A Basic Needs Baseline For Distributional Analysis, Ari Glogower
A Basic Needs Baseline For Distributional Analysis, Ari Glogower
BYU Law Review
Studies of income inequality and the distributive effects of taxes and government spending drive debates over progressive fiscal reform and economic justice. These distributional studies provide vital information on inequality in market outcomes and how government policies mitigate these disparities.
Despite its critical importance, however, distributional analysis encounters inevitable and familiar limitations. These studies face practical challenges in measuring income and the distributional impacts of government policies. Distributional analysis also faces inherent complications in seeking to distinguish between the effects of the market and the government.
Even if distributional analysis could precisely measure income and the effects of government policies, …

Searches Without Suspicion: Avoiding A Four Million Person Underclass, Tonja Jacobi, Addie Maguire
BYU Law Review
In Samson v. California, the Supreme Court upheld warrantless, suspicionless searches for parolees. That determination was controversial both because suspicionless searches are, by definition, anathema to the Fourth Amendment, and because they arguably undermine parolees’ rehabilitation. Less attention has been given to the fact that the implications of the case were not limited to parolees. The opinion in Samson included half a sentence of dicta that seemingly swept probationers into its analysis, implicating the rights of millions of additional people in the United States. Not only is analogizing parolees and probationers not logically sound because the two groups differ in …

Osha’S Covid-19 Vaccine Mandate: Why Justice Gorsuch’S Analysis Of The Mandate As An Elephant In A Mousehole Misses The Mark, Wyatt Rex Allred
BYU Law Review
Administrative law doctrines such as Chevron seek to strike a balance between adequate delegated power and sufficient checks on such power. The major questions doctrine reinforces the latter. Recent decisions finding major questions, however, have shown a departure from textualist principles, which formed the doctrine s foundation. Justice Gorsuch's opinion in NFIB v. OSHA is an example of this desertion of textualist principles and should thus be viewed as an improper application of the major questions doctrine. Rather than remodeling the major questions doctrine, textualist judges should acknowledge that this form of anti-textual analysis is nothing short of a revival …

Family health history (FHH) is an essential foundation for personalized disease prevention. As the incidence of early-onset chronic diseases is increasing among college students, it is important to provide them with the education required to learn about their FHH. This study aimed to assess college students’ interest in receiving FHH education, preferred topics, and desired learning methods. We invited college students to complete an online survey from a large research-intensive university. A total of 2276 college students completed the survey. Nearly half of the participants self-identified as non-Hispanic white (45.5%). Slightly more than half of the sample (53.9%) were not …

An Autoethnographic Reflection From Two Black Women Ph.D.’S And Their White Woman Advisor On The Use And Impact Of Sista Circle Methodology In The Dissertation Process, B. Nathan, Rashida Love, Laurie A. Carlson
The Qualitative Report
Black Women doctoral students experience the journey as “outsiders within” (Collins, 1986), navigating how to excel and thrive while being on the margins (hooks, 1991). The authors of this manuscript reflect upon the impact of adopting a culturally relevant methodology and method, integrating various forms of Black Women’s art, and challenging tenets of traditional western research. An auto-ethnographic exercise illuminated the critical need for Nathan and Love to insert their Black Womanhood into their dissertation research process using Sista Circle Methodology, an active decision to decolonize research. Carlson provided a critical link to ensuring Nathan and Love graduated and provides …

Research on refugee resettlement frequently overlooks the larger context of the experience of forced migration. As a result, the micro-level interactions between refugees and the bureaucrats who make resettlement decisions are obscured. We can better understand the socio-political dynamics between refugees and the officials deciding their resettlement cases if we approach encounters between refugees and migration officials during ceremonial visits as sites of emotional exchange. This article examines the complex socio-political emotional exchanges of power and vulnerability that underpin the refugee resettlement process through an ethnographic analysis of Bhutanese refugee camps in Nepal.

New Evidence On Employee Noncompete, No Poach, And No Hire Agreements In The Franchise Sector, Peter Norlander
School of Business: Faculty Publications and Other Works
This paper presents new evidence on anti-competitive practices in the franchise sector. Drawing from a corpus of Franchise Disclosure Documents (FDDs) filed by 3,716 franchise brands in years 2011- 2023 (partial), I report new information on franchise brands’ use of inter-firm non-solicitation (“no poach”) clauses barring recruitment between firms, no hire clauses barring employment, and franchisor requirements that franchisees use employee non-compete clauses barring workers from joining competitors. Regulatory actions that restricted the enforceability of anti-competitive clauses began to appear in FDDs in 2018. While non-solicitation and no hire clauses have declined in use, the use of non-competes remained stable …

