تسعى هذه الدراسة لاستخلاص النظرية العامة للإباحة المالية في المذهب الشافعي، حيث تناولت مفهوم الإباحة من الناحية الشرعية ثم بينت مشروعيتها، وقد أثبتت الدراسة أنها مشروعة بحكم الأصل، كما تناولت خصائص الإباحة وشروط جوازها من الناحية الشرعية، وتوسعت في بيان الفروق بينها وبين غيرها من التبرعات المالية كالعارية والهبة والوكالة والوديعة والوقف والإمتاع، ثم بينت أهم الأحكام المتعلقة بها من حيث الرجوع عنها والخلاف الذي يحصل بين المال والمبيح، وقد توصلت الدراسة إلى أن الإباحة ليست تمليكاً وأن المالك له الرجوع عنها في أي وقت شاء، وقد ختمنا هذه الدراسة بمشروع تقنين لأحكام الإباحة المالية يتكون من تسعة عشر …

Research has demonstrated that intergroup contact is essential for managing diverse multicultural societies. This dissertation studies the treatment by Saudi judges under Islamic Sharia law of liquidated damages clauses in contracts, a critical part of modern commercial transactions.

After introducing the basic and secondary sources of Islamic law and discussing the current treatment of the liquidated damages clause by Saudi judges according to general Islamic rules and the four jurisprudence schools, this dissertation demonstrates that Saudi judges have broad discretion in applying jurisprudence rules, particularly Hanbali jurisprudence, the applicable jurisprudence in the Saudi courts.

This article critically analyzes the dominant opinion prevailing regarding the foundation of Islamic jurisprudence (uṣūl al-fiqh) which states that absolute independent juristic interpretation (al-ijtihād al-muṭlaq al-mustaqill) is no longer possible. Therefore, based on the belief that this level of interpretation requires the creation of a unique method for deriving legal rules (istinbāṭ), a method that arguably ended with the founders of the primary schools of law. This article tempts to verify the intricate dynamics of political alliances between Islamist groups and opposition parties in Indonesian elections, focusing on the 2018 West Java gubernatorial contest. The study employs exit poll data, investigating the relationship between religiosity, politico-religious narratives, and voting behaviour. While the mobilising power of Islamist groups appeals to political parties, creating a temporary alliance, these do not guarantee electoral triumph even in a conservative region. The politico-religious propaganda, in principle, consolidates Islamist-inclined voters. This dissertation locates itself at the intersection of performance theory, South Asian studies and philosophy of history to examine the history of an urban consciousness known as banarasipan (literally, "Banarasi-ness") as performed by the people of Banaras in northern India. Many scholars argue that the image of Arabs in Hollywood has always been tainted by prejudice and stereotyping. However, little attention is paid to women's representation in general or the influence of 9/11 on that representation. This paper compares portrayals of Arab women in popular Hollywood films before and after 9/11. A purposive sample of 76 Arab female characters from 40 popular Hollywood films is used to conduct a content analysis, comparing portrayals in films released before and after 9/11. Discourses regarding women as imams became widespread after Amina Wadud led communal Friday prayers in 2005. Academics have predominantly responded by analyzing religious doctrine and its exegesis, ignoring the fact that women's ability to lead worship is strongly influenced by their specific socio-cultural contexts and dynamics. This article will investigate how religious texts structure and are structured by the socio-cultural context of Indonesia. In this study, data were collected by identifying hadiths of leadership, then analyzing them using content analysis. The English Court of Appeal in Beximco v. Shamil Bank chose to apply only English law in a breach of contract case, even though the choice of law clause in the contract at issue also selected Islamic law. The court cited three main reasons for this decision.
