Disgorgement Of Profits: An Alternative Solution To Stolen State Assets’ Recovery From Corporate Financial Crimes, Renny Ariyanny, Sung-Jun Bae, Mohammad Kemal Dermawan

Hasanuddin Law Review

In recent years, the Indonesian government has suffered a huge loss of state assets due to the misbehavior of corporations in financial management because the Indonesian legal system does not have a specific regulation to address corporate financial crime. When a corporate financial crime case arises, Indonesian law enforcement approaches this crime using the Anti-Corruption Act. However, the aim to retrieve the stolen government assets purloined by a corporation using the Anti-Corruption Act is still insufficient, therefore, other related regulations such as the Money Laundering Act have to apply as an additional instrument to realize optimal recovery from the misbehaving …

Contemporary Fanfiction As Decoupled Participatory Sensemaking, Mingxi Xu, Christian Kronsted

Contemporary Aesthetics (Journal Archive)

Within the last fifteen years, a new form of community-driven literary practice has developed on the internet, namely fanfiction. Fanfiction is unlicensed community-authored writing about established intellectual property, made for fans by fans. In this paper, we provide an overview of contemporary fanfiction circulated on the most popular fanfiction platforms (Wattpad and Archive of Our Own). We also bring in recent cognitive science studies on creativity and art, where there is an emerging consensus that creativity is not a product of an individual mind that imposes its intentions onto a static object. Instead, creative processes tend to be co-emergent between …

In Praise Of Dessert, Yujia Song

Contemporary Aesthetics (Journal Archive)

Is there something special about dessert? Is it the sweetness or sumptuousness or something else? This essay explores the aesthetic layers in our experience of dessert. It will turn out that dessert promises much more than sensuous pleasures. As we savor our dessert, we reach outside the humdrum of everyday life for a taste of all the good things life has to offer. Although dessert is by its nature superfluous, it is precisely its being “unnecessary” that makes it necessary for us.

Research On Path Planning Method For Autonomous Underwater Vehicles Based On Improved Informed Rrt, Bensheng Qi, Yan Li, Hongxia Miao, Jialin Chen, Chenglin Li

Journal of System Simulation

Abstract: In response to the autonomous underwater vehicle (AUV) path planning problem in complex underwater environments, an improved path planning algorithm based on Informed rapidly-exploring random trees (RRT) is proposed in this study. A target-biased sampling strategy and a target-biased extension strategy are employed to address the issue of lack of goal orientation in the sampling process, ensuring that target nodes become sampling points during random sampling. During path points extension, non-target sampling points are guided in the direction of the target point, thereby enhancing the algorithm's ability to search for the target during random sampling and extension processes. A …

Scaling Arctic Landscape And Permafrost Features Improves Active Layer Depth Modeling, Wouter Hantson, Daryl Yang, Shawn P. Serbin, Joshua B. Fisher, Daniel J. Hayes

Biology, Chemistry, and Environmental Sciences Faculty Articles and Research

Tundra ecosystems in the Arctic store up to 40% of global below-ground organic carbon but are exposed to the fastest climate warming on Earth. However, accurately monitoring landscape changes in the Arctic is challenging due to the complex interactions among permafrost, micro-topography, climate, vegetation, and disturbance. This complexity results in high spatiotemporal variability in permafrost distribution and active layer depth (ALD). Moreover, these key tundra processes interact at different scales, and an observational mismatch can limit our understanding of intrinsic connections and dynamics between above and below-ground processes. Consequently, this could limit our ability to model and anticipate how ALD …

Biology, Chemistry, and Environmental Sciences Faculty Articles and Research

We have conducted a sensitivity analysis on the mid-infrared spectral decomposition of galaxies and the modeling of the polycyclic aromatic hydrocarbon (PAH) emission spectrum with the NASA Ames PAH Infrared Spectroscopic Database (PAHdb) to assess the variance on the average galaxy PAH population properties under a grid of different modeling parameters. We find that the short-low and short-low+long-low Spitzer-IRS decomposition with PAHFIT provides consistent modeling and recovery of the 5–15 μm PAH emission spectrum. For PAHdb modeling, application of a redshift to the calculated spectra to account for anharmonic effects introduces a 15%–20% variance on the derived parameters, while its …

The Lack Of The Environmental Concern In Indonesia’S Bilateral Investment Treaties, I Gusti Ngurah Parikesit Widiatedja, I Gusti Ngurah Wairocana

Hasanuddin Law Review

In the modern era, Bilateral Investment Treaties (BITs) are relatively effective to attract more foreign direct investment (FDI). Many countries then eagerly concluded BITs, including Indonesia. Considering the adverse impact of FDI on the environment, most countries then start putting the environmental concern in their BITs, assisting them to prevent and mitigate any adverse impact of FDI on the environment. Indonesia, however, did not follow this measure. This paper then shows the lack of the current Indonesia’s BITs in putting the environmental concern in their provisions. The fact that Indonesia has terminated some BITs becomes a right momentum to start …
