This article examines the implications of Loper Bright on public land management through rulemaking. Part II provides a comprehensive overview of the case, its holding, and its potential ramifications. Part III delves into the history of the Administrative Procedure Act (“APA”), to illuminate the evolution and underlying rationale for agency deference. Part IV analyzes the constitutional framework underpinning the BLM’s statutory authority, rooted primarily in the Property Clause, which delegates the task of making “needful” rules governing public lands to Congress and to federal land management agencies. A Most Essential Power: The Case For Restoring Comprehensive Land Use Authority In Indian Country, Michelle Bryan
Public Land & Resources Law Review
Part I of this article provides a brief overview of allotment and its lingering jurisdictional quagmire on impacted reservations. Stepping outside of Indian Country, Part II then outlines the U.S. Supreme Court’s longstanding recognition of sweeping, area-wide government land use authority—authority it considers among the “most essential” and “least limitable.” The Court has never applied this established law when determining tribal sovereignty over land use. That application is long overdue.
Part III details how we arrived at this state of affairs—how tribes, despite starting with sovereign control over land use throughout their territories, experienced losses in that authority over time …

This Article begins by discussing Manoomin and Sauk-Suiattle, orienting the reader to how these complicated jurisdictional issues have been addressed by Tribal courts. Next, this Article sets forth the current framework under Montana and Merrion for determining the extent of Tribal civil jurisdiction over non-Indians. Next, this Article examines the caselaw establishing Tribal Nations’ inherent sovereign authority to exercise civil jurisdiction over non-Indian activities and conduct occurring on-reservation that threaten or affect Tribal water resources and rights. Charles Wilkinson, a beloved teacher, author, and advisor, gave his readers perhaps his most personal gift in Treaty Justice: The Northwest Tribes, the Boldt Decision, and the Recognition of Fishing Rights (U. Washington Press, 2024). Wilkinson finished the manuscript just a week before his unexpected death, at age 81, in 2023. Land title issues on Indian Reservations are notoriously but unnecessarily complex. Unsettled land titles and the resulting fragile land ownership status on Indian Reservations are well-known factors impeding productive land uses, the cure of environmental degradation, and Indian sovereignty, ownership, and control over sustainable land uses. Some lawsuits even question the existence of a Reservation itself. Land titles to many parcels on Indian Reservations have been split into thousands of owners. Using existing law and principles of equity, abandoned Reservation rights-of-way of many types do not have to sit unused and economically unproductive. Occupational noise exposure in industrial environments presents considerable hazards to workers' health and welfare. This case study analyzes the noise levels in the Maintenance & Workshop units of a small-scale food industry in Saudi Arabia, and assesses the related health impacts. The research indicates that noise levels are often above the advised safety limits, with several locations recording measures over 85 dBA, hence increasing the risk of Noise-Induced Hearing Loss (NIHL), cardiovascular complications, and psychological distress. Survey data indicates that around 32% of employees claimed that they suffer from hearing impairment, while a considerable number claimed cardiovascular and mental health …

Wheelchairs play a vital role in providing mobility for individuals with physical disabilities. Enhancing these devices with modern technology significantly improves user convenience and overall functionality. A key enhancement involves integrating smartphones into wheelchair systems. While conventional wheelchairs are generally operated manually, this research presents a smart wheelchair prototype adapted from a standard classroom chair, which is wirelessly controlled using a smartphone via Bluetooth and an Arduino Uno R3 microcontroller. Despite being prone to fungal diseases, particularly those caused by Aspergillus species, the pomegranate fruit is greatly esteemed for its nutritional value and health benefits. Fungal infections can inflict significant damage and may produce mycotoxins, which pose serious risks to human health. Species of Aspergillus are responsible for causing diseases that affect pomegranate fruit in Taif, Saudi Arabia. This study aims to assess the efficacy of neem extract and its silver nanoparticles as antifungal agents against these infections. Introduction. One consequence of DM is the emergence of peripheral artery disease (PAD) and diabetic peripheral neuropathy (DPN). Calorie restriction can increase survival and reduce mortality rates. Water treatment technology selection depends on contaminant type and budget. Fluoride removal from water is particularly challenging, requiring non-conventional treatment technologies (Radwan, 2023). Several regions in Tanzania, including Arusha City, are affected by fluoride contamination. Diagnostic criteria for substance use disorder, cocaine type (i.e., cocaine use disorder), outlined in the 5th edition of the Diagnostic and Statistical Manual of Mental Disorders, imply that the disorder arises, at least in part, from the maladaptive allocation of behavior to drug use. To date, however, the neural circuits involved in the allocation of behavior have not been systematically evaluated. Food Waste (FW) in urban households remains a serious issue as it contributes to economic losses, reduced dietary quality, and weakened food security. This study aims to identify the dominant factors influencing food management behavior, FW generation, and their implications for household food security in urban settings. A cross-sectional design was applied with urban households as the study population, and samples were selected using purposive sampling. Data were analyzed using Structural Equation Modeling (SEM) within the framework of the Theory of Planned Behavior (TPB) and Nudge Theory. The results indicate that attitude (β = 0.42; p < 0.01), subjective norm (β = 0.31; p < 0.05), and perceived behavioral control (β = 0.36; p < 0.01) significantly influence intention toward food management. Furthermore, intention strongly predicts actual food management behavior (β = 0.55; p < 0.001), which subsequently reduces FW (β = –0.47; p < 0.001). Reduced FW positively affects both food expenditure efficiency (β = 0.39; p < 0.01) and energy intake adequacy (β = 0.34; p < 0.05), two critical indicators of urban household food security. Behavioral factors play a crucial role in reducing FW and strengthening food security in urban households. Therefore, behavior-based interventions using TPB and Nudge Theory are recommended to be integrated into food education programs, household assistance, and urban food security policies to ensure effectiveness and sustainability.

Reversing a half decade in gains, the all-land average value in Nebraska declined for the year ending February 1, 2025, averaging approximately 2% lower than the prior year. Figure 2 summarizes these figures and trends along with the percent changes over the preceding year’s all-land average for the eight districts in the state.
Rates of decline were the highest in the Northeast and Southeast Districts, as these areas averaged 3% lower for the all-land average. These Districts trended slightly similar to the state's rate of decrease of 2%. The South and Southeast District also averaged 2% lower.

Seagrasses are a valuable component of global blue carbon ecosystems yet are also endangered due to natural and man-made pressures. This study assessed the seagrass resources regarding species community structure and diversity using a transect-quadrat design along the intertidal coastlines of selected towns of Surigao del Sur. Of the 19 recorded species in the Philippines, seven common species were observed: Cymodocea rotundata, Enhalus acoroides, Halodule pinifolia, Halodule uninervis, Thalassia hemprichii, Syringodium isoetifolium, and Halophila ovalis.
