Research Over Regulation: What Must Be Done To Mandate Warning Labels On Social Media, John L. Markel Jun 2025

Research Over Regulation: What Must Be Done To Mandate Warning Labels On Social Media, John L. Markel

Journal of Technology Law & Policy

Recently, outcry for social media regulation has risen after leaks, whistleblowers, and new research suggest that youth social media use has negative impacts on mental health. These claimed negative impacts can range from a variety of symptoms and diagnoses such as depression, anxiety, eating disorders, body image issues, envy, sleep loss, addiction, and even ADHD. Of course, technology companies adamantly deny such accusations and instead point to the benefits social media has for the youth and our society overall. Additionally, they make clear that this research is far from conclusive. This situation is simply a modernization of the previous situation …

The Role Of Antitrust And Pole-Attachment Oversight In Tva Broadband Deployment, Ben Sperry, Geoffrey A. Manne, Kristian Stout Jun 2025

The Role Of Antitrust And Pole-Attachment Oversight In Tva Broadband Deployment, Ben Sperry, Geoffrey A. Manne, Kristian Stout

Journal of Technology Law & Policy

As part of the Infrastructure Investment and Jobs Act (IIJA), signed by President Joe Biden in November 2021, Congress provided $42.5 billion for broadband deployment, mapping, and adoption projects through the Broadband Equity, Access, and Deployment (BEAD) program, with the stated goal of directing the funds to close the so-called “digital divide.” But actions by pole owners—such as refusing to allow broadband companies to attach their lines on reasonable and nondiscriminatory terms—threaten to slow broadband deployment significantly.

Section 224 of the Communications Act exempts municipal and electric-cooperative (co-op) pole owners, such as the LPCs, from oversight by the Federal Communications …

Through The Ai-Looking Glass And What Consumers Find There, Ashley Krenelka Chase, Sam Harden

Journal of Technology Law & Policy

While a lack of internet regulation is the norm in the United States, generative artificial intelligence (AI) presents a series of new challenges, particularly in the legal field. Those who are trained in the law know to check their sources, whether they come from case law or a generative AI tool like ChatGPT, but the average consumer is not so discerning. When that average consumer is in the midst of dealing with legal issues and has to navigate those issues without a lawyer, he or she is less likely to sit back and evaluate the information they’re being given, particularly …

The Current 'Ban-Demic': School Book Bans In The U.S., Barbara Perez, Jane Caputi

Dialogue: The Interdisciplinary Journal of Popular Culture and Pedagogy

This essay examines the alarming rise of U.S book. Our stance is grounded in our experiences as educators and academics in Florida, the state with the highest number of book bans and legislation that has significantly impacted education. Book bans infringe on freedom of expression, right to access information, = students’ right to education, and real harm to targeted communities (i.e., LGBTQIA+ and BIPOC communities), as the bans contribute to the ongoing marginalization and stigmatization of these communities. Diverse representation is key in literature and education. Banning popular culture texts from the classroom stifles critical thinking, social dialogue, and, ultimately, …
