Checks, Balances, Tariffs, And Justice Kavanaugh, Stanley I. Langbein Dec 2025

Checks, Balances, Tariffs, And Justice Kavanaugh, Stanley I. Langbein

ConLawNOW

Justice Kavanaugh’s concurring opinion in FCC v. Consumers Research was remarkable in a number of respects, principally because it expressed very strong views on matters currently under consideration by the Supreme Court, although some of the issues he resolved were not issues posed by the Consumers’ Research case itself. Foremost among the positions he expressed were a muted version of the nondelegation doctrine and the view that the major questions doctrine has virtually no application to matters involving foreign affairs. The tariff decision now pending before the Court, in the V.O.S. Enterprises and Learning Research cases, may present a collision …

It’S “Purposeful” For A Reason: Amb Media And Purposeful Availment In The Internet Age, Levi C. Griesing

St. John's Law Review

(Excerpt)

This Note argues that the Sixth Circuit’s ruling in AMB Media II expands the scope of personal jurisdiction to a degree that prevents fairness and due process for out-of-state defendants. Thus, this Note argues that the purposeful availment inquiry for cases involving generally-available commercial websites should include a targeting requirement—that there must first be an action to solicit business taken on behalf of the defendant in the forum state. Part I will review the goals of the personal jurisdiction doctrine and a brief history of purposeful availment cases before and after the Internet age. Part II will discuss AMB …

Disposing Of Misdemeanors: An Empirical Perspective, Cynthia Alkon, Jonathan Marshall, Kyle Chrisman, Lydia Sidhom

St. John's Law Review

(Excerpt)

This Article will begin by discussing why misdemeanors matter and the importance of examining these cases to better understand how the criminal legal system is functioning or not. Next, in Section III, we will discuss the importance of plea bargaining, both how it works in practice and the concerns surrounding this process. We will then turn, in Section IV, to a discussion of why it matters to have better data so that the players in the system are better informed about how the legal system actually works. Better data contributes to transparency, which can help improve the general public’s …

Packing Our Way To Balance: A Necessary Correction For The Supreme Court, Robert E. Wagner Dec 2025

Packing Our Way To Balance: A Necessary Correction For The Supreme Court, Robert E. Wagner

St. John's Law Review

The Supreme Court is in turmoil. It has the lowest recorded approval rating in its history. Multiple decisions over the past decade made by Justices nominated by a single political party, that the majority of the country viewed as political in nature, have tarnished the reputation of what was once a beacon of justice and impartiality. The Court is increasingly seen as a partisan institution with political actors rather than the fair and honest arbiter America needs it to be. In addition to dramatically unpopular decisions, the Court has suffered increasingly hostile and political machinations in its nominating process. This …

Patenting Health: How Intellectual Property Rights Jeopardise Medical Research, Lorenz N. Soukup Dec 2025

Patenting Health: How Intellectual Property Rights Jeopardise Medical Research, Lorenz N. Soukup

Bates College Journal of Political Studies

Recent health crises have taught us that proper resource allocation is an important tool in the fight against e.g., pandemics and endemics. This concerns medical care on the one side, but also medical research as a precursor and catalyst for successful implementation of interventions, on the other side. James R. Brown argues that the most effective way to make use of medical research is to make the funding a public affair, removing private stakeholders from the equation. Concretely, he proposes to remove intellectual property rights in medicine as a whole. This paper evaluates his thesis.

Recurring Patterns In Democratic Backsliding: The United States, Hungary, And Israel, Leah Brouda Dec 2025

Recurring Patterns In Democratic Backsliding: The United States, Hungary, And Israel, Leah Brouda

Bates College Journal of Political Studies

Utilizing a three-pronged analysis method, this article argues that not only is democratic backsliding – the degrading quality of democratic institutions in a state – on the rise but that it has frequent recurring themes. These themes are consolidation of executive authority, changes in court power and judicial independence, and election manipulation. Utilizing a combination of public opinion research and indexes such as Freedom House and the Global State of Democracy Index (GSDI), these themes emerge as patterns that are both understood and misconstrued by citizens in each country and of the world. The analysis is based on themes in …

Combating Human Rights Abuses In The Democratic Republic Of Congo, Karan Kuppa-Apte

Bates College Journal of Political Studies

This article focuses on human rights abuses stemming from the mining industry of the Democratic Republic of Congo, particularly in the country's eastern region. It argues that the United States (US), European Union (EU), and China should strive to uphold human rights in DRC because of their significant global presence and involvement in the country's mining industry. It begins with an overview of the conflict, including its historical origins, relevant actors, and current status quo. It continues by describing two unsuccessful strategies that have been tried to protect human rights. It concludes with a recommendation to the US, EU, and …

Conflating Disease, Morality, And Sex: Regulating Military Fitness In The War Years, Hanna Ranis Dec 2025

Conflating Disease, Morality, And Sex: Regulating Military Fitness In The War Years, Hanna Ranis

Bates College Journal of Political Studies

The United States military worried about the impact of venereal diseases on the ability of soldiers to fight in both World War 1 and 2. The war years thus resulted in an increase in regulations that sought to curb the spread of venereal diseases. Much of this regulatory shift has focused on how police targeted women who were suspected of spreading venereal diseases to American soldiers. Women were profiled as promiscuous and possible sex workers, with the lines between the two categories becoming increasingly blurred. Policing was viewed as a public health regulatory mechanism that needed to be carried out …

