The Proprietor Of Battersea: The Life And Legacy Of American Founder John Banister (1734–1788), Davis C. Simmons

This research examines the multifaceted life of Colonel John Banister (1734–1788) during the eighteenth century. Using a biographical methodology, the study highlights his significance as an American founder from Virginia. It provides a chronological account of his accomplishments and a detailed analysis of his complex character as a politician, slave owner, and public figure of cultural importance. The research draws on primary sources such as letters and official records, as well as secondary sources including biographies and historiographies that have received limited attention. The thesis argues that Banister’s role as a Revolutionary leader and American founder is underrepresented in current …

Out Of The Circle: Exploring Religious Ostracism In Cyberball, Ralph D. Stewart Iii

The purpose of this study was to investigate the psychological effects of social ostracism in group settings, particularly in relation to social identity theory (Tajfel & Turner, 1979) and the need to belong (Baumeister & Leary, 1995). Collective self-esteem, hostility, and belonging were examined to see if they changed significantly with the implementation of ostracism through the Cyberball paradigm (Williams, 2000). The relationship between ostracism, hostility, and religious fundamentalism was also explored. Though insignificant results from subsequent analysis were obtained, these results suggest weaker ostracism effects for interpersonal measures rather than intrapersonal measures consistent with findings by Hartgerink et al. …

Limitations Of Secular Values In Constitutions Of The Kingdom Of Thailand: A Critical Study Of The Concepts Of Rights And Liberty, Chayanin Nuisin

This dissertation aims to examine the limitations of secular values within the context of all twenty constitutions of the Kingdom of Thailand. The analysis focuses in particular on rights and liberties as core secular values. The study considers their origins, development, and the obstacles that have hindered the realization of rights and liberties in Thai society. The findings suggest that secular values—especially modern concepts of rights and liberties—emerged during the Reformation period under King Rama V, when Siam sought to adjust itself to the conditions of modernity. The past may be “uncomfortable,” the Washington Post pointed out on July 1, 1966, before adding a far more serious observation: “[t]he suppression of history—which is to say the judgment of historians—is an incongruity of a free society.” A year earlier, Helen C. Frick sued Professor Sylvester K. Stevens in Pennsylvania’s Cumberland County Court of Common Pleas to prevent the publication of his recent history book, Pennsylvania: Birthplace of a Nation. Reencountering Trade Legacies, Indigenous Histories, And The Early Leopoldine Society Circle In The Vienna Weltmuseum, Michael Burri

This chapter concerns the Great Lakes Indigenous peoples whose artifacts may be found in the Vienna Weltmuseum. It situates these artifacts within the larger framework of exchange modalities among Indigenous peoples, together with the Leopoldine Society, an organization founded in Vienna in 1829 to minister to German-speaking Catholics in North America. To convey this framework, the chapter recalls Indigenous artifact collections of British officers active in the region, as well as the gift giving of Odawa leader Jean-Baptiste Assiginack. It also devotes close attention to Georg Schwarz, whose inventory of Indigenous artifacts remains the centerpiece of the North American collection …

Oral traditions are irreplaceable sources of historical information, particularly with regard to Indigenous Peoples’ histories and cultures. However, when states have submitted oral traditions as evidence of historical practices, events, and circumstances in cases before the International Court of Justice (“Court”), the Court has been reluctant to afford them significant weight. This Article, which is the first detailed study on the Court’s treatment of oral traditions, examines whether the Court is failing to provide them due or appropriate weight. Reading Motivation And Achievement: Exploring Theories, Strategies, And School Climate Contexts, Andrea L. Esterly

