A Response To Rules Of Medical Necessity, Brendan S. Maher

Faculty Scholarship

Professors Monahan and Schwarcz’s recent Article in the Iowa Law Review, Rules of Medical Necessity, is a must-read for multiple audiences. In this short Response, I informally describe health insurance, and—using that perspective—describe and comment on why Rules of Medical Necessity is a piece of work that not only deserves attention from experts in the field, but is also one that casual readers should choose first when attempting to understand how health insurance works in theory and practice.

The Legal Ethics Of Family Separation, Milan Markovic Mar 2023

The Legal Ethics Of Family Separation, Milan Markovic

Faculty Scholarship

On April 6, 2018, the Trump administration announced a “zero tolerance” policy for individuals who crossed the U.S. border illegally. As part of this policy, the administration prosecuted parents with minor children for unlawful entry; previous administrations generally placed families in civil removal proceedings. Since U.S. law does not allow children to be held in immigration detention facilities pending their parents’ prosecution, the new policy caused thousands of children to be separated from their parents. Hundreds of families have yet to be reunited.

Despite a consensus that the family separation policy was cruel and ineffective, there has been minimal focus …

Racial Equality, Religious Liberty, And The Complications Of Pluralism, Rachel F. Moran Mar 2023

Racial Equality, Religious Liberty, And The Complications Of Pluralism, Rachel F. Moran

Faculty Scholarship

Constitutional law scholar Laurence Tribe once described due process and equal protection as “a legal double helix.” By this, he meant that protections for substantive liberties coupled with principles of equal treatment created “a single, unfolding tale of equal liberty and increasingly universal dignity.” In his view, equality and liberty were mutually constitutive and “center[ed] on a quest for genuine self-government of groups small and large.” Although this optimistic account of the nation’s constitutional DNA is reassuring, Professor Sahar Aziz’s new book on “The Racial Muslim: When Racism Quashes Religious Freedom” reminds us that the double helix can unravel, so …

Centering Students’ Rhetorical Knowledge: The Community Of Inquiry As Formative Assessment, Brian N. Larson

Faculty Scholarship

This essay describes an approach to peer review and classroom workshopping intended to develop a community of inquiry in the first-year law school classroom, center students’ own rhetorical knowledge, and establish the authority of students—especially minoritized students—as rhetorical agents. The technique described in this essay works from the presumption that each student who comes to law school comes with rich rhetorical experience. In other words, they have extensive experience constructing discourse suited to certain audiences and certain contexts. They use a variety of tools to construct such discourse, including linguistic registers (or styles) and rhetorical genres (such as the academic …

A Prophylactic Approach To Compact Constitutionality, Katherine Mims Crocker Mar 2023

A Prophylactic Approach To Compact Constitutionality, Katherine Mims Crocker

Faculty Scholarship

From COVID-19 to climate change, immigration to health insurance, firearms control to electoral reform: state politicians have sought to address all these hot-button issues by joining forces with other states. The U.S. Constitution, however, forbids states to “enter into any Agreement or Compact” with each other “without the Consent of Congress,” a requirement that proponents of much interstate action, especially around controversial topics, would hope to circumvent.

The Supreme Court lets them do just that. By interpreting “any Agreement or Compact” so narrowly that it is difficult to see what besides otherwise unlawful coordination qualifies, the Court has essentially read …

Towards A Design Space For Storytelling On The Fashion Technology Runway, Sydney Pratte, Anthony Tang, Shannon Hoover, Maria Elena Hoover, Matt Laprarie, Catherine Larose, Lora Oehlberg

Research Collection School Of Computing and Information Systems

Fashion is driven by a narrative, i.e. a story or idea that the designer wants to convey to the audience. Fashion-tech now adds another dimension to this narrative through dynamically changing aspects of the garments. Many factors of presentation in a runway show affect how fashion-tech garments communicate a story to the audience. In this pictorial, we review a set of twenty-eight storytelling fashion-tech garments. We identify, catalogue, and categorize the factors designers used to convey stories to the audience from the runway. The design space consists of three levels: (1) the artifact-level, (2) the viewer-level, and (3) the context-level. …

Expulsive Greening: A Cross-Sectional Analysis Of Resilience-Era Green Gentrification In Brooklyn, New York, Rose Jimenez, Juliana A. Maantay

Cities and the Environment (CATE)

This project analyzes the impacts green gentrification in Brooklyn by evaluating the spatial coincidence between gentrification rates and urban greening from 2010 to 2020. Assets formed under the NYC Green Infrastructure Program were chosen as a proxy for urban greening to represent urban greening within the 21st-century climate change resilience paradigm of development. Methods: This is a mixed method approach to a natural experiment. First, five indexes measuring variations of economic and demographic conditions related to gentrification were applied to Brooklyn for comparative analysis: NOAA’s Social Vulnerability Indicators of Gentrification Pressure, The NYC Heat Vulnerability Index, The Small Area Index …