Incorrect Administration Of The Rabies Vaccine Leading To An Unusual Case Of Acute Bursitis And Tendonitis Of The Rotator Cuff, Chelsea Lee, Jina Nmn Park, Alberto Giardini Dec 2025

Incorrect Administration Of The Rabies Vaccine Leading To An Unusual Case Of Acute Bursitis And Tendonitis Of The Rotator Cuff, Chelsea Lee, Jina Nmn Park, Alberto Giardini

The Journal of Integrated Primary Care

Shoulder injury related to vaccine administration (SIRVA) is an uncommon but increasingly recognized complication resulting from improper intramuscular injection technique. SIRVA occurs when a vaccine is administered too high or too deep into the deltoid muscle, leading to inflammation of the shoulder structures such as the rotator cuff and subacromial bursa. While most reported cases involve influenza and pneumococcal vaccines, SIRVA following rabies vaccination is rare. This case highlights a 46-year-old female who developed acute rotator cuff tendinitis and bursitis after a malplaced rabies vaccine injection. Early recognition and intervention, including corticosteroid injection and physical therapy, led to significant symptom …

Combination Treatment Of Cordycepin And Radiation Induces Apoptosis Accompanied By Protective Autophagy In Tm3 Mouse Leydig Progenitor Cells, Yu-Yan Lan, Yi-Ping Lee, Wei-Ru Huang, Chun-Ying Yu, Lyh-Jyh Hao, Chun-Hung Lin, Bu-Miin Huang

Journal of Food and Drug Analysis

Leydig cells are anatomically located in the testicular interstitial tissue, and their main function is to produce and secrete testosterone and indirectly support spermatogenesis. We previously reported that the combination treatment of cordycepin and radiation can effectively induce Leydig tumor cell apoptosis through cell cycle arrest, caspase activation, endoplasmic reticulum (ER) stress, reactive oxygen species (ROS) accumulation, and DNA damage. However, there is still a lack of scientific evidence for the susceptibility of normal Leydig cells to the combination treatment. In the present study, mouse TM3 Leydig progenitor cells were used as a model to evaluate the effects and mechanisms …

Development Of An Untargeted Metabolomics Analytical Protocol For Fecal Samples By Liquid Chromatography–Mass Spectrometry, Tsai-Wei Ting, Chih-Ning Cheng, Chieh-Chang Chen, Ching-Hua Kuo

Journal of Food and Drug Analysis

Gut microbiota has recently gained attention for its role in regulating multiple host pathways and contributing to disease developments. Fecal metabolomics using liquid chromatography—mass spectrometry (LC—MS) offers a promising approach to study gut microbial metabolites; however, it remains technically challenging due to the complex, heterogeneous nature of fecal samples and the lack of standardized protocols. This study aimed to establish a robust and reproducible untargeted fecal metabolomics workflow. We systematically evaluated sample preparation parameters―including sample amount, extraction solvent, numbers of extraction, and sample-to-solvent ratio―and assessed method reproducibility. Additionally, we compared three LC—MS data acquisition workflows using 10 samples from inflammatory …

Dna Tetrahedron-Au Nps-Go For Enhanced Fluorescence Detection Of Serotonin, Zhang Yun, Wu Qiong, Gao Hui, Zhang Hua, Miao Xiang-Min

Journal of Food and Drug Analysis

Evidence had accumulated that serotonin (5-HT), a hormone and neurotransmitter, was not only involved in a variety of different physiological and central nervous system functions but also in the development and manifestation of psychiatric diseases. Here, DNA tetrahedron-Au NPs-GO for enhanced fluorescence sensor was designed for detecting serotonin. Au NPs-GO was used as a fluorescence quencher, while fluorophore-labeled DNA tetrahedron was used as a donor, resulting in fluorescence resonance energy transfer (FRET) from the fluorophore to Au NPs-GO (signal off). With the strong binding ability of aptamer to serotonin, S5 was released from Aptamer: S5 duplex, then reacted with the …

Targeting Chemical Carcinogenesis: Α-Pinene And D-Limonene As Chemopreventive Agents Against Nnk/ Tcdd- And Urethane-Induced Lung Tumorigenesis, Kuo-Ching Huang, Vui-Hyen Chew, Yu-Ying Chen, Huey-Jen Su, Hao-Ting Chang, Rong‑Jane Chen, Ying‑Jan Wang

Journal of Food and Drug Analysis

Lung cancer is the leading cause of cancer-related deaths worldwide, driven by carcinogens such as tobacco-derived nitrosamines, dioxins, and urethane. This study evaluated the chemopreventive effects of two monoterpenes, α-pinene and D-limonene, using NNK/TCDD- and urethane-induced lung tumor models and A549 lung cancer cells. Both compounds significantly reduce tumor number and size, with enhanced effects when combined. Mechanistic studies revealed suppression of PRC1, β-catenin, and c-Myc, alongside activation of p53, Bax, and caspase-3, indicating inhibition of the PRC1—Wnt/β-catenin pathway and induction of apoptosis. These findings suggest α-pinene and D-limonene as safe, promising agents for lung cancer chemoprevention.
