The Nlrb’S Authority To Make Workers Whole, Wanny Mei Jan 2026

The Nlrb’S Authority To Make Workers Whole, Wanny Mei

Fordham Law Review

In December 2022, the National Labor Relations Board (NLRB or the “Board”) announced a modified make-whole remedial framework in Thryv, Inc.For all standard make-whole relief orders, the Board would order relief for direct or foreseeable pecuniary harms that employees suffer as a result of an unfair labor practice. Proponents of this remedial design assert that this is consistent with the Board’s authority under section 10(c) of the National Labor Relations Act (NLRA). On the other hand, opponents find that this design exceeds the Board’s statutory authority and conflicts with the Seventh Amendment right to a jury trial.

The Dead Hand And Frozen Lives: Embryonic Personhood And The Disruption Of Property Interests, Emma Miloglav Jan 2026

The Dead Hand And Frozen Lives: Embryonic Personhood And The Disruption Of Property Interests, Emma Miloglav

Fordham Law Review

Advances in assisted reproductive technology and the expansion of fetal personhood laws are colliding with a body of property doctrine built on assumptions about reproduction that no longer hold. In LePage v. Center for Reproductive Medicine, P.C., the Supreme Court of Alabama held that extrauterine embryos—fertilized and frozen in a laboratory—are “children” under the state’s Wrongful Death of a Minor Act. LePage represents a dramatic extension of fetal personhood.

This shift carries profound consequences for trusts and estates. If frozen embryos are treated as legal persons, they may qualify as heirs under intestacy statutes and as beneficiaries of wills, …

Supporting Functional Independence Through Task-Analytic Instruction: Implications For Skill Acquisition And Generalization In Students With Moderate To Severe Disabilities, Aisha Khan Jan 2026

Supporting Functional Independence Through Task-Analytic Instruction: Implications For Skill Acquisition And Generalization In Students With Moderate To Severe Disabilities, Aisha Khan

Doctor of Education (EdD)

Students with moderate to severe disabilities often demonstrate variability in acquiring and generalizing functional skills necessary for independent participation in school and daily life. Although evidence-based practices are widely recommended, less is known about how specific instructional strategies support both skill acquisition and generalization. The purpose of this quantitative single-subject study was to examine the effects of task-analytic instruction on the acquisition, efficiency, and generalization of a functional help-seeking routine among middle school students with moderate to severe disabilities in a self-contained life skills program. Using a multiple-baseline design across three participants, the study measured (a) the percentage of independently …

An Impact Evaluation Study Of The Use Of A Structured Advisory Class To Operationalize Sel Curriculum: An Intervention To Improve School Connectedness, Lacey Rebecca Rotella Jan 2026

An Impact Evaluation Study Of The Use Of A Structured Advisory Class To Operationalize Sel Curriculum: An Intervention To Improve School Connectedness, Lacey Rebecca Rotella

Doctor of Education (EdD)

This sequential explanatory mixed-methods study examined the impact of a structured, twiceweekly advisory class designed to operationalize social-emotional learning (SEL) curriculum as an intervention to strengthen middle school students’ sense of school connectedness. Prompted by low California Healthy Kids Survey (CHKS) results and inconsistent curriculum implementation, the study—grounded in stage-environment fit theory, ecological systems theory, social cognitive theory, and self-determination theory—investigated whether this intervention influenced students’ reported sense of connectedness and how students themselves defined and experienced belonging within the school environment. Phase I analyzed CHKS School Connectedness data from 378 eighth-grade students and engagement indicators, including chronic absenteeism, average …

Wastewater testing for SARS-CoV-2 provided useful public health information during the COVID-19 pandemic yet was underutilized in rural communities. We addressed this gap by implementing wastewater surveillance and assessing its performance in 10 communities in Eastern Kentucky. We collected wastewater samples 1–2 times weekly at 10 wastewater treatment plants (WWTPs) from May 2021 until April 2023 and measured SARS-CoV-2 RNA concentrations using polymerase chain reaction testing. We calculated time-lagged correlations between wastewater concentrations and county-level reported COVID-19 cases by site. We developed a generalized linear model to estimate COVID-19 incidence from wastewater SARS-CoV-2 concentrations. The 10 participating WWTPs served 2430 …

