The Bogeyman Of Environmental Regulation: Federalism, Agency Preemption, And The Roberts Court, Kamaile A.N. Turčan
The Bogeyman Of Environmental Regulation: Federalism, Agency Preemption, And The Roberts Court, Kamaile A.N. Turčan
Minnesota Law Review Vols. 106:2 onward (2021-present)
In a trio of environmental cases—West Virginia v. EPA, Sackett v. EPA, and Loper Bright v. Raimondo—the Roberts Court curtailed the federal regulatory power and produced corresponding deregulatory outcomes under seemingly neutral legal principles. This Article interrogates the doctrinal coherency of the Roberts Court’s jurisprudence by applying the rationales of these cases to climate change litigation. Climate change policies advanced by state and local governmental plaintiffs represent the inverse of what the Court has previously rejected. The regulatory burdens arise under state, not federal, law. In this analysis, the Article advances a previously undertheorized aspect of the trio’s combined effect: …

Macrophages are the primary immune cells in the cochlea, essential for maintaining cochlear homeostasis and orchestrating inflammatory responses to pathological events. Although these cells have been found in various parts of the cochlea, their presence in the organ of Corti, a critical structure for acoustic sensing, remains poorly understood. The present study was designed to examine macrophage responses to ototoxic drug-induced cochlear damage and age-related cochlear degeneration, with a particular focus on the pathological conditions that trigger macrophage recruitment into the organ of Corti. We used a model of ototoxicity induced by cyclodextrin, a cyclic oligosaccharide known for its ability …

[Excerpt From] Evidence-Informed Health Policy (2nd Ed., Rev.), Jacqueline M. Loversidge, Joyce Zurmehly
Sigma Publications: Book Excerpts
What happens in health policy at local, state, and federal levels directly affects patients, nurses, and nursing practice. Some healthcare professionals, though, are intimidated by the complex and often nonlinear policy process or simply don’t know how to take the first step toward implementing policy change. In the second edition of Evidence-Informed Health Policy, authors Jacqueline M. Loversidge and Joyce Zurmehly demystify health policymaking and equip nurses and other healthcare professionals with the knowledge, tools, and confidence to navigate the first of many steps into health policy. This book translates the EBP language of clinical decision-making into an evidence-informed health …

Coal Geology & Exploration
Objective The global helium-rich gas reservoirs are dominated by conventional natural gas reservoirs. In recent years, helium-bearing natural gas has been discovered in the Carboniferous-Permian coal measures in the Ordos Basin and surrounding regions, revealing the resource potential of coal-measure helium. However, there is almost a total lack of studies on mechanisms underlying the diffusion and migration of coal-measure helium. This severely restricts further research on the accumulation patterns of coal-measure helium. Methods This study investigated a coal seam in the Taiyuan Formation in the northern Qinshui Basin and mudstones in the coal seam roof. Using physical diffusion experiments on …

Students’ perceptions of their likelihood to graduate are important determinants of their academic engagement, yet these perceptions remain understudied. This study, which is based on the 2021 Monitoring the Future survey of 8th- and 10th-grade students in the United States, uses machine learning algorithms to identify the most important factors that influence these perceptions. Among the tested models, random forest provided the best classification performance. Using permutation-based feature importance, we identified frequent participation in schoolwork, maternal education, paternal education, and homework completion as the most important predictors of students’ graduation perceptions. These results highlight the importance of targeted and well-coordinated …
The Clean Water Act And Avoidance Creep, Jack H.L. Whiteley
The Clean Water Act And Avoidance Creep, Jack H.L. Whiteley
Minnesota Law Review Vols. 106:2 onward (2021-present)
In Sackett v. EPA, the Supreme Court set out a test for the Clean Water Act’s jurisdiction over wetlands. The Act, the Court held, protects only those wetlands that have a continuous surface connection to relatively permanent bodies of water like streams, rivers, and lakes. If the connection lies below the surface, or is at the surface but discontinuous, the wetlands are presumed to fall outside the Act’s protections. The ruling, which abruptly curtailed how each administration since the 1970s had understood the Clean Water Act’s jurisdiction, has generated persuasive criticism from environmental scholars. In this Essay, prepared for the …

The Impact Of Loper Bright V. Raimondo: An Empirical Review Of The First Six Months, Robin Kundis Craig
The Impact Of Loper Bright V. Raimondo: An Empirical Review Of The First Six Months, Robin Kundis Craig
Minnesota Law Review Vols. 106:2 onward (2021-present)
One of the most impactful decisions of the U.S. Supreme Court’s 2023–2024 term was Loper Bright Enterprises v. Raimondo, which overruled the forty-year-old administrative law doctrine of Chevron deference. This doctrine allowed federal agencies to interpret ambiguities in the statutes that they administer. Courts cited Chevron over 18,000 times in its forty-year existence, or roughly 450 times a year—more than once a day, on average. Small wonder, then, that in the first six months after the Supreme Court decided Loper Bright, courts cited it more than 400 times. This article provides an empirical review of what courts are doing with …

The Role Of Langmuir Circulation In Coastal Flows Driven By Wind, Waves And Tides, Thathsarani Dilini Herath Herath Mudiyanselage
USF Tampa Graduate Theses and Dissertations
Langmuir Circulation (LC) is a wind and wave-driven process and is a key driver of vertical mixing and transport in the ocean. In coastal shelf regions, LC can span the entire water column, linking surface and bottom boundary layers and amplifying turbulent mixing. However, the influence of LC on vertical mixing and cross-shelf transport in shallow, tidally forced coastal waters remains poorly understood. This dissertation addresses this knowledge gap by developing a novel modeling framework based on the Reynolds-Averaged Navier–Stokes (RANS) equations, offering a computationally efficient alternative to more resource-intensive Large Eddy Simulations (LES).
The proposed RANS-based approach is first …
Does Practice Make Perfect? Examining The Impact Of Text-Based Reminders On Adherence In The Helping Our Toddlers, Developing Our Children’S Skills Program, Lauren Patrusky
USF Tampa Graduate Theses and Dissertations
Disruptive behavior disorders (DBDs) are prevalent in approximately 17% of children ages birth to 5 years (CDC, 2023). DBDs can significantly impact a child’s learning, social-emotional wellbeing, and ability to develop and maintain healthy relationship (CDC, 2023). Behavioral parent training (BPT) has been proven effective in reducing disruptive behavior and improving parent-child relationships. However, many families do not fully engage in treatment, leading to poor outcomes for both the child and the family. Chacko (2016) describes BPT engagement as enrolling in treatment, attending weekly sessions, participating in group discussions or role plays in sessions, practicing skills between sessions, and completing …
