Appropriations Presidentialism, Zachary S. Price, Matthew B. Lawrence, Eloise Pasachoff
Appropriations Presidentialism, Zachary S. Price, Matthew B. Lawrence, Eloise Pasachoff
Faculty Scholarship
Since the start of the second Trump administration, the executive branch has attempted to change how federal spending works by asserting unilateral, centralized authority to condition, delay, cancel, or otherwise disrupt federal obligations and expenditures without regard to longstanding legal understandings and norms. This appropriations presidentialism is unprecedented in scope and degree, and it threatens to weaken a key congressional check on executive policy, while also disrupting the settled expectations of civil servants, contractors, grantees, program beneficiaries, and others who were counting on continued federal funding for certain programs or activities. Those injured by these executive actions are understandably turning …

Navigating The Growing Prospects And Growing Pains Of Managed Aquifer Recharge, Dave Owen, Helen Dahlke, Andrew Fisher, Ellen Bruno, Michael Kiparsky
Faculty Scholarship
Increasing water demands and declining groundwater levels have led to rising interest in managed aquifer recharge. That interest is growing in the United States—the focus of this article—and elsewhere. Increasing interest makes sense; managed aquifer recharge can reduce water-supply challenges and provide environmental benefits, sometimes with lower costs than alternative water-management approaches. But managed aquifer recharge also faces growing pains, which will make it difficult for projects to scale up and may limit the benefits provided by those projects that do go forward. Some of the problems arise from the challenges of finding physically suitable locations for managed aquifer recharge; …

The Disengagement Of Black High School Students In English Language Arts Classrooms, Michelle Chanda Singh
Theses and Dissertations
This applied dissertation explored how high school English Language Arts (ELA) teachers understand and respond to the disengagement of Black students. Racial disparities in literacy achievement persist across the United States. Despite reform efforts, many Black students continue to experience academic and emotional disconnection in ELA classrooms. Few studies have centered on teachers’ perspectives to understand the classroom-level conditions contributing to this disengagement. This qualitative study addressed that gap by examining the beliefs, practices, and experiences of four veteran ELA teachers in the southeastern United States.
Using Interpretative Phenomenological Analysis, the study examined how teachers make sense of Black student …

The Immigration Subpoena Power, Lindsay Nash
The Immigration Subpoena Power, Lindsay Nash
Articles
For over a century, the federal government has wielded the immigration subpoena power in darkness, forcing private individuals, subfederal governments, and others to help it detain and deport. This vast administrative power has remained opaque even to those who receive these subpoenas and invisible to those it affects most. Indeed, the very people targeted by these subpoenas often don’t know they exist, much less how they facilitate arrest and deportation. For these reasons—and more—this power has escaped the legal battles raging over other immigration enforcement tactics and the scrutiny of journalists, scholars, and courts. Thus, as state- and locality-held information …

Towards The Faa's Next Century: Clarifying Disclosure Requirements In Arbitration, Andrea K. Schneider, Brian Farkas
Articles
This essay provides a roadmap to the current landscape of neutrality and disclosure. It then suggests three possible reforms to the FAA that would provide better guidance to arbitrators, parties, and courts. Moreover, this essay argues that if the FAA cannot be sufficiently amended, states should take the lead. States can continue to more clearly outline disclosure requirements and enforce clearer standards than the current version of the FAA.

Cover Cropping Strategies For Improving Weed Suppression, Yashar Askarzadeh
Cover Cropping Strategies For Improving Weed Suppression, Yashar Askarzadeh
Electronic Theses and Dissertations
Cover crops (CCs) play an essential role in sustainable agriculture by providing multiple ecosystem services. However, adoption remains low due to concerns about economic returns, management complexity, and potential yield reductions in cash crops. Applying CCs uniformly across fields without accounting for spatial variability can result in inconsistent outcomes. A precision cover cropping system (PCCS), which incorporates site-specific management zones (MZs), offers a more targeted approach to improving performance while minimizing costs and uncertainties. This study explores the interaction between CCs and field variability through complementary field and greenhouse experiments. The field experiment demonstrates that field heterogeneity significantly influences CC …