Why Queer People Like Horror Films: An Empirical Study, Oscar Garcia Jan 2026

Why Queer People Like Horror Films: An Empirical Study, Oscar Garcia

Theses & ETDs

Many queer people hold a particular affinity for horror films, despite the history of harm to queer people that those films have helped to perpetuate. Previous explorations of this relationship have focused on timelines of queer and film history, personal anecdotes, and theorization about these films and the audiences who view them, with no broad study examining how queer people themselves interact with and perceive the media. This study explores how queer people engage with horror films using a multi-method approach that involves a survey and qualitative interviews, examining queer horror fans’ opinions about subgenres, identifications, preferences, impacts of horror …

This study examines the U.S. professional sports industry through the Structure-Conduct-Performance (SCP) framework, which is a model commonly used to analyze how a market organization (structure) affects a firm’s behavior and its economic performance. When applying this analytical framework to the sports sector in the United States, it is possible to see with more clarity how the competition develops, the firm’s strategic decisions, and how they perform in the market. The data and research from this study were retrieved from secondary data sources, where it was possible to analyze academic literature, industry performance reports, and financial publications to deepen the …

Empowering Paraeducators: A Mixed Methods Study Of Targeted Paraeducator Training In Trauma-Informed And Restorative Practices, Amy K. Stevenson Jan 2026

Empowering Paraeducators: A Mixed Methods Study Of Targeted Paraeducator Training In Trauma-Informed And Restorative Practices, Amy K. Stevenson

Doctor of Education (Ed.D.)

This mixed-methods study, grounded in Improvement Science, examines behavioral support provided by paraeducators, sometimes referred to as paraprofessionals, to students who receive special education services. Districts employ paraeducators to implement Individualized Education Programs (IEPs) for students with a range of disabilities. Often, paraeducators possess limited skills and receive little training to provide effective support to students. Additionally, paraeducators remain among the lowest-paid employees in school districts. Research suggests that targeted professional development, particularly whole-group instruction, followed by coaching, modeling, and feedback, can improve both paraeducator implementation fidelity and student outcomes. Five paraeducators working in a program serving elementary students with …

Decreasing Hospital Acquired Pressure Injuries Through A Multi-Intervention Approach: A Quality Improvement Project, Kendra D. Crawford

DNP Scholarly Projects

BACKGROUND: Hospital acquired pressure injuries (HAPIs) continue to plague hospitals across the country. HAPIs are an indication of the quality of care delivered by the hospital’s nursing workforce. These injuries are costly to organizations and can lead to increased length of stay (LOS). The development of a HAPI, depending on severity, is a reportable injury and is classified as patient harm. Patients who suffer from HAPIs can experience significant pain and at times, permanent disfigurement. This project’s focus is a community hospital that has seen a steady increase in HAPIs over the last 2 years. During 2025, 28% of the …

Enhancing Psychiatric Education And Training For Family Nurse Practitioners In Rural Health Settings, Jared Sanders Jan 2026

Enhancing Psychiatric Education And Training For Family Nurse Practitioners In Rural Health Settings, Jared Sanders

DNP Scholarly Projects

Abstract

Title: Enhancing Psychiatric Education and Training for Family Nurse Practitioners in Rural Health Settings

Background: Mental health conditions represent a significant and growing proportion of primary care encounters, particularly in rural and underserved regions where psychiatric specialist access remains critically limited. In these settings, Family Nurse Practitioners (FNPs) frequently serve as the sole point of contact for patients presenting with mental health concerns, often without the benefit of embedded behavioral health support or readily available consultation. Despite carrying this clinical responsibility, many FNPs report gaps in formal psychiatric training, particularly in psychopharmacology and diagnostic differentiation, that contribute to variability …

Title: Improving Confidence in Certified Registered Nurse Anesthetists in Providing Care for Patients Undergoing Transcatheter Aortic Valve Replacements (TAVR)

Background: Anesthesia staffing for complex, high-risk procedures like Transcatheter Aortic Valve Replacements (TAVR) is challenging due to a national shortage of anesthesia providers and the company's heavy reliance on non-permanent (locum tenens and 1099) Certified Registered Nurse Anesthetists (CRNAs). At this TAVR procedure location, 70% of the team is comprised of non-permanent staff. A lack of specialized training and experience in TAVR procedures led to a decrease in provider confidence and staffing shortages for these critical cases.