Background: Circulating tumor cells (CTCs) are a promising non-invasive tool for monitoring therapy response. The only Food and Drug Administration (FDA)-approved test is limited to enumeration of epithelial CTC without further characterization and is not approved for the management of non-small cell lung cancer (NSCLC). Here we use a MicroCavity Array (MCA) system to capture CTC agnostic of epithelial markers for further molecular testing in NSCLC.
Methods: CTCs were enumerated by fluorescent microscopy as longitudinal sampling throughout disease management from 213 NSCLC patients. CTC-enriched samples from a subset of 127 patients were interrogated for gene expression by reverse transcription polymerase …

Variants of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) have caused successive global waves of infection. These variants, with multiple mutations in the spike protein, are thought to facilitate escape from natural and vaccine-induced immunity and often increase in affinity for ACE2. The latest variant to cause concern is BA.2.75, identified in India where it is now the dominant strain, with evidence of wider dissemination. BA.2.75 is derived from BA.2 and contains four additional mutations in the receptor-binding domain (RBD). Here, we perform an antigenic and biophysical characterization of BA.2.75, revealing an interesting balance between humoral evasion and ACE2 receptor …

Introduction: Millions of Americans infected with the severe acute respiratory syndrome-associated coronavirus-19 (COVID-19) need oncologic surgery. Patients with acute or resolved COVID-19 illness complain of neuropsychiatric symptoms. How surgery affects postoperative neuropsychiatric outcomes such as delirium is unknown. We hypothesize that patients with a history of COVID-19 could have an exaggerated risk of developing postoperative delirium after undergoing major elective oncologic surgery.
Methods: We conducted a retrospective study to determine the association between COVID-19 status and antipsychotic drugs during postsurgical hospitalization as a surrogate of delirium. Secondary outcomes included 30 days of postoperative complications, length of stay, and mortality. Patients …

Urban Resettlement Policies In Cairo: A Case Study Of Manshaiat Nasser And Asmarat City, Roshan Abouzied
Urban Resettlement Policies In Cairo: A Case Study Of Manshaiat Nasser And Asmarat City, Roshan Abouzied
Theses and Dissertations
Egypt has a long history of urban development efforts. These efforts have provided substantial solutions in providing the urban population with adequate housing opportunities, especially those living in slum areas. However, these policies have not offered optimal solutions for all residents of informal areas, and recently governments have resorted to evictions and resettlement as one of the main strategies for removing unsafe informal areas. These strategies have had a diversity of consequences on the urban planning of cities like Cairo and repercussions on community dynamics and community social fabric. Accordingly, this thesis demonstrates the impact and reflects the consequences of …

School of Medicine Publications
Systemic lupus erythematosus (SLE) is a heterogenous, systemic disease characterized by the production of pathogenic autoantibodies against nuclear antigens. Although the most common cardiac manifestation of SLE is pericardial effusions, their progression to cardiac tamponade is rare and has an incidence between 1-3%. We describe a case of a 42-year-old Hispanic woman who presented with severe shortness of breath, vague chest pain, and hemodynamic compromise secondary to cardiac tamponade. The patient's underlying etiology of cardiac tamponade was attributed to a new diagnosis of SLE based on the 2019 European Alliance of Associations for Rheumatology/American College of Rheumatology classification (EULAR/ACR) criteria …

The Causal Effect Of Firm Productivity On Climate Change: Evidence From The Mena Region, Shahd El Azhary
The Causal Effect Of Firm Productivity On Climate Change: Evidence From The Mena Region, Shahd El Azhary
Theses and Dissertations
The relationship between firm productivity and climate change matters importantly to sustainable growth goals. The MENA region is very vulnerable to desertification because of an increase in temperature. The purpose of this study is to assess the productivity of firms, by sector, on climate change through a panel VAR (PVAR) model to investigate firms’ total factor productivity (TFP) on temperature increases on the region. The positive relationship between both variables for most sectors, except for the financial and basic materials sectors, demonstrates the need for policy makers to formulate harsher regulations against climate change.
The Rise Of Irregular Domestic Work Amongst Female Migrants In Italy, Elena Romeo
The Rise Of Irregular Domestic Work Amongst Female Migrants In Italy, Elena Romeo
Theses and Dissertations
In today’s globalized world, hardship and geopolitical and economic crises have led to the lack of decent work, and this resulted in new, migratory movements. Women have joined these migration flows in growing numbers, which has important consequences for gender equality in both countries of origin and destination (ILO,2015). Hence, migration has a new character, and it includes many women who emigrate from their country because of a lack of access and choices to jobs, exploitation, and lower wages compared to men in Europe. In this context, one can affirm that today irregular migration is on the rise, especially in …