This literature review examined the intersection of self-efficacy and motivation, and their impact on reading achievement. The analysis demonstrated how motivation and context support and shape students’ reading outcomes. This synthesis of peer-reviewed research (2014–2024) from ERIC, PsycINFO, and JSTOR highlights Self-Determination Theory (SDT) as a lens for understanding reading motivation through competence, autonomy, and relatedness. Evidence shows that fluency strategies (prosody, repeated reading, and arts integration) enhance pacing, comprehension, and engagement, while supportive school climates (characterized by safety, teaching, and relationships) further sustain motivation. European right-wing populist (RWP) parties are increasingly touting their attention to women’s issues and representation, and this has coincided with stronger electoral performances. Thus, the following puzzles emerge: how have RWP parties harnessed gender frames, issue salience, and women’s representation as part of a mainstreaming process, and through what mechanisms are these strategies resonating with voters? I address these questions by comparing France’s Rassemblement National (RN) and Italy’s Fratelli d’Italia (FdI), tracing their developments from the mid-twentieth century to the present day. Performance audits have become increasingly important across the world. Scholars know that a variety of practices are incorporated within performance audits and have mapped this diversity. However, few quantitative studies examine performance auditing as a practice. This study fills that gap. By analyzing the published performance audit documentation of the UK National Audit Office (NAO), the study explores the influences of governmental change and crises behind changes in a supreme audit institution's performance audit. During the latter half of the nineteenth century, when railroads were consolidating their control, their executives soon learned their power of controlling rates, and by extension, the entire economy. Dissecting the capitalist machine of the railroad corporations in California, Frank Norris’s 1901 novel The Octopus presents a fictionalized account of the very real circumstances of one fight against the monopoly, the Mussel Slough Tragedy of 1880 in the San Joaquin Valley. This dissertation examines trade unions' responses to the employment risks generated by labor-saving technological change in British and West German manufacturing during the third quarter of the twentieth century, an era of rapid technological advance and the period during which British manufacturing fell behind the German competition. Drawing on previously untapped archival evidence from both countries, this dissertation challenges existing views in comparative political economy and economic history regarding unions' attitudes toward technological change and the welfare state as well as received contrasts between coordinated capitalism in West Germany and its supposed opposite in Britain. This study explores the often-overlooked role of children in slavery and forced labor in Ghana, emphasizing their exploitation in domestic service, agriculture, and other labor sectors. While existing scholarship often subsumes children within broader narratives of slavery, this research highlights their distinct experiences and their crucial role in sustaining Indigenous slavery. It argues that child slavery in Ghana was reinforced by familial practices such as the pawnship system, religious obligations like the trokosi system, and the reliance on family farms, where children served as producers and carriers of cocoa. Algorithmic Selection Of Iconic Constitutions, Tejas Ramdas, Patrick Chung-Chia Huang, Nuno Garoupa, Martin T. Wells, Yun-Chien Chang, Tom Ginsburg

Public Law and Legal Theory Working Papers

This chapter examines the influence of pre-20th century constitutions using a quantitative approach, comparing expert-selected “iconic” constitutions with those identified algorithmically. In prior work, human experts identified four influential constitutions: the U.S. 1791, France 1791, Spain 1812, and France 1848. Here, we employ a genetic algorithm and Document Term Matrix (DTM) analysis to assess which one or four of 180 pre-1899 constitutions had the greatest textual impact on 581 post-1900 constitutions. Two criteria guide the selection: coverage and originality. Through iterative optimization, the algorithm identifies the most textually influential constitutions, allowing for a direct comparison with expert selections. This chapter …

Abstract: The Ku Klux Klan used a number of tactics to impact the judicial system of the South, tactics that can be seen in public interviews of Congress’s Report of the Joint Select Committee to Inquire into the Condition of Affairs in the Late Insurrectionary States. Intimidation was a powerful and widespread strategy of the KKK to create fear and inhibit the judicial system. Reciprocal balanced translocations occur when one part of a chromosome is exchanged with another, resulting in zero net loss of genetic material. While individuals with a balanced translocation are phenotypically normal, a translocation can cause increased risk of infertility, recurrent pregnancy loss, and the birth of a child with unbalanced chromosomes. In order to adequately guide an individual in their reproductive decisions, geneticists must be able to assess the risk of the patient’s unique translocation. The British colonization of Burma in 1885 marked a turning point in Myanmar’s traditional society, particularly in changes of body techniques, shikho (prostration), and the practice of wearing or removing shoes in sacred spaces. While recent scholars have examined the changes in body techniques and spiritual cult, the relationship between body techniques and domestic spaces has remained underexplored. This dissertation provides an analysis of the development of the coconut sector in Ghana during the colonial era. While previous scholarship on the export crop economy of this African society has grown impressively in recent years, little attention has so far been paid to the coconut sector. To fill this gap, this dissertation draws on previously unused archival material and on other sources dealing with the colonial economy of the Gold Coast, and it engages two of the many models used to evaluate the impact of colonialism in Africa: the vent for surplus and dependency models.

This research endeavors to locate the long-lost heirloom gamelan from the Sumenep Palace. Since the abolition of aristocratic status in 1883, the Sumenep Palace has lost political and economic legitimacy. To maintain the luxurious lifestyle of the aristocratic court, valuable items, including gamelans, were sold. The heirloom gamelans in the Sumenep Palace are believed to have been gifts from the Mataram Palace, often exchanged during various events, such as marriages. The Walasuji tradition is one of the cultural activities of the Bugis Makassar community, South Sulawesi, Indonesia. It can be found at wedding celebrations as a large gate made of bamboo called “Baruga” Walasuji. However, it is hard to find Baruga Walasuji at youth’s wedding nowadays.
