This contribution to the Notre Dame Law Review’s annual Federal Courts Symposium on “The Nature of the Federal Equity Power” asks what the traditions of equity can tell us about Article III standing. I take as my point of departure the observation by Professors Sam Bray and Paul Miller, in their contribution to the Symposium, that equity does not have causes of action as such—or at least not in the same way as actions at law. With the growing influence of intergovernmental organizations such as the European Union and the Association of Southeast Asian Nations (ASEAN), the scope and complexity of human resource development (HRD) activities have expanded. Informed by an institutional theory perspective, we examined the evolution of HRD as well as HRD-related programs in ASEAN to illuminate the mechanisms and conditions shaping HRD in ASEAN. Our primary sources were archival data from ASEAN from 1967–2021 and relevant publications of international development agencies that feature HRD-related activities in the region. Legislating Against Liberties: Congress And The Constitution In The Aftermath Of War, Harry Blain

How far can a democracy go to protect itself without jeopardizing the liberties upon which democracy depends? This dissertation examines why wartime restrictions on civil liberties outlive their original justifications. Through a comparative historical analysis of five major American wars, it illustrates the decisive role of the U.S. Congress in preserving these restrictions during peacetime. This argument challenges the prevailing consensus in the literature, which identifies wartime executive power as the main threat to postwar freedoms. It also reveals broader narratives of American constitutional development, including the rise and fall of intrusive congressional investigations, the decline of sedition legislation since …

For almost a century, Harlem has carried a symbolic weight that transcends the physical confines of upper Manhattan. In 1925, the philosopher and critic Alain Locke dubbed Harlem a “mecca,” a spiritual home that attracted people of African descent from around the world. Locke dubbed the cultural movement he chronicled in Harlem a “renaissance”—a term that describes both the “rebirth” of Black people as modern subjects and the resulting artistic effluence. In so doing, he cemented the neighborhood’s indelible connection to racial progress and artistic experimentation. Edward Said’s influential treatise on culture and imperialism, Orientalism, specifically called out German scholars of the Islamic “Orient” as being different. The lack of a formal German empire in Muslim lands seemed to preclude a culture of Orientalism. This dissertation examines the lived experience of Germans who traveled and worked in the Ottoman Empire from 1850-1918. As German interests sought their “place in the sun” during the decades before 1914, the Ottoman Empire became a major field of business investment, military-to-military contact, and missionary endeavor for Germans acting at the behest of both state and private interests. Female genital mutilation (FGM) affects women in many countries and carries significant socio-sexual and cultural implications such as affected female sexual pleasure and a strong association with traditions which are believed to form a cultural identity. This essay explored the lack of data and discourse regarding this practice among the Dawoodi Bohra community in Pakistan. Due to the Pakistani government’s lack of recognition and public dialogue on this issue, there remains no official laws, statistics, or empirical research about the ritual. This article looks at an ancient tradition of India called devadasis, which literally means “servant of God”. It requires girls as young as four years to be ‘married’ or ‘dedicated’ to a temple deity. Once a revered practice, over time the traditions evolved allowing women and children to become sexually exploited in the name of God. Looking at the reasons for the difficulty in combating this issue, this paper will first analyse its practices through a historical lense. When the manuscript is a cookery book, the well-known examples of Eliza Acton, reputedly inspired by a conversation with Mr Longman, and Isabella Beeton, who collaborated with her publisher husband, clearly demonstrate that publishers play a key role in determining whose ideas circulate, to whom they are presented and in what form.

This research explores the priorities of the gender equity commission in New York City over forty-five years. Archival commission data was organized thematically to understand the history of gender equity and suggest future possibilities for gender equity beyond New York City. In our historical analysis, we see an expansion of the definition of gender and an adoption of an intersectional approach to gender. We identify four historical gender priorities: sexual harassment and violence, pay equity and economic advancement, health and safety, and gender recognition and celebration. Yingzao referred to the Chinese architectural practice prior to the nineteenth-century introduction of the term jianzhu, the translation of “architecture.” The earliest preserved illustrated government-issued building standard was titled Yingzao fashi. Published by the Southern Song government in 1103, Yingzao fashi defined and regulated technical terms used to describe imperial construction as well as specified the labor costs of certain building techniques. These terms inform our understanding of the traditional Chinese way of categorization and knowledge system of architecture and architectural elements.

