Tort Immunity Waiver For Vaccine Injuries: Ethical And Legal Perspectives, Tammy W. Cowart, Gregory L. Bock
Tort Immunity Waiver For Vaccine Injuries: Ethical And Legal Perspectives, Tammy W. Cowart, Gregory L. Bock
Accounting, Finance, Information Systems, and Business-Law Faculty Publications and Presentations
The COVID pandemic highlighted the importance of vaccine development and availability worldwide. Operation Warp-Speed in the United States accelerated vaccine production by several major pharmaceutical manufacturers, averting some of the normal administrative processes. The result has been a financial windfall for those companies. Some recent data has shown that the COVID vaccine can cause negative side effects in some patients. There are provisions in U.S. law that allow victims of vaccine injuries to recover compensation through the court system. However, even then tort remedies are limited by federal law. Since the review process was rushed during the pandemic, should tort …

Pandemic-Driven Healthcare Disruptions And Their Disproportionate Impact On Patients With Diabetes: Evidence From Texas, Meryem Saygili, Gultekin Gollu, Zehra Tekin
Economics Faculty Publications and Presentations
Background: Diabetic Ketoacidosis (DKA) is a life-threatening complication of uncontrolled diabetes. The COVID-19 pandemic may have increased DKA incidences and worsened outcomes both through the potential diabetogenic effects of SARS-CoV-2 infection (direct effect) and through pandemic-related disruptions in healthcare (indirect effects,) including delays in seeking or receiving care, reduced access to routine outpatient services, and strains on hospital capacity. The objective of this study is to examine changes in the frequency and outcomes of hospitalizations with DKA in Texas hospitals following the COVID-19 pandemic and to quantify the contributions of pandemic-related healthcare disruptions and SARS-CoV-2 infection. Comparisons to patients with …

A Better Great Plains: Bridging The Implementation Gap For A Better Future, David W. Sandahl
A Better Great Plains: Bridging The Implementation Gap For A Better Future, David W. Sandahl
School of Natural Resources: Dissertations, Theses, and Student Research
The Northern Great Plains is experiencing extensive native grassland loss and landscape degradation, jeopardizing both ecological integrity and the socio-economic systems that rely upon these ecosystems. In an early effort to lessen degradation, the United States Department of Agriculture (USDA) introduced the Conservation Reserve Program (CRP) which generated ecosystem services benefits such as reduced soil erosion, improved water quality, and increased species diversity through the retirement of cropland and rangeland for 10- or 15-year contracts. However, CRP has not fully modernized alongside today’s agriculturalists and adoption remains shaped by an historically fraught socio-political context characterized by deep-seated mistrust between ranchers, …

Use Of Modified Z-Domain Peptides To Specifically Label The Constant Region Of Immunoglobulin G And Vegf, Madeline Allen
Department of Chemistry: Dissertations, Theses, and Student Research
Antibodies are increasingly being used in medicinal therapies due to their ability to specifically bind to a target antigen. This fundamental behavior of antibodies has been used as a key component in drug development to address common problems with traditional drug molecules such as off-targeting, fast drug clearance, and low efficacy. This thesis provides some background into how antibodies can be used as potential treatments for a few diseases. Chapter 1 begins with an overview of the human immune system, and the role antibodies play within it. Then, the variety of ways in which antibodies can be used as medicinal …

“Il N’Y A Plus De Monstres”: A Case Study On Trans And Gender-Diverse Health In Switzerland, Sophie Lin
“Il N’Y A Plus De Monstres”: A Case Study On Trans And Gender-Diverse Health In Switzerland, Sophie Lin
Switzerland: Global Health and Development Policy
Transgender and gender-diverse (TGD) populations experience significant health disparities, particularly in regards to mental health outcomes and quality of life. This case study employs a qualitative approach to elucidate barriers and enablers to TGD health and gender-affirming care in Switzerland. Evidence collected from semi-structured interviews with health professionals working with Swiss TGD communities provides a thorough understanding of contemporary resources and obstacles regarding gender-affirming treatment. This research seeks to contribute to scholarship by synthesizing health literature with critical queer theory. Drawing from Butler’s theory of gender performativity, a framework of gender self-determination is advanced as a core principle of health, …
Nutrition In Context: How Cultural Beliefs, Gender Norms, Social Environments, And Interventions Shape Maternal Nutrition In Nepal, Rebecca Fan
Switzerland: Global Health and Development Policy
Maternal nutrition is recognized as one of the most significant and modifiable determinants of persistent inequities in maternal and neonatal health. In Nepal, what women are able to eat and how they experience pregnancy are all shaped by a complex interplay of cultural beliefs, gendered expectations, household dynamics, structural barriers, and nutrition intervention efforts. This study examines these intersecting factors through ethnographic accounts, peer-reviewed scientific literature, expert interviews, and an analysis of current interventions operating across different levels. Specifically, to understand the social environments shaping maternal nutrition, the paper explores cultural beliefs and misconceptions surrounding food, women’s limited control over …

