored barriers to optimal compliance with these guidelines in private health facilities licensed by the Uganda Nursing and Midwifery Council (UNMC) in Kampala Metropolitan …