The U.S. government workforce has been consistently shrinking since a peak in the 1990s. At the same time, the need for technologically-savvy government workers has dramatically risen in this same period. This divergence in the demand for science, technology, engineering, and mathematics (STEM) employees challenges government leaders to retain these highly demanded workers in the public sector.
Decades of psychological research across many industries has investigated what motivates workers and how best to incentivize them to increase productivity. Maslow and Herzberg, among others, theorized that adult workers have both intrinsic and extrinsic needs that drive their behaviors and resultant productivity. …

In rural Canada the issue of school closures and consolidations due to low enrollment and heightened fiscal constraints has become a contentious and highly-charged issue for citizens and communities. This literature review synthesizes the major effects of school closure on rural communities, identifying economic impacts, social impacts, and implications for students. The historical context of Canadian rural schools, notions of rurality, urbanormativity and local complexity, along with considerations of urban-centred educational policy, are overarching themes identified in the rural school literature. This research examines the interpretation of 1Cor. 11:27−29 and the practice of worthy admission to the Eucharist within the historical context and tradition of the Ethiopian Orthodox Tewahedo Church (EOTC). Christianity in Ethiopia has ancient roots in Judaism and in the apostolic tradition of the early church fathers, whose religious orientation and teaching shaped the church’s history, tradition, doctrine, and religious practices. In particular, we examine the church’s focus on the sanctity of the Eucharist and the acceptable celebration of and participation in the Sacrament by the faithful.

Asian Americans occupy a contradictory position in the American educational landscape, at once glorified for their academic success and vilified for their “invasion” of White academic spaces. This narrative first took root in the 19th century, when the California Supreme Court ruled in the 1885 case Tape v. Hurley that Chinese American youth had a right to public education. Simultaneously, the state legislature declared that Chinese Americans must be educated in separate facilities from Whites. The first segregated “Oriental school” opened in San Francisco Chinatown that year. This study explores the oft-erased history of Asian American school segregation in …

Distilling lessons from the author’s book, The Media Offensive: How the Press and Public Opinion Shaped Allied Strategy during World War II, this article provides applicable suggestions for the US military today. As in World War II, the press is both a weapon and a possible vulnerability in modern warfare. Consequently, this article offers practical suggestions for how the press can be used by public affairs officers, commanders, and policymakers to achieve victory in coming conflicts.

This research revolves around drawing up the trends of scholarly contributions on collective action, in particular, the concept of ‘masses’ in a sample of literature of the Global South, driven by the significance of such action for more than a decade ago across various regions. Riding the Bahn, Reading Berlin: Berlin in Transit(ion) from Reichshauptstadt to Weltstadt (1871-1930) is a study of the relationship between Berlin’s public transit network and representations of the city in literature and film. The ride within the confines of the city differs from journeys with the national railway, and the passenger’s encounter with urban space diverges from the perambulating flâneur. Although Berlin’s intra-urban transit system relied on horse-drawn carriages and busses until the construction of the Stadtbahn in the 1880s, the number of passengers commuting and traveling in and around Berlin grew exponentially each year between the 1870s to the …

Technology is shaping our personal and professional lives every day, yet many educators struggle with its implementation and therefore are not using it to the fullest potential. The purpose of this single-case study was to analyze how a teacher’s participation in a Professional Development (PD) initiative influenced the implementation of mobile technology in teaching and learning mathematics. This study aims to highlight the lived experiences of young female professionals who currently lead in their fields, as well as the essence of a woman leader in such instances. The researchers used a hermeneutic phenomenological approach to illuminate the key informants' lived experiences as leaders with the anticipation to arrive at a novel perspective of leadership. The research findings align with the concept of purpose-driven leadership. The links between themes like compassion, empowerment, and adaptability are, however, intriguing because these leadership attributes are strongly associated with feminist conceptions of relationality, flexibility, and intuition.