Communication Sciences and Disorders Faculty Articles and Research
Background
People with post-stroke aphasia are often excluded from shaping the research meant to support their recovery. Communication barriers, research norms, and traditional outcome frameworks contribute to a lack of meaningful involvement, particularly in the identification of patient-centered outcomes. While participatory models in aphasia research are emerging, few examples describe how individuals with communication disabilities can lead or co-create research priorities.
Main body
This case study describes a structured, collaborative effort to center the voices of people with aphasia in identifying meaningful outcomes for recovery. Through a partnership between the Patient Engagement Studio (PES) and the Center for the Study …

Strategic Leadership In Security Media: Enhancing Community Safety Against Drug Abuse In Oman, Raed Awashreh, Saif Alshuhoomi,, Viola Gjylbegaj
Journal of Strategic Security
Rapid global development has led to increased security challenges, particularly regarding drug-related crimes. This study examines the role of strategic leadership in security media to enhance community security, focusing on drug abuse in Oman. Despite ongoing efforts to combat drug-related offenses, these crimes remain a significant threat to societal stability. The qualitative research involved in-depth interviews with 14 decision-makers, including 7 experts from Oman’s security media, police, and related institutions. It explores the effectiveness of security media campaigns in raising awareness and reducing drug use. Thematic analysis of the data revealed key challenges, including limited resources, outdated technologies, and insufficient …

Chapter 1: A Brief History Of Archival Appraisal. In Selecting And Appraising Archives And Manuscripts, Michelle Light
Library Staff Publications
This chapter traces the evolution of archival appraisal theory and practice in the United States, situating it within shifting technological, social, and intellectual contexts from the late nineteenth century to the present. In this roughly chronological account, the chapter underscores continuity and disruption in selecting and appraising archival records. It highlights the influence and ongoing critiques of Theodore Schellenberg’s evidential and informational values, as well as subsequent expansions by Maynard Britchford and others. It explores transformative moments such as F. Gerald Ham’s call for coordinated documentation, the development of the Black Box model, the rise of documentation strategy, and the …
'In A Mirror, Dimly, Then Face To Face:' Reflecting On Bodily Sin And Spiritual Purity In The Central Female Figures Of Hugo Van Der Goes' Vienna Diptych, Sara Kluka
Theses
This thesis seeks to examine the so-called Vienna Diptych (1478/1479) by Hugo van der Goes. The two panels of the diptych have been displayed together since the 19th century, yet difficulties in provenance and the dating of the artist’s oeuvre have resulted in the continued questioning of its intended creation as a single campaign. This research seeks to assert the diptych’s thematic unity through a concentrated analysis of its leading female figures, a vantage point that has not yet been fully addressed in the literature. This paper will therefore examine the iconographic precedents for the unique imagery of the panels …
Ambiguous Bodies: Third Gender Expressions In Ancient Maya Art, Jayme Horne
Ambiguous Bodies: Third Gender Expressions In Ancient Maya Art, Jayme Horne
Theses
This thesis examines the interpretations of Lintels 23, 24, and 25 from Yachilán, Drawing 18 from Naj Tunich, and Stela H from Copán, with a specific focus on third gender expression. These artworks depict figures that blend masculine and feminine attributes, from costuming to actions, to present intentionally ambiguous representations of the body that all ancient Maya people would have understood. Third gender expression is defined through the blending of masculine and feminine signifiers. It is a gender identity for people who do not identify as male or female, but rather as neither, both, or a combination of male and …
Draft Card Battler, Brian Moore
Draft Card Battler, Brian Moore
Theses
This project investigates how design transparency and player interaction mechanics can enhance emotional connection and strategic depth in competitive digital card game environments. Draft Card Battler transforms traditional sequential turn-based Trading Card Game (TCG) gameplay into a structured round-based system featuring asymmetric card-play patterns (1-2-2-1) and simultaneous combat resolution. Beginning with a physical card game prototype, the project evolved through iterative design and digital implementation, informed by research in social capital theory and player psychology. Through reflective playtesting and technical development, this study explores whether visibility, pacing, and commitment mechanics foster trust, fairness, and cooperation alongside competitive tension. The implementation …