Isolation, Characterization & Identification Of Cultivable Field Pea Seed Bacteria In South Dakota, Diana Wairimu Njuguna
Electronic Theses and Dissertations
Pea (Pisum sativum L.) is a legume, cultivated on over 25 million acres, particularly in Canada, France, China, Russia, and the United States. Its seeds harbor microbiota including bacteria and fungi, either on the surface (epiphytes) or within seed tissues (endophytes). These microbes can be pathogenic or beneficial, enhancing seedling metabolism and protection from environmental stresses. Characterizing beneficial seed microbiota enables development of microbial inoculants for seed treatment. Seeds from 12 varieties (green or yellow seed coats) were harvested from Sturgis and Dakota Lakes in 2021. Epiphytes were extracted using sonication followed by grinding the seeds to obtain endophytes. Isolates …

American K-12 public education is at a critical anti-civil rights inflection point amidst a rapidly changing landscape of federal and state education law and policy. From local anti-literacy measures to state “three strikes” exclusionary school discipline legislation to punitive federal executive orders, new legal mechanisms are conjoining to produce public school climates marked by structural violence, and the erasure of students with multiple marginalized identities. Attending to these political and legal realities is a growing cluster of legal scholarship empirically categorizing, and theoretically challenging, the rise of such anti-education civil rights obstructions. Though diverse in scope, analyses prominently center the …

Lawyers are not known for their proficiency in math and science. Most of us who went to law school reached a point in our math and science studies when we realized that neither medicine nor engineering were likely to be successful career paths. It is these lawyers who become judges. Yet, the United States Supreme Court has increasingly put the burden for deciding complex scientific and technical questions in the hands of judges. This Article explores this trend of putting greater responsibility for deciding scientific and technical issues on judges, particularly in the areas of evidence law, administrative law, and …
Criminal Procedure Without Consent, Kate Weisburd
Criminal Procedure Without Consent, Kate Weisburd
Faculty Scholarship
Scholars and advocates have long argued that a person’s consent to a warrantless police search is often so inherently coerced, uninformed, and shaped by race, class, gender, citizenship status, and disability that to call it a “choice” is fiction. This critique is not limited to police searches based on consent. Waiving rights and consenting to otherwise unconstitutional state action permeates criminal procedure. The definition of a seizure, the third-party doctrine, custodial confessions, plea bargains, and agreements to alternatives to incarceration (such as GPS ankle monitoring) all hinge on the idea of voluntary choices—choices that are often just as coerced and …

The Pre-Polarization And Concentration Of Cells Near Micro-Electrodes Using Ac Electric Fields Enhances The Electrical Cell Lysis In A Sessile Drop, Kishor Kaphle, Dharmakeerthi Nawarathna
Electrical & Computer Engineering Faculty Publications
Cell lysis is the starting step of many biomedical assays. Electric field-based cell lysis is widely used in many applications, including point-of-care (POC) applications, because it provides an easy one-step solution. Many electric field-based lysis methods utilize micro-electrodes to apply short electric pulses across cells. Unfortunately, these cell lysis devices produce relatively low cell lysis efficiency as electric fields do not reach a significant portion of cells in the sample. Additionally, the utility of syringe pumps for flow cells in and out of the microfluidics channel causes cell loss and low throughput cell lysis. To address these critical issues, we …

Osteoarthritis is a leading cause of disability worldwide, challenging current treatments to limited cartilage self-healing capacity. Cartilage tissue engineering (CTE) integrates cells, scaffolds, and signaling molecules, with Insulin being utilized as a differentiation biomolecule due to cost-effectiveness, dose-dependent influence on chondrogenesis, suitable biological activity, and ability to activate relevant receptors. Yet, administering differentiation biomolecules through conventional scaffolds poses a persistent challenge. Alginate (Alg) is commonly employed in CTE for its biocompatibility, though it lacks sufficient mechanical properties. Chitosan (Cs), while enhancing scaffold mechanical properties, but does not independently provide optimal support for chondrogenesis. While Alg-Cs scaffolds have garnered attention, challenges …