Assessing And Improving The Ecological Function Of Linear Parks Along The Lower Los Angeles River Channel, Los Angeles County, California, Us, Daniel S. Cooper, Nurit D. Katz, Morgan L. Rogers, Fiona M. Osborn

Cities and the Environment (CATE)

Long overlooked by conservation groups and ecologists, urban open spaces are now seen as important contributors to biodiversity at various scales. Urban greenspaces often represent the only “nature” millions of human residents around the world ever interact with, and provide cooling and aesthetic relief from the urban hardscape. In the Los Angeles Metropolitan area, over the past three decades, non-profit advocacy groups and institutions have established a network of bike paths, neighborhood access points, habitat restoration, and recreational amenities along the Los Angeles River, a major urban waterway. We investigated the environmental contribution provided by numerous linear landscaped parks along …

Preserving Nature In New York City: Nyc Parks’ Forever Wild Program, Georgina Cullman, Novem Auyeung, Jennifer Greenfeld, Kristen L. King, Marit Larson

Cities and the Environment (CATE)

Urban biodiversity has increasingly been recognized as providing multiple local, regional, and even global benefits. In New York City (NYC), conservation and planning professionals in the Department of Parks and Recreation (NYC Parks) pursued biodiversity protection through the creation of a “Forever Wild” program in 2001, which designated and aimed to protect 8,700 acres of the largest, most ecologically valuable natural areas across City parkland. In 2018-2020, NYC Parks’ Natural Resources Group (NRG) expanded the program’s extent, resulting in 2,500 acres added to the Forever Wild program, for a total of over 12,300 acres. These additions reflect new acquisitions to …

Balancing Human Development With Wildlife Habitat And Connectivity Through The Creation Of Land Use Regulations For Private Property In Los Angeles, California, Kat Superfisky

Cities and the Environment (CATE)

Urban areas are uniquely positioned to have a significant impact on biodiversity and the health and resilience of ecosystems and therefore play an essential role in advancing conservation goals. Unlike more “wildland” ecosystems, urban ecosystems are not solely owned and/or managed by public entities or with the sole goal of ecosystem restoration. The important plants, animals and ecosystems in cities are scattered across open spaces and public parks that are already protected and being managed for conservation, as well as on private properties that often comprise the majority of land in cities, which supports the need to address biodiversity and …

Biological Sciences Faculty Research and Publications

Insulin secretion from β-cells is tightly regulated by local signaling from preproglucagon (Gcg) products from neighboring α-cells. Physiological paracrine signaling within the microenvironment of the β-cell is altered after metabolic stress, such as high-fat diet or the β-cell toxin, streptozotocin (STZ). Here, we examined the role and source of Gcg peptides in β-cell function and in response to STZ-induced hyperglycemia. We used whole body Gcg null (GcgNull) mice and mice with Gcg expression either specifically within the pancreas (GcgΔPanc) or the intestine (GcgΔIntest). With lower doses of STZ exposure, insulin levels were …

Commentary: Nature-Based Insetting: A Harmful Distraction From Corporate Decarbonization, Nora Mardirossian, Jack Arnold

Columbia Center on Sustainable Investment

Carbon offsetting is used worldwide on a massive scale, purportedly to mitigate climate change by capturing atmospheric carbon or by increasing or protecting carbon storage. Yet, in recent years, offsetting has been increasingly criticized as a strategy that can harm Indigenous peoples and local communities, exacerbate land inequality, and, paradoxically, worsen the global climate crisis. “Carbon insetting” has emerged as an alternative approach to offsetting that localizes nature-based solutions projects and other greenhouse gas removal activities within company value chains and has been adopted by major global brands such as Nestlé, PepsiCo, and Burberry. This commentary takes a deep dive …

Ridesharing services such as Uber and Lyft have been substantially affected by the ongoing COVID-19 pandemic. Drawing on social capital theory, the current research investigates how social trust relates to three types of trust in compliance with COVID-19 guidelines and consumers' ridesharing intentions. Analyzing data from two economically and culturally distinct countries, the results suggest that social trust positively affects trust in platform companies' compliance with COVID-19 guidelines (TPC), but not (or to a lesser extent) trust in drivers' (TDC) and other riders (TRC) compliance with COVID-19 guidelines in both the United States and Bangladesh. Importantly, TPC, TDC, and TRC …

"Woman, Life, Freedom": A Movement In Progress In Iran, Arastoo Dabiri

Dignity: A Journal of Analysis of Exploitation and Violence

On September 16, 2022, a new movement began in Iran. It shows the potential to be a serious uprising. The death of an Iranian woman in the street in Tehran, the capital of Iran, due to being beaten by morality police because she was wearing an unappropriated hijab sparked the uprising. Her death was a result of wearing an “inappropriate” hijab. This was an excuse that turned on people’s anger not only because of hijab but also because there are many other combinations of causes to bring out people for protest. This movement was started because people were dissatisfied with …