Not Born A Democracy: Constitutional Preconditions, Martha Minow
Not Born A Democracy: Constitutional Preconditions, Martha Minow
William & Mary Law Review
Beneath growing perceptions of constitutional crisis and democratic fragility in the United States lies a fundamental conundrum. Critical preconditions for effective self-government are either weak or missing in action, and our constitutional system, at least for now, stands in the way of actions to strengthen or build those preconditions. This Article focuses on three essential predicates for constitutional democracy that face jeopardy: education, reliable news, and security against lethal violence. As basic as these elements may be, repeated efforts to secure a federal constitutional right to education have failed in the courts. Because of a confluence of legal, technological, and …
What Is The Relationship Between Success On The Limited X-Ray Machine Operator Exam And The First-Attempt Pass Rate On The National Registry Exam Among Radiologic Technology Students In Minnesota?, Britni Hardy
Education Doctorate Dissertations
This quantitative correlational study examined the relationship between success on the Limited X-Ray Machine Operator (LXMO) exam and first-attempt pass rates on the national registry exam among radiologic technology students in Minnesota. The radiologic technology field faces significant challenges, including a 14.9% national attrition rate, workforce shortages, and limited availability of clinical sites. This research explored whether LXMO certification could serve as an innovative approach to address these interrelated issues. Data were collected from the Minnesota Department of Health and the American Registry of Radiologic Technologists, spanning 2000-2024, and identified n=24 students who had completed both exams. Results revealed that …

Seeing Is Believing: Identifying The “Ideal Manifestation Of Hidden Disability” In Ontario’S And Quebec’S Social Benefits Tribunals, Pascale Malenfant
Seeing Is Believing: Identifying The “Ideal Manifestation Of Hidden Disability” In Ontario’S And Quebec’S Social Benefits Tribunals, Pascale Malenfant
Dalhousie Law Journal
The phenomenon of disability skepticism, especially in relation to “hidden” disabilities like chronic fatigue syndrome (CFS), has fostered a culture of doubt among medical, legal, and public entities. This paper explores the intersection of such skepticism with the social benefits adjudication processes in Ontario and Quebec. In drawing parallels to feminist critiques of the “ideal victim” in sexual assault cases, it argues that the tribunals’ biased framework for believability is based on a claimant’s conformity to stereotypical expectations of what an “ideal” claimant with a hidden disability looks like. By comparatively examining 10 years worth of Ontario and Quebec tribunal …
Curricular Choices: Misconceptions Regarding Law School Courses, Constance Backhouse, Holland Stille, Avery Esford
Curricular Choices: Misconceptions Regarding Law School Courses, Constance Backhouse, Holland Stille, Avery Esford
Dalhousie Law Journal
Canadian law schools offer their upper-year students a wealth of optional curricular choices. Yet many students choose narrowly and poorly. This article addresses the misconceptions that many hold as they select their second- and third-year courses. Often students believe they need certain courses to get a job, to prepare for articling, to pass the bar exams, or to prepare for future legal careers. In most cases, these concerns are erroneous. This article urges students to choose based on factual evidence rather than imagined anxieties and on personal interest rather than the “group think” rigidity that infects much of the curricular …
Border Decriminalization As A State Project: Lessons From Marijuana And Assisted Suicide Legalization Across The United States, Victor C. Romero
Border Decriminalization As A State Project: Lessons From Marijuana And Assisted Suicide Legalization Across The United States, Victor C. Romero
William & Mary Journal of Race, Gender, and Social Justice
My prior work argued for the decriminalization of border crossings without proof of specific intent to violate another law (like drug trafficking), which is even less likely to happen now than it was when the piece was published, given the current presidential administration’s zealous deportation strategy and Congress’s seeming acquiescence. As such, I advocate for a second-best solution involving federal-state cooperative agreements wherein border states abutting both Mexico and Canada are given the option by the federal government to pass local legislation decriminalizing border crossings into their states as their communities desire. To the extent that the current presidential administration …

Getting There From Here: Reflecting On Compassionate Migration Policy, Steven W. Bender
William & Mary Journal of Race, Gender, and Social Justice
Having written about Latinx issues for more than three decades, with a focus on immigration policy for at least the last two decades, I see no middle ground in this time of Trump. Those who relish hurt and hate, and those scholars who wrote the kindling for that bonfire, must be basking in the glow of their handiwork. Those of us who I claim are on the right side of history must search through the ashes for hope—the where, when, and how to nurture humanity on scorched ground. Counting myself among those searching for hope, I acknowledge the indulgence offered …

"America's Paradise": The Enduring Costs Of Imperialism And Colonial Rule--A Case Study Of The U.S. Virgin Islands, Diamond C. Ash
William & Mary Journal of Race, Gender, and Social Justice
As the United States prepared to enter World War I, it secured another strategic territorial holding in the Caribbean. Six days before declaring war on Germany, the United States purchased the Virgin Islands (USVI) from Denmark—not for economic development or the welfare of its people, but as a military asset. St. Thomas, St. Croix, and St. John became a strategic outpost for naval dominance and national security.
Like other unincorporated U.S. territories, the USVI’s governance was shaped by imperial ambitions and reinforced through legal structures that preserved federal dominance. In practice, this created a system of colonial rule in which …