Purpose: The primary …

Climate Change As A Security Interest: A Novel Defense In Fossil Fuel Investment Arbitration, Nabil Kapasi Jan 2026

Climate Change As A Security Interest: A Novel Defense In Fossil Fuel Investment Arbitration, Nabil Kapasi

Chicago Journal of International Law

Thousands of international investment and trade agreements contain provisions protecting investments made by parties from the signatory states. One such provision is Investor-State Dispute Settlement (ISDS), a mechanism allowing foreign investors to sue host states in arbitration for treaty violations. Fossil fuel investors are increasingly utilizing ISDS successfully to hold states liable for climate action; arbitral tribunals are awarding large compensations to these investors when states deny them permits for upstream activities or enact phase-out policies attempting to ban fossil fuel consumption. These awards impose heavy burdens on states while simultaneously deterring climate action by creating fears of liability. This …

Representation Of Mental Illness And Disorders In Iberoamerica Digital Media, Luis M. Romero-Rodríguez, Santiago Tejedor, David Rull Ribó, Jesús Martínez-Fernandez, Bárbara Mercedes Castillo-Abdul Hadi

Artículos científicos

A recent bibliometric analysis of 130 research studies on media coverage of mental disorders between 2002 and 2022 found that, in most cases, research insists that media coverage of mental disorders is generally negative. The objective of this research is to examine the tone and content of articles on mental health in the main digital media in Ibero-America in 2023. Likewise, we sought to identify the most common types of disorders or emerging disorders and whether the news items establish very simplistic links of mental health with topics such as video games and social, financial, or gender issues. In this …

Retention Time Of Microplastics In The Purple Sea Urchin (Arbacia Punctulata), Alexandra Shore Jan 2026

Retention Time Of Microplastics In The Purple Sea Urchin (Arbacia Punctulata), Alexandra Shore

Honors Theses and Capstones

Marine ecosystems around the world are facing the problem of plastic pollution. Large pieces of plastic eventually degrade into smaller microplastics that are suspended in the water column and sink to the seabed. Sea urchins are exposed to microplastics as they graze on the sea floor and can accidentally consume these pollutants. Sea urchins are ecologically important animals because they physically alter their ecosystem via grazing and are integral part of marine food webs. To better understand how sea urchins interact with microplastics, purple sea urchins were exposed to microfibers and microspheres in a laboratory setting, and the retention time …

More Than A Meal: What Death Row Last Meals Reveal About Identity, Power, And Humanity, Mackenzie Helbig

Honors Theses - Providence Campus

Last meals on death row may appear to be a small or insignificant part of the execution process, but they can reveal deeper meaning about the individuals who choose them and the system that allows them. Before execution, inmates are often given the opportunity to request a final meal. While this moment is brief, it can carry emotional, cultural, and symbolic meaning. This study explores what last meals reveal about identity, mental state, and personal control in a highly controlled environment.

Using a descriptive qualitative approach, this research analyzes last meal records, academic studies, and inmate reports to identify recurring …

From Sacred Practice To Social Identity: The Historical Evolution Of Vegetarianism Through Religion, Psychology, And Social Norms, Makenna Mae Seymour Jan 2026

From Sacred Practice To Social Identity: The Historical Evolution Of Vegetarianism Through Religion, Psychology, And Social Norms, Makenna Mae Seymour

Honors Theses – Charlotte Campus

This research paper aims to explore how the vegetarian diet has evolved throughout history through lenses of religion and social psychology. Using primary and secondary academic resources, over thirty resources were evaluated, including books and journal articles,  using key words, such as “vegetarian,” “attitudes,” and “social norms.” The beginnings of vegetarianism were established through religious practices, but social norms from families and friends, as well as personal gain reasons, are the driving factors that have maintained the vegetarian diet over time. Vegetarianism began from Pythagoras and his cult in the 600s BC, but it grew once Hinduism and Jainism adopted …
